“No State shall convert a liberty into a privilege, license it, and charge a fee." Murdock v. Pennsylvania, 319 U.S. 105 (1943), is a landmark Supreme Court case that addressed the issue of whether a state can impose a license tax on the exercise of constitutional rights. The Court stated that a state cannot convert a liberty into a privilege, license it, and charge a fee for it.

Yea the whole congestion pricing is illegal, they cant toll the roads in NYC without either transfer the roads from NYC DOT to MTA, then they could toll but the road condition will be just as bad as the subway, or they make a major change to the road (like make a bridge or tunnel) but THEN they would have to use bonds on it and once the bonds are paid off THEN they WOULD have to lift the tolls, but thats if they didnt transfer it to a private company (which is why the Thurway is still a toll road)

The problem is that the special interest has centralised the vast majority of the commerce and well paying jobs in that district. The district needs to be decentralize into the other boroughs of the city. Also the mta needs to stop pouring more money into more subway lines in manhattan , and connect the bronx to queens or brooklyn by subway so people can bypass manhattan when going to other boroughs. This would shift more economic activity into more depressed parts of nyc like the bronx. There would be some gentrification in those boroughs, but better paying jobs there can have some offset to that.

If you don't want to pay the tolls, then don't drive and take the train.
Before you say that it is not safe riding the train, diving is A LOT more dangerous. The MTA only had 44 people killed due to subway violence last year, but 250 people died because of car accidents.

@@wiz553you say "don't drive" like some of us have a choice. It's obviously hurting the people that have to drive the most for work. Just look at the payment structure and it explains all. It Targets the working class and business vehicles the most. Meanwhile taxi and uber barely have anything to pay and are the reason for majority of the traffic. This isn't even a fare tax!!

Since this plan is very unlikely to be defeated in court because the Supreme Court is very unlikely to even take up this argument, I think with the billions of dollars this plan brings in, I would expand construction on the air trains in LaGuardia and JFK to connect and run throughout all Five boroughs and have them stop at main hubs in every borough. It’s an extremely ambitious project, but at least they’ll have enough money to do it. keep it at its current price, it would drastically reduce the foot traffic on the buses and subways as well as the vehicle traffic going in and out of the city.
