‘Dude, I Blew Zero!’: College Athlete Sues Iowa Cops for DUI Arrest

- In a shocking case of apparent police misconduct, Tayvin Galanakis, a freshman football player at William Penn University, has filed a lawsuit against three Iowa police officers and the city of Newton following a controversial DUI arrest in August 2022. Bodycam footage from the incident reveals a disturbing scene as Galanakis, who had blown a 0.00 on a breathalyzer test and successfully completed sobriety tests, is forcibly placed under arrest. The video captures the 19-year-old's disbelief and outrage as he shouts, "Dude, I blew zero!" while being handcuffed and taken into custody. The footage has sparked widespread outrage and raised serious questions about the officers' actions and the potential violation of Galanakis' rights.

After being released later that night, once further tests confirmed his sobriety, Galanakis took the brave step of sharing the bodycam footage on his own social media accounts. The video quickly went viral, prompting an outpouring of support from the public and calls for justice. Encouraged by his supporters, Galanakis made the decision to take legal action against the officers involved in his arrest. In an exclusive interview with The Law&Crime Network's Sierra Gillespie, Galanakis discusses the details of his arrest, the impact it has had on his life, and his determination to hold the officers accountable for their actions.

That's the sense of entitlement and lack of accountability. They get away with so much wrong doing over and over, they get offended when someone tried to hold them accountable.
That's going to be two lawsuits they lose, increasing the overall loss the department will see. They need to just take the L and retrain all officers of the district with a final warning contract(or rather a "no more warnings" contract) upon retraining completion. When each officer realizes they have no more chances to save employment over such matters is when they may actually listen. Of course many wont, but they've already been given their final warning.

As of now, the case involving Tayvin Galanakis, the college student who filed a lawsuit against three Iowa police officers and the city of Newton after a DUI arrest in August 2022, has progressed. A federal judge ruled that Officer Nathan Winters violated Galanakis’s constitutional rights by arresting him without probable cause. The judge noted that Galanakis’s speech and movements were inconsistent with someone under the influence of a controlled substance, and his willingness to take a breathalyzer test was remarkable for someone allegedly intoxicated. The case is still ongoing, and further developments are awaited.

Right very true
In the UK we don’t do field sobriety tests, they’ve never been a thing for as long as I’ve been alive and aware of these things and I’m 34.
Police here exclusively use breathalysers, and if you blow zero then you go on your merry way. There’s not a chance they’d try and get you anyway, unless they do a check for drugs also, but I think they ask about medical conditions before they do any of this anyway.
The police here in the UK aren’t perfect, but they’re waaaayyyy better than the US that it’s not even a comparison. I think it’s well known we have one of if not the best police forces in the world. They really are trained well in deescalation, and not only that, if they can let you go, they absolutely will.
If you’re caught underage drinking they’ll just tell you to pour it out and leave you alone after that, they may take you home to your parents but I’ve never seen that before. I’ve seen one person caught with weed, they made him throw it in a pond, didn’t even take his name or anything, they just left. Whereas what I’ve seen in the US is they’ll try to arrest you for absolutely anything and everything. Also here, as long as your crime isn’t that serious like murder and you don’t pose a serious threat, you will get police bail which you don’t have to pay for, you’re just released and given a court date because they can only hold you for 24 hours before charging, and they also only have like 4-10 cells per police station so most people are given police bail. The dangerous ones are remanded to custody in a prison, but that doesn’t happen very often at all.
I think the whole justice system needs an overhaul in america tbh.

I do not have to ID unless a crime is confirmed.
What is going on is, they have alleged he is a corporation and using the public right of way as a place of business and she is profiting monetarily by using the roadway.
I beat tickets all the time by submitting an affidavit to the court that I am a flesh & blood person, and that the entity they have alleged does not exist. The casing used to spell your name is all it takes to claim you are a corporation, not a person. JAMES MADISON, is a corporation. James Madison, is a person.
According to Texas Rules of Civil Procedure (TCRP) Rule 52, Alleging a Corporation:
"Allegations that a corporation is incorporated shall be taken as Truth unless denied by affidavit of the adverse party, his agent or his attorney, whether such corporation is public or private and however created."
Take note of the words "however created" because when those attorneys write your name in all-capital letters on a summons or warrant or notice, you have now been constituted as a corporation. Your name was similarly corrupted when a constructive trust was established as you volunteered into Social Security, making you part of the national socialist democracy and assigning you an employee I.D. number (SSAN).

True. I'm not saying the Dutch police force is a completely clean, trustworthy organisation, but we wouldn't have the time for something like this. He would get a warning or fixed penalty for using brights in a built-up area, and an officer would have just approached him for a roadside breathalyzer 'as we do as a precaution during night-time'. Then he would blow zero and would be on his way again... There's just no way Dutch officers would be put up with all the paperwork for a 'suspect' who's so clearly innocent.

That’s the issue. You HAVE to remain patient and calm since these guys are in a position in power. The only way to get your justice and compensation is to bite your tongue and suck it up until you become in a position of power again. Once he is in custody, he’s back in power as there’s more law enforcement AND he can get a contact of a lawyer or a friend/family member. Now you have the safe space to continue to lose your cool.
Thank god we live in America where actual corrupt cops can still be brought to justice and you don’t suffer a horrific horrible “accident” on a bridge
This is why people hate the cops. Even though there are good guys out there, the profession also attracts power hungry losers who just loves making people abide to their orders even if it’s extremely petty. Usually the same people no one respects out of uniform, hence why they try to make up for it. This bullying is a result of those. Can’t stand people like that.
Here’s something interesting I found:
Shortly after Galanakis (the college kid) filed his suit, the city filed counterclaims alleging he made defamatory statements, inflected emotional distress, invaded the privacy and filed false complaints against Winters and Wing (the police officers).
So the police officer’s feelings were hurt by this video and sued. Lol
@@notboringandsmall *So the police officer’s feelings were hurt by this video and sued. Lol*
Honestly, that motive would be an optimistic best-case scenario.
It's more likely this is a SLAPP lawsuit (i.e., a strategic lawsuit intended to silence/censor someone). The city must know they don't have good odds of winning either lawsuit - but by dragging this out and making it as lengthy and expensive for the poor kid as possible, they're much more likely to convince him to drop it and move on. Iowa is one of those states that doesn't have anti-SLAPP laws.

One theory of law enforcement is that it acts as a deterrent for future criminals. Why does it seem to be the case that police officers who undertake these obvious abuses of power so rarely seem to face the consequences of their actions? And is that lack or deterrence why we continue to see endless cases like this one?
The problem is people see this as evidence that ALL cops are like that. Nowadays it would seem the actions of a handful of people from ANY group is evidence enough to attribute characteristics to ALL of them.
@@stephenthomas1492 actually, I don’t think that’s true. It’s the police response to these incidents that sours people’s view of the institution.
