Horseplay Lands Teacher in Trouble with Dept. of Ed

  • Freedom of speech is a cherished Constitutional protection, framed in the First Amendment of the Bill of Rights. Teaching is one of many forms of free speech and falls under the First Amendment's protections for the right to speech within their occupation. But the State of Minnesota disagrees and Leda Mox, a certified equine massage specialist, now faces the prospect of having to pay exorbitant fees unless her speech is approved by a government agency.

    Leda loves horses, so much so that she has turned her passion into a business teaching others how to care for them through the practice of equine massage. Horses, much like any human, can benefit from massage by alleviating muscle pain, training for athletic events, or just to ease tension and relax. Leda is an expert in the subject and has a bachelor’s degree in equine science as well as being certified in equine massage since 1997, when she skipped her high school graduation to attend one of the only certification programs in the country at the time.
    The Office of Higher Education doesn’t care about Leda’s credentials or her long history of success in the field. They are demanding Leda complete a thirty-page application, pay exorbitant fees up front, and then annually to maintain her license, and furnish the state with a great deal of information - most of which is completely inapplicable to her small business. 
    Leda, who has partnered with the Institute for Justice, has now filed a lawsuit against the state claiming a violation of her First Amendment rights and arguing the state has no right to demand their approval to freely speak on a subject which she is clearly an expert in.

    Make politicians get licenses and make them take constitution classes make them get bonded! Time government officials are held accountable.

      You would have to get rid of Qualified Immunity first. As government officials, they are covered. One of the main obstacles is that the people responsible for legislation QI away are also covered by it. They're not likely to work against their own self interests.

      Best comment here. Make people running for office obtain a license that includes education classes AND testing them on the Constitution and the Rights of every American.
      Make them do it every time they run for office to make sure it sinks in.
      Also, make them take some "Continuing Education" type classes that go more in-depth on each Constitutional Right.
      And Term Limits.

      No, that's just Minnesota. A state that is run FULLY by Democrats who can't stand it when people have great ideas and can turn those great ideas into money without paying them their cut.
      Minnesota Democrats (actually called the DFL which stands for Democratic-Farmer-Labor Party), operate much like the Mafia does. They want their cut off your intellectual ideas and hard work no matter what.

So they find something to mess Americans up irregardless of the rules complying with the US Constitution. It is also about control and dominance. The federal government is a prime example of this phenomenon.

    I nearly laughed out loud when I heard the curriculum would have to be approved. Approved for what? The state is gonna check her horse massage curriculum for misinformation? What capitol city Minnesotan bureaucrat is going to know? Hilarious.

    There's absolutely nothing that the government doesn't want to license and regulate. Why? Because they can create a cash flow bureaucracy from it. Anything they license and regulate generates fees. And jobs they can give to their cronies.

    Minnesota goverment, especially the Dept of Education, are ridiculous on their regulations. There was a guy that accidentally missed his renewal date for his engineering license. The guy got his stuff in, but a little late. Minnesota went after him because he mentioned that he was an architect during the short period of time that his license had lapsed. They are total A holes up in my home state.

      @treeaddict The poor guys name is Chuck Mahrohn. The lawsuit is titled Strong Towns vs. State of Minnesota. The Minnesota board of engineer licensure really decided to escalate the problem rather than settle the issue easily. As a citizen, it was really infuriating to watch them go after a guy for a small issue and waist a whole lot of money to bully the guy. The board just seemed to have lost all sight of common sense. Also, I am not related to any of the parties. I am just a disgusted bystander.

      It’s about control and the power of bureaucracy.
      The purpose is to create a system based upon social connections and economic influences facilitating a paper pedigree system facilitating hierarchical social structures facilitating hegemonic control systems.
      Unqualified connected people will be able to control things that they don’t understand.
      Qualified unconnected people can disqualified and blacklisted in order facilitate exploitation and control.
      It’s essentially a pay to play racketeering scheme that uses abuse of power and authority bureaucratic bureaucracies as a cudgel facilitating “protection insurance racketeering”...
      The ability to create bureaucratic structures is the new aristocratic system.

    Massage therapy is an EXCELLENT, cost-effective way for pet lovers to take care of their animals. I give my dog a light massage along his back (and his hips) 3-4 days a week for like 5-10 mins each time… and I swear it gives my little buddy so much relief!!

      @@ShainAndrews I don't know exactly what the regulations are behind creating certifications, but I do know that organizations that offer certifications and make claims about what that certification does for you that aren't true tend to come under fire. I can't imagine that the state has a problem with the teaching itself, and since she mentioned certification I'm wondering if that's related to their actual objection.

      @@mamabearthrives7815 the government is probably making the argument that horse massage is a veterinary practice, and are trying to regulate it that way, massaging a human already requires licensee and training so the idea isn't completely unfounded even if I don't agree with it,
      To be clear the government's right to decide who can teach people things and under what circumstances (at least in a professional context) is fairly solidified, clearly they have the ability to decide who can teach children math I don't see why they can't decide who can teach adults anything else (to be clear though I would love to see a ruling by the Court that decides the government has no rights decide who can teach people things, and as such basically throw out all requirements for teachers as unconditional... Mostly cuz it'd be funny to see someone who failed high School argue it's illegal to keep them from teaching high school students the very concept is amusing)

Then the legislature eliminated them all. One was about disallowing goats to graze on the capital building grounds in Atlanta.

    Politicians should be required to have actual work experience in fields other than government. Right now our country is under the control of people who only know how to control and manipulate people and not much else.

    I am fully licenced to have this thought, I paid $10.000 for my licence so I am covered. Now all I have to do is pay a further $20.000 for the licence that allows me to share it as in turn my thoughts into verbal snippets of sharable information.     If I were a citizen of Minnesota, I would have to ask what benefit is it to me to have my government spend its time (my taxpayer dollars) to investigate this matter or attempt to regulate it. I think the conclusion I would come to is that there is no public benefit. Moreover, it is detrimental to the public’s benefit because it takes away resources from areas where the need for regulation is legitimate. Whoever sent that letter to this individual should be either fired or reassigned to a position filling potholes or fired. Probably fired.

      It is a service provided so that the practice lasts beyond her. There are Bob Ross certified instructors for painting. Does a non-Bob Ross certified instructor teach worse? Probably not but at least they went through some instruction and a customer could confirm their credentialsand have a certain set of expectations.

      @@jeffreyredfern2260 Would you let a veterinarian take care of your horse if their veterinary degree came from an unaccredited school? Leda teaches a course that, by her own admission, has an impact on the health of a living creature. What happens if someone with her equine massage certification ends up injuring horses, and was in fact only hired to care for horses based on her certification? This is not to suggest that ANY regulation would be appropriate, but I can certainly see how the public might have some interest in ensuring that the training in this case is safe and effective. (By contrast, the Bob Ross certification isn’t something that could cause significant or objective harm to any living being, so there is no significant public interest.)

    This is insane. Govts are totally out of control with regulation, licensing and control.
    Ironically I know several folks, including myself, who do different agricultural teaching on farm, including teaching people how to butcher their own livestock, as a way in part, to get around onerous meat processing regulations.

    Your land, barn,horse feed, hay, shoeing, gas, car, truck, trailers, lunch, dinners out, trips, lodging, brushes, saddles, the list is endless on how you can stick it back to the government

      licenses and bureaucracy IS important.
      without it, buildings would fall, patients would die due to unlicenced doctors not following standards etc.
      If she just cut the certification part, they would probably leave her alone

    I worry they'd block that curriculum. The truth is a humans ability to massage a horse is pretty limited if you know how massage is supposed to work. Could there be marginal benefits at the poor level of massage a human could perform on a horse? Maybe. But if they were to panel some human massage therapists their standards of effectiveness may be so high that they may classify the material as bunk. But that's not government's job.

      The issue is not the efficacy but the "certification" for example the local community college here offers an equine massage certication. A lot of these regulatory issues are about guilds wanting to cut out the competition.

    I think you're going to get a lot of leverage on the point that no one in the government is actually qualified in horse massage, so what qualifies them to approve a curriculum. The fact that she owns the horses helps me see this more clearly as a 1A case. Otherwise, i thought it was fuzzy, but then I thought about the prevalence of all those DYI videos. Then we get into the laws regulating small business. Anyway, thanks for standing with all of us. Someone has to.

    I generally massage rather than pet dogs and cats and they love it. I have a friend who I visit almost daily because he's in neighborhood and physically disabled (very bad rheumatoid arthritis so I'll do small chores for him and open things for him) and his cat will run to sit in my lap for a massage whenever I sit down at his place. The funny thing is once he tried to do a contest to see who the cat loved more as in who will the cat go to when I sat down. All I'm gonna say is massages trumps pettings everytime.

    there's such a thing as transporting thoroughbred race horses nationwide to race tracks.
    it wouldn't surprise me if someday they require the drivers to have a special endorsement to transport live horses.
    I'd rather drive taxi in Carson City, Nv
    but thoroughbreds don't try to tell you how to drive.
    they're just glad to be going somewhere with 14 other thoroughbreds

      There is regulatory guidance: it's called the Veterinary Board. And to that point, I actually know and have worked with equine vets who were certified in massage therapy for horses (as well as acupuncture, even-- yes, that's offered for horses as well). But where did those veterinarians get their certification? From programs that were licensed to provide them, having run their curriculum through the necessary hoops to prove that it was in line with our knowledge of equine physiology and science.
      This video has misled a lot of people by making them think she is singularly qualified to teach a unique, revolutionary new science. It's not that new. It's not even that revolutionary. Every equine vet I've ever worked with has added these additional skills to their repertoire because it allows them to offer a wider range of services to their clients.

      Some other comments indicate a number of people who do think it's brand new, so apologies for lumping you in.
      The regulatory structure that exists (that is being discussed in this video) is purely for certification, not for the act of teaching itself. To put it simply, if Leda Mox wanted to teach equine massage therapy classes, she could, just like you can teach horseback riding or underwater basket-weaving classes.
      The issue is that she is offering it as a Certification Program. And the practice of offering a certification program is what the Dept. of Education is regulating. This is regulated because they're also regulating the content-- both in terms of how much is covered as well as what is covered. That's why they ask for her to design and submit a curriculum.
      Not mentioned in this video is the fact that the Dept of Education also requires proof that the teacher is qualified to teach before they're allowed to be licensed to teach a Certification Program (i.e has a relevant degree, have a relevant certification from another certified program, or hold a certain number of years of experience in the field).
      There are other minimums that you're required to meet, but it basically sets a minimum bar for offering a certification program. Not for teaching on its own.
      Anyone can teach equine massage therapy. Leda Mox can certainly teach it without being licensed.
      But for her classes to be worth anything in a professional context (such as to a veterinarian, rather than a horse owner who just wants to apply it to their own horses), it must be a certification program. And for her to teach a certification program, she must be licensed.
      So to be clear, the teaching itself is not what's being regulated, but rather the act of offering a certification program.

    I attended (human) massage school, and it is a form of medical care.
    You do need to know how not to harm your patient - or yourself - so I can see them wanting to prevent harm to humans or horses.
    If a human damaged their horse and sued, she would probably not have any legal protection. Or if the horse harmed the human during the massage and the human sued, same thing. Or if a human injured themself because they used poor posture or something, ditto. I can see lots of ways this could go badly.
    That said, I’m very unsure the state is taking the correct measures to achieve the goal of safety for all concerned.

    Did I miss something, ? To me there seems to be some underline problem that someone does NOT line, someone who does not like her, but is enjoying the Pleasure to use THIER use of creating a Problem for her. Did this start with a displeased student., who created this problem? All it takes is some Arrogant, narcissus person , perhaps friend of the family, relative, wanting to create this problem, and because of their position at work, others comply without realizing, or seeing the whole picture. COMPLY is what their job is to make others comply, under certain law. They do not need to KNOW anything about HORSES, do not have to visit the cite , speak to the owner, take a class to find out.

      Yes. You missed the part where she wants to offer a certification program. Not just teach horse massage therapy classes, but offer a certification program for horse massage therapy. The video did a great job of glossing over that by characterizing it as a free speech issue and making it appear like the Dept of Education is being unfair and unreasonable, but the Dept. is actually just holding her to the exact same standards as anyone else who wants to offer a certification program. She is more than welcome to teach equine massage therapy and be paid for it, just like she's more than welcome to offer horseback riding classes and be paid for it.

    Here's the part that I have a problem with: As I understand the video, when a student completes the course, they get a certification. Is that a State endorsed certification? Does that certification allow that person to then practice horse massage for money? Is it necessary to have a certification in order to hold yourself out as a horse masseuse?
    What I'm getting at is this: If I want to be a cosmetologist or an electrician, or perform therapeutic massage on people, I need such a certificate and to get that certificate I need to pass a course from someone who is authorized to do so. If the State has such requirements for horse massage, then it is simply being consistent, and protecting the public from hiring someone who claims to be a horse masseuse without having the proper training.
    On the other hand, if there is no State endorsed requirement and this gal is simply printing up certificates saying that her students have successfully passed her course, then the State agency is acting beyond its authority.

      No, it's not a state endorsed certification. It's a piece of paper that says you satisfactorily completed her curriculum. The state does not license horse massage at all. The regulations at issue apply to anyone who teaches anything vocational.

    Don't nearly all states have a requirement for a license and for at least a university bachelor's degree for teaching? And if the assertion of this video that teaching is freedom of speech, wouldn't all licensing and degree requirements be struck down for all teachers? And what are the consequences if medical schools are no longer require their teachers to have degrees and licenses or any kind? Will we have snake oil salesmen teaching medicine again? If medicine is the determinant factor on whether a license is required, and if 'therapy', in this case massage therapy, is medicine, then doesn't that mean that she can teach horse massage (not medical) without a license, but not horse massage therapy (medical)?

      Nope. Teaching "licenses" are only required to teach in public schools. That's just the government setting its own standards for its own employees. You don't need a license to teach in private schools, and you certainly don't need a license to teach one-off classes to people who want to learn.

    I'll play Government Advocate on this one. Leda is probably advertising this course, soliciting for paying customers. So this is a business. Any business needs a business license and pay business taxes. She offers a Certificate of completion for this course she teaches. For that certificate to mean anything, it has to be comparable to some standard. Lastly, because this is a Course, that has Classes, Charges a Tuition, and Graduates Students with a Certificate, that makes this a school. Walks like a duck, quacks likes a duck, it's a duck! Even dog grooming schools are licensed in Minnesota and other states. Solution: Get rid of the Certificate of Course Completion. Quit calling it a "Course". It will still be a business, but it will no longer be a school.
