The entire purpose of "Zoning Laws" is to provide a channel for the elite to displace the poor they don't like under the guise of "Public Improvement".
The government didn’t want an auto shop there, they were looking to gentrify the neighborhood.

When a government believes minimum wage retail is better (worker pay wise) than a full service auto repair business - they've lost their mind.
there will be more of those workers and they get to tax each and every one of them. Plus, the value of the property will be higher so that's more taxes. It's all about money, they don't care about the people.

Slight issue with how they did the "rezoning" though, the application form for Texas can take 10-12 weeks to be finalized but everything else that HAS to be done by law (research, planning, notifying all affected parties about it ect) for even a small area can take between 24-48 months (so 1-2 years) to complete before any rezoning can even officially be done. They can't just go "Oh this is no longer a zone that allows for mechanic shops as it's now a yuppy fucks "premium" spot" and be done with it, it just doesn't work like that.

The US has had a terrible record for liberties for small businesses for decades now. Small business owners are basically crushed under the regulatory capture implemented by mega corporations who know they're nearly the only ones who can afford to meet all the onerous regulations and codes across the country. It's amazing how many other counties actually have more small businesses than big chains because they're free to earn an honest living. In Japan, for example, there's no zoning regulations against running most types of businesses straight out of your home. You want to open a shop or provide haircuts out of your property? Just do it.

I'm so glad that the Institute for Justice exists, but at the same time, it's sad that they're the only way we can get true justice anymore. The legal system is so screwed up in this country in so many areas, that without the IfJ, regular citizens would be at the mercy of corrupt officials and authority figures. How sad is that?
As long as people are stuck in the two party paradigm, things won't change. It's too easy to inflame people to believe it's always the other party doing things to take our freedoms. It's both working for the same ends.

Google street view has numerous images of this location, all the way back to 2007. Henga ran a CLEAN shop. There's not one piece of trash in any image, there's not one broken car outside the fence, and no car is still there in a later image. That is highly unusual for these small shops. Most of them end up looking more like a car graveyard.
Also the location sat empty for FIVE YEARS after they ran him out. I guess Macaroni Grill didn't want it after all.
I remember a mechanic who was zoned out of his shop and made the city pay dearly for it

Their support for individuals or small businesses that are being victimized, often by a bureaucracy corrupted by cozy relationships with big money campaign supporters. Social injustice abounds and the Institute for Justice is one of the best and most successful protectors of our rights.
They seem to be taking over where the ACLU left off. Whatever happened to the ACLU anyway? I never hear about them anymore.

Two common issues are presented in this video:
1) NIMBY (Not in My Back Yard), the acknowledgment that something is needed but the unwillingness to have it near you.
2) Politicians finding any reason to deny solutions so they can have something to campaign on in perpetuity.
I think there is a false comparison to having a man who owns a garage compared to a woman who wants to build two homes on her tiny property compared to someone who wants to house homeless people and concentrate them in residential areas. Those are 3 very different cases. While I support the man with the garage, I do not support the other two.

I'm a small-business blacksmith, and my neighborhood impact is very minimal. And yet whenever a city zoning or planning commission gets involved, I'm right in this man's shoes. I wish I lived in a country with actual freedom instead of jingoistic claims that we have freedom. We don't.

And the municipal/county/state/federal division in particular limits what your LOCAL government can do, because they exist at the whim of a higher level of government. Failing to grandfather him very arguably violates the takings clause.
The trick is though, you have to take them into court, there is no element of the government that polices itself (at least, there isn't in the current incarnation of our system)

It seems that, at least in Mr. Hinga's case, the prohibition against _ex post facto_ laws would apply. He was legally operating his business in compliance with the extant zoning rules, so any change should allow him to keep operating until he himself decides to move or quit.
He should be "grandfathered-in".
It shud very clearly apply... But the problem is the city can enact unjust illegal rule on its citizenry; and that rule stays in place until the court process can both begin and carry on long enuf to actually achieve a result of even a temp injunction
He cudnt afford to wait for the courts to take action; and the city thus got away with takin away his business without just compensation, by knowin that its poorest business owners cant afford to fight back
Even if he would eventually win a legal case to remain in business, he has to spend the time, money and other resources to see a lawsuit through to the win. The municipality has more resources and can outwait most plaintiffs to win by default.

There is a contention that ex post facto rules do not apply to civil codes, just criminal law.
Truth! My hubby and I had a custom cabinet and woodshop for many years. The city, purely on a whim, decided that the wood finishes and spray equipment were no longer 'acceptable' in city limits. We would have to buy new 'airless' equipment at a cost of thousands of dollars at minimum. Luckily we were able to relocate, but it was never the same. We finally closed the shop and let the 3 young men that worked for us go.
Since they decided this would be needed they should have had to give you the money for those or or pay your relocation expenses or grandfather you in. Why not just request that you install better exhaust equipment?
Did you consider trying to fight it? I'm really sorry to hear what happened. You got to fight these things. Even if you lose you've got to fight these people. They're not all-powerful. The worst they can do is send Pigs around to lock up your business but at that point you can make a demonstration and hopefully get on the local news drawing attention to the matter. You could also just report the matter to your local news, and have them cover it thus embarrassing these local officials.
As soon as the city council looks like a group of bullies causing harm to a peaceful local business for no reason they may have backed down. Also I'm sure you could have sued them for just compensation and damages that they were choosing to inflict on your business and loss of revenue. You can't just roll over when these things happen, that's what they're betting on. These thugs look down on local businesses in their community instead of having maximum respect for them as the backbone of their town. If they had any respect for you they would have offered you full compensation at the first at a minimum.
Yes yes these criminals have some local goons at their command but that doesn't mean they're all powerful. You have to fight these guys in court. If the local judge is corrupt and biased, then demand another venue or take it to the next level up. If you roll over I mean... What can I say? Yeah this is a big problem this needs to stop. Once you legally own something, nobody should be able to dispossess you of it outside of highly extreme and rare circumstances and only then if you are compensated double its market value at that time and only with your permission, unless the situation is one regarding a serious crime committed on the property and the property seizure was being done to compensate victims.
Government is just a thuggery group for big business protection and advancement in this country. Sometimes counties will try to profit personally from criminal seizures AKA robberies AKA takings, but what I see is more frequently they act as the muscle for big business.

It's all about extracting tax revenue from major corporations. Dallas bean counters most likely determined that they could get more in property tax revenue and sales tax revenue from a company with deep pockets. The irony: They ended up with a fitness studio which most likely provides even less income than the auto shop. The real story is businessmen and women work behind the scenes to call in favors from their council members to drive out their competition or build a new business.
Anywhere else that I have seen, any previous business is grandfathered in, even if they change the zoning! Go get them IFJ!
This is that gentrification is all about. I’ve seen the same thing happen around the DC area. Lots of automotive shops turned into Starbucks and orange fitnesses.

Imagine thinking getting rid of a family business that is there organically and replacing it with a Starbucks is something to be proud of.
In the communities that I am familiar with, when an area is rezoned, the uses that are there may become "nonconforming" but they can continue. If a nonconforming use wants to expand or change, a zoning board of adjustment can hold a public hearing, and if the facts and sentiment are in favor, the board can grant a variance.
Mixed use zoning is often the best zoning. Single and multi-unit residences, shops and businesses all within walking distance of each other are usually mutually beneficial.

I would have thought the " Grandfather Clause " would have protected the Dallas shop owner. But I have seen that this is not always so. I've seen a whole nice area of brick houses, its people ordered to sell out to a development ( at lower than going rate ). By order of Imminent Domain. All just for a Shopping Mall to be built. I hear you . I have been thru two major situations with government in the past 15 years that have turned me into a classical liberal. I was a lifelong Republican but these events made me sit and think for many years about the wrong direction our country has been heading for over 100 years, now; at first slowly but ever increasing rapid in the past 30, 20 and 10 years.
Be cautious. Liberals are just as interested in forcing others to conform to their way of thinking. What you're looking for is less government, not the other side of government.

I’m in tears. Unscrupulous roofers are taking advantage of families in North Florida.
They continue leave homes with terrible roofing and continue to pass inspection.
If you challenge them or in our case, ask for the roof to be redone, they put a lien on your home.
This home is the only thing I have considering I’m my mother’s caregiver and can’t currently work.
My father recently passed, 9th of April, and I’m now terrified they will take our home.
How is the county permitted to pass these terrible roofs simply by a drive by?
This company has been in the local paper for predatory behavior and had changed the name of their LLC 2 times.
I’m convinced this large company has many in their pockets and they will continue to bulldoze over families that don’t have disposable incomes.
I’m heartbroken and have lost hope that the courts actually care about citizens.

I've seen this happen in my town. They tried to ruin all the auto shops out of town, but they were the only businesses that were making money. They literally wanted a Drawer Knob shop instead. You might be surprised the drawer knobs don't pay much in taxes. :P

I think the saddest part of all this to me is that the city officials who forced him out of his business probably saw him “going back to his own country” as a win. You cannot convince me those people in power did this in good faith. I mean it’s Texas for goodness sake, at least a few on them saw a black immigrant and thought zoning was the best way to push an immigrant out of their city without being blatant about it. It’s all just sickening.
Look into what kickbacks, stock gains, or other benefits these government officials recive when this happens.

this sort of rezoning is clearly a taking. if it's at all legal, then it should require the govt to compensate the owner under eminent domain

Go IJ thanks for all you do. Ive had my own zoning scrapes. There is know doubt about the codes and zoning have been used to push out people and business. Just go out and try to put apartment biuldings next to a golf course or million dollar homes. It will go no where.

Abolish all zoning laws, abolish all building codes not directly related to health and safety, prohibit building permits and mandatory inspections in rural areas, and stop subsidizing suburban sprawl!
