      100% that's how the guy operates in everything he does. His plan from the beginning was to come up with a way to avoid paying... the a/c problem and the complaints were all lie's meant to set the stage for a refund. If a company doesn't play ball , he files a suit and they get scared and settle outside of court. It's a textbook Con Artist , the kind that doesn't care who he screws over. If he somehow got exposed for everything he's done , he'd spend the rest of this life in a "gated" community , I'd put money on it.

      in the uk he could have let the suit progress and prepare to declare bankruptcy and close the company if the other person won, costs you a lot less than legal fees. you then reopen the company with a different director and after 7 years your'e no longer bankrupt and everything is back to normal. the idiot who files the suit gets zero since the company is insolvent.

      If you look at the bill carefully, it seems like he paid for the car (~$50k), but didn't want to pay for the $60k "loss of use" that Spaghetti charged him for the broken key turnaround etc. So take Spaghetti's word with a huge grain of salt before passing judgement.

      @@Badassing It may or may not fair depending on specific circumstances. For example, did the customer break the key or was the key from a finicky exotic prone to breaking and customer was just the last to touch it. I don't know the details, but everyone can see that Rob isn't exactly forthright about what the dispute with the renter is over, which might suggest he's not forthright about the rest.

      Its easy to disable major components (or anything else) in any rental car.. Risk you take when renting out anything, especially exotics. People are truly shit, Spaghetti should submit links/names for these douche bags so others can be aware.

      On principle it may be worth the trouble. Speaking on the UK I once had a British room mate and lived near a British pub. One night when a soccer (football) match was on he comes tearing in looking for the jersey of a player that had been traded from the opponents team to his. Thinking it was Arsenal vs Man U. I was curious why he was so fired up. Was told It's politics, it's political mate!! Laughed my ass off.     Lawyers are modern day legal mafia, it is the reason why this country has been growing at a snails pace. I stopped expanding my business and hiring more employees due to the legal system. Instead of giving amazing service and always doing the right thing I now second guess everything I do because of potential liability.

      Not sure about a countersuit being cost effective. Typically when a judge issues a ruling , there will be an order to pay the legal fees of the successful defender of a losing suit .

      The reason he had to pay for legal fees is because he lost the suit. I'm pretty sure the guy settled for a full refund plus legal fees. Rich people can get annoying when they want their money back. The have the time and money to make you miserable. I think Rob could sense this and was trying to pad the invoice. Can't see how that worked in his favor.

    I thought the way the law was I could be wrong correct me if I am but I thought the loser of a lawsuit has to pay the winners legal fees. If not you can file for legal fees And the judge should be able to say you need to pay this man’s legal fees. but if I’m wrong please let me know.       I believe that (legal fees paid by loser) is only for civil lawsuits, class actions can be a lot more complicated due tot he inclusion of many people. Maybe, just sue the law-firm that brought the suit.

Does the plaintiff in this case which was the loser also have to pay the court costs be in a class action?

      In general, no. In America, each party pays their own way (it's called the American rule). That being said, it depends largely on state or federal laws pertaining to the case, as well as the judge's discretion. I'm guessing the judge thought it fair for Gotham and the other defendants to have paid for their defense, given the "relatively low" cost. It might be possible to sue for damages after the fact, but in general, it's not worth it given that you would incur further legal fees in trying to do so. Generally the case has to be pretty frivolous or a matter of public interest (a case given was a California citizen suing his local city rightfully claiming that the construction they planned would cause large environmental impact, flooding, etc) for a judge to either be required or to choose to grant the defendant some sort of recovery of legal fees.

    I had someone rent my Airbnb and they sprayed/poured 76 bottles of champagne over every inch of the apartment. They were in town for New Years. The hardwood floors had to be ripped out and replaced, same with the kitchen cabinets. Plus the place needed to get repainted and all of the furniture replaced/dee cleaned. The bill was a bit over $50,000 for everything. His argument the whole time was that the spilled champagne was covered by my $50 cleaning fee.
    Airbnb paid out after 6months of fighting but that was my last Airbnb experience.

      How do you know they sprayed all 76 bottles? Also replacing the floor from champagne being on it is a bit excessive. Proper flooring can withstand being wet for a few days. Charging for the paint would of been reasonable

      @@geewoods6590 They had left all of the bottles on the floor laid out everywhere and every surface of the apartment was drenched. And no hardwood floors are not designed to be soaked especially not in a sugary liquid. To put it into perspective in order to walk in the apartment you needed to consciously lift your feet because it was so sticky. So you can give them the benefit of the doubt and say maybe they drank some of the champagne but even if they did, a vast majority of it ended up on the floors, walls, ceiling, cabinets, in the pool table, or in the sofas and beds. And considering that they only had like 20-25 people over (we had cameras watching them go in and out) I doubt that 20 people could drink 76 bottles of champagne and a handful of other liquors and beers. People can drink a lot but the bottle to person ratio was extremely high. I would have to look back to see how many of the other types of empty drink there were but I remember there were something like 40~ beer cans/bottles empty and 7-10 other liquor bottles. So yes they might have drank some of the champagne but based on how many other drinks where consumed at the party I doubt it was very much. And yes we counted and photographed all of the empty bottles tossed all over the apartment we had to for our report.
      And trust me I did not want to replace the floors but I did not have an option the champagne had gotten underneath large sections of the flooring and seeped into every crack and crevice and it would have attracted ants and other critters on top of the actual damage to the floors. When the floor was ripped out we found multiple pools of champagne under the floors. Sure the floors would survive in theory. But eventually the damage would catch up if it was from the "water" damage or the insects that would come from far and wide to feast on the puddles of sugar water waiting for them. It might seem like overkill but it really wasn't, the damage was pretty serious. The floors were only a few years old and I loved them, replacing them was a huge pain in the ass and I prefer my old floors, and the compensation never covers all of the time and energy I put into it.

      @@PlayCenterShop It was a lot of waiting and changing who I am supposed to speak with. The first few weeks were waiting for the guest to offer to pay. Obviously they had no intention of paying they offered to replace the felt on my pool table everything else they felt was covered by my $50 cleaning fee. After they refused to pay I needed to get 3 different police reports each person at Airbnb I spoke with claimed that I needed a different one and at the end my first report was what I needed. After that I needed to actually get the work done, an estimate is useful but until the place was all put back together I couldn't give them a final bill. And throughout this process there were lots of back and forth on the extent of the damage. I was very lucky that I have a small Airbnb office by me and this unit was a favorite for their employees when they came to town so I had a handful of great Airbnb employees on my side helping push my case through. Once all the work was done they had a bunch of questions about some of the expenses and tried getting out fo paying for a variety of things. The whole back and forth process took about 2 months once all the work was done. I didn't start any construction for about 6 weeks after it occurred and then it took about 8 weeks to get all of the work done due to a variety of scheduling issues. and then another 2-3 months of back and forth with Airbnb.

    I've worked in a plaintiff law firm for 3 years (the exact kind of firm which sues others). I quit. But here are my observations:
    1) No lawyer is a good lawyer unless he constantly lies and exaggerates for the benefit of his client. If you get a lawyer who is unwilling to lie on your behalf for the benefit of your case, look for someone else. This field and every field related to this field, such as the entities that get sued, will all lie, all the time. An honest lawyer simply cannot be on equal ground if he is honest, because his opponents will lie. So all good lawyers and others who work in this and related fields will all lie to the extent of which one cannot prove/disprove a lie. So a good lawyer will lie for the benefit of his client as long as he knows he can get away with it, always. The best lawyer is the one who knows where he can lie and where he cant and how to expose someone else lying.
    2) Many lawsuits are indeed bogus. In my experience, almost all of our lawsuits were an exaggeration of the actual facts and sometimes even borderline a fabrication. Usually we extremely exaggerate the extent of the damages of our client. HOWEVER, there have been plenty of cases where we had a legit case but the adversary party (such as an insurance company) treated the legit case as fraud and in the end the legit cases often got underpaid or dismissed.
    3) Even though lawyers are crooked, and by definition they have to be in the interest of their client, do realize that the reason lawyers exist is because many businesses screw over customers/clients/insureds/etc and so these people have no alternative but to hire a lawyer in order to achieve (financial) justice. Many of our clients came to us and, for example, said they were offered like $500 from a business when in fact they were entitled to at least $50k. So my point is that yes, lawyers are bad, but so are the companies we sue. You think your insurance company actually cares about you? You think you had an accident and the insurance company offering to pay your bills is them being nice? Next time you have an accident, dont take money from the insurance company, go straight to a lawyer, and see how big the difference is between how much money an insurance company can get you and how much a good lawyer can get you (and how much you actually deserve).
    4) Class action law suits. Now, these are comparatively very rare, and yes unfortunately they are also sometimes bogus. However, without CAL's, many companies could get away with soooo much crap. There are certain kind of lawsuits which can only be brought up via class action law suits. For example, nowadays we see many car companies advertise one price but in reality offer another. Or we see "oil change for $20" but when we drive in, we are charged $35. The list is endless of similar cases of ripoffs. Normally, no single person would sue them. Or at least, no reasonable person would sue because you cant really get anything out of such a law suit, financially, because your damages were extremely low. However, if you find ten or one hundred or one thousand others just like you who were fooled by false advertising, you can actually bring about a big law suit and get a good lawyer and sue not only for your damages, but also for what are called "punitive damages". In other words, you can sue not only for the damages you suffered, but also for additional $$$ to teach a company a lesson so it does not pursue illegal behavior in the future.
    SuperspeedersRob, you might be a good person, you might be not, I dont know you, maybe you have a like-able youtube persona but on business you become someone else. However, this field is full of people who will do anything when money is on the line. This is why lawyers have to be crooked and corrupted in order to level the playing field. Most of the time people lie and they don't even know it. I cannot stress how many times I've been on the phone with an insurance adjuster or a doctor or car dealership and the person on the other line could swear to me that X is true, only then 10 minutes later for me to find out that X is completely false (most often this is due to incompetence: people don't actually know what is true but they want the truth what they want it to be)
    Also, in my 3 years, we have sued some pretty popular businessmen who held lectures and had youtube videos just like you have, Rob. I even attended some of these lectures for the fun of it. My observation was that everyone who gets sued thinks he is innocent. I remember we sued one doctor for pennies but this was more out of principle because he was a fraud and we felt bad for our client, and he would at every lecture of his tell everyone how corrupt lawyers are and how money-hungry we are even though this lawsuit was completely legit and he was a fraud (long story short he would significantly overcharge patients and exaggerate the extent of their damages so that they would keep treating with him, and he would never accept a reduction for these charges despite how poor the patient could be)

    OK not all class-action lawsuits are bad. As somebody who was a part of a multimillion dollar class action lawsuit against my former employer who refused to pay overtime to the employees after we worked 12 hours a day seven days a week for four weeks. We had no other choice and because there were couple hundred of us it had to be a class-action.

    I throw all of those class action mailings away too. One of the times that I "won" I think I got a $25 airline voucher, another time a check for, like you said, about $3. On the main point, I appreciate how some people never make enough to save anything, but somehow it seems worse that you can go broke, and then some, just paying lawyers when nothing really happened!

    I got roped into one without me realizing. I was on the class side. I got an email from a games company asking me for some info about my account, either I wasn’t paying attention or they didn’t make it clear as to why they needed it. Months later I got a check in the mail for something like $0.22. It wasn’t even worth the gas it would’ve taken to go cash it so I trashed it. I understand that sometimes there is a very good reason for a class action lawsuit, but like anything with our legal system, there are people out there who will use and abuse it to make a buck, and the lawyers who represent those cases typically walk away with a huge portion of the awarded sum, while the people actually “harmed” typically get screwed. It’s silly.

    I would have thought e&o applied to any contract written during the time I pay premiums and you seem to be saying it's the day of the lawsuit that matters not the contract (even from contracts prior to my starting coverage with company?)
    I mean if I get in a car accident and I have coverage with all state and two years later I've sold my car and have no insurance and the other party sues, to me I'm still covered by all state it doesn't matter that I'm no longer a client, I was at the time.
    if I retire for example, the last contract I wrote was covered for about ten minutes if it only covers lawsuits while I'm paying premiums.
    Was it just ok if they won 3 million you could go after his insurance but since they didn't name the contract lawyer in the lawsuit you'd have had to pay your lawyer still to first fight the insurance company to get them to step in and fulfill there obligations?

      This was my thoughts exactly. The E&O insurance should have responded to defend the lawsuit as it was in force at the time the lawyer drafted the contract.

    Take a look at the bill at 7:08. This guy paid the $47,500 for the car and his damages to it. It looks like the dispute was really over Rob trying to weasel over $100k out of him for "loss of use", support technicians and roadside assistance for the rental car breaking, and even a stay at a resort and shipping for replacement parts. The breakage was with the A/C which you can't possibly claim is the customer's fault, so why should the customer pay for it? He admits later in the video that there was an issue with the charge of the A/C system, so the customer wasn't lying or having unrealistic expectations of the Lambo's A/C. Yeah, the customer screwed the front bumper on a car that's ridiculously low and easy to scrape, and broke a finicky Italian exotic car key that's probably been abused already for years. As an exotic car rental company it's your responsibility to be prepared to repair commonly damaged items (e.g. bumpers) in a timely fashion and to be prepared for failures of other common items specific to the models you're renting out. These cars are failure prone already, and renting them out only exacerbates the problems these cars experience so frequently (e.g. electronics problems, power windows, A/C, etc.).

      The point was that he didn't pay the bill, you obviously didn't listen to the video. As far as damage goes it is what it is, there is a rental contract and you are responsible for any damage done to car while it's in your possession and it's no different if it's a beater or an exotic and the prices to fix the damage is based on the car.
      End of argument, the guy signed a contract and that's that. The ac problem was just a bratty rich kid looking for an excuse to keep his money and get a free ride in someone else's dime.

    Sorry to hear u had to go thru all of this.
    You provide a service for people to drive cars that some could only dream of just sitting in.. and I thank you for that!
    Unfortunately some people try to take advantage of others..
    It really sounds like you did everything possible for this guy, paying for repairs on the spot, paying for hotel rooms, overnighting parts, offering to pay for another car.. ect.
    Hope it all works out in the end..

    $3m lawsuit over something so trivia. No wonder the US economy is so fucked up (apart from the lawyers of course!) - So technically the same lawsuit/action could occur if say, the car involved had been a Yugo? As it appears it’s more about the winning (principal) than the $$$$$ ????? In the UK🇬🇧 this would of been settled through the courts for a tiny fraction of this.

    Based on your side of the story, sounds like you were very accommodating especially with providing parts on their next stop. That's awesome. I feel like that a lot of companies/people would not go out of their way to do that. It's a shame that you ended up with paying 120k but at least you did not pay 3 million.

      What do you mean it was frivolous? They, in fact, used illegal language in their contracts. There was no abuse of process here. Don't get me wrong, it's a fucked up system but it seems handled correctly.

      Then it’s a frivolous lawsuit, and exactly why the American legal system needs a reform.
      Nobody suffered a loss, but some ambulance chasing lawyers decide they’ll make some money from good faith business owners by suing them for something that hasn’t actually affected anyone. Which is exactly why they lost.

    Class action lawsuits are important in preventing big companies from bullying normal citizens out of small enough amounts of money that there is no legal recourse. If your cable company unlawfully takes $100 from you, you will not go to court because it’s cheaper to just pay the $100 (and you won’t be able to go to court because of an arbitration clause anyway). With class action lawsuits, if 100,000 customers were robbed like that, the amount becomes large enough to create problems for those companies. It’s an important deterrent and helps keep the companies in check.

    I ain't buying. Your attorney's E&O carrier would have been on the hook for your defense costs whether he was alive or not because your lawyer would have interpleaded him into the suit. It seems more likely you just cut and paste a contract to avoid having to pay a professional, which would also explain why it was a crap contract.
