He isn't rubbing it in her face that her car is going to be towed. He is trying to help her. He asked her if anyone could pick the vehicle up and she kept asking for IDs. He is trying to tell her how much of an issue paying that tow fee will be if she doesn't shut up and listen to him, so he could allow her to phone someone to pick the vehicle up. The officier was being curtious.

Santa Rosa County is NO JOKE. Same with Escambia County (right next door to Santa Rosa). It is in the Pensacola area (NW FL in the panhandle). You can google the Santa Rosa Sheriff and see videos of him advocating/encouraging citizens to have firearms to protect themselves. Also, those are sheriffs, CONSTITUTIONALLY ELECTED, not city cops and they don't play.

I'm from Australia and drove across America for 3 months, only pulled over a few times and found the police in different states to be polite and professional, obviously your attitude towards the police is part of the equation
I think generally non-urban police want a quit life and if they haven't seen you before will give you a warning (unless they are having a bad day). Their tolerance for this type of bullshit, however, does seem to be very low, and who can blame them. An apology and contrition go a long way.

From a Floridian, there's way weirder shit than guns down here. We don't have open carry, but we have permitless concealed carry now. We also have a strange law where if it's more or less concealed, basically anything goes. That includes in my own experience everything from pistols to swords. Yes. Literal. SWORDS.

There are a few exceptions in the Florida Law that actually allows open carry. FL statute 790.25. But the cops hate it from what I've seen.

Yes, you can decline the test. You have the right to refuse a breathalyzer. However, under Florida's implied consent law, refusal of this test can result in an immediate license suspension as well as a forced blood draw (in cases of accidents involving injuries).

A buddy of mine works for a car rental company at the airport nearby. He told me they no longer accept fleet cars with California plates because there were too many complaints from customers that they were flipped off and told to "go home" during their travels, even though they weren't from Cali.. I think that's hilarious.

Once I was pulled over in a rental with New Jersey plates and when the officer saw the rental agreement he said have a nice day. My wife still laughs at me for that incident and now I always check the plates before I drive off
Since 2001 I’ve refused rental cars with California plates.
When we lived in Florida, my wife was stopped for speeding. The officer could see that my wife was very upset, and asked her what was wrong. My wife explained that she had just found out that her mother had died.. The officer let her go with a warning, and the advice to watch her speed. If my wife had been obnoxious to the officer, she would probably have gotten a ticket. By being truthful and respectful, my wife avoided a ticket.

Born Floridian, lived the longest in California, but the far Northern and forgotten part. Even Californians don't want Californians. Most people don't know that the state was VERY close to being divided into another State. Would have been called the State of Jefferson and if not for the two college towns of Chico in Butte County and Humboldt County's College (both sespools of Liberal insanity), it probably would have passed. Also Eastern Oregon is trying to split off as well and join Idaho. It's straight crazy in California. I escaped and thank god.

The cops (generally) in Florida are out of control; a lot of times they treat people like criminals without cause or justification. They do not know the law more often than not and aren’t trained properly like the cops in the rest of the country. I am a Floridian, the arrogance of these people is astounding. Just do what the cop says and so much can be avoided!! The sad thing is she won't learn one thing. People have this idea that people are getting arrested day and night for nothing in Florida. NO, we have laws here and people are expected to follow them. If you don't there are consequences. I don't feel paranoid, etc. it is safet to know that bad people will be taken care of, not like in blue states where they are practically running the show now. Instead of moving to FL in droves, stay in your home state and vote differently and change the laws, but don't bring your crap here!!

She 100% has a case. I would have a law suite on both of them. She was arrested before being told a charge. She was arrested with DUI without evidence of being over the legal limit. A BB gun is not illegal. It was not being pointed at anyone or being used. The "officer" refused to show ID.

I Moved to Florida in 2007. I see a lot of comments about how good Florida is . I beg to differ. I hated that damn place with passion. It took 10yrs to get out of that hole. The struggle was unreal, I won't even go back to visit. If it works for you more power to you. Moving to Florida was the biggest mistake I ever made.

I’m a Californian and I would not act that way. That’s just stupid. Especially since there’s some places here that send four cop cars just for a traffic violation. Where I live, we don’t mess with our cops.
It’s amazing she made it all the way from California to Florida without being stopped for an obstructed license plate. Then there’s speeding, the smell of alcohol, an open alcohol container, a rifle in plain view and possibly illegal tint. They win the Darwin Award.
A lot of states are full of "green rules" so I suspect the reason is similar to what is going on in my city. The City Council here requested that all city departments try to be "green" in reducing carbon emissions. That also meant the police cruisers no longer cruised around semi-aimlessly to look for problems as well as advertise their presence in an attempt to deter crime. They generally pick a strategic place to park while waiting for another service call. Because they don't cruise around, there is a high chance someone like this california girl can drive right through without any police car ever being able to scan her plates

That cop is not allowed to reach in and pull the woman out of the car on a detaining. For an arrest, yes. Detaining, no. That's a guaranteed lawsuit victory in every state. He has to reasonably articulate the reason for the arrest before he can trespass her vehicle and put cuffs on her.
