    It's ridiculous what you have to go through to ensure your kids are safe, but well done to you both for putting in place what is needed to ensure that Gabe will always be taken care of by those that truly love him. I have so much respect for you, you are a great family xxx

    I wish someone had been around when my brother and I had to become co-conservators of our youngest brother, who had Downs Syndrome. Both our parents passed the beginning of, 1997 withing 3 month of each other. He was living in a board and care home, which our parents had set up the year before....just in case. The woman running the home told us to get conservatorship because otherwise someone else will become payee of his Social Security checks. We became conservators that November, with me being the "spokesperson" like your Mom. They also had a trust set up for Joe, which helped. We lost our brother 3 years ago, during the pandemic, due to complications from aspiration pneumonia and early onset Alzheimer's. He was just 62. Miss him greatly.

    My parents are my conservators and guardianship over me and it’s the best thing that could have happened to me. This is the best thing ever that happened to Gabe. It’s really good to have gabe. I have disabilities. I have adhd and ppd pervasive personality disorder among other things and I am really happy that my parents are conservators and guardianship of me

    This is so important. My Dad was mentally ill and my Mother was his guardian. When she passed I had to make a brief court visit to sign papers that I would see all of his needs were met, his money would be handled as usual to provide clothing and any needs he had and his medical decisions would be made by me. My two brothers were not named in the guardianship because I was closest to him in every way, but if I had passed before him, either or both of them could step in. This information is vital for so many people. By the way, I LOVE all of you, you're an amazing family and the love is so evident. Hugs to all!

    I am so excited that everything is in place for Gabe. You know, and your mom and dad's gonna be around for years and years to camp, but it's nice to know that Gable will be taken care. Of by his favorite brother and his favorite sister. You're awesome all

      I didn’t know either and when our daughter was 30 she was impregnated by a 60 yr old man she worked with and took her from us. We got temporary interdiction but took 4 long years. Right now we are dealing with being elderly and having to find guardianship if we die because she cannot be responsible for herself. This has been a blessing you doing this post. People need to be educated on this.

    I’m so glad you did this. Our friends lost their beautiful Daughter to an evil hospital who wouldn’t let her Parents make decisions for her. The hospital let her die, she had COVID and was getting better. Sadly we believe they didn’t find her worthy of living. She was an amazing Elvis loving, kind soul.

    Without a doubt you have to advocate for the safety and well being of your loved ones when they cannot. My son 50 yrs old, got Guillion-Barre from a flu shot, and was back and forth from Mass Gen and st Lukes for a number of months. I realized he needed me to make decisions about his care etc., because he was unable to speak or respond. Power of attorney gave me the ability to choose for him, and I’m so glad I did that. After time at Spaulding in Sandwich he was able to walk again. I lost him twice but God brought him back, I will never regret taking over for him. Its been 6 yrs now and he is disabled but thankfully here with us. I relinquished power of attorney when he had recovered, so my decision to take over that part of his life helped him on his way to having as near normal life he can have. So glad Gabe has the wonderful family he has. Bravo! Love from Cape Cod

    My son is 35, will be 36 this month. He was born with what's called moderate mental retardation. Don't like that word. But that's what it's called. He did go through school. Graduated. But special schooling. He is 35 but mind of a child. He has to be watched always, because things He does or will do out of nowhere. He isn't capable of making decisions, he can bath himself, other things too, he does chores. But his mind isn't there for important things. He thinks bad people are good. Someone could talk him into things.
    Long story. I had raised 4 boys alone with only Gods help. Exes weren't good. Was hard but God brought me through. I had to get help with finances. I couldn't leave my sons. Struggled, still struggling. Work part time at our church cleaning. Two sons live with me. Youngest 29. He works part time as well at church. My son with problems gets an income.
    I'm 62 going on 63 this month. My health isn't very good. Took care of my mom with Dementia from 2014 till Dec 24th of 2017. 😔😢
    Sure took a toll on me spiritually and mentally and physically. Was a hard rough time. Going through menopause, family problems, my sons. Now have this one to worry about. He is getting worse. We don't get to town ever. Two stores close. Can't afford things.
    I'm glad you guys will have Gabe in the hands of Nick and Kira. I don't even know how to go about doing that for My son.

    Any child , adult , would be so short-changed under state conservatorship.
    I am 74, I had taken care of my brother for almost 25 yrs. I consulted a lawyer in the beginning as to how to best handle things. He passed three yrs ago at 69 from a multitude of health issues. When I 'took him in' Drs. gave him 6 months. It was a tumultous 24+ yrs. I would do it again in a heartbeat. Underneath all his trauma, there was a gifted artist. May you enjoy the peace this gives all of you as it did me.

    Thank you so much Josh and Elena for sharing this very happy moment and very important information! I had a daughter who was developmentally challenged but unfortunately passed away! I didn’t and would not probably today about the guardianship program! I do have friends with children with Downs, Autism and other developmental issues so this video helps me help my friends with the futures of their children! Thank You again and God Bless you all!     In South Australia, rather than guardianship, we can use a concept called “supported decision making” which works well for families where all members are in agreement about the approach for the person with DS. No lawyers, no court - “just” a lot of potential scenarios to work through as a family to document our preferred approach (which included my brother on the scenarios he could understand). Lots of writing, but it only took a few hours to complete.

    This is something that has been on my mind a lot. My son is 46 and I have never really had any issues about people not allowing me to speak for him. The doctors have all been wonderful as have the department of developmental services. I definitely going to get this process started. Thank you for sharing this.❤

    I agree on what you said about the Government overstepping their boundaries. My MIL was a child care services social worker. she studied for years on how to remove kids from their bad situations. Not that Gabe is in that. But she raised my great nephew for 16 years of his life. We had Social workers visits, cops, we had my MIL who died about 3 years ago (Father's day) and we lost control over my great Nephew. He is special needs. she knew it was time to pass away but she never waned him in the system. Sadly, he is. not to get into personal issues) but i am so proud of you for fighting the good fight to name both your son and daughter as Temp Guardians and are a voice for Gabe. Well done! You guys rock. You are amazing Gabe! Have a Great day!

    It's comforting to know that your parents, and then you and your sister, will be able to take of Gabriel. Being a part of his life as much as you are, there's no other people I could imagine that would ensure Gabriel's future/safety, better than his own parents and brother & sister. You truly are amazing people and I love how you all rally together and show support of one another. The world needs more families and people like you. Thank you all for sharing your journey and imparting some knowledge on the rest of us so that we can be advocates for our loved ones, should the need arise.

    Thanks for passing this information on. I am sure someone out there will need this information for their loved one. I know the kids have talked about taking care of Gabe in the past videos. Your family always stays so close together, and always makes sure Gabe is included in everything. Your family knows just what Gabe loves and surely a stranger wouldn't have a clue to what makes him happy.     I have already gone through these steps in MA courts for my daughter. As time goes by I ended up changing things as well. The end result was hiring a lawyer who specializes in Special Needs and putting together a trust and having everything in place for her future. All of these things help so much, but as a parent your never going to feel assured, but you know you've done the best you can with what's available. Thanks for sharing this valuable information for others to know ❤

    Thats such wonderful news! Knowing Gabe is safe and will continue to be safe, loved and cared for must be such a huge weight off your parents shoulders. I remember when my brother was small and was diagnosed with signifigant learning challenges, an attorney sat mum and dad down and explained the need for a will dictating a guardian for him should anything happen. Thankfully, my Auntie and Uncle stepped up and agreed to be guardians for all of us but especially my brother.

    Wow, I have been a nurse for almost 40yrs, never knew that specific paperwork was needed for guardianship!!! I am glad you were to get this taken care of before anything happened. May God continue to watch over Gabriel and your family.❤️❤️❤️

    This is such a wise decision. I am an ESE advocate and have recommended this when a child with a significant turns 18. Unfortunately, some parents do not want to their child’s “rights” taken away from the child. This resulted in disastrous results for two of my clients’ families.

    I agree, a big difference between just taking control over someone at 18+ years old, but in Gabriel's case, he needs you all to be his advocates and make those decisions. I would be so incredibly upset if the State, a Government entity whom does not necessarily have his best interests at heart, to come in there over the family whom knows him best and make those decisions. They MAY agree with you or they may NOT and this is a must. Thankfully now his siblings know what is going on and what they need to do. You all are amazing for taking care of this and explaining it to those who do not understand or whom may not know. I now wonder if one of my former students mother has this set up as well. My former student has down syndrome. Next time I see her, I will ask and hope she does, so you are helping others. I will pass this along to all parents so they are aware.

    I’m so sorry to hear you found out about guardianship by accident. That’s not right for so many reasons. I am a special educator for high schoolers with intellectual developmental disabilities. Every person and their needs are different. Every family is different. This is why it is so important for it to be determined by an outside party (legal system) to determine the best path for guardianship or support. Families should be made aware that guardianship/proxy supports may need to be considered prior to the age of 18. (I am also an auntie for a young man with significant autism. My family will be working this out shortly.)

    This is interesting information to learn but makes total sense....technically Gabe is an adult but can't make those decisions for himself. A very good friend of mine worked at a facility for 18 years working with all sorts of people with Down's Syndrome, some could work, some needed round the clock care, etc. I never thought to ask him a question like that regarding guardianship as almost all the people in the facility were of legal age. Thank you as always for sharing your family with us.

    Is this Power of Attorney over his medical and financial care? I think this is fantastic, to know that you two will make decisions on his behalf. The State will not be able to come between you now- that must be such a relief. Family is the best!!

    I know that you all are glad this is settled. I know a young lady that the state stepped in and she disappeared her dad stepmother or her mom had no idea that the state could do that.

    Thank you for your openess about this. We also have a disabled daughter that we had to make provisions for. We went one step further than you discussed in that we also made our end of life dicisions. We felt that if we had as much in place as we could that it would make life easier for our other children when the time came. When my husband died unexpectedly two years ago it took about six weeks to settle everything, not years. Another thing to remember is that each state has its own laws that must be followed.

    Amazing, I'm so happy for the family, I wasn't aware that could happen, to the disabled member if the family didn't have that taken care of, if that's your family, why should the State step in, he is being taken care of, and a while back Nick and Keira had that conversation, about Gabriel future, how no matter what, he was gonna be taken care of by the 2 of them, WOW, is crazy when you are not informed, next thing you know there's a knock on your door, and there is the State, to take over, OMG, I'm so happy for the family, to have taken care of that, God Bless, Yayyyyy for the l9ving an caring family ❤

    Wow ! I never thought of this for Gabe and others. I am old and so thankful that I set up my son and daughter in love as my DPA , as in January I had a seizure and hospitalized not able to make decisions. What a blessing this is for others in similar shoes !

    I worked for the State as a direct support professional. I tried to find out some information on how people with needs go into group homes but don't think I knew all the questions to get full information. I know family are involved if they are still around or want to be. I know too that parents or siblings are informed if there was a medical need for the house the child is in before they were allowed to pursue anything.
    Listening to this video I'm assuming families who needed to be informed must have done similar procedures your parents went through. The people were living with the State so there probably some differences.
    I'm happy to hear this. It gave me more understanding what parents have to go through to keep their child safe and let them be aware of what to do for their child.
    Personally I didn't know that your parents had to do what they did have to cause Gabe is home. I guess if a lot of this is dealing with medical needs it can be related with the HIPPA laws. 🤔

    At the end of the video when Gabe said, "I love you.", I burst into tears. It came from his heart and touched me so much. There is so much love in your family and God has blessed you abundantantly. Thank you for sharing your lives with us.

    You would think it would be a given, but technically in the eyes of the law, he’s like any other adult until proven and documented otherwise. You would think that Medicaid would have given your mom and dad a heads up. So glad they were able to get the guardianship solidified so Gabe is protected. Thanks for posting this video. I’m sure there are many other families in the same boat who will now take similar steps to protect their loved ones

    This is something Ive never thought about. You take it for granted that as the parent you continue as you always have. I have a friend with an autistic son and she most likely has thought of this. But I will be bringing the subject up now to be sure. Thank you so much for sharing everything that you do 🙏🩷

    Went through this process with my daughter with DS. We were fortunate that her high school teacher told us we needed to start this process of guardianship before she turned 18, or we would not have known either. It only took about 3 months in our county in NC. It was a relief, like your parents said. Congratulations to you all.

    My nephew has Down Syndrome. He is 27. My sister and brother in law went through gaining guardianship. She said that was a very hard thing to do. Our family and all that know him are so blessed. He participates each year in Special Olympics. He got first place in both events. He also works two days a week at a greenhouse with special needs learning about planting vegetables and flowers. I truly enjoy watching your family. Gabe is so blessed to have you and your family is blessed to have him. Greetings from Southeastern Kentucky.

    My sister and brother in law went through the same when my nephew turned 18. He also has Down Syndrome. My sister said having to go through the process was so emotional. She said for the first time she had to omit my nephew will not be able to care for himself. He is 27 now. Our family is so blessed to have him.

    Thank you so much for the info. My neighbor has a son with special needs and I’m sure she doesn’t have any thing in mind. She was just telling me that her daughter is going to be taking care of him. She has no will or nothing in writing. So thank you for this information. I will be passing it on to her. She is 79 years old and her son is late 40’s. Her daughter doesn’t even live in the same state.

    How awesome! It undoubtedly is in Gabe's best interests to have his parents & other family members be his guardians since he is incapable of making decisions regarding his welfare. You all are wonderful, loving and caring family. Gabe is truly blessed.

    Fantastic decision, fantastic family. In my country, I met a very small family, father, mother, older daughter, and the younger one with Down Syndrome. The parents died when the daughter with Down Syndrome was underage. Fortunately, the older daughter was able to "adopt" the younger one as her own daughter, otherwise she would have been left in the hands of the State. They lived happily together until the younger one passed away at the age of 54. Hugs from Venezuela.

    Congrats!!! I did respite care for a friend at one point and God Bless my friend, her husband and Emily! She couldn’t walk or talk and the doctors didn’t give her a diagnosis until she was 21. Bless your family for standing up for Gabe and continuing to provide care! He’s obviously very happy and is surrounded by a loving family! I pray that God gives you the strength to continue on this journey!

    Something I didn't know. There's so much Legally that's taken away when a child turns 18. So Thankful You Are The Legal Guardianship.

    I am SO very happy for you that Gabe is legally in your charge now. You guys can now enjoy a feeling of security that all important decisions will be made by the four of you, the people who love Gabe and want what's best for HIM, instead of some State employee who knows nothing about him.
    I, too, had to do this for my son when he turned 18, back in 1977. I can't tell you how many times I've had to produce those documents over the years. Social Security, doctors, hospitals, insurance and even some State Depts have had to put those forms on file. You will want to keep several copies on hand for emergencies and to avoid having to repeatedly go to your County Bldg ( or WHEREVER your State keeps legal rulings, etc. ) Again, I am happy for Gabe that you are ALL there to keep him secure and well-cared for. Congrats.

    It's great that Gabe's guardianship is set up. With you all you will talk things over with him and allow him as much say as possible in his own life. You all love him. so much. The state doesn't have the resources or time to really do well for folks who need an advocate. Having everything set up will give you all peace of mind going forward.
