  • Dr. Keanu Sai is a Ph.D. in Political Science specializing in International Relations and law from the island of O’ahu. He is a founding member of the Hawaiian Society of Law & Politics. He also served as lead agent for the Hawaiian Kingdom in arbitration proceedings before the Permanent Court of Arbitration at the Hague, Netherlands, from November 1999-February 2001. He is also the head of the Royal Commission of Inquiry and is a senior lecturer of political science and Hawaiian studies at windward community college and affiliate faculty member at university of Hawaii college of education graduate program as well as the chairman of Hawaiian council of regency.
    In this episode we talk about joining the military, learning about his genealogy, Hawaiian sovereignty, independence, the illegal occupation of Hawai’i, and so much more. Enjoy!

    You seriously need a part 2. I got some peeps from the mainland who will be subscribing to your podcast. This gentleman has increased my knowledge of my own culture. My gramma spoke fluent Hawaiian but refused to teach us because we should speak English. There’s so much about her past that has helped me understand her reluctance for us to learn the olelo of our culture.

    Dr. Sai knows his history well. I learned a lot, and the conversation was presented it a very respectful way. It's refreshing to hear facts and information instead of bunch of resentment and hatred fueled rhetoric.

    I love this so much! The back and forth is fantastic! He must be a fantastic teacher!
    I’m a total nerd and have been researching the overthrow of the South by the Federal government and it has a lot of similarities with the Hawaiian Kingdom.
    You’re a young guy asking all of the right questions! I only pray that your generation, which is the same age as my children to continue asking these important questions and start gathering intel! The US Federal government is like a gobstopper! There’s so many layers to their deceptions!

    Also, he didn’t mention that during an occupation, international law pauses all typical forms of citizenship, so applying for naturalization, being born in the Hawaiian Kingdom, marrying a Hawaiian subject are all invalid and do not give citizenship, the only form of citizenship left open is called “parentage”, which is inheriting the citizenship of your ancestors. So only someone who is the direct lineal descendant of someone who was a legal Hawaiian subject prior to 1-17-1893, of any ethnicity, can claim citizenship to the Hawaiian Kingdom. To be clear, if someone just lived here, but still was a citizen of a foreign country (which the overwhelming vast majority of the foreign population did), was not a Hawaiian subject and therefore their descendants cannot claim citizenship through parentage.
    We have the documents of everyone who applied and was approved for naturalization, so we can easily tell who can inherit Hawaiian citizenship through “parentage”.

      That list is well over 100 years old, so unless you’re a vampire, no you’re not 😄…… your ancestors may be on it though & all you need is solid proof that you are a lineal descendant of them.
      _Edit: and to forfeit any other citizenships you have, when the time comes, if you want to be a Hawaiian subject._

      You cannot be on the list as it’s from 131+ years ago. Your ancestors may be in it though, in which case all you need to do is prove you are a lineal descendant of theirs.

    Thnx for sharing the knowledge and setting the facts straight Dr. Sai and all involved in the Podcast because alot of people are touchy and very sensitive about Hawaii history when you tell them the truth. Braddahs like scrap just bringing up Hawaiian bloodline especially when you tell them its not a bloodline and its rather a nationality... one reason we know some of their elders didnt know why its important to pass down history because theres repercussions that come with that.

People like Dr. Willy Kauai, Dr. Kalawaiʻa Moore, Dr. Ron Williams, Donovan Preza, Kaleikoa Kāʻeo, Aunty Kauʻi Sai (Dr. Keanu Sai’s cousin), etc. He could even consider bringing in others like Dr. William Schabas from England I believe, Dr. Frederico Lenzerini from Italy, and Dr. Lorenz Gonschor from Germany to name a few.

    That genealogy statement is so true! It wasn't until I started to build my family tree on my own that it led me to finally learn Hawaiian history I'm 30 yrs old now but I feel so connected to my Hawaiian side more than I ever did. I'm only Half Hawaiian but I feel full hawaiian now. Hahaha

    I enjoyed istening to this information again with greater understanding. ....I now gather that, as my grandmother was born on Kauaʻi in 1883 from German parentage, my father was born on Maui in 1910, and I was born on O`ahu, I can legitimately consider myserlf a Hawaiian subject..(Not to mention that I signed a declaration of allegiance to the Hawaiian Kingdom, notorized at Perfect Title.) ....My children and grandchildren are all part Kanana Maoli, each having more than 10 other ethnicities, consider themselves to be Hawaiian. ....Therefore, I am to understand that there can be no American law which can determine otherwise. .... -Itʻs interesting that, in 1996 -1997, the US - IRS would NOT respond to my letter which stated clearly my choice to have Hawaiian subject status. This letter was supported by copies of pertinent, legal certificates, When I re-sent the same material, explaining that I had received no appropriate response from my intial letter, i simply received a letter which threatened to have ALL my financial connections immediatly severed if Idinʻt comply. How does one obtain an appropriate document of Hawaiian identification that is honored by other countries? Mahalo. 🌺

    Dr. Sai I think mentioned about a place to get help with genealogy. I’m interested in getting help and researching my family history. Also because my biological father left my mother before I was born. I’ve seen him 3 times in my life and last seen him on my 10th birthday in 1986. Any help or direction would be appreciated!       first of all, I'm confident you have no idea why japan invaded china, phillipines or guam. You didn't know why japan attacked pearl harbor. if probed as to the motivation, you'd repeat the same tired propaganda weve all been been fed the past 80 years of the the evil axis and the hero allies narrative. america chose the wrong side in WWII. japan was trying to stop the spread of communism into china and stop the european "colonization" of the pacific. if you saw your asian and pacific islader brothers being "colonized" by a foreign european spanish country who were changing their language, interbreeding with them and setting up a european foreign presence in your region wouldn't you do something about it? the entire pacific was being taken over by the french (tahiti), spanish (guam, phillipines), english (new zealand, australia) germans (samoa), etc...
      hawaii was a unique case in all the pacific, hawaii was in the original 44 independent nations before the UN was created after WWII. it was this reason why japan had treaties with the hawaiian kingdom and we're actively trying to join the recognized independent nations through hawaii. this is also why sun yat sen got his education in hawaii.
      you talk about hawaii as if we should be greatful we were overthrown. you talk about this imminent danger than that never came. you talk as if you are inculcated by the aggressor. you have the battered wife syndrome take to the hawaiian kingdoms overthtow, where the battered wife accepts the beatings because someone else would be beating her if not her husband. do you recognize how toxic of stance on this subject you are taking? the "you should be greatful america took over you'd be speaking Japanese" argument. is so tired and stale to repeat these things that are untrue and not based in historical facts. the only reason why japan did anything back then was because of European expansion into the pacific theatre. you demonize the race of people who tried to stop this expansion. you believe the European expansion into the pacific is a good thing? are polynesians better off because of this? hawaiians definitely are not, we were initially and now we are a race that has virtually no power in our own lands and we have people like you want to keep it that way for some reason.
      european expansion into the pacific has ran its course already. its time the Europeans focus on saving their own countries from the mass immigration agenda and cultural marxist revolutions happening in their countries. hawaii needs to be deoccupied and returned to neutral independent nation. its the best way to heal the hawaiian people and fix all the problems facing hawaii and it's native people. is this not what you want to see for hawaii? you want this system that isn't obviously not working to continue on this path?

      All ancient Pacific people are cousins from one family we all came from e lelemu hawaii is right in the middle of mu. The first people were kumuaimaia, and all ancient Pacific people were descendants from them. Hawaii are the mountain tops of lelemu. Hawaii got its name from two brothers, haloa and waloa. Waloa is the younger brother. Waloa established kingship in hawaii, but King Ship in all of the Pacific/earth was introduced by Ea, who was reared out of africa, but his bloodline came from the stars.     I love family stories of love. I have tried to keep mine there. A few cannot get it. They are too busy being modernized. This all gets pretty nuts. You all have had your share of rough times, I cried for your little cousins story. Always caring to see you all safe and at peace within all these sad struggles. I feel a lot of compiled evils get put on one talking head to rid the faults of so many, in a very complicated system, and skimmed over to those very many. Unless one has all day to really investigate, most try to enjoy their one life, than stuck in Soo many variables, due to such poor std schooling. Each state is a country really, and independent, from what I got out of it, yet we almost all came to these states united, on boats. We were to have a 7 year indenture to give servitude to learning language. I cannot condone this whole CPS, here. It's unGodly, but they purposely throw in the drugs to keep policing and jailing businesses, on your Dunn and Bradstreet with this Birthing bill of lading / banking scenario...ugh, soooooo much to open up . It called , they make all accessories to their brainwashing, to take all down as Misery loves company, so to speak.now asking if all is just in our heads, why kill anyone ? No harm must be the situation. Especially to ones who confess. Or none gets anywhere. Whe have to end this caging of men and women. We are too intelligent to act out as wild sneaks on anyone. That should be the only law. Then we can go forward, love brings more enthusiasm to do for one another.

    During the time before the European Arrival in Hawaii, the Samoans are one of the last Pacific Islanders to arrive in Hawaii, therefor is that Samoan bloodline considered Aboriginal to Hawaii?
    Also to say someone is 100% Kanaka or Hawaiian is impossible and inaccurate because the bloodline in Hawaii before the European arrival was "already mixed pacific islanders". Mixed with Marquesan, Tahitian, Maori, etc...
    Most say the Marquesan bloodline is the first arrivals/ original to Hawaii islands, therefor if true I don't think anyone in Hawaii has a pure Marquesan bloodline to be called 100% blood quantum Aboriginal to Hawaii.

      you must not have met any or many pure hawaiians, they don't look like, sound like or resemble marquesans, samoans, tongans, tahitians or maoris except in superficial aspects that all polynesians have i.e. dark skin, wide noses etc. hawaiians are a distinct race of people, with a distinct language and culture separate and unique from all other polynesian races.

      @@naturalmystic5098 idk, i believe the realm we live in is created by a creator. i can't explain why all the polynesian races are similar yet unique. probably because centuries of separation with limited interbreeding through ocean travel, trade, and various conquerings etc. i would say the tahitians and marquesans look the most similar to hawaiians.

For me it makes more sense once i realized humans migrate and navigate through the oceans and all came from somewhere or multiple places(I don't believe in the out of Africa theory). Because so called hawaiians that record history do know they are mixed pacific islanders and have proof of that with similar culture influences(style of preparing food, craftsmanship, language, etc.).

If I'm not mistaken The KANAKA maoli are one of the only PEOPLES who can trace their roots back through records. IDK WHETE those records are stored tho.     He claims that “nationality is all about allegiance”, but that’s not true, there are Hawaiian Kingdom laws regarding citizenship. A Hawaiian subject CANNOT be a dual citizen.

      Otherwise there’s sources online, I believe even Dr Sai’s website still has the Hawaiian Kingdom laws.
      You can also go to UH, they have probably the most extensive and organized (& also digitized) collection of Hawaiian Kingdom laws.

    No the PCA did not verify the Kingdom Of Hawaii still exists. The PCA explicitly stated they did not make a determination either way about the existence of the Kingdom Of Hawaii. The PCA also accepts cases to be heard from private parties and nations, basically from anyone that can pay and the PCA charged around $50,000 to hear the Larson case. So just because a PCA agreed to hear a case does not automatically equate to them affirming the existence of a nation. All of these facts can be found on the PCA site and their archives. Dr. Sai is certainly being intellectually dishonest in this regard.

      You’re right the PCA did NOT verify the “Kingdom Of Hawaii” still exists, it verified that the Hawaiian Kingdom exists.
      The structure of the Permanent Court of Arbitration comprises "three bodies: (1) a panel of members [who serve as arbitrators]; (2) an International Bureau; and (3) an Administrative Council." The Administrative Council is "composed of the Minister of Foreign Affairs of the Netherlands, as President, and of the diplomatic representatives at The Hague of state parties to the" PCA Convention." According to Article 49 of the 1907 Convention, the Administrative Council "publishes an annual report on the work of the Court, the functioning of its administration services, and on its expenditure." 9 The United States, by its embassy in The Hague, is a member of the Administrative Council and, therefore, publishes the PCA annual reports. These annual reports acknowledge the status of the Hawaiian Kingdom as a non-Contracting Power. This constitutes clear and unequivocal evidence that the United States recognizes the continuity of the Hawaiian Kingdom as a non- Contracting Power to the PCA Convention.
      Unlike the United States, which is a Contracting Power to the Convention, the Hawaiian Kingdom is not a signatory to the Convention and, therefore, is a non-Contracting Power. The term non-Contracting Power is synonymous with non-Contracting State. After the PCA verified the continued existence of the Hawaiian State, for the purposes of its institutional jurisdiction, it also simultaneously verified that the Hawaiian State was represented by its government-the Council of Regency. The PCA identified the international dispute in Larsen as between a "State" and a "private entity." Furthermore, the PCA described the dispute between the Council of Regency and Larsen as between a government and a resident of Hawai'i.
      If the United States objected to the PCA Administrative Council's annual reports that the Hawaiian Kingdom is a non-Contracting State to the 1907 Convention, it would have filed a declaration with the Dutch Foreign Ministry as it did when it objected to Palestine's accession to the 1907 Convention on 28 December 2015. Palestine was seeking to become a Contracting State to the 1907 Convention and submitted its accession to the Dutch government on 30 October 2015. In its declaration, which the Dutch Foreign Ministry translated into French, the United States explicitly stated, inter alia, "the government of the United States considers that 'the State of Palestine' does not answer to the definition of a sovereign State and does not recognize it as such (translation)."" The State of Palestine is a new State, whereas the Hawaiian Kingdom is a State in continuity since the nineteenth century. Furthermore, since the United States explicitly recognized the validity of the Hawaiian Kingdom as an independent State in the nineteenth century it is precluded from "contesting its validity at any future time."
      For the purposes of international arbitration, a State, as a juridical person, requires a government to speak on its behalf, without which the State is silent and, therefore, there could be no arbitral tribunal to be established by the PCA to resolve an international dispute. On the contrary, the PCA did form a tribunal after confirming the existence of the Hawaiian State and its government, the Council of Regency, pursuant to Article 47
      The PCA Administrative Council's annual reports from 2000-2011 clearly acknowledges the continued existence of the Hawaiian Kingdom as a non- Contracting State to the 1907 Convention. Along with the United States, the other Contracting States with the Hawaiian Kingdom in its treaties that are also members of the PCA Administrative Council, include Austria, Belgium," Denmark, France, Germany, Great Britain, Hungary, Italy, Japan, Luxembourg, Netherlands, Norway, Portugal, Russia, Spain, Sweden, and Switzerland. Their acknowledgment of the continuity of the Hawaiian State also acknowledges the full force and effect of their treaties with the Hawaiian Kingdom except where the law of occupation supersedes them. Neither the Hawaiian Kingdom nor its treaty partners provided notice to the other of its intention to terminate the treaties in accordance with the treaty provisions.
      In his legal opinion, Federico Lenzerini, professor of international law, provided the legal basis, under both Hawaiian Kingdom law and the rules of international law, for concluding that the Council of Regency "has the authority to represent the Hawaiian Kingdom as a State, which has been under a belligerent occupation by the United States of America since 17 January 1893, both at the domestic and international level."
      As an Italian scholar of international law, Lenzerini's legal opinion is a source of the rules of international law--unlike those within the jurisprudence of the United States. The latter form of legal opinions are limited to an "understanding of the law as applied to the assumed facts." They are not regarded as a source of United States law, which include the United States constitution, State constitutions, Federal and State statutes, common law, case law, and administrative law. These types of legal opinions have persuasive qualities, but they are not a source of law.
      Unlike the jurisprudence within States, there is "no 'world government' [and] no central legislature with general law-making authority" on the international plane. International law, however, is an essential component in the international system, which "has the character and qualities of law, and serves the functions and purposes of law, providing restraints against arbitrary state action and guidance in international relations."
      The American Law Institute also concludes that when "determining whether a rule has become international law, substantial weight is accorded to...the writings of scholars." This is highlighted in the seminal case The PaqueteHabana,where the U.S. Supreme Court concluded that the writing of scholars, in consideration of "whether a rule has become international law" or not, are not prescriptive but rather descriptive "of what the law really is."
      If Hawai'i was indeed lawfully incorporated into the United States as the so-called 50th State of the American Union, the PCA would have denied access because Hawai'i would not have been considered a "non- contracting power" under the Convention. The United States, as a Federal State, is a "contracting power" to the Convention and not its constituent States beneath it. These constituent States of the United States are not independent States under international law.
      In light of the Larsen case, the University of Hawai'i, as a higher learning institution within the Hawaiian State itself, has not provided critical scholarship that would engage and/or develop this dialogue taking place on the international plane. Instead, it has promoted the false narrative that Hawai'i had undergone colonization, and that the aboriginal Hawaiian population is an indigenous people not unlike Native American tribes that reside within the State of the United States.

      Many people are not familiar with dispute resolution under international law and the role the Permanent Court of Arbitration (PCA) plays in international relations.
      When the first International Peace Conference was convened in July 1899 in The Hague, Netherlands, the major States of the world were in attendance. Its first treaty-Convention for the Pacific Settlement of International Disputes, established a global institution for international dispute settlement called the Permanent Court of Arbitration. This international court predates the Permanent Court of International Justice established by the League of Nations from 1922-1946 and its successor the International Court of Justice (ICJ) established by the United Nations from 1946-present.
      The mere fact that the PCA accepted the Hawaiian Kingdom v. Larsen case shows that the PCA acknowledged the Hawaiian Kingdom as a State as the PCA only accepts cases that involve States (aka “countries”).
      In fact, as part of the International Bureau’s due diligence into the status of the Hawaiian Kingdom as an independent State under international law, the PCA’s Secretary General Van Den Hout made a formal recommendation to David Keanu Sai, Agent for the Hawaiian Government, to provide a formal invitation to the United States to join in the arbitration proceedings. This would have one of three outcomes-first, the United States would dispute the existence of the Hawaiian Kingdom as a State and the PCA would terminate the proceedings, second, it could join the arbitration in order to answer Larsen’s allegations of violating his rights that led to his incarceration, or, third, it could refuse to join in the arbitration, but allow it to go forward.
      In a conference call held in Washington, D.C., on March 3, 2000, between Mr. John Crook, United States Assistant Legal Adviser for United Nations Affairs, Ms. Parks and Mr. Sai, the United States was formally invited to join in the arbitration. It wasn’t until a couple of weeks later that the United States Embassy in The Hague notified the PCA that the United States will not join in the arbitration, but asked permission of the Hawaiian Government and Mr. Larsen’s attorney to have access to all pleadings, transcripts and records. The United States took the third option and did not deny the existence of the Hawaiian Kingdom as a State.
      After the PCA verified and recognized that the Hawaiian Kingdom did exist as a State under international law with a legitimate government and that Larsen is a Hawaiian subject, steps were then taken to form the Tribunal. Mr. Keoni Agard, Esquire, was appointed by Ms. Parks, on behalf of Mr. Larsen, and the Hawaiian Government to serve as the Appointing Authority to work with the PCA in order to secure the appointment of three arbitrators. As the Appointing Authority, Mr. Agard was given a list of arbitrators provided by the PCA for each of the parties to select. The Hawaiian Government selected Professor Christopher Greenwood, QC, and Ms. Parks selected Dr. Gavan Griffith, QC. These two arbitrators then recommended the appointment of a Presiding Arbitrator, Professor James Crawford, SC, which both parties agreed to.
      Ultimately the Tribunal at the PCA concluded that it could not determine whether the Respondent has failed to discharge its obligations towards the Claimant without ruling on the legality of the acts of the United States of America - something the Tribunal was precluded from doing as the United States was not party to the case.

    Pie-in-the-sky Keanu Sai. We've all heard it by now, Hawaii is under prolonged illegal military occupation. We heard some UN experts say it. We've heard countless academics say it. We even have an Apology from the US government recognizing the overthrow as illegal (among other things).
    So why hasn't this manifested in any sort of tangible sovereignty, i.e. any real self-determination? The answer is actually quite simple. Sai's HKG is trying to achieve a goal regarding the law without any means of enforcing it. Much like the ICJ or ICC, without any means of enforcing the law, the law (i.e. "de jure") is meaningless. What matters are the facts (i.e. "de facto"). Hawaii is a de facto member of the US, and there are no other nations who will claim otherwise. In fact (there's that word again), most, if not all countries recognize Hawaii as part of the US.
    You can say they're wrong or ignorant or whatever you want, but that doesn't change the *fact* of the matter. You can argue with me until you're blue in the face. It won't change anything.
    A few years ago, HKG tried to take this issue up against the Federal government (see: [David Keanu Sai vs. Donald John Trump et. al] and [Hawaiian Kingdom v. Joseph Robinette Biden Jr. et. al]), to no avail. In the Hawaiian Kingdom v. Biden case, HKG wanted to make it an Article II (occupation) court. The whole case pretty much got thrown out.
    Now, even more recently, HKG and its advocates are pushing Adjutant General Hara to basically commit treason, and transform the State government from civil to military government, which would require him to violate his oath to uphold the Constitution.
    All this is to say that the Hawaiian Kingdom isn't going to return anytime soon, and frankly, with all this politicking and very little governing experience, I have to wonder if it coming back will ever be possible. Very few people in the movement seem to have any experience in government, and even less seem to understand the international sentiment towards siding with HKG *against* the United States.
    For these reasons, I no longer have any faith in this movement, and feel all it is doing is chasing its tail, achieving a whole lot of noting. Raising awareness is probably all this movement is good for.

You want to put doubt in the minds of kanakas that don't understand the process, nor the length of it. We endured the American-forced oppression with great fortitude.       I'm not advocating for independence. I've worked with Pacific Island countries, all of which look at the State of Hawaii with envy. They have to beg for support with emergency responses (like Tonga after the earthquake/tsunami and Papua New Guinea after the landslide). They clamor for USCG equipment for maritime police (like with Solomon Islands and foreign pirates), stuff Hawaii takes for granted. Samoa has to deal with food shortages on a regular basis because it can't always secure food shipments.
      Don't wait for my solutions. Instead, I invite you to see how the other independent Pacific Island countries are making do without foreign occupation. See how Tonga, Samoa, Solomon Islands, Nauru, and Papua New Guinea make ends meet without things like US federal funding and military. Check it out. Time for a reality check.

    I'm Kamaaina born O'ahu raised Makaha. Proud US citizen. I've been sympathetic to this cause since I went to my first Makaha Sons concert with my dad. However, after all these years you still have no leader and no unified voice. My sympathy is gone for this movement, especially after the Mauna Kea fiasco. Unless you have a unified voice and leader I'm done giving two sh*ts about your movement and will consider you communists from now on.

    Someone would’ve invaded! You guys had a weak argument. Look at Hong Kong, Tonga, Tahiti… a modern country would’ve conquered Hawaii easily. If the US leaves now… you get China coming in. Hawaii’s geographic region/location in the world would’ve necessitated control. Many counties take over far away places as military outposts. Hence all of our bases on Oahu, Guam, and the Philippines… and Taiwan 🤐. We gotta get with the times cause we sure are enjoying it.
