9:02 Brings back memories from when I was a kid and my family went to Florida. We took a day off from visiting the Theme parks and went to Daytona. It was strange to be able to drive onto the beach as that's restricted in the UK. We stayed in Kissimee, we even got to see the very bad part of Orlando by accident when my dad took a wrong turn and saw all these people sitting out on thier lawn giving us strange looks. Managed to pull a cop over to ask for directions out as it was like a scene from The Wire :) Beck Yeah!
Well done, Mikey, as a retired HGV I always had a thing that while driving even before legislation came in I would never use a phone while driving. As an agency driver my agency would make customers aware that to call me while driving would result in no answer until I was not. It's no big deal not to use your phone while driving, just concentrate on one thing at a time ffs!
Saturday night I was out having a few beers with my best mate, I got the train home he walked. I woke up to messages and calls. He’d been hit whilst crossing the road, delivery driver pulling out of a lay-by. Police believe he was on the phone. My mate went up in the air and landed behind the car. He’s escaped with a fractured ankle and ungodly amount of bruises, I joked he looked like a sunburned Smurf with how purple he is. Put your fucking phones down

I think, with Mikey’s support and the video evidence, there would have been a prosecution and the van driver would have been found entirely liable. Basically no change except a higher cost to the van driver as the taxi would be out of service until inspected (they’re inspected regularly to a higher standard than MOTs I understand anyway) as per the rules, so lost earnings added to the claim. Van driver’s insurance would be, ahem, more noticeable in his next financial year

I love racing the same traffic, and usually beating them with my fully legal electric bike to the red lights when the intersections are close in a row. The bigger the truck, the more annoyed they get, and the faster they go to try to get ahead of me.
If you like being quicker, you should try a velomobile. I regularly beat commuting coworkers on their way to work between cities, on distances up to ~30 mi.

Question Mickey, if they prosecute, do you have to attend court? I always use a camera when riding but never thought of uploading to the Police, but if I do, not sure how comfortable I would be going to court. Thanks.
Most of the prosecutions happen without me - I think I go to court for perhaps 2-5 in 100 reports. Going to court is mostly boring and time wasting, but it's otherwise fine.
The offender, when traced, is usually offered a fixed penalty with points to pay instead of being prosecuted. The vast majority accept this offer. If they don't accept the offer then it goes to court. If they plead 'Guilty' at court then they are sentenced and that is the end of it. If the plead 'not guilty' then there will be a trial and depending on the basis of their defence the prosecution (or the defence) may call Mikey as a witness to authenticate his video, give evidence in chief and be cross examined.
That would have been you first rear ended on film. He may have seen you in his rear view mirror and tried to keep in front of you. The police could use your video to show the dangers in using phones while driving.

In Denmark it is the person capturing video in a public space who is prosecuted and fined for sharing a video of alleged criminal activity online. NOT the alleged criminal being filmed. A cyclist leaving the compulsory cycle path, where provided, could also be prosecuted. Mobile phone use while driving is very widespread in Denmark. Particularly amongst heavy goods vehicle drivers. Stay safe!
Back you 100% if it was me using phone behind wheel should be treated the same as drink driving, however I always try to take a balanced view, do you think it's possible that you might cause an accident because you are distracted by looking out for drivers using mobile phones and pursuing them, the whole point is distraction causes accidents, Injury and death, you cannot say you are concentrating 100% on your cycling because of your crusade against drivers commiting road traffic offences, no hate here I'm with you all the way but there's two sides to every coin.

The safe breaking distance at 20mph is about two car lengths so why drive at less than one car length. Completely responsible driving. It must be incredibly stressful driving like that, id rather hold back 3 car length and drive relaxed.

I was cycling along my local High Street last summer, following a BMW with a 30-something female driver. She had a clear road ahead of her, but kept sudden-braking and moving from side to side in the lane. I thought she was drunk. Then she came up behind a car that was pulled up at a pelican crossing and almost rear-ended it. I got level with her. She had a phone in her lap and was continually looking down at it and swiping it. I gave a full description of the car and the driver to the police. "Were there any other witnesses?" they asked. No. I was on my bike. "Then there's nothing we can do." Okay. Wait until this twat hits someone and kills them. Will you do something then?
I suspect that van driver has points on his licence already. Anway, good catch Mikey, I wonder what his insurance premium will be next year. Let's hope he has learned a lesson for the safety of drivers, cyclists and pedestrians!

However in this case, the first I've seen so far, you finally filmed someone who really was driving dangerously. High five to you!
Just because someone is stationary while using the phone, doesn't make them any less dangerous, numerous videos on youtube, show people who pick up the phone when they stop in traffic, then either roll forwards into someone or they see traffic move a little in their peripheral and drive straight into the back of the person in front, all because they were distracted, there's ZERO defence for using the phone at the wheel.
