- The plaintiff claims she hired the defendant to make a cake for her wedding, but the baker was a no-show on the big day. She’s suing for pain and suffering. The defendant says she’s been baking for 45 years, and claims the plaintiff never paid her to create the cake. She’s filed a countersuit to cover her losses.

she did take a 60 dollar deposit but then she said she waas putting the deposit towards the old cake.... like lady just ask her to pay her old balance FIRST and THEN put down an additional deposit for the new cake. clear miscommuincation here on both ends but i do think the cake-maker should take some responsibility here ... if you have an issue that you dont want to make or deliver someones cake you need to tell them beforehand, not leave that person hanging on their wedding day.

Cake lady was half-hearted about taking the deal. Never stiff a person on a bill. Their hard work is worth cost. You may need them again later in life. Especially, if they do excellent work.
She tried to get two free cakes but ended having to pay for them. My mother is a baker and runs into this all the time. People want free stuff. If your clients are always stiffing you on payment or demanding free stuff that means your prices aren’t high enough. If you attract people who are used to getting handouts and entitlement programs they are going to demand free stuff from you as well.
She raised her prices and now gets generous tips and thank you cards instead of people demanding free cakes.

The cake lady shouldn't have taken her business after she didn't pay 6 years ago. Unless she paid her upfront for the past die balance before making a new deal. I don't think the cake lady even made the cake. And I think the plaintiff didn't tell her where the hall was. I believe she could have had proof of the calls and texts but you don't take the time to prove that, you end up loosing. And what her daughter sent wasn't proof, it was just a text her daughter saying she was trying to reach out to the cake lady, not what she actually sent to the cake lady that day.
I see where she's coming from though, she's trying to make their special day right by making the cake cause she's their first pick... and she Was trying to get paid the "IOU" And the wedding cake in Full, before delivering it.... which sounds like where she ran into trouble, Again, not getting paid in time.

Balance of 6 year old debt was to be paid when she balance of the current wedding cake, which she didn't have "all of it" 1 day before the wedding.

@Joeh1154 Except, wedding cakes are usually delivered because usually each tier is in an individual box and they're assembled at the reception hall. However, if you don't pay, each tier can be frozen and sold at a later date.
I think the baker is just a nice lady who appreciated the business, tried to help her out, and was taken advantage of unfortunately. The bride was scrambling trying to come up with the funds and probably got the money at the final hour. I know folks who do that. But both didn't present enough proof so it was fair.

That's absolutely rediculous. Justice was served. She owed her money and the nerve to sue. I'm glad the judge made her pay it. She got what she deserved. Nothing but a bill.
First of all 50% deposit is due at the time of putting in your order and the rest is due at time of pick up or drop off. NO EXCEPTIONS

Now you know DAMN WELL the only reason this defendant agreed to work with this lady again after 6 years was so she could get revenge for not paying. At her wedding too! And then to have kept the receipts for everything and put her in her place in court...must have felt like the icing on top of the cake (no pun intended).

When I married 32 years ago it was clear the cake must be paid in full before the wedding. I also made sure to do that, and the lady had the address & time. She did a wonderful job, and the cake was beautiful & tasted great! This Plaintiff had no proof of anything & didn't deserve any money!
I thought it was common knowledge the cake had to be paid in full before the wedding date.
