Can you direct me to scholarship that elucidates the distinctions between private and public entities? I want to know how can a private non fiction entity exist in a public legal fiction.
@@LawSessions I shall attempt to; a mortal being is a non fiction entity considered to be “Private”. Spaces on the Land that said entity may traverse/move about outside her/his domicile is considered “Public” or “Public Property”. Said property is considered to be property of the State, which is a Legal Fiction that does not posses constitutionally enshrined Rights. So, how can a private entity/mortal being a non fiction, said to be in a “public domain” or fail to comply with a “public” order, when Public is a legal fiction? Where can I find scholarship that would assist me in reconciling that? Even simpler…how can a private entity with constitutionally enshrined rights be a member of the public simultaneously?
