  • Alabama Supreme Court Justice Tom Parker drew scrutiny after he invoked the threat of “the wrath of a holy God” in his legal opinion that embryos have the legal rights of children. Parker is a believer in the Christian Nationalist ideology known as the Seven Mountains Mandate which commands followers to control the ‘seven mountains’ of society - including government. An alarming number of prominent GOP figures, including Speaker of the House Mike Johnson, have embraced Christian Nationalist ideas. “Congress shall make no law respecting an establishment of religion,” wrote the Founders in the First Amendment, but today’s GOP seems bent on tearing down the wall between church and state. University of Miami Law Professor Caroline Mala Corbin joins Ali Velshi on the erosion of the Establishment Clause.

      @@He_Is4NowHow does taxing businesses held by churches increase the church power? How does taxing donations made to them increase their power? Both moves would make them accountable - literally - for the money they make.
      If churches wish to remain charities then they should refrain from political interference - including donations to candidates and agitating on social issues. That is what the separation of church and state actually means - church looks after the 'spiritual', the state looks after social welfare etc .

      We have some scientific evidence that may explain that. A study was done using a functional MRI to see what parts of the brain activated when asked questions. People were asked what THEY thought about something, or what someone they know (like a brother) might think, or what "god" would think.
      For non-believers, the part of the brain used to figure out what another person might think was the same one used to try to figure out what a god might think, and a totally different part activated when asked what they themselves thought. But for believers, the part of the brain that decided what they thought was the same part that decided what god thinks, and the other part only activated when asked what another human might think.

    There are religious wars going on today in the middle east and elsewhere, do we want that here? The founders welcomed all faiths here and wanted our government to favor none and to disfavor none.

      Obviously DON’T TAX religious organizations and individual churches. If you tax the church/religious-worship-services, that would grant due-cause to acknowledge them as services which are entitled to representation in government.
      They aren’t taxed because they have no rights to representation in government, because it’s explicitly a secular nation.
      Want tax dollars spent on religious schools and other institutions of religious worship? Start taxing them and see how quickly they qualify for your tax money to fund their services.

    Whenever you speak to someone who doesn't believe in the separation of church and state, and ask them about the establishment clause, they often seem to be under the impression that it says that "government can't establish a religion". Within the establishment clause, the verb is not "establish". Establishment is a noun. The verb in question is "respecting". Congress shall pass no law *respecting* an establishment of religion. What does the word respect mean in this instance? A simple dictionary definition gives us "have due regard for the feelings, wishes, rights, or traditions of". So no law can be made that has due regard for the feelings, wishes, rights, or traditions of an establishment of religion. This is a simple, plain English, textualist reading of the amendment. Anyone who doesn't believe in the separation of church and state is either illiterate, or does not value our Constitution.

      "Respecting" - to be fair - also has a traditional meaning which is roughly like "accepting" or "allowing" - in other words, it says Congress shall not pass any law in which the establishment of religion is considered legitimate.
      Just a quibble. Agree the main point, which anyone with any knowledge of the founders and the point of the creation of the government knows, is that they wanted to ensure that government stay out of people's practice or not of religion and make no law that infringes into that area.

    Alabama is one of the Southern states who are refusing EBT summer lunches from the federal government for low-income children whose main source of nutrition are school breakfast and lunches. This program benefits children also of struggling working parents. Everyone gets a summer meal, no questions asked.

    The statement One Nation under GOD was added in 1954 by President DDE. In the 1950s, the IRS said Churches can file non profit tax exempt. They don't pay Federal Taxes to support the government, but they want me government to support their schools and control what is taught in public schools.

    I love that Ali Velshi allowed the professor to delve into some detail concerning the legal, statutory analysis and the stakes. Too often talk show hosts cut-off the attorney guest for fear that viewers will get frustrated or annoyed if the conversation goes into the weeds. (I do not believe that is true...) One need not be an attorney to understand what is being said... One doesn't need to fully understand every word or comment in order to benefit, follow-along, learn, and find it interesting. The audience is SMART.
    Great job by Mr. Velshi...Excellent writing and explanation and delivery....and topic selection. Hope MSNBC covers more on these developments (As a tax attorney, I sense that a lot of these groups should not be eligible for their tax exemptions; they are POLITICAL groups--blatant ones...)

    The Pledge of Aliegence, written in 1892 to mark the 400th anniversary of Columbus's landing, did not contain the words " under God" . These words were inserted in 1954. So the pledge had nothing to do with the Constitution or the founding fathers. I am guessing they were were probably added without the author"s knowledge or permission if he were deceased 1954. I remember having to learn to say the new version. This information should be considered when discussing the Pledge.

    This form of Christianity thinks everyone is against them, when in reality, we just dont their laws to govern all citizens.
    I grew up going to church "religiously". My grandparents were preachers. Jesus doesn't want to force people to the church because faith is determined by what's in your heart not what your forced to follow

    I'd love to know - does the ruling say "Embryos" or does it say "Human Embryos"? I'm sure there are dog embryos out there - sure would be nice to know if they are considered "children."

    A favorite phrase that encompasses these thoughts is,
    "You can't have freedom OF religion, without freedom FROM religion"
    Our founding fathers came from countries with long histories of religious leaderships and the corruption and atrocities that accompany that type of government. They wrote the Constitution and the first amendment fully intending to protect this country from those corruptions and atrocities.

Think of all the lives they are destroying by enacting anti-abortion laws, or laws banning trans healthcare, or laws forcing children to be apart from their parents at the border...

    This was specifically because of the religious persecutions and wars in Europe from the Moment Luther nailed his lettyer to the church door. I actually see this happening online. "It should be a law that everyone is christian!" A tweet. They did that in Spain. Those who converted stayed while those who chose not to convert left the country. Those who stayed and converted were suddenly accused of back sliding and put though this little thing called The Spanish Inquisition. Thats just one of the things that simple sentence allows should it become mainstream.

    The first amendment should be read knowing history of the time it was written. So many people had just been persecuted by tyrants around the world that claimed their power from god. American founders have been very wise to impose separation of church and state and for good reasons being conservative should include protecting that too.

    The judges oppinion would seem to suggest that no legislation could be passed that would be permissable to subvert the personhood of the embryo. Meaning the congress of Alabama has no say.
    Best to be on the safe side and move such medical practices out of the state.
