However, take note of Article 1327, which says that The following cannot give consent to a contract: (1) Unemancipated minors; (2) Insane or demented persons, and deaf-mutes who do not know how to write. So if the illiterate person is a deaf mute who cannot write, then he cannot give consent. Tinanong ko po bakit hindi po kasama sa contract sagot po sa akin yun daw po ang standard template ng contract. Legal po ba yun?

Generally, the heirs, successors, or assigns may be compelled to respect the option contract and may be compelled to enter into the main contract because all rights acquired by virtue of an obligation are transmissible, except those disallowed by law (see art. 1178 of the Civil Code of the Philippines). An example of a right that cannot be transmitted is a purely personal right, such as the right to vote. In case, however, the heirs, successors, or assigns refuse to honor the option, they will instead be liable for damages for breach of the option contract. If you have taken up the law on sales, you should know this. If you haven't, then at least now you have advanced knowledge. I will also be making a series on the Law on sales soon. Thank you.
