What is not registered? The mortgage contract? Or did you mean the mortgage is constituted over unregistered land? What do you mean not authorized, is the person who constituted the mortgage not the owner of the property? Is this a real problem or is this an academic exercise for school?

When it is absolutely impossible to settle doubts by the rules established in the preceding articles, and the doubts refer to incidental circumstances of a gratuitous contract, the least transmission of rights and interests shall prevail.
