    Neil, as a former law enforcement officer and LE instructor, as well as someone who owned a defensive firearms training school for more than 20 years, allow me to congratulate you on the wonderful job you and Mr. Friedman did with this video.       I'm confused about posted establishments. How do you end up charged for carrying a firearm against a mere posting? How does the "no guns" posting trump a state statute that allows CCW? I'm not saying you can't be told to leave Joe's Pizza half-way thru lunch if you "print," but I don't get how it becomes an arrestable offense. Do you know?

      teller121: as they say, every state is different. Here in kY, I can still go in but have to leave if asked. If I refuse, cops are called and I’m charged with trespassing. Still, I might not get changed cause the officer will ask me to leave and if I do, the matter is considered closed per ky law.

      In the state of Washington one should never say “I intended to kill...only intended to stop the threat””. Otherwise your actions come under legal scrutiny.

      If you have to deploy your weapon and use it. It is a last resort and only if you are in fear of your life.
      If you can keep several options of defense with you. Use that verbal judo and try to get away if feasible. Self control is key as well. Make sure you check yourself before you start your day.

It blows me away that the legal gun owners are being so persecuted with the absurd laws that they have to follow when they are the folks that want peace. They are the first people to do whatever they can to be good people, they are law abiding and considerate. Seems it's just easier to go after the good guys these days. The criminals must just laugh at the politicians.

      RS Barrett the 14 minute mark could make or break the rest of your life. cannot be understated. composure, collected acurate thoughts on the record are paramount if it goes to trial. even if you are justified and this happens in defense of your own home. there will be plenty of time for your statement later. no bonus points early and it ONLY can serve to hurt you later.

      Another way I've heard this point made is the archetypal wording of the Miranda Rights.
      "Anything you say can and will be used against you in a court of law"
      Not "anything you say will be used in court", but "anything you can can and will be used AGAINST you". Because anything you say is admissible as evidence against you by the prosecution, but is INadmissible by defense, because then the court considers it "hearsay", as they assume you'll lie to get out of trouble, but not into it..

      BUT! CCW holders should be aware of the laws in their own state! The law varies dramatically state to state. I have taken CCW permit courses for several states and the laws are all completely different and change constantly. A lot of what was discussed here does not apply to the state I live in (Oregon). We have no laws against consumption of alcohol or carrying in bars, no brandishing laws (technically speaking - but still a TERRIBLE idea / can still get you arrested), and gun free zone signs by private establishments carry no weight of law. The only places we cannot carry in this state are Federal buildings, courthouses and beyond the security checkpoints at airports. It is perfectly legal to carry on a school property here, even if the school has gun free zone signs.

      I love Arizona's constitutional carry laws. SHALL NOT BE INFRINGED sounds pretty self explanatory to me.
      Of course you still need to know the laws, but they're mostly geared to allow honest people to exercise our second amendment rights. Most experienced officers are used to the average honest citizen being armed. When seconds count, law enforcement officials are minutes away at best!
      "Gun free zones" are dangerous, criminals actually prefer them.
      Our criminals have to be extremely careful, they never know how many citizens are legally armed in any given place. The community I live in, it's very common for grandparents to be consistently armed and ready to protect their loved ones.
      I would rather be judged by twelve, then carried by six, and at my age, life in prison just isn't the deterrent it once was.

A bank robber doesn't give a shit if the bank is a "gun free zone", they're gonna rob a bank if they want to.

      I agree.. although, I lived in ohio my whole life up until last year.. so not only do these laws sorta apply to me because I go there for holidays.. but the state I now live in has much more lenient gun laws so I will just assume these laws for the most part will apply to me as well.

    I was in a situation almost identical to the road rage scenario mentioned at 19:30. Someone thought I cut them off and then followed me till I was at a redlight. They then tried to break into my truck and punched the windows repeatedly. I was able to drive away and called the police and the guy was charged with disorderly conduct. This situation made me think a lot more about the responsibility of carrying a firearm and when to use deadly force. I still know I made the absolute best decision in that situation by driving away

      Joshua Anderson I agree, you did what I hope all responsible guns owners are calm and rational enough to do in a high stress situation. Guy made a disorderly conduct mistake. I've never been arrested or called on for one, but many of us civilians have at some point, including family members. Your life matters too but I also don't think someone's cousin or sibling should be dead cause they're an idiot punching your car. The thought of anyone getting the death penalty from another civilian for throwing a fit scares me. But as soon as that window starts to give or they pull a weapon, different story. This is just driving obviously.
      I once had a guy even tap my rear bumper with his front bumper cause I slowed down to ten under the speed limit (35 in a 45) to avoid escalation of the road rage.

      @Joshua, you made the right decision Joshua. just think what would have happened if you would have shot the guy? 20k legal fees. lose your firearm. your life turmoil for the next 2 years and the possibility of a court seeing you guilty of a crime.

      Well first off some state laws are worse than others.
      Some states you have a duty to flee if possible.
      Ex: guy comes up to you with a machete threatening your life.
      You have a gun but you also have a clear path to escape.
      If you shoot him, you're going to prison.
      Some states have an "equal force" law. Meaning you can only use as much force as you're being threatened with.
      Just like previous example, if you shoot the guy wielding a machete, you're going to prison.
      Manage to wrestle a guy with a gun to the ground and you get his firearm? As long as hes no longer coming at you you are not allowed to use it.
      Some states you're not allowed to use lethal force against robbers if they arent armed.
      Catch a guy stealing your shit and hes unarmed? Think "ill just shoot him in the leg. I'll get in less trouble."
      Nope. A gun is considered lethal force even if you didnt aim to kill. You're going to prison.
      That last example is from my state. And we have stand your ground AND castle doctrine.

    I'm not aware of the laws where this lawyer is from but in Florida if you have a concealed weapons license you cannot be charged for bringing a weapon (including firearms) into any place with "no gun signs". The owners or security of the establishment have the right to ask you to leave and you must leave, However you will not be charged unless you refuse to leave.

      Kelly Fadel As far as I am aware, like I said before. The establishment has the right to ask you to leave if they see or find a weapon on you. As long as you comply with their request to leave you will not face any charges (even if it was a government building). In fact a coworker of my (an avid gun collector and hunter) accidentally left a gun in his bag and took it to the airport. He was detained and questioned of course, but explained it was an honest mistake and he was allowed to leaved after putting the gun back in his car. However I'm not sure about schools. I assume the same applies however the board of education is particularly skilled at jumping to conclusions, acting instinctively and not thoughtfully.

      It IS illegal in FL to bring your gun into those places that Fierce Mouse brought up , except for churches. You can and likely will get arrested in one of those places for having your firearm on you. Pretty much everywhere else it works like you said. If your firearm is noticed and you're asked to leave you have to leave. If you don't leave leave and you get arrested for trespassing it becomes a third degree felony because you're armed.

      (12)(a) A license issued under this section does not authorize any person to openly carry a handgun or carry a concealed weapon or firearm into:
      1. Any place of nuisance as defined in s. 823.05;
      2. Any police, sheriff, or highway patrol station;
      3. Any detention facility, prison, or jail;
      4. Any courthouse;
      5. Any courtroom, except that nothing in this section would preclude a judge from carrying a concealed weapon or determining who will carry a concealed weapon in his or her courtroom;
      6. Any polling place;
      7. Any meeting of the governing body of a county, public school district, municipality, or special district;
      8. Any meeting of the Legislature or a committee thereof;
      9. Any school, college, or professional athletic event not related to firearms;
      10. Any elementary or secondary school facility or administration building;
      11. Any career center;
      12. Any portion of an establishment licensed to dispense alcoholic beverages for consumption on the premises, which portion of the establishment is primarily devoted to such purpose;
      13. Any college or university facility unless the licensee is a registered student, employee, or faculty member of such college or university and the weapon is a stun gun or nonlethal electric weapon or device designed solely for defensive purposes and the weapon does not fire a dart or projectile;
      14. The inside of the passenger terminal and sterile area of any airport, provided that no person shall be prohibited from carrying any legal firearm into the terminal, which firearm is encased for shipment for purposes of checking such firearm as baggage to be lawfully transported on any aircraft; or
      15. Any place where the carrying of firearms is prohibited by federal law. (pretty much property that is owned by the federal government - courts/prisons/national parks and forests/national cemetaries/most importantly post offices)

I totally appreciate the value of counsel's information and recommendations, being a CC permit holder in the open carry state of Virginia. I have carefully listened to everything you have said and the information is very empowering. In fact, I wrote notes as I listened and I also saved the link to this video to rewatch again and again.
    No one could get this much legal information by someone so reputable in a free or low fee consultation.     The video was a work of art. I usually do not review videos that are in excess of this one. It is imperative that one review a video of this caliber with an attorney from your state. I would like to see the question(s) of "Do I administer first aid if I shoot someone", Do I call 911 first or call my attorney in the state of Missouri. Do I have to wait until someone (intruder) enter my home completely before I can defend, also in the state of Missouri? Wow! The two of you provided the law abiding community with a wealth of usable knowledge. Thanks for what you do!

    I've always felt open carry makes you a target. Like stated in the video, if you're in a gas station and someone comes in to rob the place and they see you with a gun you're automatically perceived as a threat and there's a pretty good chance you're getting popped. I never understood why anyone would want to put themselves in that position.

      It's really not taking the fifth until you're called to testify. Call it a right to counsel. The guy knows what he's talking about, but I disagree on the suit + tie combo.

      I’m a civil litigation lawyer in a southern state, and this guy is sharp as a tack. My good friend and law school roommate was an assistant DA for years, and just switched to criminal defense a couple of years ago. He likes him too. If I ever have a client who needs a criminal lawyer in Ohio or NC, I’m calling this guy.

    Some of my friends are LEO's and I have asked them about CC and traffic stops. They all said that they appreciate being informed of CC by the driver as soon as they walk up to the driver's side. This single act will most likely end up with no traffic violation being issued because of the courtesy of the CC driver. Good advice! Let the LEO's know first thing.

    Another great presentation with sound advice. Every state has their own laws. We have in Virginia open carry as well as CCW. If a business or the Mall has a sign stating No Weapons or Firearms, and someone reports you for having a weapon we get a Trespassing charge. Our laws with regard to alcohol are that same as yours.

    Outstanding video! As a few folks in the comments have mentioned, the laws in each state can vary considerably for carrying concealed. (Carrying in bars, churches, around schools etc)... Carrying in certain establishments can be perfectly legal in one state and carry a significant penalty in another state. There are several outstanding apps available that provide good overviews of each state's concealed carry laws and restrictions. In future episodes it would be great to see what the lawyer and Neil recommend for preparing to travel through and to states where your CCW permit is honored. Also, how to safely and legally transport your firearm through states where your permit may not be honored. Thanks again for the outstanding video.

    I’m a defense criminal investigator for the government specializing in homicides with over 15 years of experience. All this to say that the information and/or advice in this video is extremely useful and SHOULD be considered by anyone who takes on the responsibility as a gun owner. I would add that if police have read you your Miranda rights, there is a likely probably that they intend to charge you with a crime. Best to ONLY say that you wish to cooperate and give a statement with your attorney present. If they persist repeat again and again and again until they stop. No two incidents are alike.     It's absolutely amazing that LEOs can freely pull their guns out at any given moment on people (without any reasonable cause) & get away with it, without even a slap on their wrists. But when citizens's homes, vehicles are being broken into ect, we got to follow a strict set of guidelines or else we'll be punished in a court of law is beyond me 🤦🏻‍♂️

      Quit attempting to fabricate some social injustice. Anytime a officer even draws his weapon out of his hostler he has to make a written statement along with his report. The statement is then evaluate by superiors. Most and I say most cause there are a very few amount that abuse the badge (and usually don’t last long) don’t draw unless the circumstances directs towards it.

    Be very very careful watching this video if you live anywhere other than Ohio! This video has very good and correct information in general. Especially the concept of having a greater responsibility, which is a huge thing to consider. However, some of the things the lawyer is saying are Ohio specific laws! For instance, he states that you can bring your firearm into a bar. This is true for Ohio, it is NOT true for Texas. In the state of Texas you cannot bring your firearm into any establishment that does more than 50% of it's sales in alcohol which would include all bars immediately.
    He also states that in the state of Ohio, any size and type of "No Guns Allowed" sign is legal to keep someone from bringing their firearm into an establishment. In the state of Texas, however, there is only ONE style, size and shape of sign that a firearm owner has to legally obey. It even has to have the exact correct font and size letters to be legal. If a store owner in Texas puts one of those little "No Guns" symbols on their door, you can wave at it and keep walking in with your gun because it's not legal signage. That being said, if the proprietor sees you with your firearm and asks you to leave with it, then you must comply with their wishes.

      Ohio so has a law with specific wording and posting requirements for concealed carriers.
      If the sign is not displayed or worded as per law requirements it can be ignored.
      It must conforrn to the legal description to be considered a valid warning according to state law.

      In Arizona, we have no duty to read that, or any other sign.
      If your weapon is properly concealed, nobody's going to know it's there. But if you're asked to, you have to leave or you can be charged. I don't spend my money in places that don't honor the second amendment!

    another thing that needs discussed is whether or not "no gun" signs are force of law in your state. here in Colorado they are NOT force of law. you can be asked to leave the premises or refused service but it is not a chargeable criminal offense. ...unless you refuse to leave of course. as a gun owner ccw permit holder I'm ok with leaving because 8 consider it "voting with my wallet". some people get dumb about it though. ....

      In Texas, they have to post a very specific sign with specific language, font size etc. They are called 30.06 (prohibits concealed carry) and 30.07 (prohibits open carry) signs in reference to the applicable statutes. If they have these specific signs displayed correctly and you carry anyway, you are in violation of law. If any other sign is posted, no violation. But, if asked to leave (or conceal, if open carrying) and you refuse to comply then you will be charged with criminal trespass and may loose your license to carry as a result.

    Here's a question that was not answered in this video that I am very curious about:
    What happens if someone breaks into your home and you fear for your safety and shoot them with your spouses/parents/relatives gun? I'm assuming there are a lot of homes where the gun belongs to one person but several people reside there. I live in Florida, by the way if that matters.

      If somebody's breaking into your home and you use a gun that's in your home you're still protected for self-defense the castle doctrine if you are not legally allowed a gun you might get charged with using the gun but you will not be charged for murder it would be a weapons charge only

    As a teacher, I kept written notes about student behavior. As long as no one knows about those notes they stay private (in Texas). I’d immediately write down everything I could remember as soon as possible and not tell anyone except the attorney about those notes. I was told “Don’t write down anything you wouldn’t want seen in court.”

It rightfully puts the fear of God in you (as well as the courts of man) - if you have the sense to recognize the seriousness of what comes with the territory of firearm ownership and CCW.
    I appreciate the comments near the end [35:57-37:00] by Ian regarding the overwhelming sense of responsibility and 'legal' concerns over all the reasons and potential scenarios laid out in your video. But then Ian follows up and gives some insight into the fact that with time (thought and practice), this all will begin to become 'second nature' to you. I suppose one could say it is similar to learning to drive a manual 'stick-shift' as opposed to an automatic transmission. It all will become 'automatic' and 2nd nature in time with practice.

    Great video!! Man, I thought NY was bad. We don't have to worry about most of this I don't think. We can go to a bar and have a drink (for you safty Nazis I'm not saying it's okay)and although it's hard to get a permit here we are very liberal as to where you can carry. I have never seen any no gun signs here that I recall. Schools are off limits and Federal buildings. Local government buildings it's up to the local laws and where I live you can carry as of now. Post Offices are a gray area, I carry in reception area after hours but during business hours if I'm in the main part of the post office I won't. We have a castle doctrine but no stand your ground law and I wish that would change.
    If you do have to defend yourself our gun club lawyer said just say you where in fear for your life repeatedly and tell them you need to speak to your attorney.

Your financial status has nothing to do with that. You just have to be legally aloud to possess or purchase or carry etc. Further laws in Ohio cover that term "legally".

    Something that a trainer told me which made a lot of sense, if you are in a shooting incident, if possible, have someone else call 911. You don't want to get on the phone to 911 and say "I shot someone" or anything that can be misconstrued or used against you. If someone else calls, what they say bears nothing on your statement when you get your lawyer.

    After listening to this entire interview, my main question is this: If I am in a situation where I am attacked, robbed or even fear for my life and I did pull my gun out with the definite intention to kill the attacker or robber, but after I pull out my gun the attacker turns and runs away and then I decide not to fire a round because the attacker has their back to me as they are running away, am I going to be prosecuted for brandishing my firearm??

Especially after Mass Shooting in Oregon District, I have stepped up training and situational Awareness. I become way to complacent carrying and this video should be Mandatory before or after any Ccw class. Bravo!

    When I was a kid, my dad found out that I was carrying a knife for self defense. He made it very clear that he didn't really approve and I should definitely not take it out until I absolutely needed it because it would automatically escalate the situation. People need to understand how absolutely seriously this needs to be taken. If you can't trust yourself the same or more than a police officer you should reconsider carrying a weapon.

      @poor fellow I had to shoot a intruder that broke into my house that had a gun and use my ccw insurances. That didn't happen. Got arrested. They bailed me out and everything went smooth. The prosecuter saw that I had a strong legal defense team and money from the ccw insurance and knew it wasn't a easy case to win with them so they dropped the case. So it helps you. If I didn't have the insurance even tho I did the right thing since I didn't have insurance they would have took me to trial because I have limited resources. That's that my lawyer said

    Got pulled over a couple weeks ago, turned the interior lights on, rolled the window down, put my hands on the wheel at 12:00. Trooper started talking, I interrupted and said, "there's firearm right by my leg, what would you like me to do?" and nodded at it but left my hands on the steering wheel. Trooper shined his light where I nodded and said "where is it?" located it with his flash light and said, "don't touch yours, I won't touch mine" and the interaction proceeded calmly and normally. Told him where my wallet was, (in a bag next to me) asked him how I should get it and said "go ahead and get it" and followed my hand with his light. Other hand was on the steering wheel the whole time. Same with the registration and insurance in the glove compartment that I had to reach directly over the firearm to get to. Both he and I were respectful of each other and the whole thing just wasn't a big deal. BTW, he claimed he pulled me over because I was weaving (I wasn't and we both knew it) and yes, I felt insulted and wronged by the lie that I couldn't push back against but I have a real life, I know he was just running his game and I don't sweat the small stuff. If you have an interaction with law enforcement, take it personally and bow up, you're a fool. Tou won't win and if the cop is an asshole, they'll just enjoy it. So keep your cool.

    AZ. has constitutional carry,but,you can't carry 95% of the places you go to. so what's the point?might as well sell my pistol, being as the carry restrictions make the able to carry law null and void.

      very true. believe it or not, it's kinda bad like that in the formerly sovereign state of Mississippi...not 95%, bit somewhere around 33% or more.

    A very intelligently presented video. Aside from the advice on Ohio law, much of what the attorney is saying is universal. I think we should all, for example, have safe storage for weapons in our cars. You may be carrying and need to go to another state unexpectedly. Or you may be travelling cross country. It's extremely useful to have a secure place to lock your weapon so you are in compliance.

    In my concealed carry class the instructor said to pass on the information mentioned in the video and hang up. Do not answer if 911 calls back. Wait for the police and say you want to talk to counsel and that's it.

    In Louisiana you can only be in a bar armed if you have permission from the owner. Also the BAL for Louisiana is .05 for carrying a fire arm. But still best advice is to not drink while carrying.

    In NC, if you take a ccw into a no firearms establishment, you can be kicked out but no arrested for that. In NC a proprietor must tell you to leave and if you do not leave then you are trespassing and then can be arrested for that charge only.

    Very informative. Common sense saves us a ton of trouble for sure. But tto hear this from an attorney really helps no matter what stat we live in.

      yes seems like everyone mentions ccwsafe, USCCA, Second Call Defense - but not much can be found online of actual testimonials - therein lies the problem - any professional opinion would be helpful, but of course the attorney would probably not recommend any legal membership services

      good points! I will say that before I purchased my insurance I personally spoke to the company and asked a bunch of questions and they were great at giving me answers. That being said, I realize they are selling something, so I did research more thoroughly. I did come across a few individual cases where they did exactly what they said they would do. For me personally, the benefits outweigh the cost.

    12:32 -Police are under no obligation to protect you. (Supreme court ruling). They are LAW ENFORCEMENT. Not bodyguards.

    Some of this is Ohio specific. You cannot bring a firearm in a bar or liquor store or any establishment that does more than 50% of sales in alcohol in some other states. In CCW class, the instructor said you may have to ask this question of the proprietor.

    Thank You Great video! I live in NYS and just received my ccw and came across your channel. Happy to say you have some great suggestions, and knowledge that made me subscribe to your channel. This video is one example that I’ve learned a lot from even though I’m in New York State I can apply these principles.

    The cop who tought my ccw class in Florida said that its not necessary to tell a cop unless asked that youre carring.

    *The attorney made one big mistake* that everybody needs to be aware of. When you shoot someone and the police come of course *you don't make a statement* but your *family member(s) should not make a statement without counsel present.* And he did not mention that
