Stayskal: Denied Despite Law That Bears His Name

- After fighting like hell to pass a bill that bears his name and celebrating the fact that active duty service members would now have a mechanism to sue the Department of Defense for medical malpractice - after all that, Master Sgt. Richard Stayskal watched officials deny his malpractice claim earlier this month.
And he wasn’t the only one.

The Army doctors didn't misdiagnose , they just ignored the tumor and failed to inform this SOLDIER until it was too late !
When I was in the Army I went to see an Army dentist about my wisdom teeth being removed. He told me they were fine and I had plenty of room in my jaws to accommodate them. Turned out to not be true. I got out of the Army at the end of my service and with through hell until I finally had them removed. I operated under the assumption that the Army Dentist was correct and did not seek a 2nd civilian opinion until I was in extreme pain. Never trust an Army Doctor.
It’s nuts one time I went to get medicine filled they gave me the wrong ones they gave me anti seizure medication which thank God didn’t cause me to have one which is one of the very possible side effects if you don’t need them smh.
Never. A civilian option is almost always a better option.
I got out and got civilian health care. To hell with the VA. To hell with DOD. Only thing the military gave me was to be strong enough to realize I have to watch my own 6 medically

Not really surprising. The article says
"Stayskal did receive a letter from Secretary of the Army Christine Wormuth indicating that she was planning to pay him $600,000 from a discretionary fund."
So that's something. Great video and article.
That's not going to force change in the DoD medical system. That's effectively a sanctioned bribe.

I agree I can go and through negligence kill someone deployed and go to prison for life, but the Dr gets a pass? They shouldn’t.
Well of course, the DOD is not going to pay out, oversight of teh claims should never have been give to the DOD, should be a third party non profit

If I remember correctly, generally speaking laws don't have retroactivity on them. If Master Sgt. Richard Stayskal filed for medical malpratrice BEFORE the passage of the law, it would be junked for the sole reason it was filed before the law came into effect...
