Wether she lied is a matter for the courts, but false testimony to (a commission of) congress is illegal in its own right, and is in the jurisdiction of congress. Cruz respects the seperation of powers this way.
She said "settlement" instead of "litigation." She misspoke. It seems odd to me how much is being made of this. Just because she's on the other side of the aisle, you interpret her motivations in the worst light possible. For all intents and purposes, the lawsuit is irrelevant because it's not targeting her. She is technically a party to the settlement because there's a paragraph dealing with employees of the company and she's employed by the company. Her point was that she wasn't involved in the suit in any significant way.

He's voting on her because that's the process. The Senate has to confirm these nominees which in almost all cases happens. That's not to say Cruz will vote FOR her or any Biden nominee (which if you've watched any of these interactions with other Biden nominees you'll see that a YES vote from Cruz is highly unlikely to happen) , but he does have to vote in the process. When the Dems hold the majority, it's virtually impossible for the Repubs to win anything. Hopefully the mid-terms later this year will flip the House AND the Senate but by that time, the majority of the damage will have been done but it will make it harder for further damage to be done for the next 2 years.
