Attorneys argue that Florida law discriminates against Chinese nationals trying to buy homes

  • An attorney wants a federal court to overturn a Florida law that she says discriminates against Chinese citizens by barring their purchase of real estate in much of the state.
    Protesters gathered outside the Miami courthouse in support of the lawsuit.
    Ashley Gorski represented four Chinese nationals before the 11th Circuit Court of Appeals on Friday.
    She argued that the law is similar to long-overturned 20th century bans on Asians buying property.
    Attorney Nathan Forrester represented the state.
    He said the law addresses national security concerns, including threats posed by the Chinese government. Gov. Ron DeSantis signed the law a year ago.
    It applies to farms and properties within 10 miles of military installations and other critical infrastructure.

    When China allows me to buy land in China, I will agree to let Chinese Nationals purchase land in The US .

    Fair law. Its only for land near military sites, makes sense

    So just don’t buy farmland within 10 miles of a military installment?? The law isn’t preventing people from purchasing land, just not specific land that could be used to target national security. But of course thats not how the media wants to word it, they want the general public to focus on some reaching notion that this is racial prejudice when its clearly not.

      That's actually not true. SB 264 mentions "foreign principals" as people from China, Russia, Iran, North Korea, Cuba, etc. These "foreign principals" are not allowed to own agricultural land or land within 10 miles of a military base or important infrastructure. However, the law also specifically targets people from China from owning any property in Florida. "Prohibits [...] persons domiciled in China, but who are not citizens or lawful permanent residents of the U.S., from purchasing or acquiring any interest in real property in the state." So basically unless the person from China is a US citizen or green card holder, they can't purchase any property. Look it up for yourself if you don't believe me.
      Now, I don't think this is a racist law. You could argue it's a country-ist since it only targets China nationals and not Chinese from domiciled in any other country.

    I'm Chinese American and I'm against Chinese national buying homes in USA. Look what they did to Vancouver. Not everything is a discrimination. Sometimes is actually common sense to not let your adversary to buy your country's land. No Russia, China, Iran or North korean national should be able to buy any land in USA. If they wanna buy here, be an ally then.

      I do like the idea of only citizens being allowed to buy property but the problem is that it now makes it harder for immigrants working their way into becoming citizens. If such a law was in place, non-citizens intending to become citizens cannot purchase homes in the mean time. That might mean that they decide to leave the country and take their talents elsewhere.

      @@thesadboxman maybe add immigrant with a visa or green card too then. But we shouldn't let our adversary nationals who don't work or even stay here longer than a month a year our land.
