The entire purpose of this “interview” was to intimidate the officer and let him know that if he does this again, they’ll jam him up on another interview and/or fire him.

He told him he needs to put a written report about the written report he already put in, with the new perspective he’s hoping he has after the meeting they are having right now. Wink wink. “I thought what I saw was the chief put his hands around the guys neck and apply pressure, but after meeting with the interview I realize that he was actually just giving the guy a neck rub, and because he had never been trained in HOW to choke someone into compliance, it’s not excessive force because it’s only excessive force if you were trained how to do it?

The *sheriff* conducting this interrogation is Jared Rigby. He was given the job as Utah's Peace Officers Standards and Training Director. BUT ----- when this video became known, and his actions were seen, his appointment to that job was RESCINDED.
At least there's little bit of justice for this sociopath.
But can you imagine this sociopath being in charge of the agency that writes policy and trains all Utah law enforcement???

This situation sort of lives between the difference in the letter of the law and the spirit of the law. One word makes all the difference - incidental. This falls under the category of motives and intentions. It sounds like this incident was given every due consideration honestly. You ever been in a fight or a scuffle? Shit happens and body parts end up places you didn’t intend them to go because it’s entirely dynamic. It’s plausible that the chief was going by the book doing the right thing, and his hand placement was unintentional. That’s between him and his gods, but it would be a travesty of justice to call a man guilty when reasonable doubt exists.
I faced a made up situation like this during my time as a Sheriff

As a retired police officer, who taught use of force, that was a clear use of force, and it was excessive.

@@lorenzo41942 You obviously didnt watch the trial. I watched every minute of it. Officer Chauvins knee wasnt even on his neck, it was on his shoulder blade. They also analyzed his footing on the ground and can see in the video that he put most of his weight on one of his foot, not on the knee that WASNT even on his neck, but was on his shoulder.
Not only that, you can also see in the video, a pill on Floyds tongue right as the officer pulls up, and he ate the speedball which is a mixture of fentanyl and methamphetamine, which were all found in his system, to be more specific, a deadly amount was found in his system. That matters.
His drug dealer was in the car at the time he was stopped. Floyd had just had COVID, had high blood pressure and I forget exactly, but some major problem with his heart that had been documented.
Finally, Floyd literally said "Im claustrophobic" "Dont put me in the back of that car" "Youre gonna have to take me down to the ground"
Well, they did just that because he resisted and ignored somewhere close to 75 commands/orders until the time he died. You dont get to ignore everything and do whatever you want and be belligerent and eat drugs and have various health problems and be a life long drug user and not expect a police encounter like this to hurt you.
He quite literally got what he had coming and youre going to see that when Chauvins attorneys appeal the conviction. He was only convicted because the nation was worried about another nationwide looting/burning/murder spree that plagued this country and marked the beginning of the decline of the USA as we know it.
Go and educate yourself. YOU are the problem.

A police union isn't going to protect a guy reporting other police. They will pretend to. But police unions ARE police. I served on an executive board of a police department and that was a rough lesson to learn. Never again will I get involved in that nonsense.

The cop being interviewed has constant eye contact, attentive posture and zero psychological fear. He's an investigator's worst nightmare. That detective had no chance.

In 2021, McTaggart reported Booth for excessive use of force. Body camera video shows Booth repeatedly placing his hands on a suspect’s throat.
Booth did not create a use-of-force report after the incident.
Jarvie forwarded McTaggart’s concerns to the mayor, which launched an internal affairs investigation.
*Both Jarvie and McTaggart have since QUIT the Heber City Police Department.*
According to Jarvie’s resignation letter, he left “solely due to the City’s retaliatory actions.”
Heber City agreed to pay $7,800 to Jarvie and another sergeant who also accused the city of retaliation.

As a police supervisor with 22 years of experience, this is really discouraging to see. I'm thankful that I've never had any personal experience with something like this, and it's unacceptable that it happens. Officers should always be encouraged to report ANY violations of law, policy, or people's constitutional rights, and the LAST people officers should have to worry about are supervisors and administrators. They should be leading by example.
I doubt there's a single dept that's clean.

on the streets. He seems like he’s confident, he researched laws and protocols and he knew he was doing the right thing. The interrogator, on the other hand- wow. Immediately he’s talking in circles, manipulating and trying to be a good old boy like “this is how we do things, you need to play ball”. It blows my mind that he’s outright trying to silence a cop who is CLEARLY doing the right thing. He sounds like the exact kind of cop that we DON’T want in our police forces. He super concerned about who this guy told about the excessive force, and why. Not very concerned about the fact that there IS excessive force. Unbelievable.

What pissed me off was when he basically said if you dont agree with our decision about this then you have no future in this job and wont be looked as a candidate for a supervisory position. That was a straight up threat.

The mental hoops they had to jump through to say that “putting your hand on another persons throat is not a technique or tactic if we didn’t teach it to you”, when the policy itself makes no mention of who taught you a specific technique or tactic, is just astounding.
I can't believe they even brought that up. They should have just said "Dude, I know you won't like this, but we're not gonna charge him because we felt it was incidental and don't want to waste our resources on a 2-second choke that didn't hurt the perp." Instead, they really made themselves sound unbelievable and covering up.

Smart Cop vs. Bad Detective. Use of force: "You were not taught a technique or tactic to cut off someones balls with boxcutters, so using boxcutters to cut off someones balls is NOT excessive use of force."
With that way of thinking, excessive force would never be used. Cops walk into a mall, put nerve gas in the vents and go on a killing spree= not a use of force.
This is like working for a company and talking to an HR rep with the detective being the HR rep. They're not they're to help you, they're there to protect the company.

The hardest thing is being a good person and doing the right thing when everyone around you is corrupt.
Consequence of that is that good people stop acting, just because it will hurt them if they do, or even damage them (fired, reported, arrested, ignored by coworkers, not being able to find another job in the future, police harassment/retaliations).
In the 1930's people were happy with the police fighting the maffia. Maybe we should be happpy with a maffia fighting the police now.

I mean, it's the "investigator's" (or whatever is his title) job to question things all the time and just get the facts and nothing but the facts. I think he made some good points along the way and definitely showed at least a great amount of intelligence and a little bit of arrogance on top of that. @timmydoty60 I always stood up against chiefs and supervisors, as every company has at least one pain the ass lol. I loved critisizing supervisors and call them stupid when they came with some stupid new idea.
It didn't help my career very much though, but hey, I did the good thing, I helped a lot of people.
Now I don't work for a company anymore, I made a choice to rather to die free than to live by the grace of someone else. My life has improved a lot since then!

I want to commend and congratulate the officer on reporting this. He is the kind of police one can be proud of. Hope he receives some day the huge respect he deserves and the formal recognition of his moral and professional great performance. Im sure there is a valid argument as to why it exists, but youd think an "external" investigation would always be more impartial.
I don't think you understand exactly what an internal investigation unit does. This guy is not an example of how one operates. IA, in a properly run police department, is CONSTANTLY and SOLELY investigating the police. They review every charge, issue, interrogation, civilian complaint, internal complaint, and any other police interaction and activity. This is good, and is what is needed. When run properly, they would have interceded in this case BEFORE this officer made a complaint. They are good for everyone, when run properly.

You neglected to include the final duty of EVERY IA investigation, the required closing statement:
“After a thorough investigation by IA it has been determined that there was no wrong doing on the part of any police officer.”
This would have been much easier if they would have just said "dude, it was for 2 seconds, we're not gonna get him in trouble for 2 seconds of a mild choke". What they did instead was just unbelievable and obviously coverup.
McTaggart is truly an officer with integrity. I hope that his new employer, mentioned at the end of the video, appreciates him and has high standards. He deserves a much better work environment than this. I'm shocked at the tactics used to try to intimidate him, and I was cheering that McTaggart was such a class act!

This is a prime example of gaslighting. No matter what type of organization you work for, you risk retaliation, gaslighting, and all kinds of coercion to keep you in line from that point on. You stay in line or risk losing your job.

They are just coworkers. The problem is that corruption tempts people into abusing power and acting more as a gang than any sort of legitimate public servant. This isn't the military we are talking about, no matter how much cops pretend it is, they aren't brothers dependent on each other in a war zone. The only thing a cop gets to do is turn on lights and sirens when they ignore a traffic control device. Otherwise, they are subject to every law you and I are.

It can be incredibly dangerous. It's even worse in the army. There were 4 US soldiers who committed a horrific crime against a family (they all ended up jailed for it) and the guy that reported it was basically set up to be murdered by his brothers until someone else stepped in and made sure he got removed before anyone could get to him. I can imagine the risk to a police officer reporting someone could ultimately face the same risk.

It's seems funny to me that in investigations/interrogations against citizens they have to prove their innocence. Their treated as guilty until they can prove innocence. Yet when it's done to a fellow officer, they want to portray them as innocent until proven guilty.

Yeah it's a very rare occurrence that it's going to do anything favorable in resolving the action being reported. Unfortunately it's going to take many more years and people phased out and retiring and guys like this investigator missing out on promotions like the one this cost him.
If they are so comfortable treating an officer this way, there’s no way their abuse of the public stops at the physical level. Interrogations by these two asshats must be atrocious (if they even recorded them in full). They need to make examples of cops like these who tarnish the badge by immediate dismissal with zero benefits irregardless of years on the job.

Based on this conversation, the cop doing the interrogation needs to be investigated. This entire interview is just him trying to silence a cop who was doing the right thing. He’s so obvious. Doesn’t he understand that they can’t police the same way they’ve been doing? Everything is recorded, the public has cameras. All their wrong-doings will come to light.

If you want to go into THOSE weeds...how do you know he is THE Sheriff, and not just a detective who is an investigator who happens to work for the sheriff's office? THE sheriff is the overall head of the sheriff's department. THE Sheriff usually does not actually do the interviewing or investigating. Usually, the deputies who work for the sheriff or internal affairs deputies do.
In this case, it sounds like the "Chief" who did the alleged choke hold was apparently the Police Chief of Huber City. ...from what I gather from what the investigator said.
The investigator, whatever his rank which I believe was unspecified in this video, WORKS for the Sheriff's Office; he says we have been asked by the Mayor and the Huber City PD to investigate this what I assume to be Huber City PD Police Chief.
I mean we can go further into the weeds about how sheriff's office hierarchy have a "Chief Deputy" so that might mean the plain-clothes choker was simply a Chief Deputy (aka, second-in-command to the SHERIFF). But then why is the Huber City PD mentioned at all in the interview?
The interviewer might be the sheriff, but unless you can point to a time stamp where he says he is THE Sheriff in charge of the entire sheriff's department, I think most of us will continue to presume he is some form of detective.
Also, actual evidence of his rank / position and department will be acceptable instead of your comment that doesn't really add anything to the actual point at hand.
Whether it is THE sheriff, one of THE sheriff's underlings, or the man-in-the-moon with a badge, the POINT is the officer reported what he felt was a use of force and he we are.

Friends and fellow employees do NOT interview one another. It's a clear issue in conflict of and evidence tampering as well as an ethical issue.
This SHOULD NOT have ever happened. If need be an investigator from another office, different organization should have been hired as 3rd party contractor OR an agent of the FBI or court system brought in and completed the questioning and interview.

That poor man wanted nothing more in life than to make detective. As a patrolman he witnessed petty corruption and on principle refused even free lunches from Delis with quid pro quo deals on parking enforcement. He didn't go and narc out the grunts getting free pastrami sandwiches he just wanted to pay for his.
He excelled as a beat cop and won over his colleagues, but he needed a transfer to a high profile narcotics task force if he wanted to make detective one day. That's when he went from seeing petty corruption and sometimes excessive force to finding himself in the shoes of Ethan Hawke in Training Day. The new narcotics unit was paid off millions adjusted for inflation by the gangsters they were supposed to be stopping. Ultimately they either directly set him up to get shot or indirectly allowed him to get shot and indisputably refused to call an ambulance for him. All because he talked to a commission on police corruption.
His actions slowly killed off the open graft in most police departments, but absolutely no one faced any consequences for what happened to him. He's only alive bc an elderly neighbor called for help. His partners were going to let him die.

The smartest thing this officer did was when he realized he was being set up to leave for a new job. He would never live it down in the sense they would crap on him the rest of his time there. He did the right thing reporting it, and he did the right thing by walking away when he realized he would pay for doing the right thing.
