  • Many of our Veterans are receiving letters from the VA saying that they've been paid too much in benefits, and now owe the VA money! This is one of the most ridiculous things we've seen in a while, but it's really happening.     Let me see if I got this straight...If you are on a VA MEANS TESTED AND BASED income (you can only have a certain amount of income and assets), AND you also receive Social Security, you will most likely receive that letter. When the social security raise causes your means to go above the limit, you are (from that moment - on) being overpaid by the VA. If you do not INSTANTLY claim that extra money to the VA (so they can lower your pension according to the means test), you will be considered overpaid until the VA catches it. The few instances I've seen of this letter, the overpayment had been happening for YEARS, resulting in hundreds of thousands of dollars in overpayment. Am I on the right track?
    What enrages me the most about this is the timing. The VA suddenly realized they were overpaying all these veterans at the same time the rest of the government decided to fund two wars and every illegal immigrant that happens across our wide open border. It's disgusting and unfortunately typical of the VA's treatment of veterans.
    Fortunately (depending on how you look at it), I don't receive pension or social security and hopefully, will not be directly affected by the money grab. I am saddened, though, that our government is crippling our veterans while handing our country over to illegals. My best advice to all means tested veterans is this: If you receive one penny in raises, take another means test IMMEDIATELY. May God bless us all because our government WILL NOT.

      dvet, if you accept special provisions they come with rules. many veterans HOPE they are nt caught, but same as the IRS they have system too audit DIC Speical MC ect... If you are 100% TDIU goget a good paying job, then you lose TDIU. If you have assistance but inherit $$$ and you do not report it, then they could charge you with fraud. They do no normally do this. But many veterans have just not reported accurate earnings and as such will owe.

      @@Franklin-j2024 Yes, I understand what you are saying. Basically, it's the veteran's fault because they did not claim their extra income. Hence; my advice. What I don't understand is why the VA's 'auditors' waited so long (decades in some cases) to reclaim their overpayments. It's similar to a certain store chain waiting until a thief (smile for the cameras) has stolen a felonious amount of merchandise before they press charges against that thief. The VA waited until the veteran's accumulated overpayment was more than their total assets. I wonder where all of the VA's reclaimed money or confiscated assets will go. Oh! That's right,...they are going to offer health care to immigrants.

    I addressed this 6 months ago. Called the VA toll number and requested an audit on benefits due to a VA error. Three months later, I received a letter, stating my audit request was completed and I was granted approval on my appeal. Case closed...

    Same collection efforts are happening at the Social Security Adminstration. Thousands of SSA recipients are experiencing the same b.s.
    Sen. Sherrod Brown is looking into this - one problem is number of VA and SSA workers has been cut back.
    Congress needs to hit both agencies HARD to make them stop the collection efforts and absorb the overages in their budget.

    If they ever give me a letter like that I can promise a lawsuit they won't soon forget! Medical malpractice, intentional withholding of medical treatments, pain and suffering, involuntary emotional distress, and EXTORTION of telling me to ditch my attorney or I will have my benefits "indefinitely on hold". Yep, they then gave me my 80%. Since I do have this on paper from a BVA judge, I have more teeth!

      @@Franklin-j2024 Its called an SF-95. Yes, you can do it without a lawyer and all you have to do is show up to court when they give you a letter with a date to show. Bring all supporting documents.

      Yes, because DIC ect.. has rules. If you dont pay your taxes is the same result.

      I have a VA story from Louisville VA. A woman in finance office embezzled over 300k from the VA. No charges were brought, she kept her job and was promoted soon after. It's truth, google it. Still can't believe it. They let her keep the stolen money too.

      Correct. The VA never processed paperwork to remove my ex and a dependent, and because of that the VA demanded I pay them nearly $12,000 in "overpayments". What really sucks is that the "overpayments" weren't extra money from the VA to pay for dependents, but it was money that was taken from my retirement that's offset due to my disability rating, meaning the money from my retirement should have been taxable income. Granted the DFAS paid me the amount due, but they taxed the money leaving me over $2,400 short money still "owed". Then I get a letter about 5 weeks ago, telling me there was a mistake and that I owe them an addition $1,700 on top of the already $2,400 I still owe. They are garnishing my disability income, and I have to wait to file my taxes to try recouping the $2,400 to pay them the remained, but this doesn't cover the addition $,1700. It's total BS what they are doing! I've written my Senator to address this issue, but due to the holidays, I haven't heard anything back yet.

    You are correct...Congress doesn't care...no one there is low income or struggling to pay bills...The VA made the mistake they should eat the losses

    Spouses benefits for a disability rating should automatically go to the spouse if the veteran dies. America borrows money from China to give to Israel and Ukraine but the VA acts like your a welfare case for getting service connected injury benefits.

    They said I owed them co-pay money and just cut my benefits and half for the month because they don't think we need our benefit to eat or pay bills.
    I got them to give them money back to me with the understanding I would pay it $25 a check and then a few months later they took the whole thing again without ever taking $25 out of my checks .
    Then they said they agreed they screwed up and would give it back again and do it right.
    They didn't.
    The Leaders of the VA have No Honor or Integrity.
    You may be able to trust your war time enemy better than you can trust the VA.

      Let your Congressional Representative know, lets do a Veteran's "Voter Show of Force". Mass Veteran Voter Turnouts in All Elections, Always. (1) Vote Local . (2) Vote State. (3) Vote Federal. "All Politics Is Local". Vote - Vote - Vote...

    This is one of the many ways that the VA is giving Vets another chance to die. The VA is trying to save as much money as they can.

      The VA budget covers VETs benefits and VA employee salary and benefits. The less money VETs get, there is more money for bonuses in VA administration.

    I had this happen over some co-pays when I wasn't rated high enough. They attached my Social Security check. The reason that I was given was my VA compensation check could not be garnished and that Social Security was the method to use under the laws. States can also garnish via the SSA. Not for all debt, but for any due taxes and such.
    It took me thru 4 different agencies to find out why and who was taking this money.
    The VA will file a delinquent debt. Then the VA Dept's Office of Debt Management will issue an attachment order for the debt with the Department of Treasury which in turn notify SSA. It is a cluster ****. Nothing can be changed without the VA's approval. They took too much back and it wasn't fun trying to reclaim it. There is a separate financial office at most VAMC's. They may be able to help.

    My 94 year old mother who was in the Air Force from 1950-1957 received one of these letters. She is in assisted living and her income is negative. 🤬

    I had this problem when my step-son started college...I kept track of paper trail for when I had him removed from my claim and started his VA dependent education program...the VA stated they would re-coup $300+ per month...I produced dates of when VA received the requests/forms for the dependent changes/VAED program and that VA dragged their feet on decisions. I did my due diligence, they did not. VA approved my dispute...no re-coup of 'overpayments'

    Veterans go through a complete and thorough approval process of the VA's own design. The VA itself NEEDS TO PROVIDE PROOF OF OVER-PAYMENT and their own mistake in calculations before they can demand a single penny or touch someone's compensation. I mean that THEY need to provide paper documentation to the veteran or spouse showing their proof - not just claim a wrong. Every VSO, veteran and spouse should be calling their Senators and Representatives about this and demanding this unfair process be stopped.

      There's a rule VAB mistake they eat it. That's on comp. Why doesn't this guy mention it. Cannot speak for pension.

      @@combatdouglas1306 That may not be written in stone anywhere, and might have been just a general "nice guy" policy. The government usually covers its ass as long as it can. They'll be nice for a long time if they can retain control when it really matters. See if you can find that rule written down anywhere in the VA regulations.

    So for some veterans who were drafted or enlisted, this is how our government is showing their appreciation to some veterans, for the governments mistake? Instead of our government writing a veteran a letter and putting it all in their lap, to now prove their worthiness, doesn't it make more sense for our government to schedule an appt. with the veteran to resolve this, and treat the veteran with a little bit of honor and dignity?
    It feels like to me now, the only mistake I made trying to do the right thing and serving my country for 21 years, is staying in for so long, in the career field I was in, and letting JP4/8 Jet Fuel pickle my brain and body all those years, and now having to go through a process to try and keep my head above water financially with the VBA, because I can't work. I don't understand how some veterans are receiving 100% VA Disability and still able to work/hold a full time job? I believe if a veteran is at 100% VA Disability, they should be P&T or TDIU, and receiving the 100% because they can't work, not receiving it while working to try and live high on the hog, instead of receiving it to just try and get by. Wondering if that is the mistake that the government is trying to correct now, and totally going about it the wrong way? I had an Allstate Claims Adjuster who was retired military, receiving a pension and 100% VA Disability, who was able to climb a ladder several times just fine, walk all around my roof, take notes and pictures, and brag about all the money he made, while living in a big house...and don't believe this is how the VA Disability system was intended to be, but if they are allowing it, then this is on them not a veteran, I don't believe.

    My Govt employer did me that same thing in 2021 on my retirement disability, claim that they overpaid me in 1yr, and I must pay it back. It was their mistake it was $27k. You can't argue with them they’ll take it out your monthly check and leave you with nothing. No sympathy for anyone. I thank God I had saved some money and gave them back all my savings. It hurts so bad, you can never win when it comes to government.

    Congress sets the VA Budget each Year. The Voters elect the Congress every 2-years. Mass Veteran Voter Turnout at all local elections, gives power to Vet Voters. "All Politics Is Local" Vote-Local. Vote always. Let your Congressional Representatives know you are watching the Congressional Vote Record on any Legislation affecting Veterans Benefits..

    I just got a letter saying I owe 48,800 dollars and the payment will be 1,350 starting in May and will be garnished but doesn't say what the debt is for? 😮😢 When i called Va debt management they said they can turn the 3 year payment to 5 year payment

    This is why many veterans should not rely of VA $$$ they can and at some point will take this stuff away. Not to mention many vets taking 100% do not work and as such will get very little in SS when they reach that age.

    Funny how our disability award is "non-taxable." Yet, breaking the promise of one of our finest presidents and governments, after age 65, we are suddenly taxed on it.
    My friend is a disabled veteran. He lives paycheck to paycheck, the same as many others. After turning 65, he no longer receives the free medical treatments he was promised, as now he pays $560+ per month for Medicare.
    He still goes to the VA as they're all he knows. However, now it comes with the burden of a monthly bill.
    He didn't retire. So, I will give you a couple of guesses as to where he has to scrape this medical tax burden from.

    I suggest you sit down with your Congressperson staff and invite at least one Senator staff and work on a draft of actual intent for his/her sponsorship of congressional legislation to stop this practice. Then invite your local VSO's leasdership to the table and pursuade them to get involved with their National Commanders Legislative Offices. You know they all address both the Congressional and Senate Veterans Committees at least once a year.
    Your right, as you discribed, that it is unfair, especially to low income eldery .veterans on fixed income. And those with disabilites not as a result of service. And their suviving elderly dependents. They did not ask for the VA to make a mistake. Their are supposed to be formal by the book checks and balances. Who's minding the store? Was this caused by a Federal Contractor Computer Program? Then make them pay.
    Don't get me wrong. I am apprecitive of everything the VA Benefits Administration and Health Services Administration has done for me and my lwife. And especiall;y the VSO's that stepped in to solve complicated issues for me and other Veterans. The VA good works save many a Veterans life, including mine. But the overpayment appeal process should in no way as complicated as you describe. It can be fixed. You can do it! Just have to take the initiative. It will take time, but Congress controls the VA Budget and can quickly act give the right motavation. Your great! Others will follow your lead. Like our past great Speaker of the House Thomas P. "Tip" O'Neil use to say "All Politics Is Local". And as a good pol and Irishman his pal President Ronald Reagan agreed! Respectfully a fellow 75 year old combat Vietnam Veteran. Bill

    For those that get this letter I owed $18,000 from 11 years back and they calculated it all to 2023 I called them and they said in order to waive the debt you need to write a letter of hardship and the debt was clean

    It doesn't matter what you do.they have the power.they said they over paid me for 2 years.i got a divorce filled out the paperwork the day I received my divorce.to have my spouse removed.two years later they took my entire check said they over paid me.i had custody of two minor children at the time.who depends on me.they took my check in december.we had no Christmas that year.well they thought me to never feel secure with v.a.income cause they can and most likely will mess with you.the spouse over payment was their failure to do there job update your file for 2 years which is un heard of in the civilian world.they admitted it .but not to take it back would un fairly inrich me.

    I did 20 years 8 active 12 reserve and retired in 2019, I served in Iraq. I have injurys and i have entertained filing a claim. But i still work..I feel my body breaking down on me because im in my mid fortys now and its labor intensive..I cant call off work for all these VA appointments and stories like this just makes me not wanna even try. I wish i didnt have to wait till im 60 to collect my pension since i retired as a reservist. Part of me wants to start the process, part of me says these people are too much to deal with..I dont know what to do.

    Is the VA licensed to operate as a debt collector within the US? Ill see them in court...
    Also it is they who make the claim that has to prove the claim is valid... simple contract law... id send it back and just say no thank you and ill see you in court if necessary.

    Its not always over payment. Its most likely a overdue payment form medical bills from the past. Some bill from before your compensation checks started rolling in.

    I got this letter. I was previously married, but i forgot to tell the va i got a divorce. Went to add my current wife and boom, found out i owed 1800 bucks. They took 2-300 bucks a month from my benefits.

    I was paid 2,650 after my disability was granted and a week later was told I had to pay back 2,100

      I called the VA and asked why I was overpaid and the lady couldn't find a reason why. She filed a request for a review and an audit of my account I should have been paid for 16 months back pay from the intent to file date and 270 dollars per month.

    I got a letter like this stating I owed them approximately $70,000. I requested a waiver due to the inability to repay. Haven't heard anything else.

    The VA should hold their employees who input that erroneous data into the computer system who then confirmed the VA overpaid the veteran their entittlments that the veteran rightly earned. VA and their employees need to take accountability for their own mistakes!

    I received severance pay in 2015. Should have been med boarded in my opinion. I received 100% total and permanent in 2022 so i guess ibwas audited because i received a nonpay due on nov 2023. I called the VA and they tolf me i wont see a check until July because they want to recoup the $28K.

      I got overpaid because I did not report my divorce fast enough. I applied for them to waive what I owed back and the accepted it. Requires a financial statement but check it out.

    I was told that I had been overpaid since 1980 because they (the VA and NAVY still showed me married to my first wife who divorced me in 1968. They told me this in 2019 BECAUSE I had the AUDACITY TO TRY AND FILE A CLAIM FOR AN INCREASE BECAUSE OF EXPOSURE TO AGENT ORANGE, RADIATION, AND ASBESTOS WHILE ON THREE DIFFERENT SHIPS PLUS FIREFIGHTING FOAM IN SAN DIEGO. I WAS ON THE USS AMERICA(CVA-66) IN THE TONKIN GULF IN 1968 (AUGUST through OCTOBER), THE USS HANCOCK(CVA-19) IN 1969 and then after OAK KNOLL NAVAL HOSPITAL, on to the USS MIDWAY(CVA-41) FROM 1969 TO 1972.

    Your unreimbersed medical expenses would not be in a file. You would need to keep all receipts and provide them to the VA. Every year when I receive my COLA increase letter, it clearly states you are responsible for reporting increases (or decreases) in income and/or assets. It's important that you read all correspondence from the VA. Welfare, SSI and real property plus your residence up to 2 acres are not counted as assets.

      Serious question. Increases in income wouldn't have an effect on regular monthly VA payments right? You are referring to payments for additional medical services that the VA is reimbursing? I feel like I do understand everything the VA has sent, but I don't think I have ever seen a letter describing what you are. Thanks.

      Well Frankie J ive done means tests in 2014, 2016 and 2019. Nothing has changed but increases in SS retirement. So if you are trying to defend the VA good luck with that they have screwed alot of vets over.

    But they don’t have a problem delegating the illegal immigrants to obtain services for veterans administration which is disgusting to me that somebody that just crossed the border is eligible for VA medical care. If you don’t believe me Google it! Moreover, they send millions and billions and billions and billions and billions of dollars overseas to Israel in Ukraine yet, when Veteran needs help, they scrutinize the request and make it hard to Grant compensation. For example, you fill out a fully developed playing at the Veterans Administration and they still want to conduct a C&P exam in order to have the examiner, QTC the third-party contractor, denied your claim. Another crazy thing is, per legal immigrants, this country pays for medical care and hotel and Perdiem if they cross the border with a child on their arms. This whole society is ridiculously backwards not to mention millionaires and billionaires don’t pay taxes but hard-working people to both Democrats and Republicans are full of crap! I’m so worried about this country is going downhill. Are they wondering why generation Z is not willing to sign up for the military? I wonder why?

    First what has cause all this is vets gaming the system. This is why they are on the hunt, changing rating criteria ect.... I live in Clarksville and every other vehicle is a 100% vet in corvets, BMWs, Mercedez. Thats not what it was supposed to be. Im a disabled vet got 70% and had the VA pay for a Masters and I make bank. This is not a bank to pay you for everything in your life. Likewise, it comes with rules, like if you make this much you lose this much. But NOOOOO. I cannot report this because I WANT do not need the money. Well this is the result. Sad thing is because the system is essentially in total f--k mode. many vets will lose out because all the BLUE FALCONS games the system.

    Please clarify the sources of VA pay/compensation you are referencing in this video. I am a US Marine Veteran as my wife is as well. We both receive VA disability income for injuries and illnesses sustained while on active duty and we were both stationed at Camp Lejeune so we each have VA healthcare. Is this income in jeopardy of clawback for income/assets testing?

      This is for VA pension, not compensation. I have a VA pension. I receive a certain amount every month. I can only receive that amount period. For example, let’s say the VA deems I can receive $1,000 a month. If I receive $500 a month from Social Security I have to report that to the VA and then the VA will only pay me $500 that month for a total of $1,000. This is the amount the VA has deemed I can receive. If I don’t report the Social Security payment the VA will come back and say I was overpaid $500. I get a VA pension based on the fact that I served during wartime and other factors like being homeless and no income due to being unemployable because I have been deemed non-service connected disabled at a VA C&P exam. I can only make the amount the VA gives me every month which is not enough to live on. I have to live with family, but that ends next year and I will be homeless again. The compensation side allows you to receive extra income. The pension side does not. I hope this helps.

    The VA is just like any other business private or government, if your overpaid, they have the right to recoup the money. You know what your monthly benefits should be it is your responsibility to speak up. No different than if you were overpaid while you were on active duty.
    I know a private company who recouped overpayment from employees from 5 years back.
    The courts look at it the same as if you borrowed the money and it's a repayable debt.
    So it's your responsibility to send them a letter back asking for validation of this debt just like any other debt you don't agree with.

I know what my monthly benefits are, and I know if I've been overpaid, and if that's the case I KNOW I need to reach out to my regional office and find out who I must contact to rectify the issue.

    What I don’t understand is if you went through the process and you were granted 100% permanent total with no future exams required and then they say you owe them money. I don’t understand that they do 100% permanent in total with no future exams and its service connected so I’m not quite understanding, is it the disability payments that they’re saying they overpaid you or is it something else at the VA is giving you that they overpaid you on if you could explain more I would appreciate it

      Its if you take special payments for living , cargiver, ect... You cannot getthis and make bank. You haveto follow the rules. Evertone who take this money just keeps taking it when their situation changes, get better, have a divorce, kids age out. They keep taking it and honestly most know they should not.       Here's how it works. Vets that receive 40% (or below) VA disability compensation - plus - 100% military retirement, the percentage of disability received is offset (or deducted) from their military retirement, for the purpose of taxes. Conversely, Vets that collect 50% to 100% VA disability compensation - plus - a military retirement, are authorized and paid their assigned percentage of disability compensation - plus - 100% of their military retirement.
      For example, I am retired Air Force and collect 30% VA monthly disability compensation. 30% of my military retirement is offset (or deducted), equaling 100% of the two combined. I receive two monthly payments; one for 30% VA disability, which is non-taxable, and one for 70% of my military pension, which is taxable. I receive a 1099-R for 70% of my gross military retirement. 30% of my VA disability compensation is not declared. Likewise, 100% of a military retiree's pension is counted as taxable income.

      Not click bait. many vets have gotten caught by the VA by overpayments. The lawyers are after a piece of the pie. Its just more BS on top of BS. The whole VA benifits needs change as it has becaome a welfare system other than what was supposd to be. They are changing the rating criteria and many vets will be reduced.
