    I won at my initial application. While my medical conditions where severe (respiratory failure). I credit your videos to my winning. They helped me correctly fill out my application and how to answer the questions asked during two telephone conversations with the person assigned to my case. I'm ever so thankful for you !!

    I watched many of your videos and followed exactly what was instructed to do. My husband was awarded SSDI this month. It took 8 months, but worth the wait! Thank you!!!

    First thank you for another video. But from someone that is on disability my advice is never go into a hearing without an attorney.

      That's the best course of action and highly recommended!
      You have a 300% better chance of success with a lawyer. (per recent gov't study)

    It’s been 13 months and my attorney still can’t get in touch with SSDI to find out a status! They told me to call and try to get in touch. I am 100% Va disabled, but no word from SSDI.

      If your attorney has ERE access, he/she should login to get the adjudicator's name,number and fax number. If no response, then the attorney should call the supervisor.

      Nope. ERE access only shows the attorney what records have been received. There is nothing there about case status.

    What is date of last insured? I have the onset date

      The DLI is the last date you have coverage for SSDI. You have to prove that your onset date was before your DLI to recovery SSDI.

      I would let your attorney know what happened. If you don't have a lawyer call the hearing office ASAP to tell them and ask for your case to be rescheduled.

    During your video you mentioned that social security doesn't ask doctors after you file an appeal for more information. I just filed an appeal for reconsideration on my disability, and social security stated that they will reach out to my psychologist to get any new information from her . To make sure it gets in record before my appeal is this not true ? Please help thank you.

      No, what I said was that once you request a hearing SSA does not update the record. THey do update the record at the reconsideration stage.

    When I went to see the ALJ I lost but still got some bennies I wanted ssdi but got ssi it was a mess at the time I never knew about your office I got partial some SSI and some SDI and they said there are no jobs for me, in the todays, working world I refused to believe that it was going to be so hard what a mess!!!

    Hi. Both my denial letters didn’t include half of my most important doctors. Does SSDI look at the medical records I sent or do they just try and get them on their own?

    I am a 61 years old with debilitating autoimmune disease. I am also having glaucoma, just had my cataract surgery and have macular degeneration. Also I have A-fib. I have heard that you have to be at least 6 months not working. I can't stop working, but my eyes and my hands making it impossible to do. Please advise.

      THere is no 6 month requirement - you can apply the day after you stop working. However, you have to have a condition that has lasted or is expected to last 12 consecutive months at a disabling level. THis means that you have to be out of work for 12 months. If you are working and earning more than $1,350 per month you are not "disabled" per SSA.

    My hearing is Wednesday, and I’m getting worried my attorney isn’t doing his job. How many times should we have talked by now? We’ve only had one 4 minute phone call. He hasn’t prepared me and I’m not sure he even knows my medical conditions. Any advice?

      That's better then I got in 2 years I got 9 min and that was a month b4 the hearing. I think they knew all along I was going to lose

      Hannah, every attorney has his/her own style. Hopefully the medical record in your case is strong and you didn't have to say too much. How did your hearing go?

      @@ssdattorney I think I was very well prepared and had every answer ready, my attorney was a joke! I have Ehlers Danlos Syndrome and Postural Orthostatic Tachycardia Syndrome as well as others, and he didn’t know the names of my conditions, the limitations, or have a closing statement. His opening statement was piss poor, due to not knowing my conditions, and I emailed him the Day before asking him if he had all my medical records in, and was prepared. And he assured me he was and I had nothing to worry about.

    I have a hearing coming up for a retinal detachment and I don’t have a lawyer so should I go by myself?

      If you can find a lawyer you should do so. If you can't find a lawyer be prepared to explain why retinal detachment (in one eye?) prevents you from working every job that exists in the U.S. economy.

    thank you, after so long is it still worth trying to get SSDI instead of SSI? my case is messed up I am not sure what to do, soon I will be homeless the girl I stay with is out of money and soon, she will be leaving this apartment and then I will have to go. I opened my case in 2016 and have been on SSI for all this time it's not enough to pay my rent and I am getting food stamps so I can eat what should I do do you think you can help? or is it too late? and is it too late for back pay IDK thanks again, David Rosenberg.

      David if you don't have earnings credits you can't change to SSDI. If you were not insured in 2016 you would not be insured now.

    If i may, let me tell a story, way back in 2014 i had my first hearing without a lawyer and got approve BUT, months later the damn appeals council letter came and stated no substantial evidence, at that time i didnt know NOTHING about the laws and rules of disability, i was sending random documents, yet later the case got remanded back to the ALJ long story short, after the remand hearing i got denied and my SSI taken away! (Favorable decision reversed!) Also long story short my next case got denied because of a lazy lawyer i had, taken to Federal Court received a sentence 4 remand had another hearing with judge Allard at the newark ODAR back in Nov 2022 and now the decision is in writing this time i have a great chance of winning because i have a more diligent lawyer and more fair judge, and is a matter of meeting a listing of 12.05B of intellectual disability and maybe 12.06 of anxiety and the therapy and medication had been ongoing for 8 years! The moral of this story is DONT EVER EVER SHOW YOUR FACE IN THE HEARING WITHOUT A LAWYER! Either way you will not win and may never will! Especially if its in front of a tough low approval judge! (they will eat you up alive!) I may gotten past the judge but not the appeals council and look how much it cost me to get my SSI back! Listen to Mr Ginsberg! DONT RISK IT! And also STAY WITH YOUR DOCTOR!

    I have perc interview in 2 weeks. My mom and I had an oral agreement about me paying her back rent if I'm approved. Will I receive the full monthly amount going back to my application date?

    I was told by a disability attorney to not hire anyone before the first denial. Would it be appropriate to hire an attorney for the reconsderation?

      Personally I take cases at any stage of a case, including filing initial applications. I also tell prospective clients that they may want to file their own applications since about 35% of claims are approved at initial. You can file your own recon but since the odds of winning at recon are so low, it probably makes sense to hire a lawyer after the initial denial.

    I just got denied and I had added an on set day of when my work started to change were my hours were reduced a lot more frequently due to illness or doctor visits. That was 4/2022 but my doctor took me off on state disability on 10/2022 I think that maybe one of the reasons that I was denied. I wasn’t clear to what an onset date was. So I got denied. Is this one reason that SSA would deny Jen person?
