For those that say Robert is being stubborn and acting like a child , just remember if you give up your rights just to please those in power then you are part of the problem. Our Constitution clearly states we dont have to answer questions from law enforcement if we choose not to. We also dont have to be subjected to unreasonable searches. We should be thanking this man.

This is the story of an American citizen on his way to a restaurant, and is stopped for no reason. He has done nothing wrong, but they refuse to allow him to leave without proof of his citizenship. He is not the only victim of the border patrol. Just one thousand of Americans every day going about their daily lives.I heard the cop admit he was doing wrong, but because he refused their commands to roll down his window, they refused to allow him to exercise his Constitutional right to leave. I have a lot of respect for his courage in the face of tyranny. Does he drive a rental for his videos? I would hope so. He must know these thugs will break his windows for standing up for his Constitutional rights. If it's a rental, the insurance will take care of the damages they cause. The issue is his U.S. citizenship in the face of tyranny. They know he's a citizen, but the tyrants are just following like Hitler's Nazi Storm Troopers. This is a man of courage, and he deserves our respect.

I have seen videos like this done by other auditors, and even attorneys who were yanked from the cars illegally searched detained for long period of time. Also had their vehicle searched. They never answered the questions that they wanted to answer yet they eventually let them go. There was one, however, I believe he was arrested because they made up charges on him because of retaliation, which were eventually dismissed. If you give up your rights, you don’t get them back. We have the right to remain silent. Even the Supreme Court has made the statement never talked to law-enforcement without an attorney.

The shredding of the Constitution by way of Interior Checkpoints wastes countless dollars and people’s time. While it may anger some to see what Robert does at some of the checks, it is his right to redress his grievances. At least this time he was not met with violence at the hand of our very own government.

    • @cajunncanada3913
      @cajunncanada3913 Месяц назад

@@slapukaz How about stronger border defences AT THE ACTUAL BORDER! It has been statistically proven that these checkpoints (up to 100 miles inland) provide nominal results as it relates to apprehension of illegal immigrants. The checkpoints are more about drug interdiction, which is a violation of their stated purpose. Perhaps tighter controls within a one to five mile range of a land border with some special authority to enquire about nationality within those areas. According to the ACLU, two-thirds of the U.S. population, or about 200 million people, reside within this expanded border region, according to the 2010 census. The constitutional right to be free from interrogation by government agents, absent reasonable suspicion, has been stripped away from the majority of Americans! If we allow our civil rights to be stripped away bit-by-bit, what will remain?

Agent F. JIMENEZ is wrong about his job here. There are at least 3 paths at this point.
    1: "open your window"
2: Cited for what? It's the agent keeping the driver from continuing
3: Allow the person to continue on his way
"The Border Patrol's routine stopping of a vehicle at a permanent checkpoint located on a major highway away from the Mexican border for brief questioning of the vehicle's occupants is consistent with the Fourth Amendment... any further detention or search must be based on [the greater showing of] consent or probable cause." United States v. Martinez-Fuerte, 428 U.S. 543 (1976)
"We have consistently held that a refusal to cooperate, without more, does not furnish the minimal level of objective justification needed for a detention or seizure." Florida v. Bostick (89-1717), 501 U.S. 429 (1991) (Supreme Court)

They say they will prosecute for impeding traffic, I'd like to see how that goes when they stopped you and haven't given you permission to go Can't say that I think much of your Constitution, it don't seem to count for much! 1st Prize for a totally legal silent treatment.

    • @yuma310
      @yuma310  29 дней назад +1

They tell the Sheriff the vehicle blocked traffic and after seeing the vehicle moves to Secondary, the Sheriff doesn't bother citing the driver so U.S. Border Patrol breaks in the vehicle and seizes everything, impounds the vehicle, holds the driver handcuffed for most of 10 hours, threatens to keep his Passport because it's Federal Property, makes fun of of the company he works for, "Government Motors" then creates a fake CBP Whistleblowing Agent, Michael Flanders, and has him contact law enforcement's fake social media mogul, famous for refusing to go to Secondary, Terry Bressi, contact the falsely accused traffic impeder while CBP still has hm in custody and offer help along with sending him to an ACLU lawyer that is working with the Terrorism Liaison Office to further investigate him.
The record that the driver impedes traffic is forever in the CBP system so future Agents expect him to block traffic and are surprised when he goes to Secondary when allowed.

It sounds like you're referring to a situation where someone might refuse to show identification at a U.S. Border Patrol immigration checkpoint, possibly in the context of a drive-through at a place like Burger King in Sarita, TX. Here's a breakdown of the relevant points:
    ### U.S. Border Patrol Immigration Checkpoints
    1. **Legal Authority**:
    - U.S. Border Patrol has the authority to set up immigration checkpoints within 100 miles of any U.S. border or coastline. These checkpoints are designed to enforce immigration laws and stop illegal immigration.
    2. **Refusal to Show ID**:
    - At these checkpoints, agents may ask for identification to verify citizenship status. While U.S. citizens are not legally required to carry identification, refusing to answer questions about your citizenship status can lead to further detention or questioning.
    - The Supreme Court case *United States v. Martinez-Fuerte* (1976) upheld the legality of these checkpoints and the limited questioning of vehicle occupants.
    3. **Your Rights**:
    - You have the right to remain silent, but this may result in a longer detention while agents attempt to verify your status.
    - Recording interactions with Border Patrol agents is generally allowed, but you should be aware of state laws regarding recording conversations.
    ### Burger King Drive-Thru Context
    1. **Location**:
    - Sarita, TX, is located within the 100-mile border zone, making it a common area for Border Patrol checkpoints.
    2. **Scenario**:
    - If you are in a drive-thru line (e.g., at Burger King) and encounter a Border Patrol checkpoint, the same rules apply. Agents may approach your vehicle and ask about your citizenship status.
    ### Practical Advice
    1. **Cooperate Respectfully**:
    - Being polite and cooperative can often result in a quicker resolution. Answering basic questions about your citizenship status can expedite the process.
    2. **Know Your Rights**:
    - You have the right to ask if you are being detained. If not, you can politely ask if you are free to go.
    - If you choose to remain silent, be prepared for potential delays as agents verify your information through other means.
    ### Conclusion
Navigating a Border Patrol checkpoint, even in a seemingly mundane situation like a drive-thru, involves balancing your rights with practical considerations. Understanding your legal position and preparing for possible outcomes can help you handle the situation more effectively.

So we agree that U.S. citizens are not required to answer questions at this type of internal Border Patrol checkpoint.
Additionally, refusal to answer questions cannot be the reason to continue the stop:
"We have consistently held that a refusal to cooperate, without more, does not furnish the minimal level of objective justification needed for a detention or seizure." Florida v. Bostick (89-1717), 501 U.S. 429 (1991) (Supreme Court)
Also, we agree that Fuerte did not hold that all people are required to answer questions at this type of internal Border patrol checkpoint.
