  • In Europe, the right to abortion is not universal. Poland is the scene of vociferous protests against some of the continent’s strictest abortion laws. Further south, in Italy, some doctors refuse to terminate pregnancies - even in medical emergencies.
    Valentina should still be alive, Salvatore Milluzzo is sure of that. His daughter died in 2016. Pregnant with twins, she was taken to a hospital where doctors refused her an abortion for idealogical reasons, despite the acute danger to her life. This resulted in the deaths of both the unborn babies and the 32-year-old mother. Many women wishing to have an abortion in Italy meet resistance: 70 per cent of doctors there refuse to participate in surgery to terminate a pregnancy, even if the law permits it.
    Poland has effectively moved to ban all abortions. For months now, Marta Lampert has been organizing protests against the government and the ultra-conservative Christian lobbyist organization Ordo Iuris. She rejects the paternalism of the church: "Our movement is the reaction to a patriarchal culture, to a patriarchal, fundamentalist state that treats women especially badly.”
    In Spain too, Christian fundamentalists are trying to torpedo the statutory right of pregnant women to have an abortion. There are frequent reports of expectant mothers being deliberately deceived about the health of their embryo in a bid to "force” them into giving birth to a severely disabled child.
    In Germany too, women seeking an abortion still face considerable hurdles, particularly in rural regions. In the Catholic city of Münster, few doctors are willing to carry out the procedure. Gynecologist Kristina Hänel runs a practice in Gießen. For years, she’s been embroiled in a high-profile legal battle. Anti-abortionists and public prosecutors say her website is breaking the law. At issue is a controversial paragraph of the criminal code prohibiting doctors from advertising their abortion services.
    The pro-choice lobby is heartened by the new coalition government’s plan to scrap the offending "paragraph 219.” But this change in the law won’t necessarily make it easier for doctors to inform patients about abortions, let alone carry them out. After all, fanatical anti-abortionist voices are unlikely to be silenced. Consequently, many doctors simply decide not to offer the service at all.

    Ending a pregnancy by delivery to save a woman's health/life is basic medical care. If the babies had any chance of survival they would have done an immediate cesarean on them. Instead they allowed her to die while waiting for them to die. They should be in prison and banned from medicine.

    What kind of moral grounds do you have to fucking wait out the guaranteed deaths of two stillborns? What the hell? At best that's prolonging the suffering of all involved. And in the case of Valentina they saw the worse possible outcome. Absolutely ridiculous.

    There should be law to list doctors who are conscientious objectors on moral ground for abortion that can be publically access, so consumers/patients can choose their doctors correctly. Make it as consumers protection, consumers has right to choose their service providers.

      @Monkeys Will you just listen to what you're saying?! 🙄 A doctor is a trained professional whose primary task is to heal human beings and save lives, not target, destroy and kill at the consumer's command! As such, s/he is acting totally within her/his competence when s/he objects to poor and life endangering, bogus, medical practice. And btw, freedom of conscience is an internationally recognized human right, as is the right to life.

      No there shouldn't. If it is an emergency the woman can't look through a list, try to figure out where the doctor works and then go there. She might not even be conscious. Doctors like this should simply loose their license and be criminally charged,

      @@m.forrestal5893 That depends on what country you're in? Where I am it's incredibly unlikely to happen, for which I am extremely grateful.
      Also in most cases a doctor doesn't really perform abortions, they hand you the pills and you take them yourself.

    On a finite planet, with dwindling resources and growing inequality, how many more poor children do we need? There are millions of children without the possibility for a good education, healthy food and job opportunities and they are just supposed to "be".

    This is heartbreaking. Barbaric. That poor woman taking so long to die..in a hospital, surrounded by the doctors and equipment that could have saved her life and her suffering in minutes. This is nothing to do with ' moral' objections, this is rampant misogyny.

      Abortion is NOT illegal in Germany. That's an intentional misinterpertration of the law by self hating Germans.
      It's legal on request till 12 weeks or it's atleast unpunished. If it's unpunished then it's legal.

      It comes down to the German basic law (constitution), which goes back to 1949 and says life begins at conception. This is extremely hard to amend because unlike other laws to amend the constitution you have to go through special procedures like in pretty much every country.
      They decided to just not enforce the law in the 90s though so it doesn't make an awful lot of difference.

    I appreciate DW for highlighting these issues. In the case of the Italian woman, I don't understand why she wasn't at least given oral if not IV antibiotics which are commonly prescribed during pregnancy including any range of penicillins, cephalosporins, or clindamycin. If I'm following the logic of these conscientious objector physicians and ultra conservative Catholic beliefs, then any medical intervention would be contrary to God's plan for the individual in question. If you have a heart attack, then you only get paracetamol/Tylenol. If you have a stroke, you only get paracetamol/Tylenol, etc.

      Actually, Catholic beliefs do not prohibit the use of oral or IV antibiotics, nor early medical intervention when the life of a woman is in imminent danger. The aim is always to try and save both lives, if possible, even if that might lead to the unintentional or indirect death of the unborn child.

      Sepsis can be difficult to recognize until it's too late. Either way, abortion is not the treatment: the rapid application of antiobiotics is the treatment for sepsis... It might also be noted here that wome also die of sepsis after an abortion. There are many such cases, but the media do not like highlighting them as they disprove the claim that abortion is safe!

      @@m.forrestal5893 I’m a doctor. No, it’s not hard to recognize sepsis. And the case I’m talking about happened as the result of carrying a dead baby, not because of an abortion. And abortion in early pregnancy is safer than continuing a pregnancy to its conclusion, statistically.
      Regardless I’m talking about the woman being allowed to suffer and die. You sound like you’re fine with women dying.

    The outcome of abortion law restriction in Poland. July is the month with the biggest number of births in Poland. In July 2021 (9 months after the law restriction) births have dropped by 15%. February this year had the least births since the 2nd World War.

    as someone living in Turkey, it even surprised me. why do i say like this? Because Turkey is a secular country but turkish people is mostly conservative but abortion did not ban in turkey, or rather there is not high demand in this issue. Europe countries were very liberal in my sight. Yes, conservatives are in every country, i know but even so i'm surprised that the things I heard.

      I believe that in Islam there is a different belief about when a foetus is considered a person, even in secular countries, these kinds of cultural influences matter. Isn't it 5 months or something like that? So abortion isn't seen in the same way because modern Christianity considers that life begins at conception.

If you thought you might not be able to get life saving care, you might avoid getting pregnant at all, which seems to fly in the face of encouraging traditional families like these right wing groups propose. Pregnancy used to be incredibly risky and it seems like people don't realize without access to termination you're taking us right back to time when many women could expect to die.

      Also, just an FYI since you seem to have poor sex education, pregnancy doesn’t occur when a woman spreads her legs. That’s not how babies are made. That would make yoga classes and ballet widely unpopular!

    It should horrify everyone with a conscience that the Catholics have created a “hospice” where they “care” for terminally doomed babies that mothers have been forced to birth, and which have horrific defects, until they die “naturally.” When a pet is sick and in pain, we put it down to end its suffering. It is an act of mercy. These people will not even extend that mercy to a helpless, suffering baby. Instead, they choose to deliberately increase and prolong the suffering of both the mother and child as much as possible. That is how much respect and regard they have for human life. They appear to be dangerous zealots who are acting out their sadomasochistic religious impulses on helpless, dying babies which they treat as ritualistic fetish objects in their perverse theatre of Christ mythology.

    Question 1: If this is partly about preserving the family unit, should divorce be illegal?
    Question 2: If this is about the fetus' human rights, should the fetus have legal guarantees from the father for child support starting at conception?
    Question 3: If this is about the fetus' rights, should governments make it legal for parents to purchase life insurance for the fetus at conception?
    Question 4: Should there be laws around how men engage in reproductive activities with women to ensure that they don't create a fetus (then child) that they can't care for?
    Question 5: Should all religious beliefs be incorporated into government law? If so, which religions and which beliefs get incorporated and which do not?

      @@iblendallday not exactly 50%. All the man does up until birth in this type of situation is provide sperm. It should be up to the woman since she is carrying the child for 9 months, which is very physically taxing on the body and can lead to death.
      Since women risk more, they should have the right to abort at will.

      I like how you bring up to those fundamental questions. I just men don't want to actively participate in pregnancy neither abortion justice for women. Some men are care but I don't see the majority step up yo care about women's pregnancy It's like her problem and her decision to get pregnant. Nonetheless, don't get pregnant at the first place, and don't hope the guy will help you with supporting the child, if men are responsible creatures, there would not be many single mothers, orphans, use protection, and continue to advocate for abortion rights otherwise if women don't fight for themselves, nobody would care about women, leave alone pregnancy. You can't rely on government assistance when abortion is the least issue on their national, city agenda.

    I had no idea abortion was still illegal in Germany. The fact that abortion was legalised in the UK in 1968 just made me automatically assume that everywhere else in western Europe, except for particularly religious countries such as Italy, would have done the same by now. I can understand some of the arguments against abortion, but if a women has been r*ped, or it's medically necessary, then there's no excuse for it to not be an option.

      Abortion is legal in germany until 12 weeks and allowed after that for exceptional cases. The idea that it's illegal is a myth. Look at any map which colors country regarding their legal status of abortion and Germany is always one of the green countries.

      Product? Humans conceived in rape are precisely that: HUMANS, not products! Women who have experienced both rape and abortion are on record as saying that their abortion was more traumatic than the rape, and that while they found healing after the rape, they never got over their abortion. Women also say that choosing life was a victory over their rape, and that their child actually brought them healing and gave them a reason to live. Many people conceived in rape have also gone on to live fulfilling and fruitful lives. They are not their rapist father, neither should they be penalised for his deeds. I mean, seriously, the rapist gets a ten year sentence and the innocent child gets life! Where is the justice in that? And how does abortion change anything? The women you refer to in your comment may still live in poverty afterwards. They may experience more rape, more domestic violence, more incest. Abortion does not change that. It merely adds to their pain and trauma, and often assists the perpetrators of violence, rape and incest in hiding their crimes, as well as possibly coercing their victims into an abortion. Women and their unborn children deserve better! Much better!

    The state should never be allowed to dictate what happens to one's own body. That does not only go way beyond every democratic norms, but also calls in question the democratic state of any country that has similar legislation. Important to note: these countries that are fighting so hard against abortion are taking part in the advertising of abortion in third world countries, they even provide financial background, citing that contraception, and if that fails, abortion is the solution to the poverty in these countries - hypocrisy at its best!

The law admited abortion in cases of rape, mental conditions which would object delivering a baby - not imposed by law, just at the request of the pregnant woman -, of inviable foetus, of any deficiency that the child would carry, if being born, as detected in the foetus.
      Women who would decide to abort in any other conditions, often went to Spain, our neighbour country and take the procedure.

In "very conservative" Russia abortions are legal for more than 60 years without any restrictions. In any region, besides very small Muslim regions, a woman can find a doctor to perform an abortion. From Moscow to Vladivostok, from Saint Petersburg to Novosibirsk...
    I'm absolutely against organ transplantation/organ donation. I'd never give an organ to someone, and I'd never agree to get an organ from another person, BUT I support right to abortion.

    I think that doctors should be able to opt out of doing abortions EXCEPT when the pregnant woman’s life is at stake. I truly don’t understand how they could let that Italian woman die. As I understand it, there was no way that the fetuses were going to make it to term anyway, so why not remove them to save the woman’s life? Even if these doctors were opposed to abortion, how could they be opposed to it in that case? I wonder if her parents can sue those doctors. Sounds like their daughter didn’t have to die.

    The title of this documentary is misleading because it only talks about the situation in a few countries in Europe. In most European countries abortion is regulated by law. Germany, Italy and Poland are not representing the whole continent. It would have been nice if the documentary would have included the implementation of abortion in other European countries where women can get the medical support they need. In some countries a doctor who refuses to do an abortion for whatever reason ( ethical, religious, etc) should refer the woman to another doctor. This is (in some countries) included in the law about abortion. What happened to the Italian woman is just horrible.

      I see your point, it's an excellent documentary focussing on the issues with abortion in Europe, I don't know how I would have named it but sure. However a slightly German centric view makes sense, just like CNN has an American perspective and the BBC puts a British world view forward this is a German public network, so while looking at other parts of Europe too they did focus the documentary on the countries that actually have an issue in the matter. A map might have reconciled you with the documentary mentioning all of Europe, but in general I like that they addressed the issue and weren't like "All well in Sweden!" for the sake of completeness, because that would have detracted from the point they were trying to make about abortion issues.

    People are always complaining about the world being over populated. They ask why do people in poor and wartorn countries have children but when it comes to Europe and other rich countries then they re pro-life. They worry about birth rates decreasing and so on. I wonder if it's really lives that they care about or just the lives of children in western nations.

      Actually, abortion is NOT a "human right"! There is NO right to abortion in any universal human rights document. However, the right to life is recognized as a universal human right. The right of children to medical care before and after birth is recognized, as is the right of pregnant women facing execution not to be killed until after the birth of their unborn child so the child does not share the fate of his/her other. Likewise, the right to freedom of conscience is a universally recognised right.

    It's terrible what happened to that poor woman and it shouldn't have and I don't get why she couldn't had been transferred to another hospital and get the abortion elsewhere and why on earth that hospital had only doctors that are objectors? But if you look at the statistics on paper: Italy is in the average of western European countries on the topic of abortions, which by the way are lower than in US and in eastern Europe. Since 2015 it's been around approx 170-180 abortions to 1000 live borns ratio, and migrants abortion practice is 3 times more than among italian women.

    Isnt it that medical practitioners should know better? Like if a nurse or doctor saw 10 people dying and they have limited resources to help, they have the knowledge which among the ten that they can still save since they cant save them all. And so in this scenario if someone is in danger because of her baby, she has to be saved first. in conclusion the doctor made a tragic decision. If it were true that the woman was in danger because of her fetus inside her womb and not just wanting to get rid of her baby, then the doctor made a serious mistake because it is not their choice which one should live specially if its just a fetus versus the woman who carried the baby.

      Because most people outside of Europe think the entirety of Europe is like Finland. I assume the point of this documentary is bring awareness to countries that are like this. For most of us this is shocking because we consider European countries to be liberal and progressive. While I expected this of Italy, I didn't of Germany and I've been to Germany many times.

    An amazing documentary very well made, thanks once again DW. It would be good to provide more background comparison about the past practice of forced labours to with all of the 'catholic mass burial sites' of unwanted children left to die. Eg in Ireland, and the link to women's mental health suffering. I never visited Ireland.. and I have little respect for anyone who will refuse medical treatment to conscientious, mature, loving, practical women, who already know the gravity and guilt of the situation, they don't need anything other than love, emotionally support and some medical support.'' ... Leave women's bodies to them to decide over... Men have done enough damage to women over the centuries. Considering italy even only very recently decided that even rape us a crime.. they for me are the worse for women sights in euopre.. despite Poland and ireland having or have recently had a total abortion ban.. as they are only following the advice of the italians after all.. down with the patriarchy!!

      @@merovech7 well, for those babies, it is better not to be born at all. Will YOU take care of them? Who's going to replace the loving family? Or is it ok to just create yet another potential criminal? I'm not saying that everyone who grows up in foster care will become criminal, but a good deal of them. Do you realize that the child's life will always be incomplete without a proper family? It'll bring him/her pain and suffering. Likewise, if he/she grows up in a family which did not want the baby, do you think it is going to be any better than foster care? Just because of personal beliefs about what is right and what is wrong, you would be ready to torture at least two human beings for an entire lifetime. How nice is that.

      Unless the mother was coerced, there is no injustice in abortion. If you choose to bring a child into the world, you owe them everything, but no zygote is owed life just by the accident of its conception. If it was, I’d have some terribly tragic news about the fate of trillions of “potential lives” (zygotes) across time. Yet for some reason people only cry when it involves a woman’s uterus and her choice.
