The individual is in our country illegally, and he is not part of "all members of the political community" i.e. citizens who have the right to vote. So why should he fall under our protections? All free peoples should have the right to vote, but they shouldn't vote in countries to which they don't belong to. Same prospect with 2A. Everyone has a right to self defense as a human being, but the protections designed for OUR people should not extend to anyone who is just here by residence, and not participating in our citizen-government agreement. If you stroll into a bank or a school open carrying, do you expect *not* to get arrested and jailed? You *do* have the right to carry a weapon to defend yourself, but if you break established laws while doing so, don't expect things to go your way. This illegal immigrant has the natural right of self defense, but he's breaking numerous laws just by being in the U.S. So why should he enjoy *our* civil protection of his rights if he isn't a US citizen and didn't respect our country enough to enter through the proper methods?

Exactly. When all you see is arbitrary lines separating countries, your perception of citizenship is muddied. They see citizens of the world, not the country. But there's a reason people are flooding here from everywhere else. By keeping an open border and extending the rights of our own citizens to everyone, we lose our core identity and will fall into despotism just like the places these people came from.

    • @lshn8457
      @lshn8457 5 месяцев назад +1

The reason I think those lines are arbitrary, is because we don’t get to choose where we are born. There are objectively richer and poorer parts of the world. These differences are not there just because the people in one country are smarter/ work harder. They are differences created over decades of violence, luck, and resources. When someone today is born into the USA compared to for example Somalia, they are automatically richer and have way more opportunities. This person did nothing to deserve these opportunities, therefore the person in Somalia has equally as much right to come to the USA. Saying that we should protect our borders is crazy if you realise that nobody deserves to live in any specific country.

You have to acknowledge that the people of different regions are intrinsically different and sometimes fundamentally incompatible with a society. It's not happenchance that the USA became the most prosperous country in the world and it cannot be reduced to luck, violence, and resources. There's a core American identity that was created by an industrious, scientifically-driven Christian people. Our governmental and societal institutions reflect that ethos. By having no borders, none of that exists, and it's just chaotic reflections of the infinite number of people that entered. Using your example: If large swaths of Somalians entered, the diasporas they would create would represent Somalia, not anything remotely American. Clause 5 of the U.S. Constitution outlines the qualifications for the presidency, stating that only natural-born citizens or citizens at the time of the Constitution's adoption are eligible for the office. Additionally, candidates must be at least thirty-five years old and have been a resident within the United States for at least fourteen years. These criteria ensure that those who hold the highest office in the nation have a deep connection to and understanding of the country.
Regarding the Second Amendment, it enshrines the right of individuals to keep and bear arms, often considered a fundamental aspect of individual liberty, sometimes described as a God-given or natural right.
While the Constitution does not explicitly address immigration or specific civil rights, it lays the foundation for principles such as equality and due process. The phrase "all men" in constitutional rights has been historically interpreted as inclusive of all individuals, regardless of race, gender, or other factors. Additionally, the preamble, "We the People," signifies the collective will and participation of the citizenry in the formation and governance of the nation.
So, there was no such thing as "Illegal Alien" in the constitution. And a "God Given Right" is a "God Given Right". To defend your person and property. If you commit a crime then you pay what you owe to whom ever you did it too, hence the right to bare arms and defend your pursue of happiness I suppose.

Congratulations, I'm so glad someone is actually using the grey matter that our good Lord gifted us with. I argued with people on another channel where this topic was discussed and I'm appalled at the number of people out there who think that... because 'it's a God-given right', no one should be denied the privilege of arming themselves with a heat stick. Even illegal aliens. But you are so right in your comment, and it's the very thing I was trying to get people to understand, that; if someone is in the US illegally, there's no point in even raising the question if that person can be armed. Because there's basically 2 ways in which to handle an illegal alien... If they commit a crime that requires a court hearing and sentencing, they should be kept in detention until that happens. If they are just caught here for entering illegally and didn't commit a felony, they should get an expedited deportation hearing and immediately deported back to their home country. It's so simple... some people cannot wrap their mind around it. What people also don't understand is that 'rights' are subject to the authority under which we live and operate. If one recognizes and acknowledges their Creator as the one, true God, they will acknowledge that He is the Supreme Authority. He is over all the earthly authority in human government on earth. Humans, because of their devious and carnal nature, often disobey and disregard the Supreme Authority that is over them. One can say all they want that 'bearing arms is a God-given right', and obviously the Founders of this country recognized that and wrote it into the Constitution to protect that right. But try telling that to the citizens of communist countries around the world. They choose, as probably you and I would, to obey their government on this issue so as to stay out of prison or be executed. Whether we're talking about God's kingdom or the governments of earthly nations, there are laws. And in both cases, breaking those laws will result in a denial of privileges. It's that way with citizens. So who comes up with the stupid idea that illegal aliens are exempt from denial of privileges when they break the law. Especially, when they are automatically breaking the law by entering illegally ?

John, your reasoning doesn't hold up to the negative test.
If you claim that our constitution only protects citizens, why do non-citizens enjoy protections of all other rights? (life, unreasonable search, attorney, trial, etc...)
If a non-citizen has a legal protection against being harmed while here, even illegally, why does that same person not enjoy legal protection to defend their life from harm with arms?
A God-given right, arbitrarily restricted by man, is a man-given right... and those can be taken away with a pen stroke.
If a human enjoys the right to life, by extension, they must also enjoy the right to defense as they see fit. This is not a citizen issue. It's a human rights issue. If we cede ground in saying who can and who cannot exercise human rights, when they have shown no reason why that particular right should be restricted, we establish the foundation for future abuses of rights, even for citizens. We're drawing up ever more arbitrary requirements for who gets rights, and who doesn't. And we know where that leads...

This isn't a human issue. It's a legal issue. The American bill of rights only applies to those subject to American jurisdiction, not people on American soil. @@christopherliotta5008 You know for a fact that illegal aliens enjoy all due process rights. They also enjoy the natural right to life. This is not up for debate.
Yet, for some reason, when the right to defend their life comes up, suddenly that's somehow only applicable to Americans on American soil.
If we accept that the right to life, and to defend one's life, are God-given, there is no jurisdiction that can claim to have authority to arbitrarily restrict them.
There is no such thing as "American rights". There are natural rights, and there are legal(civil) rights. All free humans should enjoy all natural rights. Legal(civil) rights are designated only for those who are within the citizenry of the country that created the right by law. The right to keep and bear arms (defend one's life with arms) predates the constitution. The founders agreed that they were recognizing pre-existing rights, and establishing protections for them, but that other rights still existed which were not explicitly mentioned.
A person does not lose their natural rights unless they show, by action, that they cannot be trusted with that particular right. This is why there was a recent court ruling stating that a person convicted of illegal drug possession and use should NOT lose their 2nd amendment protected right. They did no show, by action, to be a violent threat to the rights of others. The same is true in this case. It is consistent.
We either believe in and protect all God-given natural rights, or we play god and decide which special category gets them. The former is the only path of liberty. The latter is a direct road to tyranny.

@@christopherliotta5008 Now are you suggesting that undocumented aliens are not subject to American law? That would be a fine pickle.
As a matter of law, you are incorrect. The Supreme Court has, for some time, made clear that the basic rights enumerated in the constitution apply to "the people," and that includes non-citizens. See:
      Yamatay v. Fisher (1912)
      Bridges v. Wixon (1945)
      Knauff v. Shaughnessy (1950)
      Johnson v. Eisentrager (1950)
Kwon Hai Chew v. Colding (1953)
      Shaughnessee v US (1953)
      Plyler v. Doe (1982)
      Landen v. Plasencia (1982)
      US v. Verdugo-Urquidez (1990)
      Rasul v. Bush (2004)
Specifically, In Matthews v. Diaz (1976): rights apply to "all ‘persons’ within the United States, including aliens, whether their presence here is lawful, unlawful, temporary, or permanent."
Now, they have on multiple occasions noted that such rights are not absolute, and can be weighed against state interest, and that you can, for example, curtail non-citizens 1A rights (e.g., in the case of the PATRIOT Act). Now, if you are looking to diminish the power of the 2A, that would be a great way to get started. You would be wrong to think it would end there.
