Sadly it’s not only the indigenous peoples land. It’s the place they were forced. My great grandmother was forced to walk the Trail of Tears from Alabama to Oklahoma. Her home was Alabama but you won’t see her ancestors getting their land back. At least it’s a start though.

Missouri has started giving back state owned land in some areas to the Osage Nation. ON has also purchased quet a bit a other land on MO. They don't have the protection of land like on OK as MO doesn't recognize separate Indian territory though.

That’s the territory where Indians were driven from all over the county into a permanent “Indian colonization zone.” The history is very muddy and complicated from there, of course, but to act like Chicago and Oklahoma are the same sort of case is a highly disingenuous argument.

He still legally obtained it and Federal Law applies to indian nations and Article I, Section 9, Clause 3 of the us constitution states "No Bill of Attainder or ex post facto Law shall be passed" which means that he legally owns the land. The 5th amendment's "Takings clause" states that: "...nor shall private property be taken for public use, without just compensation..."

Because the SC in McGirt held that the domain over the land the Indians held by Treaty with the US Gov't before his ancestors obtained the land has never been dis-established. So even though he owns the land, it being on Indian Territory the Indian Tribes may end up with domain over it, just like the State of Oklahoma had. They then can tax, regulate him, his business and his property as they like.

@@aycc-nbh7289 Tribal Courts have jurisdiction in civil matters with non-Indians. They do not in most criminal matters. But until McGirt Oklahoma claimed domain over Creek Territory claiming the Tribes domain over the lands had been de-established due to several Gov't activities in the past ( land re-allotment, broken treaties etc). This SC ruling potentially affects the States regulatory authority over Indian land. As the guy noted in 8:48 the Tribes were powerless to get the oil company to clean up the oil spill. They had to rely on the State who did nothing. That could change in the near future. Its only a matter of time before a civil case comes up challenging the States regulatory authority over Indian Territory, and they most surely will point to McGirt as precedent.
My great great uncle, James Ledonia Goad, married a Cherokee / Chickasaw woman, Eliza Mae Leader and they moved from Hopkins Texas to Indian Territory latter half 1800's (Oklahoma not a state yet). Eliza and 8 children were given land allotments and it is recorded on the Dawe's Miitary List. It's their land. US Government/Andrew Jackson stole the Cherokee Lands in NC, GA etc... and marched them on the Trail of Tears and almost 5,000 Cherokee died along the way. This also includes the 4 other tribes marched separately to Indian Territory ! It's their land !

Stitt is part of the tribe. He's a member of the Cherokee nation. The tribe essentially IS in charge, they have reached all levels of gov't. They have the power to influence how the state is run, how it's legislated. They have significant voting power as well to put in office those who would back their desires and ideals.
I worked in Muskogee for quite some time, and during that time I saw many examples of racism, and maltreatment 🤬 Not only against native Americans, but also the black people there. For example: there would be clubs where I'd go up, and they'd say; Are you a member ?? I'd say: No I'm from Iowa, and they'd ask for my I.D. and then say: That's $1 and I'd sign this ledger, and go right on in. I was the one who ended that (at least for a while), as my black, and red friends (not at the same time), but I didn't realize that kept the undesirables (to them) out 😬 Working the night shift for a while, one night after work, we all went to this club, and they'd not let Willie in. They asked: Are you a member ? He said; No !! Then they said: Oh sorry, you have to be a member. He asked: How do I do that ? They said: Do you have a sponsor, and after some squabbling he was going go leave. I told them: I'm his sponsor ✋ Oh I got the dirty eye, but they let him in. I remember him looking at me like I'd just done some amazing thing, but in my mind it was simply the "right" thing to do. I had some amazing native American friends (that's not what they were called then), and a fairly long relationship with a family of friends sister 🥰 I was invited to this dance, called a 49 down by 3 Forks river and actually made a family member of the Cherokee/Choctaw nation !! I didn't get along with everyone, but that was the case with any nationality, as well as my 🏈 team. Some (in my case fortunately most) love you, some are neutral, and some hate you. Regardless I was 1 of them, and so I saw their treatment close up !! Being forced to go to illegal bars, with dirt floors. Where you could literally see teeth in the sawdust 😬 I mean it's just natural to want to hit the bars on weekends, and dance/drink and live it up !! It was just horrible that my adopted families were driven to places like that. In the 80's, just like I'd read about in the 50's and before was mind boggling to me 😢 I still have my connections with my red brothers/sister's, and families: The Tom's and Chucalates in Muskogee, Taft and other cities in Oklahoma !! Finally a VICTORY after all this time, even though my health won't let me return to celebrate this with them 😊☝️🙏💯

100% Support of Native Tribes to be given the respect and resources it deserves. They were slaughtered and denied their ancestral homeland. Return the land to the people that it belongs to. The United States government has violated international law, international sovereignty. Those deeds and documents that show they purchased that land are null-in-void because they were illegally purchased to begin with.

Thank you David Noriega for this report that dared pose the questions that nobody cares to really answer. Points of improvement I observed are in the quality of questions given such as "do you think the tribes can put you out of business", it is a leading question which also does not tackle the balanced or opposing question of "what does it concretely take to create better working relationships moving forward from McGirt?" , and "what improvements in processes are we looking at, that we are not prone so far to consider?". Maybe this can be informative too within a limited time, by also using interviews with transition management and human development experts, NOT only from the 2 opposing parties of tribes and state reps.
There are many more that got off due to McGirt, we had an employee convicted of embezzling tens of thousands of dollars that got his conviction thrown out due to McGirt. It's a much larger problem than this article portrays.

Little do I know of my 1/2 of the culture, because both sides try to denounce I am considered Cherokee. I live a life of somewhat rejected since I can recall. Taught to Stay out of the sun, so I do not get too dark. Relatives, did not like to see me red skinned. I was an INSULT to the Family TREE. The same thing happened to the Mexican population after the signing of the treaty of Hidalgo with Mexico. One of the stipulations of the treaty was that the Mexicans residing in land won by the US were to become American citizens and keep their land. We all know how that worked.
Considering that the history of this continent (at least for the past 500 years) is one of indigenous inhabitants being pushed aside so the earth could be plundered, the Natives are probably going to lose this fight as well. Sadly it’s not only the indigenous peoples land. It’s the place they were forced. My great grandmother was forced to walk the Trail of Tears from Alabama to Oklahoma. Her home was Alabama but you won’t see her ancestors getting their land back. At least it’s a start though.

That’s the territory where Indians were driven from all over the county into a permanent “Indian colonization zone.” The history is very muddy and complicated from there, of course, but to act like Chicago and Oklahoma are the same sort of case is a highly disingenuous argument.

He still legally obtained it and Federal Law applies to indian nations and Article I, Section 9, Clause 3 of the us constitution states "No Bill of Attainder or ex post facto Law shall be passed" which means that he legally owns the land. The 5th amendment's "Takings clause" states that: "...nor shall private property be taken for public use, without just compensation..."

Because the SC in McGirt held that the domain over the land the Indians held by Treaty with the US Gov't before his ancestors obtained the land has never been dis-established. So even though he owns the land, it being on Indian Territory the Indian Tribes may end up with domain over it, just like the State of Oklahoma had. They then can tax, regulate him, his business and his property as they like.

This SC ruling potentially affects the States regulatory authority over Indian land. As the guy noted in 8:48 the Tribes were powerless to get the oil company to clean up the oil spill. They had to rely on the State who did nothing. That could change in the near future. Its only a matter of time before a civil case comes up challenging the States regulatory authority over Indian Territory, and they most surely will point to McGirt as precedent.

My great great uncle, James Ledonia Goad, married a Cherokee / Chickasaw woman, Eliza Mae Leader and they moved from Hopkins Texas to Indian Territory latter half 1800's (Oklahoma not a state yet). Eliza and 8 children were given land allotments and it is recorded on the Dawe's Miitary List. It's their land. US Government/Andrew Jackson stole the Cherokee Lands in NC, GA etc... and marched them on the Trail of Tears and almost 5,000 Cherokee died along the way. This also includes the 4 other tribes marched separately to Indian Territory ! It's their land !

Stitt is part of the tribe. He's a member of the Cherokee nation. The tribe essentially IS in charge, they have reached all levels of gov't. Not only against native Americans, but also the black people there. For example: there would be clubs where I'd go up, and they'd say; Are you a member ?? I'd say: No I'm from Iowa, and they'd ask for my I.D. and then say: That's $1 and I'd sign this ledger, and go right on in. I was the one who ended that (at least for a while), as my black, and red friends (not at the same time), but I didn't realize that kept the undesirables (to them) out 😬
Working the night shift for a while, one night after work, we all went to this club, and they'd not let Willie in. They asked: Are you a member ? He said; No !! Then they said: Oh sorry, you have to be a member. He asked: How do I do that ? They said: Do you have a sponsor, and after some squabbling he was going go leave. I told them: I'm his sponsor ✋ Oh I got the dirty eye, but they let him in. I remember him looking at me like I'd just done some amazing thing, but in my mind it was simply the "right" thing to do. I had some amazing native American friends (that's not what they were called then), and a fairly long relationship with a family of friends sister 🥰 I was invited to this dance, called a 49 down by 3 Forks river and actually made a family member of the Cherokee/Choctaw nation !! I didn't get along with everyone, but that was the case with any nationality, as well as my 🏈 team. Some (in my case fortunately most) love you, some are neutral, and some hate you. Regardless I was 1 of them, and so I saw their treatment close up !! Being forced to go to illegal bars, with dirt floors. Where you could literally see teeth in the sawdust 😬 I mean it's just natural to want to hit the bars on weekends, and dance/drink and live it up !! It was just horrible that my adopted families were driven to places like that. In the 80's, just like I'd read about in the 50's and before was mind boggling to me 😢 I still have my connections with my red brothers/sister's, and families: The Tom's and Chucalates in Muskogee, Taft and other cities in Oklahoma !! Finally a VICTORY after all this time, even though my health won't let me return to celebrate this with them 😊☝️🙏💯

We're now in a relatively more peaceful era and the natives are within their right to wage lawfare against their assailants who violated their right to sovereignty. The line is drawn where they should have always been according to the agreements that were made over a century ago. If that means other native tribes will be able to swallow up large swaths of land that they legally should have always owned according to treaties signed and agreed to by the US government... well then that's exactly what it means.

Points of improvement I observed are in the quality of questions given such as "do you think the tribes can put you out of business", it is a leading question which also does not tackle the balanced or opposing question of "what does it concretely take to create better working relationships moving forward from McGirt?" , and "what improvements in processes are we looking at, that we are not prone so far to consider?". Maybe this can be informative too within a limited time, by also using interviews with transition management and human development experts, NOT only from the 2 opposing parties of tribes and state reps.

The US didn't steal Oklahoma form the Indians. We bought as part of the Louisiana Purchase. It was taken under eminent domain and the tribes were paid.

The same thing happened to the Mexican population after the signing of the treaty of Hidalgo with Mexico. One of the stipulations of the treaty was that the Mexicans residing in land won by the US were to become American citizens and keep their land. We all know how that worked.
Considering that the history of this continent (at least for the past 500 years) is one of indigenous inhabitants being pushed aside so the earth could be plundered, the Natives are probably going to lose this fight as well.
