    As a general legal principle the police are not permitted to break the law in order to enforce the law.
    There are some exceptions for specific instances.
    (The police can speed and park almost anywhere to react to a crime being committed such as theft, violence and robbery etc)
    But this is not one of them.
    ......
    As an example ... a traffic warden who is a civilian employee cannot park his vehicle on yellow lines in order to park up while giving you a ticket for doing exactly the same thing.
    That is why they drive around in twos, 1 jumps out to give you the ticket while the other drives around the block looking for the next victim,
    (Oops... I should have said offender)
    So the police can break simple traffic laws when reacting to a crime but they cannot do this when a crime has not yet been witnessed or reported.
    A policeman driving above the speed limit without his blue lights on is committing an offence and can be prosecuted.
    A policeman driving under blue lights and speeding when NOT engaged in an emergency response is also committing an offence and can be prosecuted.
    ......
    In this situation this guy is not breaking the law while 'REACTING' to a crime that has been committed but actually sitting there breaking the law while 'WAITING' for one to be committed.
    The main point here though is that he Is NOT the police but a civilian employee who is NOT exempt but he is working for the very people who are empowered with the authority to prosecute his behaviour.
    .........
    It is almost impossible to hold these people to account as you would need someone from the authorities prepared to prosecute their own staff.
    And they are the ones who have briefed him on how to conduct himself anyway.
    ........
    Same old story, who do you get to govern the governors.

      It is the vehicle that is exempt, not the occupant.
      All Traffic Regulation Orders allow liveried police, fire and ambulance vehicles to park where other vehicles are prohibited. In the case of the fire brigade and ambulance service, the vehicle must be attending an emergency, however marked police vehicles can park in otherwise prohibited places under any circumstances."

      Just one point in your answer, yes a constable has extended powers under the road traffic act, so is not actually breaking the law, in order to enforce the law. But a civilian speed camera operator has no such powers. And in fact, should that civilian be operating a police marked vehicle? Almost a deception fooling the public into thinking a police constable is present if required in an emergency?

    • @robg521
      @robg521 Год назад +1

      @@philgreen815
      Yep, totally agree with you but it has since been pointed out to me that in this situation the police authority is allocated to the vehicle and not necessarily the actual user of the vehicle.
      So the van can be parked anywhere [within reason] because it is a designated police vehicle, and the fact that the person in it is a civilian engaged in police business is after the fact.
      [As usual …… ‘do as we say, and not as we do’ because we are exempt from the law and you are not.]

      Too right, mate! Couldn't agree more! They keep telling us that the traffic accident rate has fallen. Really? What's the old saying: "Seeing is Believing" really mean? Are we as a nation really that gullible or that the ordinary man in the street really that stupid? They try to convince us that this approach is working while in reality, their coffers swelled immeasurably! Meanwhile, violent crimes remain on the rise, and the coppers are finding it too hard to keep that under control even though they're trained for that. (It doesn't take a degree in advanced Physics to work that out!) So instead, it's just easy money from targeting "soft" targets like motorists instead of tackling the real issue of the ever-increasing violent crimes prevalent in our towns and cities. At the end of the day, it's all about the money, right? Enough said!

      It isn't a case of being above the law, it is a police vehicle with a recognised legal exemption, just like a police officer carrying a loaded handgun has and you don't:
      The spokesperson said: "The relevant legislation, allowing enforcement to take place at the site, is under 'The City of Plymouth (Traffic Regulations and Parking Places) (Consolidation) Order 2004'.
      "Part H of that Order lists 'Exemptions from Prohibitions and Restrictions' in which is included 'Exemptions for Emergency Services'.
      "Within this section of the Order it states: 'Nothing in this Order shall apply to any vehicle on an occasion when it is being used for fire brigade, ambulance or police purposes, if the observance of that provision would be likely to hinder the use of that vehicle for the purpose for which it is being used on that occasion'.

    This is being taught at police college this year - 2019
    Care and attention to parking restrictions should be observed and complied with. There will be exceptions where parking a police vehicle contrary to parking regulations or restrictions is required and necessary to deal with incidents, including scenes of collisions. There can be no legitimate excuse for ignoring restrictions unless it can be justified. Inconsiderate or illegal parking of police vehicles may result in negative press reporting and may adversely affect public perceptions. Where an officer or staff member receives notice of enforcement for breach of any such regulation or restriction, they must take personal responsibility for the outcome unless they are able to justify their actions.

    Firstly it IS an offence to park on the single line...not exempt...silly comment to say he is. A Traffic Officer would view it differently. Blue light on top of vehicle? And Police words? That is a response vehicle....question! What permit does this driver hold...certainly not a class 5nor a 2 or 1. With that Laser device why is he operating it in the rain...Laser deflects through rain and can give erroneous readings. Little wonder the Traffic Officers are fed up getting all the Flack when these individuals do not comply with the Laws themselves. Very much like PCSOs who drive Police Vehicles. A few years ago even a Police Officer could not get behind a Police vehicle until after 2 years. How the job has gone down the pan. I hope that speed limit was 30mph, if it were 40 or above with the vehicle facing oncoming traffic it is an offence even today!!

    • @Only_Fools_and_Audits
      @Only_Fools_and_Audits 6 лет назад +1

      The above vehicle is driven only A to B, so the driver requires no response training or special permit.
      The laser simply returns an Error 1 if the rain is too heavy, or works perfectly if the rain is light enough to allow the laser out/back.
      The above is exempt under local authority TRO's.

    However you dress up the rights and wrongs of camera vans, it is undeniable that they prey on easy targets: the generally law-abiding motorist. What about drunk-drivers; drivers on drugs; stolen cars; cars with no tax, insurance, MOT; disqualified drivers; drivers with a shotgun on the back seat and any other case you can mention? They dress it up as all about 'safety' when it is so obviously a revenue generator. If it truly were about safety then surely all the circumstances I've mentioned would constitute a higher risk to 'safety', but these camera vans have no interest in those as these would be too difficult to deal with. The public are being brainwashed into believing their primary motivation is safety with all their branding, but the truth is very different. Is it a mere coincidence that since the fines have just been increased that there seems to be many more camera vans out and cops with radar guns? Surely they are not seeing that as a way to generate even more money, are they? The truth is speed is rarely the cause of traffic collisions but we are all told 'speed kills' in an attempt to justify their 'safety' revenue generation and brainwash the susceptible.

    • @Only_Fools_and_Audits
      @Only_Fools_and_Audits 7 лет назад +1

      You are completely misinformed, speed enforcement isn't about stopping collisions, that wouldn't be a realistic expectation whilst human beings are in control of moving metal boxes. Speed enforcement is about reducing physical trauma WHEN a collision takes place.
      Equally they are staffed by police staff so regular officers can focus on other duties such as drunk driving.
      'Speed Kills' simply means hit something fast enough and death will result. How is that not accurate?

    • @BigToeCrypto
      @BigToeCrypto 7 лет назад +14

      Dude, your point of view is intriguing but fundamentally flawed. We are told 'speed kills' and speed enforcement is a preventative measure and required for safety. Speed does not kill any more than guns, knives, flying or running for example. They can all kill in the wrong hands. The 'speed kills' campaign is essentially propaganda designed to make speed enforcement and therefore revenue generation, more publicly acceptable. Being told it is safe to drive at 79mph on a motorway but unsafe at 81mph regardless of car, age of driver, skill level of driver, reaction speed of driver, road conditions etc is ludicrous. It is akin to saying Lewis Hamilton driving at 81mph in a £200,000 Ferrari is less safe than a 95 year old driving a 25 year old Vauxhall Chevette, borderline MOT at 79mph. Pre-supposing a collision WILL happen and arguing the higher the speed, the more likelihood of death is flawed reasoning. It is all about money, my friend. The world is run by the banks and people should not be brainwashed by this pro speed-enforcement rhetoric. Do you really think the government is bothered how many road deaths there are each year? Well, they're not. You and I are here to make them money while we are alive.

    • @Only_Fools_and_Audits
      @Only_Fools_and_Audits 7 лет назад +3

      You simply don't understand, you read far too much into a simple campaign slogan. 'Speed Kills' is the same as 'Clunk-Click', in that it encapsulates in two words the essence of the underlying message = hit something or someone fast enough and death will result. It clearly doesn't infer that by itself, speed will result in death (g-force acceleration not withstanding).
      Speed enforcement isn't a preventative measure, nor is it 'required' for safety, it is just to encourage motorists to observe the posted thresholds, so that when a collision takes place, physical trauma is minimised.
      You also appear to confuse the cause of a collision with the cause of death, they are two separate elements of a fatal crash. Speed is the determining factor of how much inertia requires dissipating, the faster the impact speed, the more energy is involved.
      There is no reason to pre-suppose a collision will take place, they do every single day without fail.
      Every year, speed enforcement in the UK generates a figure somewhere around £100m. However, as a country we pay the equivalent of that to the EU every two days, plus in 2016 we spent 13.3bn in overseas aid and these are but two of the countless conduits where money haemorrhages from The Treasury . So in the scheme of things, speed enforcement makes peanuts, a mere egg cup's worth from an Olympic sized swimming pool.
      In addition, few people have the slightest idea how it works and never consider the follow-on processes, systems and manpower that must exist post-offence detection and what it costs to operate.
      First of all, there will be those engaged in the manual detections, so however many enforcement officers (often van and motorcycle based). Then those in the viewing team who have to physically go through every offence from manual and static cameras, interrogate DVLA and produce the initial file. Next, there is an admin team who deals with all the incoming/outgoing mail, printing, telephone calls, emails and scanning each bit of associated correspondence to the database. They deal with around 10,000-15,000 bits of individual mail every week.
      Then there’s a prosecutions team who deal with those cases that end up in court. There will also be team leaders and unit manager, totalling around 50 people, some working overtime. So there’s £115-£120k in wages every four weeks just for starters.
      On top of that there’s a very hefty stationery and postage bill to meet, electricity and telephony costs. There’s then the ongoing HADECS/SPECS, RedSpeed and software contracts, vehicle fuel and servicing costs, plus speedmeter calibration and ancillary repairs and all kinds of ad-hoc purchasing costs such as recording media. If a camera is criminally damaged, then that can add another £10-£20k.
      In total this all adds to anything up to £140k every monthly period for just one constabulary (yes, sizes vary, but the larger the operation, the greater the running costs). Your average person never factors any of the above into their view of speed enforcement.
      So yes, there is a financial element, but simply the demanded public service of speed enforcement could not be supplied without a self-funded mechanism in place, as all central govt funding ceased in 2011.

    • @BigToeCrypto
      @BigToeCrypto 7 лет назад +5

      An enlightening amount of detail there. However, what you have overlooked is the 'employment' of each and every operative in speed detection 'services' is paid a salary on which they pay income tax. They then buy goods and services on which they pay VAT. Then they pay council tax, then road fund license for their car/s, then their TV license, then fuel for their cars, then...... Need I go on? The government raise money from easy targets - the motorist, to fund an operation on which they receive an exponential magnitude of their initial outlay and guess what, they actually have had no outlay to fund it. Don't you see? Brilliant isn't it? It is like fractional reserve banking. All designed to make money from the public. The only thing backing money is the fruits of mine and your labour; nothing else. Whilst speed enforcement may not make a great deal of money directly, the exponential magnitude is unquantifiable. As I said, It is all about revenue generation despite your argument to the contrary.

    • @Only_Fools_and_Audits
      @Only_Fools_and_Audits 7 лет назад +1

      Yes, you need to go on, because the amount of money earned by the comparatively microscopic number of people you cite, is minuscule. You base your argument on the income of just a few hundred people, so think it through = more peanuts. Equally, the money that is generated isn't 'the government's', it goes in to The Consolidated Fund = public purse. Your argument holds no water due to the inconsequential sums of money involved from the sources you mention.
      In 2011, central government withdrew funding for speed enforcement. meaning the majority of static cameras were switched off and partnerships folded. There was no way of knowing if speed enforcement could/would continue = not the actions of an organisation intent on making money. Central government have no control over speed enforcement, each constabulary cobbles it together themselves and many barely break even.
      You clearly do not understand how this works.

    They can park where they want apparantly - however as they are supposed to be there for the safety of the public, parking as to cause cars to enter oncoming traffic is actually endangering the public - also I would assume that the exemption is there to allow the police to carry out the work they have to do when they have to park where they can - the police speed vehicle has a choice of where to park and its not an emergency situation - As usual one rule for them and one for everbody else - Just goes to prove its all about revenue !

      You simply don't understand bernie.
      The kit in use has an operational range of 1000m/1km and the road is magnified because it's being viewed through a powerful optic, so speeds are measured, displayed and recorded in 0.3sec before the foot has moved from the throttle to the brake. The greater the view the operator has of the carriageway, the less opportunity a vehicle has of being slowed before detection.
      Not on an emergency? No he isn't, he doesn't have to be, the exemption refers to vehicles being used for police purposes - so yes, of course it is different, the local authority TRO for the road specifies this. You don't have highlight that the rules are different, no-one is attempting to deny it.
      He cannot break the law if there is a legal exemption written in.

      Also the manufacturers of the machine in the handbook state that in order to guarantee accuracy the laser should have several checks carried out before and after use - This would include a sighting check carried out against a target at a known distance this is a bulls eye painted onto a wall at the police station with a distance mark painted on the floor- The laser should also be calibrated against a moving vehicle with a guaranteed calibrated speedometer - also in order to guarantee accuracy the laser must be aimed at a flat area of the vehicle again the manufacturer recommends the numberplate or the headlight - if it were to be aimed at a sloping part of the vehicle it would be impossible for the computer to work out the speed unless it knew the specific angle of the area it was pointed -
      I have used lasers for over 30 years and any readings they give are worthless unless properly used and calibrated - The police however state that the manufacturers instructions are merely guide lines and that they dont have to carry them out - the only one they are guaranteed to do is the yearly manufacturers calibration at the factory -
      I recently went to court on a speeding charge at allegedly 4mph over the speed limit - The police provided no witness - the photo evidence was handed to me 10 mins before appearing in court ( supposed to be handed over 7 days prior so you can evaluate and seek council) and could provide no evidence of calibration to the laser - I was still found guillty - The police and magistrates make it up as they go along they havnt a clue about using a laser correctly other than a short training course on it - I certainly understand how laser work and also how to correctly calibrate and use one - Why dont the police ?
      Its all about revenue if you believe anything else you are naive in the extreme - if it was about road safety why dont they repair the potholes in the roads that cause so many accidents and deaths every year ?

      How can they park illegally at a sanctioned, surveyed enforcement site that has a recognised local authority TRO exemption? Please be specific.
      Every local authority provides an exemption for police fleet vehicles being used for police purposes. There is no requirement for them to be attending an emergency.
      The above is Looseleigh Lane. Page 40 of relevant Traffic Regulation Order that covers this particular road states:
      EXEMPTIONS FROM PROHIBITIONS AND RESTRICTIONS
      EXEMPTIONS FOR EMERGENCY SERVICES
      51. 1) Nothing in this Order shall apply to any vehicle on an occasion when it is being used
      for fire brigade, ambulance or police purposes, if the observance of that provision would be likely to hinder the use of that vehicle for the purpose for which it is being used on that occasion.
      The above is EXEMPT from any parking restrictions whilst engaged in constabulary business.

    One is allowed to park on single yellows at times of operation.
    The lampost beside the speed van does seem to display a sign which no doubt will have times for parking stated.
    Double yellows are a straight no parking offence but still in certain circumstances and areas they too may have times for parking.
    I think crusaders with phones need to do research about this before entering uncharted territory.

    They can technically park anywhere for ‘police purposes’ under the same legislation that allows emergency service vehicles to stop in what would be otherwise considered a dangerous area. You may also be able to consider it a form of traffic calming measure, as people tend to be aware of a fluorescent van and slow down to allow traffic opposite to pass.
    Seeing as how these are civilians operating it though, and very rarely officers, let alone retired ones (retired officers either stay retired or come back into teaching roles. These jobs are cheap and easily hireable) it’s still a very sneaky tactic

    As much as I don’t like the stupid speed vans. Leave the man alone and let him do his job. I mean what does it have to do with you if it’s pared there anyway it doesn’t affect you. If it is wrong for him to be parked, then if the traffic warden sees him he then may get a fine. But it’s not for you to do what you’re doing. Really really gets my back up when people of the public interfere with Peoples jobs. If that van said ambulance on the side you went say a thing, if that van said anything else you wouldn’t nothing. You’re only pestering that man because the van says police. It really isn’t your job to tell him if he’s in the right or the wrong if you have a issue should contact the police station or inform the council and if it’s an offence they will do what is necessary.

    • @morgz84
      @morgz84 5 лет назад

      Why exceed 30 mph? It's not hard to stick to. I put my foot down on rural roads and motorways, but the risks of speeding in a 30, far outweigh the tiny benefit in journey time. Your reply to "Great Stuff" was unnecessarily aggressive!
      There was a time when I used to frantically flash my lights to alert oncoming drivers, but the number who either don't notice or ignore me made me think perhaps it's a good thing the police are trying to catch these inattentive halfwits. It's the same said halfwits who are up my arse whenever I DARE to observe the speed limit. Now I don't bother to warn anyone, of speed vans and even if it's a friend or family member, I am usually glad they have been caught.
      The only place cameras annoy me is on fast dual carriageways or motorways. But generally, if you put your foot down in more appropriate places, you are unlikely to be prosecuted.
