You should be able to take them back to court and sue them for everything they cost you, since there is now precedent set by a higher court. Good on Shelby for slapping Denice down. (Also, she DEFINITELY did not create or design that car)
That's not how a settlement works. And anyway, all this shows is why you shouldn't give in to over-reaching beeeeyatches and make them prove their case in court when you know you're in the right. Yeah, it's pretty widely known the Eleanor body kit was designed by a man known as Chip Foose. I don't know if he was working for her when he designed it. If not, their claims become even sketchier.

It's not like Christine/Herbie where it at least acts on its own with some degree of sentience which you could actually argue makes it a "character" its just a car that they gave a nickname to in a movie.

Shelby had drive. When he was looking for funding for the original Cobra cars, he had only built one (1) car. Before each event he would repaint it so people thought they were already being produced. DRIVE!

I think Donut did a pretty good job explaining the situation with Halicki's business model, being a "license troll" firm, they obtained the license for the character of "Elanor" from the movie and then went around with the accuracy of a blindfolded skeet shooter trying to sue anyone with a silver Mustang with black racing stripes. Your theory is not far off and I hope to see more from your shop in the future.

Dude! I am so excited for this! As a car kid I loved that car Nick Cage drove, but was too young to know it’s full Shelby heritage. It started my love of classic cars. Then I saw a real GT500 on an auction and realized that the Shelby design was amazing & timeless. Something I’m not sure that could be said about the movie car.
The ending portion of this video is plainly and simply an epic win. I could see the virtual flipping of the bird in the direction of one single person. Just awesome, and very well played. Good on you sir.

Its so unfortunate that the Halicki team has spent years going out of their way to really destroy people's love for Eleanor. I always wanted one ever since I first saw the 2000 film. And I genuinely believe the vast majority of people just wanted to have a piece of that iconic Shelby Mustang history. I'm glad the right side came out on top on this and justice was eventually served. Although, it NEVER should've reached that point. Congrats for the win.

Such an awesome video. You're definitely going in the right direction honoring and giving all praise to Carroll Shelby with this new build. Thanks for explaining all the intricacies of the legal case. I also wasn't aware of how similar the G500 was to the E even though I am a huge Mustang fan. Also, the Gt500 wasn't the first choice for the hero car in the movie. It was a Ford GT or GT40. It was because of parts availability and cost.

It's funny how people can be doing so well in life and then they just keep wanting more and more and it's never enough so they start going after what they probably consider the little guys, honestly I think having thousands of people building replica cars from your movie is a verry good thing and just brings more attention to the movie and everyone involved. The Eleanor car was always my favorite movie car and like pretty much everyone who has seen the movie I always wanted one. Not anymore I wouldn't want to do anything that could help bring any attention to anything she's involved in.

In the Nicolas Cage movie "Gone In 60 Seconds" His character refers to the 1967 Shelby GT500 as Eleanor. And he says "The 1967 Shelby GT500" a few times. In the original "Gone In 60 Seconds" from 1974, they refer to a 1970 Mustang as Eleanor. So, I was always confused from the lawsuit to begin with, since those are totally different cars anyway.

I was saying this when this kicked off: in the pursuit of exclusivity Heliki excluded the fans. I'm happy that the courts finally gave a crap and stopped her from doing this to even more people. From what I've heard from other sources that was her MO of bullying builders with huge legal fees and "precedent." And much like the bully trope she decided to pick a fight with someone who was willing to fight back.

Chris, I think some of this story starts in the '90s- Foose had built the car, the movie went bang, and Chip had entered a deal with Unique Motorcars, of Dallas, Texas- mostly a kit car builder to that time. That all got shut down, and in the aftermath Foose's lawyers (his wife, I suspect) tried to get the court to release the already built cars, got denied, with no public explanation. This lady has been pushing and shoving on this for a while- Good on Ya' for helping her get hers! FR

This suit comes from the remake, where they negotiated with the studio for the use of “Eleanor” name and gone in 60 secs franchise rights, hence the GT500 thing.

Nah, he wants it to be a daily driver that exhibits his skills and creativity. It is a car he wants to be proud of. Calling it Hellinor would be forever pasting all the B.S. and frustration he has had to go through into his new car. I wouldn’t want that sour taste in my mouth every time I get in my car to go somewhere. It is better to close the door and forever leave Elenor in the past.

Denise almost single handedly destroyed the ambition and dreams for my entire generation of car lovers. I remember in high school writing whole book reports dedicated to Elanor, and every car guy I know loved that car too...and then they pulled all these lawsuits and overnight I and everyone else I know suddenly hated it. I'm so happy the courts got this right in an almost timely manner. The car I used to fall asleep dreaming about isn't gone.

Dude! I am so excited for this! As a car kid I loved that car Nick Cage drove, but was too young to know it’s full Shelby heritage. It started my love of classic cars. Then I saw a real GT500 on an auction and realized that the Shelby design was amazing & timeless. Something I’m not sure that could be said about the movie car.

Its so unfortunate that the Halicki team has spent years going out of their way to really destroy people's love for Eleanor. I always wanted one ever since I first saw the 2000 film. And I genuinely believe the vast majority of people just wanted to have a piece of that iconic Shelby Mustang history.
I'm glad the right side came out on top on this and justice was eventually served. Although, it NEVER should've reached that point. Congrats for the win.

The original film “Gone in Sixty Seconds” did feature an Eleanor, as a 71/73 Mustang Mach 1. That Eleanor was even credited like any other character and actor in a film.

Such an awesome video. You're definitely going in the right direction honoring and giving all praise to Carroll Shelby with this new build. Thanks for explaining all the intricacies of the legal case. I also wasn't aware of how similar the G500 was to the E even though I am a huge Mustang fan. Also, the Gt500 wasn't the first choice for the hero car in the movie. It was a Ford GT or GT40. It was because of parts availability and cost.
After hearing your thoughts on all of the players involved in the saga, and then hearing your final plans on the topic warmed my crusty 'ol soul!

It's funny how people can be doing so well in life and then they just keep wanting more and more and it's never enough so they start going after what they probably consider the little guys, honestly I think having thousands of people building replica cars from your movie is a verry good thing and just brings more attention to the movie and everyone involved. The Eleanor car was always my favorite movie car and like pretty much everyone who has seen the movie I always wanted one. Not anymore I wouldn't want to do anything that could help bring any attention to anything she's involved in.

In the Nicolas Cage movie "Gone In 60 Seconds" His character refers to the 1967 Shelby GT500 as Eleanor. And he says "The 1967 Shelby GT500" a few times.
In the original "Gone In 60 Seconds" from 1974, they refer to a 1970 Mustang as Eleanor. So, I was always confused from the lawsuit to begin with, since those are totally different cars anyway.

This story is quite compelling, seeing the lengths that people with a severe lack of understanding of somebody else's life and work will go to just to make a fast buck. Great video, still think you should get your car back (slap suit of your own) hopefully that is something you can and do pursue. Not for retribution but enforce the fact this was never okay and hopefully prevent it from being done to others. Awesome that you are doing a tribute build to Shelby, definitely an icon and one of my personal heroes.

I’d say that a Eleanor is a Shelby GT 500, but a Shelby GT500 is not Eleanor. Two different concepts entirely. Glad they figured it out!

I was saying this when this kicked off: in the pursuit of exclusivity Heliki excluded the fans. I'm happy that the courts finally gave a crap and stopped her from doing this to even more people. From what I've heard from other sources that was her MO of bullying builders with huge legal fees and "precedent." And much like the bully trope she decided to pick a fight with someone who was willing to fight back.

Chris, I think some of this story starts in the '90s- Foose had built the car, the movie went bang, and Chip had entered a deal with Unique Motorcars, of Dallas, Texas- mostly a kit car builder to that time. That all got shut down, and in the aftermath Foose's lawyers (his wife, I suspect) tried to get the court to release the already built cars, got denied, with no public explanation. This lady has been pushing and shoving on this for a while- Good on Ya' for helping her get hers! FR

This suit comes from the remake, where they negotiated with the studio for the use of “Eleanor” name and gone in 60 secs franchise rights, hence the GT500 thing.

Calling it Hellinor would be forever pasting all the B.S. and frustration he has had to go through into his new car. Denise almost single handedly destroyed the ambition and dreams for my entire generation of car lovers. I remember in high school writing whole book reports dedicated to Elanor, and every car guy I know loved that car too...and then they pulled all these lawsuits and overnight I and everyone else I know suddenly hated it. I'm so happy the courts got this right in an almost timely manner. The car I used to fall asleep dreaming about isn't gone.

Beautifully said, I'm sorry you had all that aggravation, I'd love to look at a case she won and compare the legal fees she claimed against the quality of their work, it seems like they got the cheapest lawyers who can't spell and can't fact check which would make this is "legal fee scam".
