I find it so strange that tennants under that system are responsible for finding the next tennant before they can get their deposit back. It seems like such an unfair thing to ask a tennant for something that is the landlord's fault. I hope it all works out for you!
I asked my wife about this. The reason why she needs to find a next tenant is because the house owner invested the money into something else. For that reason she cannot give the money back, instead of there is a next tenant who basically is paying the money to Rachel. So it is not solving the problem, it is passing it on the next one. What I think the best thing to do is, just buying the house completely from the house owner and then remove the construction and sell it again. She will lose a lot of money, but less then what she is at risk of losing now.
@@Johanneslol11 I'm just wondering but, isn't the money you give to the landlord suppose to be for x amount of time? In that case can't one wait for the time to run out and then move out?
Isn't the owner liable for this since they are responsible for illegally expanding, thus the renter is no longer obligated? She should be able to sue for the money and move out. But that's a USA style of thinking. I don't know how corrupt the laws are in Korea.
@@namename-ph7bg it is for a time but if you do this type of renting they expect you ti be there for a longer time. Also you need to find the next tenant. There is a reason why this type of renting is getting less populair in Korea. There are huge risks involved.

You should contact a real estate attorney. The unit owner created the non conforming use and there should be recourse agonist the company. The fact that the owner is a company and not an individual is not a problem, because the company has an asset (the apartment) against which you can collect a judgment. The lawyer will be able to bring a ouch pressure to force the unit owner (company) to agree to some fair resolution. Finally, you could tear out the drywall and illegal construction, and then ask for an inspection from the building authority, to declare the property is conforming. You can then sue the owner for your costs to remove the nonconforming construction.

it seems that if she did any big construction in the apartment she will lose X amount of her money ,that part of her lease contract,so if the owner are not willing to cooperate and make an exception she not be gettihng her full deposit money back
Illegal construction.. expansion.. should not be the tenants responsibility. I would do two things that would hopefully help. First I assume there is a buildings department we might want to reach out to them to find out if permits were filed and if the building is up to code. Next would be to get a lawyer.. demanded that the entity correct the situation or refund you your money.
If none of that is satisfactory maybe contact the media. This is a lot of money and I’m sure it’s a bit of a scam that you shouldn’t know way to be responsible for.
Your land lady was taking advantage of you since the beginning, there is no way she didn't know about the illegal construction thing and that she could keep the money if anything happened. I feel so angry and so sorry that this happened to you. Find a lawyer asap, best of luck!
She said the laws had changed and they weren't aware of it. I've been caught with fines because the law was changed, and we weren't made aware of it. It's always your fault for not knowing all the laws.
Have you already asked for legal advice since it's a contract-related problem? Maybe there's some way they could help you especially I think the lessor didn't inform you beforehand the signing of the contract about the illegal structure in that building.

You need to find a lawyer and bring this to court and since you signed a contract, I’d review EVERYTHING in there and work it out with the lawyer.

I'm curious, is it a possibility to reverse the illegal structure back to legal structure by tearing down the room back into a balcony? If it's possible would hiring people be too expensive and would the expense land on you or the "company"? And what is the Korean word for illegal structure to look out for?
The value of the apartment would drop, so she wouldn't get her $300k back. Though, it would mean she would get something back.

My background is in structural engineering. Did you know that realtors make 10X the amount that an engineer makes just by reselling an existing property multiple times? I could take a look at the building and see if it meets the NDS and IBC codes and write the legal documents proving it or upgrading it -- but I am only in Canada...
Wait, since it was in the renewing contract to get the insurance... if the insurance got rejected because of the illegal construction they made... wouldn't the renewing contract get canceled? Therefore, she should give you your money back without having to find a new tenant?

I hope Korea passes a law preventing jeonse system if they aren't able to qualify for the insurance or most list why they don't qualify for the insurance.I hope this gets worked out sooner and later for your peace of mind.

Please be strong. The worst thing you can do is fall deeper into depression.
You can blame yourself for not being more careful but that doesn’t help the situation.
Got to keep moving forward no matter how hard. Losing a phuck ton of money stings horribly but use that pain. Make it propel you forward. And this video is basically a “don’t do what I did” warning you us which shows you are of good character (not that we didn’t know that already).
You might be stuck but I don’t think you will be stuck forever.
Please believe that. And no matter how hard some days might be, know that your subscribers are cheering for you. It might take time and it will hurt financially but you will get through this somehow.

Just had to inquire, since I live under the American Judicial System! Just based on what you said, I see potential issues that could be raised based on the facts you mentioned, like the validity of the contract, based on the following issues (i.e notice, disclosure, assumption of risk, fraud, etc). However, if Korean property and contract law protects the landlord, where the renter, or buyer totally assumes the risk, regardless of these kinds of issues, than maybe there’s no recourse! Just interested, since I think like a lawyer! Take Care!

You have a good case for a lawsuit. Sue the landlord for fraud. None of this is your fault.
Hi Rachel! I'm sorry that this has happened to you in spite of your carefulness. But don't give up until you have explored all possible solutions. For this, you need a good lawyer or legal advice. There are many ways of going out of a contract. One has to find the proper legal base. I'll pray for you in the meantime.

You may now consider that you are currently paying month rent for this place.
Calculate how many months or years for the amount that you have paid in relation to as a month rental apartment? Once you know how many months/years the money that you have paid for then just stay at least till then. With this, you do not consider losing your money, just that you has converted the money spend as month rental apartment cost.
Maybe then you would have found a way to tackle this situation. Law may changed then, or maybe the landlord got to his/her self concise and return some/full amount back to you when he/she gotten profit from their investment...
Just forget this for the time being and live your life happily and to the fullest. Take care and stay safe always.

In the US we would of sued the owner for fraud. Can you rent out your current apartment or turn it into a short term rental?
Oof, what an awful situation! My thoughts are 1) talk to a real estate lawyer about options (seems fraudulent of landlord to not tell you about illegal extension at purchase), and 2) what are the possibilities for removing the 'illegally extended' label . . . can you hire a contractor to refurbish the space so it is no longer 'illegal'?

I hope that you make it through your predicament. One question I have is this. When laws change is there no such thing as a grandfather clause in the insurance? I moved out of my house and bought a boat. That's when everything went wrong. Ha Ha. Although things looked bleak a lot of very good people helped me out beyond belief. Since part of the problem is that the law changed perhaps you should contact the office of your local legislator who voted on that change. They might have a way to help those in this situation.

Jeez. Never heard of a balcony being converted to a closet. Sounds like a very difficult, unfair stretch of time at that apartment with the upstairs neighbor, cost, contracts, COVID. Meditation, chicken and beer are called for.

That sounds like a tough situation, for sure. Good luck finding a resolution to it.
In the US you might well have grounds for a lawsuit, if the property owner knew (or should have known) that they had modified the property in a way which would make it uninsurable - especially if they knew that and then signed a contract which required insurance. But then again, I can't imagine a situation in which a US landlord would demand that their _dissatisfied tenants_ should be responsible for finding new occupants for their property.

A good house here can cost maybe 120,000 or 180,000, you can pay more but you'd get the same if you look around, and there's a lot here - hell I wish I loved in a house, little garden, you know...

Check do scheam giving you access to land when building is place ... if so SUE them for criminal activities including land register and this will breach also other tenants contract so prosecutor will need investigate other ppl in same building make multiple cases from this .
I don’t know how her building insurance permitted that situation because in general you’re building insurance only ensures approve structures so if a fire started in your apartment and burnt the whole building down they wouldn’t want to pay at all. I would think it would be criminal to lease an apartment in an unapproved structure that would be in adequately insured for fire and other hazards. She should give back the money so her insurance doesn’t drop her and go back and get proper approval
That sucks a lot. Landlady should really try to redo to its initial state, otherwise she is out of business except she scams you. But really...its not your fault at all. How long is her investment going to be locked before she can take money from wherever she is investing and pay it back. At least the law should have made an exception for those who signed a contract before the year the law was adopted they simply gave a lot of people an opportunity to scam. As they say lawyer up... I would suggest 3 things!
1) Contact a lawyer. Who knows, perhaps there's a law that you can use get your money back or perhaps you can find that the Landlord violated their end of the contract allowing you to get your money back.
2) Don't actually get out of your contract! You might actually be able to find someone, it may take a year or 16 months or whatever, but you might actually be able to find someone.
3) Contact your government representative(s). They might be able to suggest options for you or even be able to create new laws to help this from happening to someone else in the future.
I hope you can figure this out. Money issues are the worst thing ever. 😓😓
Good grief! I feel for you Rachel, as a tennant who's been renting for over 18 years, I've been stolen from also due to landlord/ agencies incompetence. However, I end up buying my own place with no problems. I wish I was rich enough to help you. I hope things get much better for you, maybe this year isn't too lucky for you.
Am watching this video bit late, not sure how it is there in Korea, but there is another option, he removes walls he placed on "original" structure, because as it looks he only added metal construction to it, so removing it would not be "impossible". This way it should be listed back as normal building (if he removes all added construction) Since it would go back to being balcony but yes, you would lose a room to store your stuff. I might be wrong but its an idea :)

Wow that is a really difficult situation to be in. I really wish there was a way I could help you! Is it possible to keep the new contract and move into your new apartment then sub-let your current apartment for the duration its contact? Is that an option? You could make money from it until your landlady has to return your payment. I know how strong you are Rachel, you will find a way!
I think that is the insurance company fault. They should check if everything is alright with the apartment before signing off documents

Oh, I understand your situation. In America people frequently add on whole sections to their house illegally. You can do it legally if you get the correct permits. But illegally they can force you to tear down the illegal portion of your house. However, you can appeal and sometimes have it approved by the state or county as long as it meets current standards.
Tenant needs to be free, to opt-out if any irregularity appears due to the act of owner.
Sadly not a good business practice.

Since it was in your housing contract that they need to have the insurance, doesn't it break the contract on the owner's side since they are not able to insure it? I'm wondering if you could take legal action???
I'm really sorry you are in this situation. Is it possible that the illegal closet is removed? So the apartment will go back to the original structure and then the bank will have no problem accepting your contract?
I almost thought of asking if you're able to sublet this place, as a stop-gap measure.
If legal to do so, and the landlord would have to agree. So can move into new place, and don't lose much money straight away. But realised you may need insurance if subletting.
Then also realised you need the money for the new place if that too is jeonse system.
I think you and Claire should get legal advice; i assume there's something like legal aid where it's very inexpensive or free, initial, legal advice. (I've seen there's a Korean lawyer that's a youtuber - could be somewhere to start).
Another thought was because the addition is illegal, it shouldn't be entirely your responsibility to find the next tenant, and the landlord should also be trying to as well.
It's a pity that new regulation applies retrospectively (from way it sounded). Sometimes new regulations don't apply to things that occurred before the regulation came in. Here, anyway.
Of course I know almost nothing about Korean legal system and insurances there, so my comments may be useless. Just "thinking out loud". Wish I knew more...
What are the rules on returning the closet to it's original state? I don't know the laws in Korea regarding such things but it seems like you and the landlord should be able to come to an agreement on returning the closet to a balcony. If that's an option? It's something to look into maybe. Good luck on figuring it out. Keep being a good person and thinking positively and things will work out eventually. In one way or another. 💜
many comments are suggesting to sue the owner company and although that would be a feasible option, under different circumstances, im afraid a lawyer would not take on this case. from my understanding (and in simplified terms) since rachel was aware of the risk (admitted to having watched a video four years before -prior to moving in) as well as renewing the contract (still having the knowledge of the illegal structure), it was a willing transaction and, therefore, has to assume all risks. the risk, in this case, being the loss of her deposit.
i, however, am not giving any legal advice and would, instead, recommend consulting w a lawyer anyways.

Isn't there any state institution that handles illegal expansion that you could report the building to? I don't know how it works in Korea but in Italy if the owner builds illegally, they are responsible for restructuring or demolishing back to the way it was.
I would really try to see what you can find about this.
