what i dont understand is how scamming is often way worse then theft with larger amounts stolen, psychological damages, longer term stress etc. but rarely are people held criminally liable. I steal a guys $20 off the street and i do jail time. i scam thousands of people online, probably dont even get caught.

As someone who bought the plushie, it made a lot more sense now that this came out. That why after the initial batch it took so long to recieve mine. Sucks to see one of my favorite content creators get absolutely screwed by anothers greed and lies.
I've bought merch from three separate RUclipsrs on 3 separate occasions and never got my merch or a refund.

This is one of the reasons I still like Asmon and watch some of his videos. He is on the side of the little guys (sometimes), gives their trouble a louder voice and that helps them a lot.
Asmongold true Chad for standing up for Maddie, truly the one true king. It might have only been an hour of content but shedding light on this with an audience of his size really gets the word out. this is the exact reason why i do everything myself. i bought commercial machines to create clothes, embroider, and print on high volume, all shipping services give free boxes / label printers etc so thats a huge plus and saves a lot of money, shipping is easy to do, actually when you (as a customer) PAY for shipping, it creates the label for you to attach onto a box, all you have to do is print and slap it on a box with the stuff inside. ITS NOT HARD. (as a note, i am able to complete around 400 orders a day, working for about 6 hours a day, and a large portion of it getting distracted by asmongold/sodapoppin vids like right now.

There are so many things here to sue him for. Even open a case against him as a group. No matter what happens he needs to feel this for the rest of his life.
Had no idea this happened, figured it took so long because of production/ was thinking "small creator maybe take more time". I got mine and it is easily one of my favorite possessions and hurts to see Barny get screwed like this.
People joke about how asmon turns a 13 minute video into a 1 hour long session but if more people actually engaged, researched and talked about the stuff they watched instead of forgetting it an hour later we would all have better attention spans.
This is the most popular "business model" on the internet right now.
You present a "product" and a way to order it (and of course, a way to pay for it). People pay for it. You get ALL the money, AND THEN you start ordering the things you need to turn into your product USING the money that people paid you. And then somewhere along the way you deliver the product along with a freebie and a "sorry for the delay here's a freebie" message.
This way, you don't pay for stuff. Your customers pay for it. No need to frontload on huge inventory of materials, nope, just wait for the orders.
This is literally how TONS of business is done.. Its called Purchase Orders

Most contracts(at least in the US) have a clause for arbitration to address the issue that taking legal action is often too expensive for it to be practical. After arbitration, if a party wants to challenge the ruling or take further action then they can often become liable for any additional costs the other party may now incur. Also, in a similar situation I'd strongly advise against doing what Barny did; especially for someone with your amount of money and viewership - meaning A LOT to lose... that's just asking for a libel/ slander/ defamation of character suit. What Barny did is exactly what you shouldn't do unless you wanna just burn everything down.
You can't provide select excerpts from a contract, certain specific pieces of communication, and tell an entire narrative from your perspective without; not only, providing full documentation for people to review themselves, but allowing the opposition to provide their side of the story. I mean, this is why we have a legal system... Maybe the dude is a lying scumbag who cheated and stole, but you can't come out and say your half of a story, provide selective information, and try to ruin someone's reputation in a way that will have clear and identifiable financial ramifications! You even mentioned a case where false accusations ruined someone's life. Although, I will say that Barny's story sounds legit and if no suit comes from him it is probably indictive of Barny's story being mostly true... so, FIGHT THE GOOD FIGHT EVEN IF IT MIGHT NOT BE THE SMARTEST/BEST CHOICE :P

the thing is with them declaring bankruptcy is, you can still acquire any assets they may have to equal the amount owed in resell value, liquidity I'm pretty sure it can be sometimes called. She doesn't even need a good lawyer, not only that this could be a class action law suit, as multiple people have been defrauded out of money from this person, they just need to split the cost of a lawyer, and just sue him. If they don't acquire all monetary value from his assets to equal the amount that is defrauded, at least the guy has had everything taken from him. He deserves to be penalised for his unlawful actions and dealings, and needs to pay the price so he can learn to be a better person. He will continue to do this because there is no consequences for his actions.

I used to not like Asmon simply based off of watching some of his older content and forming an early opinion. Maybe it's how he's matured more or he's just able to be himself now, but whatever the reason, I've never resonated with and agreed on as many things as I do with him. His thought process and way of thinking is so similar to mine. He's one of the most raw and genuine content creators all while still being respectful and entertaining. Even though I'm a nobody, I still apologize for being so dense to form an untrue opinion of you. You seem like a really great guy and wish you nothing but more success.

This is by definition, embezzlement, the agency is under contract and in her “employment” as her business management firm. Him being the CEO makes him responsible for payments not being made to her or any other creators that holds this agency under contract.
Also, most likely Maddie put this guy's name in the tags so if you search his name on google (which many employers do) this youtube vid will probably come up. Certainly will if they look into the company he used to own.
One thing most people think of when you successfully sue someone..is that lawsuit stays on their Public Records on that pop up on every credit report check here in the US. So that's also a rep and trust destroyer is having that on it.

I used to work for a guy that acted like this. He would only pay the people that complained the most and seemed to enjoy delaying paying people as if it was some kind of game and he was trying to hit a high score for how long he could stretch out the period before he actually had to pay. Multiple times I had to deal with debt collectors that would turn up to the office. Debtors would sometimes give up and negotiate a reduced settlement. When he got the opportunity to pay someone less than he owed them, after often a year or more, he would be so happy he often danced with joy that he had got one over on them. He ended up changing career and becoming a human rights lawyer. So perhaps there is some kind of link with the kind of people that do that work and this kind of behaviour

Whats crazy is that Raid paid me 800 dollars for their sponsor. I only averaged 15 viewers at the time. 400 of it was guaranteed with 0 sign ups. Only needed 10 signups for the other 400 bucks. I think the contract shown in video is a bunch of bullshit.

Usually, contingency lawyers would take about 33% (and sometimes you can get the fees levied against the defendant). As this case would be against Poqito's company, he's likely judgement proof because he can just declare chapter 11 after losing the case.
I ordered a plushie and got mine eventually but it did take an insanely long amount of time, i eventually forgot i ordered it until it arrived in the mail one day lol.

As someone who got scammed in a renovation deal I can guarantee you that you stand nowhere, these types of people get away with A LOT , crime pays. And the reason is what Asmon says, your contract is only as good as your lawyer. yeah so whatever you do you close a contract and all you can do is hope the other party has no ill intent. They take orders, and if they sell enough, they then manufacture them in China and eventually ship them out. If they don't sell enough, it randomally gets canceled like 6 months later, which has happened to me and my wife multiple times with unique INK merch. It's an issue with seasonal items like coats, hoodies and tanks. You order them months b4 the season, but they don't arrive until the season you can't wear it. We ordered INK coats in spring, and now that it's getting cold, they still haven't been manufactured and they sent an update email saying it got delayed again, we'll probably get them next spring where we won't need them for another 6 months.
