  • The plaintiff brings her former tenant to court for an unpaid water bill she's suing him for. The defendant admits he was struggling financially at the time, but the plaintiff already took the water bill out of his security, so he doesn't owe her. The defendant is countersuing for the remaining balance on his security deposit.

      this verdict was unfair . the defendant let the plaintiffs keep a thousand dollars so they would have the money for the utility bill and the judge totally ignored that fact . i thought court was about making ALL parties whole .

    The defendant had it good. Most landlords would not keep renewing the lease if a tenant pays late, and they definitely wouldn’t lower rent if a tenant is going through financial difficulties.

      Was shocked when the landlords said they temporarily lowered the rent so he could get back on his feet and he STILL tried to screw'em. He was far from an ideal tenant and probably why they decided to sell and be done with it all.

      Lowered rent to help him. Constantly late. Only paid half of one month. Plus stayed into the next month. He owed half a months rent, plus actually owed the full rent for that next month he stayed into. And thought he shouldn't have to pay that water bill. Crazy logic.

    Nice to see someone coming into court smiling. The plaintiff is too kind for her own good. The defendant is a user and a loser. He KNOWS he owes that lady money. They aren't scamming, he is.I hate the way he opens his eyes wide in an attempt to appear innocent. He knows he owes her. I wish JM had charged him triple!!! "I fell on hard times." The rest of us did too, buddy. The loser always says, it is what it is.

    Where I live, the water can ONLY be in the homeowners name. It can never be transferred into the tenants name as it attaches to your owed taxes if it isn't paid. That being said, you can require the tenant to pay as part of the lease or rental agreement.

      Same here. It's frustrating bc I could not get any information as the tenant. I'd call the water company and they'd always want the landlord to call in and wouldn't tell me anything. When I moved out, I had to file proof of moving bc my landlord refused to admit I'd moved out and tried to charge me for subsequent water bills.

      I think that depends on if the water company is public or private. I've never had a credit score change bc of a water bill. Usually the water company is owned by the government and no credit score change is offered

    The defendant is very entitled. Imagine thinking you did nothing wrong after not paying your rent on time and still being allowed to live there year after year. Most Landlords would've evicted him years ago. 30 late fees over 5 years mean he was late 50% of the time. Not paying the water bill showed his true colors.

    Absolutely NO accountability whatsoever. Tenants who pay their rent late probably don’t realize the position they’re potentially putting their landlords in when the landlord has BILLS that they have to pay. Renting properties is like a job, i.e., it’s a form of income they should be as timely as one’s residency. I’m pretty sure if he worked two weeks at his job, and his employer was consistently late paying him, he’d be upset, yet he had no problem with being late with rent 30+ times, not to mention the audacity to be indignant about it all! He’s shameful and clueless azell.

    He's an ungrateful person, he feels entitled to other people's money. They did a lot for him. Someone had to pay that bill and he tried scamming his deposit back before they found out they had to. He's a liar and a thief. The look on his girlfriend's face shows she knew he knew he was wrong.

    What she should have done was made the plaintiff use the money they deducted for “late fees” that they admittedly never charged before (30 late fees at $50) and whatever was left goes back to the defendant. Landlords are often full of it and will try everything possible to not return the security deposit. Lastly, I would never let a bill in my name accumulate. She didn’t make him put it his name, take it out the rent deducted from your rent profit.

    I think she should of deducted those late fees from the water bill. They never complained about the late fees before, why should they get to charge them at the end?! I’ve seen cases where she tells landlords exactly that.

      They took $1000 out of his deposit for "late fees" and then sued him $1100 for the water bill. Which IMO is wrong because they never charged him late fees before. They just wanted that extra money.

    This dude keeps saying he was promised the world if he moved out earlier, 1) you didn’t move out early. 2) why do they keep having to promise you stuff when they already did countless favors for you over the years. He should have been more than happy to help them out by moving out early. But he took their kindness for weakness. And kept pushing boundaries to see what else he can get away with.

    I wish people knew that about being in public, I'm tired of hearing people hollar 'You can't film me without my permission' and they're in a public place.
    They don't reason that they are being filmed without their permission every time you drive or ride in a car at every light, every grocery store, every merchant you go to, you are being filmed!!! If you don't want to be filmed then, stay yo azz at home and shut up complaining!

      The problem comes when someone is trying to escape an abusive situation, or is in witness protection or a child is being hidden from an abusive parent who will kidnap them or someone is escaping a stalker, and the video ends up all over the internet. It puts these people in danger.

    I'm curious if the plaintiffs told the defendant about the late fees. If he was late by 2 days every month for five years and the landlord didn't say anything then it would be considered full accord and satisfaction of the transaction. They failed to mitigate their damages by reminding the plaintiff it's due on the first since many landlords give an unwritten grace period to maintain a good relationship.

      Had he left when he couldn’t afford it, he would have gotten the his deposit instead he used their kindness against them. This is why places are so expensive now to off set all the dumb choices made during the pandemic

    people are so quick to fall on the sword of the landlord. they retroactively added late fees and winged it to an itemization - obviously not in the time period mandated by law. he just needed to watch what he signed. why in the world would they keep it in their name? too many questions

    This defendants ridiculous like you are a tenant. She is a landlord. There is nothing promised other than roof over your head as long as you’re paying your rent if they give you notice to move out, you need to move and pay your bills.!

    I don't understand, if he accepted $1100 less off his deposit, wasn't it for them to pay off his water bill and for the extra week he was there, yet now the judge is making him pay for the whole water bill again!...

      He forfeited the money and maybe they could've negotiated applying that to the bill HAD HE EVER TOLD THEM ABOUT IT!!! He tried to screw them instead and he got caught.
