Finally sole good news. This is a big step in the right direction. Establishing identity and likeness as something that can be protected might help artists protect their identity. I do hope it doesn't get abused, ie two artists have a similar style and one sues them. Many artists are influenced by others and develop similar styles, like Guweiz and Wlop, for example.

well, i think it's suppose to keep from training. i don't think it has anything to do with people having similar style, it seems dedicated to ai 🤔

Hearing about these two bills definitely gave me a lot more hope-- especially since it came right after the EU passed the AI Act as well. The EU says they want to 'lead the world' in AI regulation, so it doesn't sound like they're done yet. Also, Adam Schiff proposed the Generative AI Copyright Disclosure Act, which would require AI companies to file with the US Copyright Office and disclose if they've used copyrighted material in training their generative AI-- and if so, what they used. This is one of the provisions in the EU's AI Act as well, and it's this provision that prompted Sam Altman himself to basically threaten to shut down all of OpenAI's branches in EU countries. Welp... It's starting to look like the US is going to do the same thing, so is Sam gonna shut down all of OpenAI's branches in the US as well? LOL! If he does, I say "Don't let the door hit ya in the ass on your way out."
By the way, I'm looking forward to the updated Glaze and Nightshade video! ;) I've been testing Nightshade and Glaze on some new artwork, trying to figure out what to do with the backgrounds to mitigate the artifact problem on flat colors and gradient backgrounds. I wasn't able to do it on the artwork I already gave you because it was created in Photoshop and I haven't had Photoshop in a while-- I switched to CSP a long time ago. Anyway, the point is, I've found that it's really simple to solve the problem. All I did was download a paint texture, desaturate it, and set the layer mode to 'hard Light', and turn the opacity down. I also did a test where all I did was use a heavy Gaussian blur on a random photo, set the layer mode to 'Overlay', and turn the opacity way down. Both of those work pretty well. You can do one or the other, or both. I can send you the new artwork in the DM on Twitter if you want. Don't worry, it's not 36 images this time, lol. It's like 4. Let me know what you think.

Good to know, sadly laws dont evolve at the same rate as tech, but at least they are starting to do something. Im an engineer, i work at the food industry sometimes making audits, other times designing factory layouts and machinery (mostly with 3d modeling using autocad/solidwork + blender) or programming PLC/HMI related things.... I use AI sometimes to speed up my work, but i know that at this rate even with my skillset, my job will be redundant in the next 10 years. But at least there is a beacon of hope in these times full of uncertainty.
I think in the near future, people will start appreciating more things made by humans, there will be a split in the market... like we see with the handmade stuff. And even more in the case of artists, people and not companies... will appreciate something made by another human more than something that cameout from a prompt.
Thanks for sharing the news, sorry for the bad english.

First, it's only passed their Senate, it's not a law, so hurray for clickbait video titles. It's a bill. Second, this does nothing that current copyright law doesn't already do, i.e., it protects artists from having their work reproduced and sold as somebody else's work. It also contains massive loopholes for news, satire and parody - as it must, because if it didn't it would be superceded by existing federal copyright law.
There is also nearly no way of proving that A.I. has been used at any point in the life cycle of the creation of a given piece, and there are already incidents of artists being falsely accused of using A.I. simply because their style resembles the output of popular generative AI programs. Reliable A.I. detection does not exist.
Since AI is incapable of making perfect replicas of other artists' paintings to start with, but only copying artists' styles (which cannot be protected by copyright), this bill essentially does nothing to help anyone, and is largely just performative. Considering it does nothing that isn't already covered by federal law, and that it is almost entirely unenforceable due to the lack of standardized procedures for detecting the use of AI generated graphics, its chances of passing and becoming an actual law are very low.

@@GeneTurnbow Only thing that's shameful here is you ostensibly supporting ML and trying to convince artists that its hopeless to try protecting our work.
"AI is incapable of making perfect replicas of other artists' paintings to start with, but only copying artists' styles (which cannot be protected by copyright)"
It has been shown to spit out it's training data almost to an exact degree at times. Even things like it's tendency to make weird signatures and patreon logos in the corners of its outputted "paintings" should tell you all you need to know.
Its stolen, compressed data of many living artist's work. I don't care what the law says now. Its insanely unethical what is happening and the law needs to change.
