Ukraine and Russia are not ICC members. Ukraine decided to give the case to the ICC and it works from it's permission in it's territories.

Youre crazy. The International crimninal tribunals have imprisoned thousands. The ICC has the same kind of powers and it looks like people are starting to realise the power of the ICC (since the security council wont set up the necessary tribunals). If the ICC itself issues warrants the people subject to the warrant are stuck with being able to travel to very few countries because most of the countries of the world are parties to the ICC conventions.
Law functions via a monopoly on violence. I say this *not* as a criticism of law, but as an observation- if the victim, unsatisfied with the verdict, takes matters into his own hands, the state will orient it's violence away from the original aggressor and towards the original victim. In this way, it maintains order. However, on the international level, this simply doesn't work, especially with nuclear weapons existing, as any totalizing violent force (excluding something goofy like aliens here) would have to contend with a renewed MAD. In this sense, truly enforcing law at the international level is a sisyphean task. The fact that nations such as China, India, Russia, and of course the United States (as mentioned in the video) are not members may tell us a bit about those nations, but I think it reveals much more about law itself
In case anyone was wondering, ICC is honestly kind of a joke. It was established in 2002 after the Rome Statute of the International Criminal Court. The main idea was that any signatory countries would be obligated to assist when possible to arrest people the court deemed were needed to be tried for various crimes against humanity. Of course, this inevitably wouldn't work, because multiple signing countries have started accusing each other of committing crimes against humanity. So now the ICC has investigators and lawyers and review boards and really it means it's just a giant bureaucratic mess that gets almost nothing done. in 22 years they've only officially issued 46 arrest warrants and actually prosecuted less than half of them. And a surprising number of them were just acquitted or dismissed anyways. Partially due to their honestly lacking procedures and authority, the U.S. withdrew it's signature in order to pursue such prosecutions through more traditional U.N. and ally channels. And yes, the ICC has a warrant out for Putin too, as well as five other Russian Government officials. EDIT: Oh dear this really stirred up the comments it seems. Like I think the ICC is a great idea too. But just because it's a nice idea, doesn't mean it will work, let alone actually have the effects that were intended. For example, After nearly twenty years, the key leader of the "child soldiers" in Uganda was at last sentenced for his crimes. And the ICC, in their infinite wisdom, decided to try and award some of the victims of his crimes. With a paltry amount of money per person, that most felt was just insulting considering what they had lost. And even now, the only reason they're pushing so hard for Netanyahu, is because legal teams from South Africa have been advocating it for months. The ICC acts on the whims of it's signature countries, and it contains biases and opinions just like a regular jury. Such a body, in my opinion, shouldn't really be trusted considering the lack of oversight. It should be left to the UN directly to handle such things. ICC not having power is a misconception, it’s just that most war criminals are tried by signatories, so the ICC doesn’t have to get involved, it doesn’t have the capacity to take on all those cases itself anyway.

It seems like Israeli claims that the ICC is biased may be true when they finally issued arrest warrants for Hamas leaders but only because they wanted to issue one for Israeli leaders. If the ICC was not biased the ICC would have issued warrants for Hamas leaders months before Israeli leaders and for different reasons.
Israel and US was also willing to comply. They were going to make plans to comply the same day the applications were announced. In other words, the ICC lied by promising that no such actions would be taken before complying with Israel.

That would still exclude the ones we got from other countries that were not theaters of those wars. It's the same reason it's illegal for Russia to just take and hold Ukranians indefinitely. They are required to establish their status (civilians, PoWs, sabatures, etc) and then release any civilians. Once a conflict ends, you are also suppose to repatriate those being held and not found guilty of war crimes. Something the US has failed to do at the end of those conflicts.

These international organisations have long since became the analogy of Civilization V's world summit, where the number of delegates you send is deciding world policy making and definitions, as opposed to principals upon which these orgs were initially built. @@Sauce787 The US withdrew its signature in May of 2002, the Rome Statute didn't even enter into force until July of 2002. Meaning that the ICC literally hadn't started doing anything when the US withdrew. So no, that is not the reason due to the fact that time is linear.

Youre crazy. The International crimninal tribunals have imprisoned thousands. The ICC has the same kind of powers and it looks like people are starting to realise the power of the ICC (since the security council wont set up the necessary tribunals). If the ICC itself issues warrants the people subject to the warrant are stuck with being able to travel to very few countries because most of the countries of the world are parties to the ICC conventions.

Law functions via a monopoly on violence. I say this *not* as a criticism of law, but as an observation- if the victim, unsatisfied with the verdict, takes matters into his own hands, the state will orient it's violence away from the original aggressor and towards the original victim. In this way, it maintains order. However, on the international level, this simply doesn't work, especially with nuclear weapons existing, as any totalizing violent force (excluding something goofy like aliens here) would have to contend with a renewed MAD. In this sense, truly enforcing law at the international level is a sisyphean task. The fact that nations such as China, India, Russia, and of course the United States (as mentioned in the video) are not members may tell us a bit about those nations, but I think it reveals much more about law itself

In case anyone was wondering, ICC is honestly kind of a joke. It was established in 2002 after the Rome Statute of the International Criminal Court. The main idea was that any signatory countries would be obligated to assist when possible to arrest people the court deemed were needed to be tried for various crimes against humanity. Of course, this inevitably wouldn't work, because multiple signing countries have started accusing each other of committing crimes against humanity. So now the ICC has investigators and lawyers and review boards and really it means it's just a giant bureaucratic mess that gets almost nothing done. in 22 years they've only officially issued 46 arrest warrants and actually prosecuted less than half of them. And a surprising number of them were just acquitted or dismissed anyways. Partially due to their honestly lacking procedures and authority, the U.S. withdrew it's signature in order to pursue such prosecutions through more traditional U.N. and ally channels. And yes, the ICC has a warrant out for Putin too, as well as five other Russian Government officials.
EDIT: Oh dear this really stirred up the comments it seems. Like I think the ICC is a great idea too. But just because it's a nice idea, doesn't mean it will work, let alone actually have the effects that were intended. For example, After nearly twenty years, the key leader of the "child soldiers" in Uganda was at last sentenced for his crimes. And the ICC, in their infinite wisdom, decided to try and award some of the victims of his crimes. With a paltry amount of money per person, that most felt was just insulting considering what they had lost. And even now, the only reason they're pushing so hard for Netanyahu, is because legal teams from South Africa have been advocating it for months. The ICC acts on the whims of it's signature countries, and it contains biases and opinions just like a regular jury. Such a body, in my opinion, shouldn't really be trusted considering the lack of oversight. It should be left to the UN directly to handle such things. I trust the UN IHRC to get things done right far more than I'll ever trust the ICC.

The number doesn't negate the fact that it violated international law. Again, ones the US itself helped to write. Including ones on establishing guilt of prisoners and rules for establishing said guilt. Something the US failed to do in most cases. And then continued to hold them.
Additionally, even if it was a case that all of the ones captured in Iraq and Afghanistan were found guilty under the rules set up. That would still exclude the ones we got from other countries that were not theaters of those wars. It's the same reason it's illegal for Russia to just take and hold Ukranians indefinitely. They are required to establish their status (civilians, PoWs, sabatures, etc) and then release any civilians. Once a conflict ends, you are also suppose to repatriate those being held and not found guilty of war crimes. Something the US has failed to do at the end of those conflicts.

@@Sauce787 The US withdrew its signature in May of 2002, the Rome Statute didn't even enter into force until July of 2002. Meaning that the ICC literally hadn't started doing anything when the US withdrew. So no, that is not the reason due to the fact that time is linear.

There would also have to be changes made to the ICC to give persons on trial the same protections offered by the Constitution/Bill of Rights that the ICC does not give now.
