Would you rather pay someone half the salary to generate $300/mth at local bake sales or someone who can drive significant donations and excels at networking to net huge benefactors to justify twice the pay?     A friend of mine was injured as a child. A trust was set up by a local bank. The bank put the money in an account that did NOT even earn a low rate of interest for 12 years. Nothing.

      Sounds like an escrow account. Why they would leave it there beats me. Somebody should have insisted on a better form of investment. At 7% your money will double in ten years, so this was a massive loss of capital. The bank benefited greatly out of having free money to use.

    I'm not sure if they have a fiduciary duty but I suspect that the board is liable in a civil sense if under their watch as corporate officers they facilitated an unsecured loan to another corporate officer. I suspect they're not complicit in a criminal sense but likely failed in their duties. Hopefully a lawyer skilled in this area can weigh in further.

    Keep saying they should have brought in the Federal Bureau of Investigation from the beginning over two years ago instead of a law firm!!! At this point the IRS should be involved and investigate the companies that involved as well as the former chairman and his board to see who benefited from those transactions that totalled one hundred million dollars.

    Anyone can start a none profit and take off. There was a lady in Florida that caused issues after Irma in fact I went over to them about four years after Irma out of curiosity when the lady told me I didn’t qualify for hurricane relief due to no ID which makes no sense as they ask for all of this before they did the paper work. I found out not only did they fire that worker that worker lied and told them that I was suppose to shoot them where they had to literally get to no me just to wipe the slate clean. I told them “if you had to fire someone for being a bad employee don’t you think it’s best to not even give them the time of day because they had this bad track record?”
    Imma assume they got that story from my ex landlord that was also let go for her conduct as one lawyer down there said “the reason we no longer take tenant landlord cases is because even if you win they find a way to make you lose where they call everyone to deny an application as one of my client won and due to it being a small world she had to move to another county”
    And also find it ironic as I had an attorney call a non profit only for them to go from that to claiming “we a business we can deny whoever we want” similar to the bad landlady case even spirit pulls that one where standard airline rules might as well be throw out the window for “this is my house we do what we want” when in reality they just bunking in a building that doesn’t really belong to them. Kinda like those section 8 people with the “it’s my house” bs when everyone knows that’s not their house

    The problem with a NFP run by a board is that the board members are protected from losing their personal wealth...homes, cars, jewelry, etc.... if the company had the right protection. I can't trust people who protect themselves from being sued personally for their wrong doings. It is a sad greedy evil that if I was a super hero or Queen Witch of the Universe, I would remove greed from humakind to make us better people. No consequences means people will do selfish things.

    I think there does need to be more oversight for nonprofits. Seems like this happens a lot where people funnel obscene amounts of money through nonprofits into their own pockets.

    Often, the people entrusted to oversee large sums of money, are wealthy individuals who don’t live within their means. No matter how much money they “acquire”,it’s not enough. Safeguards should have been in place that no monies could be removed from the trust without a legitimate third party’s permission and signature, so that there would be some accountability by someone. I hope that each and every board member is thoroughly investigated and brought to justice. How could these people be so low and slimy as to steal from the special needs community? Disgusting!

    Reminds me of the "social workers" who jacked up elderly people who were fine, yet the "social workers" took control of their accounts and even got the local police involved (implicated) to chuck them out of their house under the guise of "caretaking."

    This is more common than we even know. I’d venture to guess the vast majority of nonprofits misappropriate funds in one way or another. Same with government agencies.
    Next time you want to donate to a nonprofit, take a look at what percentage of their funding goes to administration vs what percentage goes to direct client services/support.

      Most nonprofits I have seen do not misappropriate funds. Percentages don't tell the whole story about how effective programs are, you have to dig deeper to see what the impact is. Unfortunately there can be abuses whether for profit, non profit or govt. agency, but you can't make such huge generalizations.

    When it comes to a trust, there should be regular reports from a third party on what money has been spent, where it was spent, and by whom. That way crooks can’t “loan” themselves money and get away with it.
