Border Agents Brutalize a 75-Year-Old Vietnam Vet

  • A Vietnam vet and former prison guard, Larry Kirschenman thought he had the right to ask what probable cause U.S. border agents had to search his vehicle. Larry wound up in the hospital with serious injuries after asking an innocent question. He attempted to file a complaint with U.S. Customs and Border Protection (CBP) about the incident, but has never gotten an answer.
    Excessive use of force by U.S. border agents has also led to an unacceptable loss of human life. At least 27 people have died since January 2010 as a result of use of force by CBP agents. This has included 7 minors under twenty-one, 9 U.S. citizens, and six individuals who were standing in Mexico when fatally shot. Most of the victims were Latinos.
    Yet even in these cases, CBP has been unresponsive to public demands for transparency and accountability. The agency has never made public the results of any investigations into these deaths, not even to the families of the victims, nor any disciplinary measures that may have been taken against the agents involved.
    In May of 2012, members of Congress began looking into CBP's response to complaints, and found that the agency lacked a "streamlined, integrated complaint process... that represents a serious barrier to building a culture of accountability within CBP."
    Congress asked the Office of Inspector General and the Police Executive Research Forum (PERF), an independent policy research organization, to evaluate CBP's use of force policies and come up with recommendations. The agency has refused to release the PERF report, but the Los Angeles Times obtained a leaked copy. Among the disturbing conclusions described in the Times articles, PERF found that agents intentionally provoked confrontations to justify the use of force.
    The ACLU and other rights organizations are calling on CBP to establish a robust investigation and complaint process for holding CBP agents accountable for any abuses.

    Larry Kirschenman speaking: I've been in combat and I've never been hurt that bad in my life. They've got my wrists, handcuffed wrists up behind my back and they are pushing them up very hard. They are not trying to restrain me, they are trying to hurt me. Ever since then I'm beginning to realize our country is not nearly as free and democratic like we might think.
    For about eight years I've been going back and forth across the border to get haircuts or dental work or sometimes just to go for lunch. I went over to Mexico on the 27th of March 2013. When I came back at approximately 5:00 in afternoon, the first officer said, "Follow me into secondary." That's where they searched vehicles for contraband or whatever. So I followed him there. The officer told me, "Get out of the vehicle." And he was using a very gruff angry tone of voice, and he said, "Turn around and put your hands on the truck, I want to search you."
    And I turned about halfway, and I said, "Officer, I really don't know the rules in here, but don't you need some probable cause to search me." "No, I don't." And he grabbed me in an arm lock and I work in a prison, same techniques, and bent my wrist back, and then he picked me up by the seat of my pants and the handcuffs and slammed my head into the floor.
    Now I'm bleeding, I had wound ... peeled a piece of meat off the top of my head about as big as an egg. I'm handcuffed and chained to a bench and, man, the pain was really hitting my chest, and I said, "I need to go to an emergency room, I think I'm having a heart attack." Finally, they called an ambulance. The American doctor, he says, "My God, I don't care what you did, Mr. Kirschenman, you were handcuffed behind your back, there is four or five young men around you, you are in a secure facility, there is actually no justification for doing these things to you. I'm calling the police." And he did, and then the police made a report, took then pictures, they are evidence now.
    I went down there the next day to file a complaint. And they say, "Oh, we can't take it now." That's not right, that's totally wrong. They are supposed to take your complaints immediately. I was angry. And I felt that I have a right to protest. And the only thing I could think of was something like this drive back and forth through that gate until someone got tired of it and decided they would talk to me about it, but it's apparent they won't do it.
    I wake up dreaming about this thing, it wakes me up and I'm trembling, and I can't go back sleep. The thumbs are just a low-grade like a toothache all the time. If I try to pick up a pencil it hurts. I put 22 years in the Army, I got metals out of Vietnam for valor. I just thought unless you were doing some criminal act that police or border patrol agents, they just couldn't treat you that way.

    Dude you weren't told how to file a federal lawsuit for constitutional rights violations. Force all those cops before a federal judge to explain why they used excessive force against you. The pay out could have been rather large. Hope the statute of limitations has not run out.

      He might not be aware of the system in place to help him financially for this type of thing. But you should be made aware that this was posted a few years back and hopefully by now justice has been served if not for this honourable veteran then hopefully at least on the head of this piece of shit border guard.

    Had a pretty similar incident I was accused of having drugs in my vehicle because a dog alerted which was a lie because he did a hand motion and then that's when the dog went crazy my car was torn up I was humiliated no warrant no nothing no reimbursement

Good citizens can't relax because sooner or later, something like this can happen to you...at the hands of police officers. When I'm walking alone at night, my heart races when I see a police car strolling around me. Sad.

      I contacted the ACLU to inquire about the status of this gentleman's case and the attorney I spoke to stated that they declined to file a claim as "it was not economically viable".

    Do you have the name/names if the patrol officers, who ASSAULTED you? What became of the police complaint? Was the patrol officer arrested for assault?

    I was mistreated in a similar fashion by border patrol in North San Diego County about 40 miles from the border. I had not even been in Mexico, I had gotten lost out in the middle of nowhere, no cell service. I'm also a senior citizen, a U.S. citizen, female, 62 at the time of the incident, which was in 2015. While I was not physically abused by the border patrol, I was distraught by their abusive actions and having trouble breathing and was taken by ambulance... to a mental hospital in San Diego! What happened there I cannot talk about yet. I have been so traumatized by everything that I buried it and this is the first time I've talked about it publicly because I'm afraid of retaliation. I'm afraid for my safety, and afraid for this country. It is not a free country and we do not have rights.

    Want their attention? Type your complaint out on a court complaint/motion form, and mail it to them certified mail, return receipt, so they have to sign for it, and you get back a mailed signature card, that creates a paper trail.

    My brother vietnam vet ,, i have never been in the military , police force , or any public works . but i have all the respects for men like urself. I have always believed that if anyone hurts , robs , or even kill a vet that person should be given death penalty. I dont even know what to say for what this animals did to ya.     Sir, I am so sorry and disappointed for the way law enforcement treated you it is absolutely shameful and disgusting, times have changed in this world and not for the good, I am afraid that the darkside of creation is grasping at the souls of mankind, manipulating and using people in power to do its bidding, I am afraid the days of respect and brotherly love have all but gone, but as for myself I want to thank you from the bottom of my heart for your many sacrifices, and bravery that you have given me and all others of this country, the coward that assaulted you will pay for his crimes eventually, he will not escape his sentence, not ever give up hope there is a reason for hope we all could sure use it, you stay well and again thank you sir.

    Facts, all countries have secured borders. What border patrol agents did this?Where were are these agents from? It seems that now a day the selection of agents and police are GED grads with low scores. Americans must stand up to these injustices. Remember what happened to the Jewish people in Germany?       Thanks for your concern. I'm sorry, but your statement that "all countries have secured borders" is incorrect. Somalia does not (Somalia has no government; it has markets which serve the people's needs). Some countries in the Arabian peninsula do not.
      But being a Libertarian, I DO NOT believe in "borders" or "government" for that matter, in the first place. I DO believe in private property. In anarch-capitalist societies, there will BE NO "public property," only private property. There will be no border patrol thugs to beat on helpless old men this way, and NO GOVERNMENT to order us around and violate our rights.

    What is as scarey as a law-abiding veteran being attacked without cause or a warrant by the border patrol is the fact that the border patrol has checkpoints set up over 100 miles inside the US-Mexico border where they also demand to search vehicles for goods and people smuggled from into the US.
    These people have no right to re-draw the US border and if it's 100 miles today, will it be 1000 miles next year? (The 100-mile stops with searches have been going on for many years.) The demand to produce "papers" to prove US citizenship is offensive. I don't carry a passport unless I'm planning on leaving the US and none of us should need to carry "papers." These clowns can easily Google to learn where the US border with Mexico is.
    The rudeness of these keystone kops would be unacceptable if it was only directed at known criminals but these yahoos treat everyone like they are convicted serial pedophiles or murderers.
    It's time that the US AG stops this misbehavior and prosecutes these supposed US LEOs.

    The border patrol has done that to me a number of times. If they treat their own citizens like that on a daily bases, what do you think they are doing to the Mexican people who have no voices . It’s criminal what they do, you have no rights really, the whole system has to change.

    Change the primary and follow on training regimen. Change their perspective from contract money going back and forth to accountability. I don't doubt it's contracted trainers and that corporation needs to sense accountability for turning out anything that just wears a uniform.

    I am sorry to hear your story. I have no excuses for your treatment by that agent. I am sure there will be a full investigation and punishment if neede. Please not think all BPAs behave in this manner.

    The fact that they would do this to any American citizen is just wrong. A Viet Nam veteran???? 75 year old guy??? Hope you sue the PISS out of them. Assault on a person over the age of 60???? This country is a police state now......

    Hold on...he’s been going back and forth across the border for eight years and he doesn’t know that they can search you and/or your vehicle for no reason?? He claims to have served in the military as well as been a prison guard, but doesn’t know how to cooperate with law enforcement personnel. This guy is a joke.

    Yeah.... I’m fairly certain there is WAAYYYY more to this story than he is telling. Federal officials have huge requirements on the application of physical force on people and they have cameras all over the ports of entry to ensure compliance by the officers.
