In the past it was widely ASSUMED that the AMA filled all the requirements of a "community based organization" that could establish the rules - but this is the first time I've heard the FAA formally acknowledge this as fact. This is an extremely significant development. Now we know where to find the definitive regulations. Thanks for setting such a landmark precedent!
They (FAA) don't quite go that far. They make reference to "organizations like AMA" or similar wording, but don't make the stipulation. Actually, that is all an overstep in my estimation. I've said before (and don't plan to change my mind) : any club that can establish rules that I must abide by, has in fact established a law in its own right. It's not far from there to the point where (as we are with insurance) one must pay a fee to the organization in order to be a human being in the USA. In other words, our laws must be established by government, and no agency - FAA or otherwise - has the right to say that any "outside organization" should establish guidelines/rules/laws that I _must_ follow.

But the local AMA club, who is unnamed here and who has no jurisdiction over non-members, has yet to publicly publish their rules. So, besides that being an inconceivable task, it is also not within the rights of the FAA to pass pseudo law-making privileges on to another, public or private organization.

Thanks so much for getting answers to these questions for us. I don't have a 107 but when working second shift, I fly at night after work all the time. it's a good feeling knowing the FAA rules. I have ask the local police if it was okay and their answer was always "As long as people didn't complain it's okay with them." I'm lucky to live in a laid back little town.

I just searched "night time drone" and here is this guy in front of a big red barn. The color caught my eye and I'm so glad it did. Not only did I get my questions answered, I was so entertained by your video. I could have searched and read for hours to get this answer and probably would have gave up. With all the legal jargon they put in, who knows if I would of even understood it. Thank you for making me laugh and being an innovative teacher. Can't wait to watch the next video.
Another great video. Awesome content and very informative...Thank you! Before I decided to go commercial I was flying as a hobby, so I had researched those guidelines. When I was making the transition it was explained to me almost the exact same way. One FAA representative broke it down like this. Technically if you're just flying around the park for fun...and the parks director comes to you and says he will pay you for some aerial shots, you must land your aircraft and start a whole new flight log and take off again for the paid job.

I’ve been considering making a video about this for a while! Some people don’t understand that it is all based on the particular flight. Each flight comes with a set of rules. You can either fly under hobbyists rules or Part 107 rules. The only difference is that if you are flying in a manner that furthers yours or another business, than you MUST fly under Part 107 rules. And you can’t change rules during flight. You have to decide what set of rules you are using before taking off!

Hi Ken. Great edition and instructional Video. FYI, in Chile is illegal give the control to other UAV operator when the aircraft is in the air (as you did at 7:42). You need to land the aircraft first and THEN you can give the control to other pilot. (DGAC Rules DAN-151). Crazy things...!! Big hug Pal...!!!

Good. I have a night fly helicopter with graphic display main rotor blades and many LED's all over the frame, boom, canopy and skids. It is literally easier to decipher the orientation of this heli at night than to fly a "normal" one in the day! Also, it is never flown further out than approximately 150 feet and never above an altitude of approximately 50 - 60 feet. It is a very cool experience for pilot and spectators alike and one I'm not prepared to give up.

Had this convo w/ FAA 5yrs ago. The plan was to use white strobes w/ possible red and green lights. The FAA requires strobes tobe visible up to 3 mi. at night. Subject to change. You can lose sight of your drone easier during the day than at night w/ these strobes. The bigger the drone, then the bigger the lighting and strobe system. My larger drone's are visible up to 10 mi or more.
Have always said that you are one of the MOST entertaining you tubers out there... and this episode proves it... like another said... "laughed from start to finish" now I have to watch again to get the information...

I'm a couple months late to seeing this video but I think at the root of it is the confusion / conflating of being a "hobbyist" drone owner versus a "flying for fun" drone owner. The spirit of the Mode Airplane rule / 336, etc. is that you are a member of the AMA or similar club flying within their programming, at their functions or events within the airspace allocated for their clubs airstrip or FAA authorized location for the club to hold their event. I hold a Part 107 Cert, so I'm good all around. I also hold an FCC Amateur Radio Operators license. That is one of my hobbies, Ham radio. Without the license, one can't legally operate a radio on Ham bands. When my license was Technician Class I could enjoy my hobby but only on certain bands that I was authorized to operate on per that class of license. If say Steve from down the street enjoys his FMR or GMRS walkie talkies...thats great. He's operating in a band that is available to the general public with no restrictions (just like CB radio) but with the understanding that they are frequencies and channels that others also operate on...and he has no privileges to operate on ANY other frequencies or channels just because he "owns a radio". Soooo just because Steve from down the street now owns a drone, with no 107 Cert or with no FAA Nationally recognized club affiliation to better enjoy his drone and legitimately be called a hobbyist in this scenario, it doesn't mean he can fly wherever the flip he wants whenever he wants. There are apps for drone pilots that literally spell this out for and yet there are many who want to bend and skirt the rules and intent to suit their own needs because they feel entitled.

Ken, I that that was perfect. A little gray area but good enough for me. Us 107 can fly at night as long as it is not for the furtherance to make money. Of course, high-intensity lights are still needed they way I read it via the AMA. That is the main answer that everyone has been looking for and arguing about. Now, riding on the top of a moving vehicle is another story.

Good. I have a night fly helicopter with graphic display main rotor blades and many LED's all over the frame, boom, canopy and skids. It is literally easier to decipher the orientation of this heli at night than to fly a "normal" one in the day! Also, it is never flown further out than approximately 150 feet and never above an altitude of approximately 50 - 60 feet. It is a very cool experience for pilot and spectators alike and one I'm not prepared to give up.

Had this convo w/ FAA 5yrs ago. The plan was to use white strobes w/ possible red and green lights. The FAA requires strobes tobe visible up to 3 mi. at night. Subject to change. You can lose sight of your drone easier during the day than at night w/ these strobes. The bigger the drone, then the bigger the lighting and strobe system. My larger drone's are visible up to 10 mi or more.
If you keep this up, you might get your own TV show. Greatest editing job. Love the time you put in. Love your ch.

I'm a couple months late to seeing this video but I think at the root of it is the confusion / conflating of being a "hobbyist" drone owner versus a "flying for fun" drone owner.
The spirit of the Mode Airplane rule / 336, etc. is that you are a member of the AMA or similar club flying within their programming, at their functions or events within the airspace allocated for their clubs airstrip or FAA authorized location for the club to hold their event. I hold a Part 107 Cert, so I'm good all around. I also hold an FCC Amateur Radio Operators license. That is one of my hobbies, Ham radio. Without the license, one can't legally operate a radio on Ham bands. When my license was Technician Class I could enjoy my hobby but only on certain bands that I was authorized to operate on per that class of license.
If say Steve from down the street enjoys his FMR or GMRS walkie talkies...thats great. He's operating in a band that is available to the general public with no restrictions (just like CB radio) but with the understanding that they are frequencies and channels that others also operate on...and he has no privileges to operate on ANY other frequencies or channels just because he "owns a radio".
Soooo just because Steve from down the street now owns a drone, with no 107 Cert or with no FAA Nationally recognized club affiliation to better enjoy his drone and legitimately be called a hobbyist in this scenario, it doesn't mean he can fly wherever the flip he wants whenever he wants. There are apps for drone pilots that literally spell this out for and yet there are many who want to bend and skirt the rules and intent to suit their own needs because they feel entitled.

Ken, I that that was perfect. A little gray area but good enough for me. Us 107 can fly at night as long as it is not for the furtherance to make money. Of course, high-intensity lights are still needed they way I read it via the AMA. That is the main answer that everyone has been looking for and arguing about. Now, riding on the top of a moving vehicle is another story.
