    A lot has changed with the government concerning back pay along rather or not you had any assistance in-between waiting. I was told the amount of back pay only goes only for 12 months or less (depending on when you applied for disability or SSI and when you was approve). Also, the SSA representative in my area (state) took some of my back pay and didn't tell me why when I asked. Anyway, I called the 1 800 (main number) and got info from the person I spoke with about my claim as well as told how rude and hateful the representative was towards me. The woman from the 1800 number told me the SSA representative took some of my back pay due to getting public assistance (help with my electric bill and snap benefits) in which didn't make sense at all to me. She assured me it was a legal reason without a proper or understanding cause (she wasn't for sure herself). It's all so confusing!

      They took your money because you were on food stamps?? I am on food stamps. I'm a single mother. Does that mean they will take money off of me? That would be outrageous. I only get enough to last me half the month as it is.

      I haven't applied yet. I was asking the state (sw MI) disability ?'s. They said if I applied for SDA State Disability Assistance & then was approved for SSI Disability that SSI would pay back to the State the amount paid out to me while waiting for approval. They never mentioned anything about paying back food assistance benefits, only SDA (cash) benefits🤔🤔🤔. Is there a law school near by you could call for free advice? Some good attorneys will answer ?'s for free also. I am left confused myself now. Sending love & prayers to anyone else struggling.

      I think attorneys are the only people able to clarify the laws or rules. There is too much inconsistency between federal and state programs

    I was out 27 months before my Disability got approved. My attorney said I will not be getting my back pay because I was collecting Workers Compensation that settled 2 days my before my Social Security hearing. I bet my greedy attorney will be collecting her commission on the 27 months back pay.

      If your attorney wasn’t involved in your workers comp case they can’t demand payment on that, look at your contract

    Social security back dated my disability onset date to November 2019 - that’s when I became disabled and the Army doctors would no longer allow me to work. I medically retired from the Army after 18 years. I applied for social security disability 16 months ago and I’m still waiting on approval. So even though my onset date is more than 12 months from the date I applied, I can’t receive more than 12 months of backpay? Also, since it’s been 16 months since I applied, will I get 16 months of retroactive pay? Or do they cap that at 12 months too? Thanks in advance!

      I cannot ever get a clear answer on back pay. I was approved in March and my official disability date was June 2021. It is may 2024 and I haven't received anything yet. No monthly , no backpay.

    The deal is....they know how desperate you are lF and BY THE TIME you are approved. Not to mention confused and blind to the system operations. Utterly surreal when it all happens and the attorney has already cashed in so no help from them anymore. On your own now. Just another stray dog that gets slung a scrap! Literally.

    I need help with my disability I haven't worked since 2018 and they keep denying me I had to start over telling me I can only get the 12 months pay when and if I get it this time I have RA arthritis and spinal stenosis

      Hi Tammy! I just have RA with cont fx on my feet and loss of a left thumb joint. Back pain. Denied. If you have any mental health issues please list! Bipolar disorder or Severe Depression can be added then you can win your case! Good luck sweetie do not give up and get a lawyer. They only get paid if you win! ❤️

    Can I get my back money back after it’s been spent without my consent. When I was little my aunt tricked me into signing a form that stated we both split the money and spent it but I never touch a penny of it. It’s a really crushing feeling being used like that by my own family

    4:58 hello, I filed for SSDI 3/2024. I got approved 9/2024. Is SS supposed to hold 5 months from my back pay? That would leave me with no back pay. I'm not complaining, but the time I was out of work, I racked up some bills, and of course, my attorney got 25%, and I couldn't get him to return any of my phone calls. I need help with this please 🙏

    Im expecting a back pay for my son for August 6th. Should i call the process center and see are they going to deposit it this Friday or just wait? I got his first check February 1st and back pay in a dedicated account February 6th. Only saying because a coworker waited for ssa to deposit her daughter second installment she calld they said they forgot. My son starting a tutorial program on the 28th of this month and i need the funds to pay for it.

      you submit your date of onset in your application and if agreed upon by SSA they will pay based on that date. So it is not automatic.

    So confusing. EOD is June 2022, application date is Aug 2022. $1857 per month and my hearing finally is June 2024. So is it June +5 months is Nov 2022. So would i get paid from Nov 2022 to the approval date. Example June 2024 is the approval date. So would it be 19 months in backpay? Im getting conflicting information i found a calculator that basically does the transaction above. But also peopke are talking about 12 months. And some are saying they are not getting any back oay even though its been years. I have to pay the lawyer plus pay the state back for the $373 a month they gave me for T-dap. I'm seeing people mention paying back food stamps? Is that the case and what about medical coverage, do i have to pay that back?

    After 3 years of not working and 3 hearing they approved me at the date of my last hearing?? I can appeal in 15 days of today. I have watched you and because of your videos I was approved nov 10th 2022 stopped working nov 19 th 2019. So ?? Retro pay? Is it possible? Should I not appeal? As of nov 10th it put me in the 55 year old age group. I believe that is why I won. No back pay and citizens' disability bailed on me after nov 10th hearing. Do They get any of my checks? And retro ? Should or could I get that and not appeal? Citizens disability is a horrible company!! Trust everything this man says! His advice is the only reason after 2 hearings I won my 3rd kinda? Thank you

    My brother has applied three times for disability and been denied twice and appealed both times. He is currently waiting on the judge to decide on his third attempt. If the judge decides in his favor, will he receive back pay from his first attempt to now (roughly 36 months)?

    my LTD insurance company is going after me for 3 years of SSDI back pay. Same LTD company was supposed to pay me after SSDI started , just a lower amount, the LTD company kept 2 years of it and applied it towards the backpay total they say I owed them.Now I'm too old ( over 66) so now the LTD kicked me out and the SSDI is turning to regular retirement SS this year because of my age. Can this LTD comp garnish my SS retirement benefits ? I'm really worried because SS retirement is all I have .

    Look when they took the money out of my paycheck I did not say WELL OUT OF THE 12 MONTH I CAN ONLY PAY YOU "GOVERNMENT" 5 MONTHS. They took the money so for what ever reason if I get approved 3 years after initial registration date I should be entitled to the 3 years of retroactive pay.

    I remembered 30yrs back I had an issue with my employer(Federal Government)and was on leave without pay and I filed for assistance and was told once I get back to work I will have to pay back every dime back.I pay taxes and you have immigrants who get assistance and never have to pay a penny back.Bullshit!!

    Sadly, part of why I had to quit working was that words quit meaning anything to me at times. Which sucks because I used to be really intelligent. I solved things no one else could and here we are. A body so broken by covid I can't work anymore. 2 years ago, I ended my career as a virtualization engineer/manager. I just submitted paperwork for disability when it became clear I won't recover. I'm over 60, so it may not be worth it? My question: How would backpay work for someone like me? Only the time from submission to hopeful approval, or do they go back after I had to leave work? I'm sorry, I just couldn't keep track of your explanation... 🙄😢 written word helps me.

It takes me forever because I keep forgetting stuff, forget what I am supposed to answer, etc. I don't even know if I did it right. And now they are sending me to not one, but two doctors appointments. Why? I don't know. Everything is in my medical records. And none of my conditions can be faked. weird!

    Hello I just filled for my disability in March but I had filled back in January of 2020 then I called them and told them that I changed my mind and was going to try and work alittle longer. So when I filed in March they went back to 2019 because that was the last time I had made over 20.000 dollars in income for the year. And so I'm wondering if that could count as the 2 years your talking about? Also I'm wondering if I don't see a Dr. Regularly if that will cause my case to be denied?

    Hi Brian, I have a question. I worked right up to the day I had wrist surgery back in 2020 October 27th was last day worked, surgery didnt go well tried going back to work but couldnt. I had other injuries from past surgeries . filed for disability in February of 2023. I looked on my online acount for social security and my file said 80% completed and hit verification letter for the heck of it and it says under their rules they found me disabled on October 27th my last day of work.?? How can this be

      My case was about 2010 I'm 59 just had 3 separate stent. Was lucky lost me first one but second went smooth then third one again had problems. Now working on diabetes type 2 was out of control effecting bacterial infection in organs but gone and still weak hope to feel better. But was disabled from broken neck and surgeon compressed nerve under plate I believe was told. Two years of atrophy and constant pain now permit damage. Just cause surgeon even after nerve conduction test after not before surgery. Oh this gets better. So my company shuts down cause was during bank crises are couldn't work. Saved my 401 k max my whole life to see while all BS going on was hoping I was going to hit 300 k in it. Was growing at times great. Market collapse and that's expected right? Bank comes after my house and 401k dropped to 100 and something. Same bank that is trying to get my home I had to get taxed 65k right off the bat. So goes to them to bail out right? I'm in auto industry but right got money to save banks but fought to not help industry I was in. Then what's funny doctor who did nerve conduction test did my corporal tunner couple years before remember me and I knew him. Runs test says you have compression in neck. Go back and lost it. Surgeron should of done that test first period. So two years past shoulder down atrophies. I Google best othapedic surgeon in our area right? He wanted his MRI which is great. I had two more blown disk and you know the interns under him spotted that and compressed nerve. He fixed me and said top two went well and I felt great no bad back spasms from top disk. He released other nerve but said was like a5 percent chance can repair. My second surgeon was Dr.Daniel Reiw and all heads of states use him and come to our country . Now has wing in NY Presbyterian hospital and number one in teaching technically orthopedic.Im thankfully.Bank if America almost had me lose my home but saved it. Did I mention three years before my soulmate came down with ALS and was hardest crap ever to see her go. Busted my ass but couldn't stop it of coarse. The mother about time Riew was done came down with cancer and helped best I could. But hold my backpay that's classy and can't make this up. I could of waited had another judge but wait 12 plus months again. I saved my house by one day. Yes I'm mad cause my heart will drop me within 3 years at at latest. Had to take with no backpay to save home. Never rented whole life dream of being home owner since day I bought first house at 20. I'm done but it's BS no one will help anyone on hear and to late now anyway. Seen in my mailbox so hope I don't get more spam

    I need help with representation. They have told me repeatedly since 2016 that I was denied SSDI they put me on SSI and consequently I found a letter that was an open. I don’t know my mother had got it and I didn’t have it that says that under the Social Security disability rules that I grew up, I do qualify and so now I went down to surgery. I I said that he’s better but I have says that I didn’t qualify back in 2016. Tell me well that was a long time ago not sure understand and fly peeled they’re saying I didn’t qualify and now I need representation to our plan so that when I go in for this appeal, I can be able to understand exactly what I need to bring.

    I cannot ever get a clear answer on back pay. I was approved in March 2024 and my official disability date was June 2021. It is may 2024 and I haven't received anything yet. No monthly , no backpay.

    I got approved for SSD in September but I still haven’t seen any money from them how long does it take to start seeing a check? They told me that they are trying to figure out how much I am going to be getting back in back pay
    We are going into November now. Do you know if it will be much longer?

    My granddaughter just got approved in Sept 2023 to now. I don't know how back pay works for her. She's 3 years old and has Autism. Now on her paperwork it's saying that she was approved in June 2022. Now this is why I am confused 🤔 because SC is always ripping ppl off. So could someone please help me figure this out.

In your granddaughter's case, if she was approved in September 2023 but her paperwork indicates that she was eligible from June 2022, she may be entitled to back pay for that period.

    I got a letter saying I was supposed to get 2 backpayment checks. One for $1,944, which I received and one for $2,790, which I never received. I saw two other guys with 2 backpayment checks in their hands, but I only got the one $1,944. Is there anyway I can still get my $2,790 check or is it just embezzled??? I got approved for Social Security in 2012. Thanks!

    Question. Filed 06/2021 and as of today my online status finally states as 04/22/22 that DDS has completed the medical review. Now a rep in another state is starting a final review to make sure that you still meet the non medical requirements for Disability requirements. Which could take 2 to 4 weeks? I guess a letter will be coming with decision? Don’t want to get my hopes up since this is an initial application and I know the denial rates but does this sound normal? But they conducted a non medical review in the beginning so why do it again?

      @@thomasalewis340 Just a complete guess, you filed to both? Because of income and assets, SSI wasn't approved, SSDI was approved as you had 40 credits. I would also guess you received back pay...correct?

      So i basically wasn't able to apply for social security, basically till december 2019 but I'm on a 2nd case cause i didn't appeal my first case cause of depression and it was hard to do stuff during 2020 but i remade my 2nd case till sometime that year and they can see that
      So you're telling me that no matter what, i can only go back 12 months for pay no matter if my onset day is december 2019 or august 2016? That's a lot of money to lose, especially if I'm only getting hundreds and not thousands for my monthly payment
      All of this stuff is confusing

    I was electrocuted in june 2001 burned 55% of my body working on a billboard. I applied for disability sometime in 2002 and was denied, (which i couldn't understand why). I'm about to apply again and won't stop untill im approved. Will I get backpay or retro pay from 2002?

    Hey Brian, when I applied for SSI my mother and I had an oral agreement that I would pay her back my fair share if ever approved. Now here we are about 3 weeks away from my hearing. Will the SSI honor this agreement and give me the full backpay from when I applied or will they only give me 2/3 since I have nothing in writing? Thank You

      @@shawnprince8352 first make sure you call Social Security and make sure that they have the correct up-to-date phone number for you you should receive a letter that tells you when your phone call will be but always call and check because I never received the letter when I was approved saying my phone call was at this time and I missed the phone call thank God I called the very next day because they did not have the correct phone number for me

      @@shawnprince8352 once I was approved the following month they started my payments and I got my first payment for back pay one of three payments if you're getting SSD you will get all your back pay at once they only pay up to 2 years back at this point doesn't matter when you applied if you got approved for SSI your back pay will be paid in three increments if it's SSD will get it all at once

    Heifers disease and in 2005 unemployment denied me of getting my unemployment they called and told me that I should be getting disability immediately tried to find another job when they told me I had to pay $800 back from the one payment I got and unemployment since then I've been going job to job disability said they'd only hold me back when my lawyer started filing
