Explained better than anyone so far. Thank you
my on set date is 05012020. I applied for SSDI on 092821. I got unemployment from 040120 to 073121. If I am approved for SSDI. Will my back pay be offset by my unemployment? I live in the State of Texas
what if it took the SSA 4 years to approve past the AOD? Still maximum of 12 months of back (SSDI) pay? What about the other 3 years it took to decide?
What about dac benefits though if a person applied for it in may how long would a person get benefits?
I just recently filed for SSDI. Now the waiting game starts...
I just won my SS Disability case BUT the Judge wants to change my onset date to only one year in arrears from today's date! Can he do that and what can I do to fight for what I'm entitled to without the Judge changing his mind?
I applied in December 2022. Got denied once, then denied with my lawyer. Got a hearing in October 2023. The judge told us that there gonna pass on my information to a psychiatrist and use what they have on file to make a decision. It's July 2024 and I'm still waiting. I feel my lawyers aren't doing anything on my behalf. All my lawyers say is, well we have to wait on the judge. This is stressful! I would've thought by being 100% P&T would help but I guess it doesn't.
Here in West Virginia its supposed to be 2 years some people they went a little feather back they went back 29 months on me with SSI and SSDI
I paid into the SEWER SYSTEM they took 11,OOO from my lump some they told me i should have been getting SSI i didn't get anything, barely got food stamps took 2 years to get approved they haven't stopped taking😢
I filled for SSDI November 17th, 2021. I've been denied twice, (My attorney recently filed my 2nd appeal) My question: When I was denied both times, they deny both SSI/SSDI. I never applied for SSI. By chance I win my case. When determining back pay, will I have to wait the 5 month period for SSDI, which I originally filed for? Or receive the regular back pay for SSI since they deny me that also, even if I didn't apply for it?
Thank you for the info. 👍
How much for dac benefits though?
If I got disability nov 10th 2022 do I have to wait 5 months ? My first hearing was March 2020.
I think this is what happened to me concerning my back pay (5 months rule)? The SSA representative claimed she has legal rights to take some of my back pay (she didn't explain why and was very rude). Anyway, I supposedly got back for 12 months from my onset date.
So they TOOK your money?? 🤬
It’s not your money 💰 .. you have to give most of it back to the government.
I applied 17yrs ago here in TX. Took 1 year for Medicare to kick in, they auto enroll you. I don't even qualify for food stamps, Medicaid, etc. because they say I get too much money! $2k a month isn't that much.
SSA told me I had to be unemployed for a minimum of 1 year before applying, then a normal application took 2yrs & she was spot on.
I applied after a year of unemployment & they took 2yrs to approve my 1st application.
I got a $27k Lump Sum 1st payment, plus $697ea Child to 18yrs old & now, 17yrs later I get $2k a month.
I haven't heard from them since.
I claimed my back, spine, ears & neck because I was in an Explosion, they found me to have Bipolar 😂
Move to NYC -- they'll give you everything & then some.
They went from the day i signed up on June 12 2014 and got my hearing and settlement was March 13 2016
I told the 800 I moved by myself an was getting 600 a month ,so I got a letter saying it was not put in my file an they owe me back pay , that was in June 2023 , now it’s Jan 2024 an haven’t heard nothing but I called they said in process center an can’t tell me nothing , how long does it take to redo my case, sorry so long
If you are approved for SSDI at age 61 for example, does it get moved to SSI once you become eligible for regular SSI? Or do you stay on SSDI as long as you are disabled and unable to work, i guess, when would it change,,, thanks
I am in that exact situation, was hoping to see the answer here
In wisconsin I was TOLD it would change even though amount doesn't. Apparently, it's two different things paid out by two different accounts. I have no idea if it's automatic.
Again this is what I was told. I have been told two different things in regard to what my payment would be so take this for what it is.
When you become eligible for regular Social Security (66 to 67 years old) SSDI switches over to regular Social Security. Same payment amount (+ the usual COLA increases). BTW: SSI is for those who haven't worked enough.
@@sayyedal-afghani exactly 👍
@sayyedal-afghani7896 what about for dac benefits though?
I applied 2020 at the peak of covid-19 one would talk to me until December of 2020 I was verified December 31st 2020 wait until August of 2021 to get a payment for Social Security disability
What about medicaid
So, 5 months evaporates, lawyer gets $6 or $7 thousand, that leaves me a back pay check for around 2 or 3 months , I wish I was made aware ,jeez
Except that these days it can take a couple of years to get approved.
Lawyer fees are limited to a percentage up to a maximum dollar amount so it isn't going to eat up the bulk of the back pay.
Yes it’s 25% or 7200 max
I thought it goes back longer than a year if u been disabled longer like 3 years
It all depends on the date and year they determine when became fully Disabled. Things are all different with this process, not like 10 years ago when I became permanently Disabled.
It does go back longer when it comes to the date you filed for disability. When it comes to the days before you filed for disability they will only go back 1yr for SSDI not SSI, it's called retro pay.
So even though the letter says my onset date is sept 2020 I can’t get paid back that far. So they use that date only for Medicaid or Medicare purposes??
If you have 2 kids under 18 do they get back also
Yes
Does this also apply if you have one kid under 18?
@@MessiahGlenn-c3g yes any kids under 18
@@kevinhobbs9896 alright thank you I have an question I putted I have depression anxiety scoliosis and fatty liver on my ssi application the only thing stopping me from working Is my spine. Do I only need documents for my scoliosis since that's the only thing stopping me from working And how much is the pay back thing for kids under 18? He doesnt have an disability or anything but I did put down I have an kid under 18
@@MessiahGlenn-c3gyour children under 18 get a check also….it’s have of what you qualify for….if you get $2000 per month your child will receive $1000 per month up until 18 or graduation day.
You get screwed on your back pay. Number 1 the law firm takes there cut.
Number 2 if you were working and used long term disability your insurance company then takes back the cut of money they paid you.
You have to simplify your explanation of back pay. Respectfully, you are all over the place. My recommendation is, use an eraseable white board and write down the dates & speak slower.
Go to settings and change your playback speed to 75%. That will slow down his talking. I personally don’t think he is talking fast but I have used that feature for other people.
I understood him better than anyone so far.
