      Not true. The trend is actually going in exactly the other direction as big music labels are loosing power over artists as they can do marketing alone by themselves

    You can post your bootlegs, edits reworks etc., to RUclips in most cases now I believe. The screening technology will check your work before you publish it and will tell you if the rights holder will allow you to post it. Like he said though, it can’t be monitized for your gain. The ad revenue goes to the original rights holders ie., the artist labels.

      What if you don't have any samples or anything from the original track and only use like hardly any of the melody or notes on a 5+ minute track that is otherwise original composition. I will remix stuff and make it completely different tracks with original composition in them coz I'm like what's the point of a remix if you're just basically making another version of the same track with the exact same parts etc.

    I've just done an edit to one of my favourite songs, sent it to the original producer -- he liked it and is considering releasing it as an official remix. If you put the effort in to put your own spin on a track you like, it's totally worth showing the original artist your work because you never know what may come of it.

    Thanks Jon. This is a really informative vlog today. You've provided real examples of what the labels and artists do when an "illegal' remix is found. It rarely comes down to suing and and extended court cases. I personally think the labels like unsolicited edits and remixes since it gives them all the power when negotiating a deal. Either they remove your song or they take the rights and get 99.9% of any money made. I agree with you on that a better, updated solution is needed for copyright infringement

      There are entire departments & firms dedicated to scanning the internet for copyrighted material (including memes) to negotiate settlements. I have seen a few interviews of content creators who disclosed that companies that own the copyrights have settled for a portion of ownership over the content creators business & influencer accounts.

    Good idea to always put a fair use disclaimer in your remix and not monetize it if you do not have permission!

    As someone who does a lot of covers, I don't try to release them on stores unless I pay a share to the publisher through distrokid/soundrop.
    As for youtube/sc there won't be any troubles as long as it is specified that it's a cover. In the worst case you receive a copyright notice on youtube and the right owners monetizes your video. But I have never received a strike for a cover song (and I wish I will never, lol)
    Although I have sent strikes myself when people publish my original works without my consent (such as "promo" channels)
    From the artist perspective, covers are cool if the original gets credits

    Re: Your remix of Nina Simone and being released and signed to Universal: As an unknown producer, you would approach, for example, Universal and ask them for the stems of Nina Simone to remix. They would probably say no, right? Scenario No.2: as in your case, you just do it without their permission. It draws Universal's attention if it gets successful (as in your case); they contact you and offer you an 'offer you can't refuse". Ok, but you got a) noticed by Universal and b) got signed to them. Both a) and b) would not have happened if you just approached them beforehand. So my question is: is it worth the risk to just "go for it" to get noticed, and are the risks (to get sued and NOT get offered any other option) too great? In other words, is going for it without prior permission a good option?

    If someone remixes your track and gets like 5 million plays, ant it's unofficial, would you strike the channel/person or let it be because you're probably getting exposure?

      I would require them to share the royalties and to give songwriting credits (and to give all the songwriting royalties to me). If they ignored or denied, I would force it down

      @@EdenSnowled Yeah, I know and that's what I hate about the music industry. Even when it's a remix. Give the original creator a kickback but not a 100%. And (s)he's asking to get it taken down. When all the original artist is getting is free promotion. If it truly is a bad remix or labeled as a remix yes then please go for the legal takedown. But when it's a mere bootleg. why a takedown? Reminds me of what nintendo tried to do to streamers and youtube gamers. They failed hard. Music is always to be heard and shared by all People nowadays get hung up on money and fame. Fuck that let music be music. If remixes and covers are to be taken down then music would die instantly. Just look at the broken copyright system on youtube now. People getting blocked for playing a cover/remix and get taken down because they used a part of a song for education. GTFO music is meant to be shared and remixes/bootlegs and covers are part of the very nature of music. In my humble opinion. Where words fail, music speaks. I rest my case.

      Lalaland a sample is different than remixing... using a sample is twisting it for your own use and yeah you usually or most of the time should get all of the royalties but if you remix, you have to credit the original creator and at minimum share royalties... why getting so mad?

      I would say the best thing you can do is contact the person who made the remix of your track because that person wants to give you the full rights of that work but also want a little percentage of the remix but obviously the original artist will get more because is a remix of his or her work .. and instead of people being mad of others creating a remix of their hit song they should be flattered because if it wasn't for that dj remixer or editor that artist wouldn't never had found a better version of their song and what the artist should do is give that person who make the remix of their song an opportunity to work with the original artist of the song to have the remix released on your next big album....if you can see is already a huge hit I don't see why not get in contact with the person who created the remix....but don't flag them down ...work something out ...I do remixes also and I wish someone would give me the opportunity to work with me also.

    I'd be cautious with your laptop too. Same issue happened to my friend and one day he wasn't able to turn it on anymore. He lost everything on it. If anything, make sure all your stuff is backed up!!!!!

    Hi Jon! Great job! Thanks for that! I have additional question - what do you think about beatbox interpretation of famous original songs? I am little bit confused how it looks with law. Lets say I take Sweet Dreams song and make it 100% beatbox way so actually I use idea of song but I make everything by my mouth. What then? Do I need a license - if yes, which type? What do you think ? Also how would be called - cover, beatbox cover or something else? Would be perfect if you can answer that question! Best regards, Karol.

    Thanks. Ive almost finished a remix that I just started for fun....just to see if it could be done, and it's turned out surprisingly well. I wanted to let people hear it but because it uses an acapella that I ripped from the original track, I'm being careful. Just as I'd expect my own music copyright to be respected, I view others work with the same respect. I tried to contact the artists who wrote the song, but it's not possible to contact them directly. I think I need to find out who their publisher is, and ask them for permission. I don't want to make any money from the track, but still want to do it legally. Thanks for the advice Jon .

    4:45 Not in the UK (and possibly the EU). Covers are totally legal under copyright law.

    Thanks dude for the video it's indeed an important topic to discuss cause it gets confusing very easy i just wanted to ask about a case when you make an unofficial track using some kinda accaplla , and release a track on soundcloud like for free with a free download without any label release or without gaining any money from it , let's say for a tribute sake, maybe you loved a track/acapella or melody and as an artist you want to poor your own thing your way does it count as a trouble ?

    This topic was actually on my mind this morning as I just watched some couple of days ago a mini documentary about Burial's 'Untrue' album as it turned this month 10 years after its releasing. I already knew that, but watching this made me ask myself once again how the fuck Hyperdub - the label - cleared all that samples used on the album?? They are a lot. And they are taken from major artists. If so, perhaps they didn't make any money with this album. And if they didn't cleared the samples, how come they didn't get sued? The album got pretty big, and not just in the underground scene.

    Hey Jon, first of all a big thanks for all the insights you give us, really appreciate it :-) Could you do a video on how to start from zero following? Meaning tracks are release ready and have a high production quality, just with no existing social media yet. Would you just release the first couple of tracks for free to gain a following? If yes, how and where? What I have in mind are youtube promo channels for example. Would love to hear which steps you would take if you had to start from zero with the knowledge you have now.       VOYD hey, you may contact RUclips channels like trap city, trap nation etc which have a large number of followers , they provide their business email in their description. if your tracks are really nice they will surely upload it . and your tracks will get a wide audience. by the way if you are expecting that your music can get u earn money then it is necessary to always copy right your original product in digital platform before submitting to anyone else.

    What about spotify? You said maybe they don't know when u will upload it to SoundCloud or RUclips. But what happens when I upload an unoffcial remix to Spotify?

    Is it possible to still call a track a cover if you add new elements to it? for example if i was to create a cover and add my own melody over it for my own extra flavour, would that be allowed? Or would that be too close to being a remix/bootleg? I've been producing for some years but i've never done covers, I've always made original music or remixes of friends music. I would love a reply, thanks!

    I just threw boulder into some mud lifted the boulder out of the mud, swirled the mud added water with a stick and threw the boulder back into the mud recorded all of that put it into my DAW released it now I’m afraid I might get sued.

    What about a total interpolation? I used and totally reperformed a foreign rap song and did it in english. Melody is mostly the same but everything re performed and vocals r totally original.

    Correct me if im wrong but you still can make a remix and put it up for free grabs. In that case you dont make any money of of it, just exposure for you.

    Literally every remix I upload to SoundCloud gets a copyright strike. Is there anything I can do? Is there any hope for me?

      brisvegan89 Try to add some Little empty space in the begining, solved it for me in the past. Tho Can Not recommend to Upload copyright Tracks as they closed my Channel with about 10.000+ Follower. Just my experience with SC and Copyright uploads. But give it a Go, and try for yourself. :)

      yeah ... its a total pain, i will maybe consult a lawyer, have heared about a simmilar situation with a Pro Gamer Account who was Deleted by a Company and The Lawyer made them to bring it back with all details and Followers .. let's see.       Unless you’re famous, they’ll just ignore you. if you can’t guarantee more exposure and money for them outside their own current consumer base, then they don’t care about you, which is sad. Trust me I’ve tried

      @@TK_Trickster If they're not bothered about replying, I'd almost take it as a "go on then, you're nobody and we don't give a fuck about you, unless you blow up because of it". Can always start negotiating afterwards if you're lucky to get noticed and even if you give all the royalties to them, you're no longer a nobody and have made a bit of a name for yourself.

    what you should mention about cover versions is that the original artists hasnt got a choice whether he wants to grant you a license or not. Cover licenses (so called mechanical license) are not negotiable. thats why there are so many EDM covers of tracks surfacing recently. instead of begging someone to get right to remix a tune (which they will either never grant or will want a huge amount of money), just find a decent singer that sounds similar, recreate the sounds and your golden.

    I do Reactions to covers and they are great bc they go into Share mode. Your vid is 3 years old, so I ma not sure if its relevant. All you have to do is dispute it. However, Reaction videos are different than covers. I can always Trim out the music or mute the song. I then change from Reaction to Review. I came here bc I saw Sia - Unstoppable
    and there's a couple of versions with movies from the Professional and Wonder Woman. How is this possible? Is that called a mashup?

    What if the cover is in another language??? (english to spanish ) (spanish to english).
    Alot of popular songs are exact translations or modified translation or the lyrics are diff in another language but the melody is same ???? What about these examples? Are they legal?

    Jon would I get in trouble for using a vocal sample from splice? It's a whole vocal song sample called "Rise" by Reniit. I looked up the song on spoify and found out it's a Actual song . But on the sample pack cover it States that all samples are available to use commercially. I'm Confused can you please help me! I just don't want to put a lot to work on this song based on the vocals and find out at the end that I can't use it. Thank you for all your help with Music🎼🎵🎶🎹🔊

    I've had so, so many SoundClouds banned. My channel on RUclips, this channel is hanging by a thread. So, so many strikes. I've had some success with my remixes. But never had a label knocking except when I'm being served with a "cease and desist" 🤦‍♂️🤷‍♂️

    Usually why is best to front money to lease a beat and/or hook save you time and lots more money in the long run. If you’re using all that energy use it wisely. OWNERSHIP
