- forced arbitration clauses should not be enforceable
- class action waiver clauses should not be enforceable
they probably aren't... its just perception & inconvenience.

It has failed in US courts already, as have many other TOS, as have NDAs. Companies put them in there to scare you away from trying to sue or talk, the same as they send "Cease and Desist" letters with empty threats of implied lawsuits that have no chance of even being heard in court.
The legal precedent is, more or less, that because nobody can get a job or use a product without signing these absurdly long, tinyprint contracts with incredibly unfavourable terms that no reasonable person could be expected to read or get a lawyer to look over, they aren't an enforceable contract (and indeed, even enforceable contracts sometimes aren't, if the terms are too onerous).
Edit: Of course, even better is the fact that this can backfire magnificently, since the arbitration has to be paid for by the corporation, not the plaintiffs. It then doesn't even matter how the arbitrators rule, all that matters is you make Roku pay for hundreds of thousands of them, at something like 50k a session.

Whats funny (or not), is my dad bought a Roku TV, just because he wanted a bigger TV. He's NEVER connected it to the internet (I don't think he knows how), and he just uses the antenna and the RCA jacks for a DVD player. But hey, he's happy so I guess that's what matters. I just opted for a non smart TV and skipped the junk. (Insignia N10). Anything I want to "stream" I can do from my firewalled PC.

I hate that “updates” are used for this term. People will mindlessly click this to update, being trained in the fact that updates are important for security. I don’t think 99% of real users read this.

@@Splarkszter I disabled automatic updates on my smart TV. And then they turned back on, because they pushed an update that added ads to it. Which of course nobody would opt in to. Ads are, by definition, the thing you don't want to watch.
It's also not obvious to me that accepting the terms after they've already had the breach means the terms apply to class action suits brought because of the breach.

Some software/hardware have updates that don't ask and are mandatory. No opt in, nothing, the software/device just updates itself silently. It's how ppl are getting forced to agree to mandatory arbitration by Roku : they simply have no choice if they don't want an expensive paper-weight taking up space.
The injecting ads via hdmi is actually insane. Idk how anyone is okay with that. And the forced arbitration is even worse. For people who like to own what they buy, and people who care about their rights, the future is looking more and more bleak each month.

Thankfully they've just filed a patent. That doesn't even mean they have the ability to do it yet. For example, Ford filed a patent for self-repossessing cars, but the self dricing technology is probably a decade from being that viable.

I sent Roku a letter to opt out weeks ago, and I haven't received any confirmation that they received it. I called Roku, and they've had to "escalate my ticket". Still nothing. I have zero confirmation that they received my opt out, so as far as courts are concerned, I may as well have not mailed it. They can just deny that I opted out because there's no electronic record.

It isnt legally binding. As roku also cannot provide evidence that you agreed or even were able to read the terms of service.
But then again, it will not be on roku to sue you, it will be on you to sue them, so that part only comes into play the moment you actually sue them.
That's the rub. If you didn't sign anything, you didn't agree to anything. Just because a button was clicked means nothing.
When I apply for a remote job, they don't give me the option to "agree" and that's it. They also require my signature. Clicking agree is not binding. Someone needs to sue just to sue.
Not only did I disable my roku on my tv because of this, I also will never buy roku or a tv with roku ever again. In fact, I will go out of my way to disparage and discourage the purchase of roku to anyone that asks and, being an electronics guy, I get asked commonly.

He was told costco no longer carries those, but most TVs have the app built in, along with ALL the others.

I'm in law school rn and I came so close to opting out of the Roku terms just for the fuck of it (which you could do per the terms, but only by mailing a letter to their corporate address within 30 days) and now I really regret not doing it because-- ahh!! This data breach probably exactly why they updated their terms!

This has been going on for at least a full decade in the video game industry: microtransactions, DLCs only adding 10% more content for 50% of the base game's price, games being shipped pretty much in a pre-alpha state, servers having a logic seizure or something, etc..
Only now do we see gamers in general being fed up with all but the absolutely most popular games/franchises, with good games getting a bigger slice of the cake on average this year than ripoffs.
But it's taken so long. During that time, several beloved franchises have been destroyed, beloved studios have been bought up, drained of developers and shut down, CEOs, investors, shareholders and executives in general have been gorging on the money the games raked in, and in general the video game industry is in an absolutely miserable state.

Because of all of this, I told myself the next "TV" I get, I should just get a big screen computer monitor so I don't have to deal with smart TV crap... Cut to the other day I'm browsing electronics, look at monitors, and what do I find? SMART MONITORS.

This frustrates me on so many levels. For one thing, now monitors are becoming infected with this crap. For another thing, THE HELL DO YOU MEAN SMART MONITOR??? It's not a smart monitor, it's either a smart TV with the antenna port removed OR it's an all-in-one PC with a shittier OS, shittier specs and no ability to upgrade the hardware plus all the other bullshit that comes with smart TVs.
You can't win unless you go back to using older tech before all these "smart" features were embedded into the hardware. Maybe that's why I keep seeing articles of kids these days playing more retro games instead of modern releases cause they're done with the bullshit and found retro games don't try to nickel and dime you for horse armor.

You are spot on on this. These companies want slaves, not citizens who pay, and pay whatever, take whatever is tossed at them with bended knee and a smile - if you know what is good for them. So says someone who, if Benjamin Franklin was alive, would be a double first cousin. People ought to remember, companies today in America have all the rights of citizens without any of the burdens of it. It was one the worse ruling from the Supreme Court in this past hundred years granting this win-win option to them, and the people increasingly are under the weight more excessive than King George ever had a wet-dream for.
Individuals in the company have the rights of citizens however a collective cannot be considered a citizen.

I own a Roku TV (a gift). I first started noticing the forced ad control when I woke up one morning and found that my background had been changed to some shitty movie's theme. It has randomly happened several times since. It pisses me off to no end. I DESPISE being harassed--no, not "bothered", HARASSED--by ads and "promotions". And they only call it that to legally avoid being accused of being ads.
You can opt out of that. If you keep it check Settings and turn it off. Total violation imo
The whole "When are you going to want to sue them, anyway?" response ages like milk on a summer day, anyway. I remember back in 2012 when I started getting upset about this sort of behavior, the response I usually got was along the lines of "Well I don't see myself ever wanting to sue Blizzard."
About a decade later and a lot of people were shouting and screaming about suing Blizzard, only to discover they'd agreed to a terms of service that forbade it. And all I had to say was "Told you so."
In 2024 alone, I've had nine different companies suddenly update their ToS to include or expand forced arbitration. If all the businesses are doing this, it is not to the benefit of the consumer.
Perfect time to switch to 100% FOSS software! Avoid proprietary software, and continue the fight for free software, which should never be impacted this way!
You may know of this already, but Ubisoft shut down the servers for the game The Crew which is online only for whatever reason. And obviously nobody got a refund or anything from not being able to play the game anymore. But here's where it gets interesting, Ubisoft has taken away the license from owners of the game, you can't launch it from steam or the ubisoft launcher anymore.

@@samuelswayze It should, but so should almost all eula's on software you have to agree to on install vs before purchase. This case is just more blatant. Since this was forced on the user over the internet I see it like any other sort of malware. I'd like to see it prosecuted like ransom ware, same for companies that remote remove features that came with something but allow you to subscribe to get it back. That latter should also be extortion or something similar.

A lot of hospitality TVs are not internet connectable, or you have to host the content on a server to push network content to them. They're also generally more durable and have more ports.
You can also just buy a big computer monitor.
Just buy a dumb TV or simply don’t connect the TV to the internet if you need a modern one

Not only giving up your rights to sue, but the more we allow it, the more precedent it will get. Its also affecting contractual law, because it's not allowing you to negotiate the terms, but rather forcing you to agree. And its interfering with consumer protections, because its disabling a product based on terms you didn't agree to at the sale. Its them trying to say "you need to organize a remedy with us, not the court" so they can screw you over whenever you have a complaint because they make the terms of the remedy.
Unless you want the future of owning nothing and living in the pod, you need to start rejecting this on principle instead of "who cares about watch history"?

Thanks for the hdmi video.. I was able to block roku’s software domain in my router and my tv cannot auto update anymore. From now on i will check for changes in the updates and will only allow if it doesnt force features on my tv.

my tv is a roku smart tv. I was watching some MP4's of a show (that's still on the air and available on stream *wink*) that I had on an external hard drive. I played it on my Xbox using VLC player, roku popped a little notification saying something to the degree of "hey, you should watch this show on one of these platforms!". needless to say my tv is now offline
100% agree. We are being bought and sold. I still can't believe having to watch advertisements on these platforms. One of the primary reasons why people switched away from cable.

I dropped Vultr after I saw you video on there forced arbitration. I got around their 'click here to accept' by using the developer tools in chrome to temporarily delete the element blocking access to their site. turns out I had to email them to delete my account. Any service that pulls this shit I leave. Sick of being held hostage by these service and it's getting difficult to stay away from it..
We need a law that requires companies to grant the same rights and methods for cancelling a service as they offer for customers to start a service.
If you can sign up with a button you need to be able to cancel via a button.

Comcast recently added forced arbitration as well. They put an opt out clause but you have to mail it to them within 30 days of service start which has literally already long passed for most of their customers

@@runed0s86 as someone who used to work for them they basically keep trying to roll you into a new "promotion" to get you to pay for more services because the "normal" price is completely absurd. Just talk to their retention department and they will get you something. or worst case cancel your service and start it up again in someone else's name, but I highly doubt you'll need to do that.
I think this would go against the terms of the original service agreement. However, of course, they put this b.s. into their "we may amend the terms from time to time etc" in their ToS at the time of signing. These slimy buggers.

The irony of all this is some of us bought a Roku STB because we didn't want to deal with Google's shady practices and their dangerous fork of Linux. Also knowing this OS was Roku's own and not like Amazon's modified version of Android.

How do they prove in court that it was me who clicked I agree? If my guest clicks it I am not bound by that .If I buy used tv and previous owner clicked it I am not bound by it. If my 4 year old kid clicks it I am not bound by it. How do they prove that I clicked it?

Personal property rights need to be reenforced. No organization acts like you have a right to anything, not your own time, not your own money, not your own property, not your own privacy. Whether it's the government or some shady company, none of them are respecting you or your property. We own next to nothing now, not your house, not your car, not your phone nor computer, and you barely still own yourself. Private property of the individual means next to nothing, and that must be fixed.
When Peloton pulled their BS a few years ago making their products unusable if you don't buy a subscription I woke up. I buy NOTHING if it only works if it's temporarily licensed. Gleim Aviation is now pulling this BS. You can pay hundreds of dollars for their learning material, but the audio media portions are only good for a year. I contacted them about it asked why anyone would enter such a deal when you can go to other sources for the same thing and own it. No response. They seem to be trying to get on the same train of taking advantage of customers. Louis is correct, shut this practice down.
There is a second part to the history lesson. Unfortunately part of how the U. S. were founded is also the reason why forced arbitration “works” in the U. S.. Due to history the acceptance of state authorities in the U. S. is much more limited. That’s why the U. S. states have much more power compared to federated states in other countries, that’s why the 2nd amendment exists, that’s why libertarianism plays a much larger role in U. S. politics and society than in other countries. On the contrary, given how e. g. European countries went from autocracies to democracies, there is still a greater consensus in these countries that the state has a monopoly on the legal use of force, which includes not just executive force, but legislative and judicial force. As I said before, in my country’s constitution there is an article that nobody shall be removed from the jurisdiction of their lawful judge. In that context, if the state allowed forced arbitration, it would be not just a violation of our constitutional rights, but also of the monopoly on the legal use of force which says that only the state in form of courts is authorized to dispense justice.

I'm glad someone is out there bringing this stuff to light. This one of the many reasons I'm not buying smart TVs. I buy old TVs that don't have any software in them. I have computers to hook to them via HDMI and watch what ever I want. Also, my computers are running Linux one, or two, that have Windows 10 or 7. I worked in the computer field for over 15 years, So I saw this coming. The phones are already becoming an issue. My phone is an old Moto z4. But some day I will have to get something newer, and I dread it. I'm really starting to hate tech for this reason.
All we had to do is not buy their DVR years ago. (At least in USA. They don't exist in Europe and I'm grateful.)

My Roku is an attachment to my TV. Right now and probably forever it's a screen saver that will be disconnected if Roku continues with this policy. I only got it because Crunchyroll, Daily Wire, and HBO Max weren't available on my TV. That's not the case anymore. Removing it will be an easy thing.

A friend wanted to replace the current, perfectly operational TV with cable signal for a "smart" option. I said to that person "do not" especially if it's a Roku. Refrain for these vile options.

The thing about Discord's TOS is that, if you can't resolve your dispute with them after 60 days from the time you start working with them, you can take them to court then. At least, that's how I interpreted it. It's hard to tell though, since they use such complex language in their TOS document.

Sure, they may change the conditions and force you to state that you accept forced arbitration. But I don't think the courts would agree that you have willingly accepted forced arbitration.
So simply do what Americans are generally inclined to do. Sue them. And see what the courts say.

I worked at a large cell phone carrier and was taking a business law class at the same time. We had a lecture on contracts and I decided to read the agreement we made customers sign when they wanted a new phone financed. It was a forced arbitration contract. They’re all the same for all carriers.

@@donavonlarney what I mean is that the "agreement" is likely not enforceable, and not within the bounds of current contract laws, etc. But, it has to get to court to get to that point of it being ruled as not legal..... so yeah.

Glad I live in Europe. Any change of contract needs to be agreed by both parties, so next to a yes button is a no button. And they CANNOT alter services that you signed up for. And any contract has to be available in the same format to opt out as the method you opted in with, and at LEAST as easy.

also through contract law, any unlawful thing in a contract makes the contract void. so forcing people to sign to agree would make the contract itself void. it's an unlawful contract due to the FAIR act violated.
for those who dont know. to hold businesses accountable u want a court system, NOT arbitrations which generally are rigged and business try to use them to get out of legal accountability.
ups(the brown trucks transportation company) actually also did this on their applications for package handler in ontairo california. in order to proceed with the job application you had to sign the agreement. there was no disagree option.

My Roku TV has never had WiFi privileges. All it's gotten since I bought it is 120 V and HDMI inputs.
