Thanks for giving Tota ram and Puna ram judgement of Hon'ble Supreme Court. I have one problems. One gentlemen has sold his plot to a distance from person who has sold same plot to me within 8 months. It is a be_lagaandeeh plot from 1910. And no mutations is required for any be_ lagaan deeh plot by circle officer of area. Here in first stage original owner was living in that plot and after selling in 2001 he was residing in same plot as usual. When I purchased this plot from his relationship, first man asked to give him permission to staying in this half built home which was given honorarium. After 8 years first original man died but his son and his family did not vacated and lived as usual and blocked giving any advance upfront called rent ( it's a village and rent is below 500 rupee). In 2011 send notice after failing his father commitment to pay rent. Then later his son adjoining the hands with local cheapest quality anti social elements, and trying to abuse continuous ly. Second notice was given but not replied After sending third notice, he says.. That it is his Patterns property Case has been filed on court in November 2021 and notice has been issued in October
Not only settled possession, it must be an open possession where owner must be aware of the possession of tenant and still doesn't object to it... Then only adverse possession applies. Secret possession does not entitle anyone to claim adverse possession even if it is a settled possession of more than 12 years.

There is no way you can evict a trespasser in one day. That India doesn't exist. There is so much harassment and bribery in lawful eviction, that God save everyone from going to court. Judge को घर किराए पर दिया था 5 साल पहले 3 साल तक तो बराबर किराया आता रहा और हर साल rent agreement भी अपडेट होता रहा लेकिन उसके बाद ना रेंट एग्रीमेंट भी अपडेट नहीं हुआ और ना किराया आता है judge बात करने को राज़ी नहीं है और ना ख़ाली कर रहा है कोठी में मोज कर रहा है अब क्या करूँ

Iska answer to main bhi de sakta hun.. if the tenant is paying Electricity bill or similar other bills (landline/gas) which is not on tenant's name but to the real owner's name then the tenant can't even claim for such possession. So you can sleep peacefully and enjoy your rent :)

Not only settled possession, it must be an open possession where owner must be aware of the possession of tenant and still doesn't object to it... Then only adverse possession applies. Secret possession does not entitle anyone to claim adverse possession even if it is a settled possession of more than 12 years.

My neighbor in village constructed a small temple on my land while i was in army. The temple built was in residential area and next to my house and it was all intentional as we were not on good terms. Now i got retired and thought to expand my house but found out 80% of the temple is on my property and 20% on his. So now how to acquire my land again.

Kanoon toh aisa hi hona chahiye ke jo Malik hai, Jiske Naam Property registered hai( clear registration no jhol jhaal) hai. Jo uss property ka waris hai, jiske naam bills of municipality, electricity aate hai , usse property aur possession mil na hi chahiye.( The municipality and electric company cannot do illegal transfer( jo corruption karte hai usse saja mil ni hi chahiye)

At time of my grandma they have given one property on rent with rent of only few rupees, it went for long time because in those days no one need them, but as he was not increasing rent uncle told him that leave the property but he didn't listen
So we went to court, but he has produced fake witnesses by giving money result came on his side, 2 times we lost the case, now the person who took on rent has died & his kids are not ready to leave that place even we sent them notice, it is actually a shop on road but they are living in that shop & now we need that property because of some financial issues

Judge को घर किराए पर दिया था 5 साल पहले
3 साल तक तो बराबर किराया आता रहा और हर साल rent agreement भी अपडेट होता रहा
लेकिन उसके बाद ना रेंट एग्रीमेंट भी अपडेट नहीं हुआ और ना किराया आता है judge बात करने को राज़ी नहीं है और ना ख़ाली कर रहा है

Sir my tenant is a good person doing business in our land but if 12 years passes and if he asked for possession then can we vacate him legally, every 3 year we makes agreement now 9 years passed
Iska answer to main bhi de sakta hun.. if the tenant is paying Electricity bill or similar other bills (landline/gas) which is not on tenant's name but to the real owner's name then the tenant can't even claim for such possession. So you can sleep peacefully and enjoy your rent :)
