    Wow, thanks for this video, I wrote an assignment for CIM and included a fair few sections. My tutor reviewed it and said to "be very careful" (which translates to, it's a lot of work so I don't want to tell you to rewrite it, but you really should) because "PECR is extremely clear". Apparently not so much. I was shitting the bed until I watched this.

    I hope you don't mind I have a question if I have a list of cold data but all ltd companies, and I have call recording set up on my phones linking the conversations with the account or data as such, can I use the audio recording of the consent, ei them saying it's ok for us to send over an email?

      Thanks for your question Kristian! You'll appreciate we can't give legal advice and each situation is very fact specific and you have very specific facts here! So, first principles... On records of consent, the key is to be able to prove who consented to what, when, against what privacy notice etc. On call recordings, there are specific rules per country but essentially you need prior consent from everyone on the call before you can record it (in the US, some states vary but it's the right starting point). On consent and B2B emails (as we define B2B in the video), it's not necessary as per the video. On lawfulness, you need to have collected the personal data lawfully in the first place and still have to comply with all of GDPR on retention, notices etc. Hope those first principles help!

    Came here for clarification about cold emailing potential clients as a freelance web developer, going away feeling 100 times more confused. Not a helpful video ☹️

      Sorry you feel that way, it's not what we generally hear on our videos. High level summary (not legal advice): email marketing to legal entities like Ltds and LLPs in the UK can be done on legitimate interests (do a legitimate interest assessment, obtain the info fairly etc) whereas email marketing to individuals, sole practitioners and other non-legal entities like unincorporated partnerships needs consent or soft opt-in. Hope that clarifies things! It is something you need to work through, we aim to make it easier to do so.
