    Nobody killed for marrying, but arvey malhotra is indirectly killed by society for being gay, and thousands of other like him living a life of hell.
    This law is needed. Enough bloodshed.
    Im straight male, but this demeaning a person based on sexuality (which is not in his /her control) is absolutely cowardice and unjust. We have thousands of other pbm where other humans are affected. These people don't harm anybody. Let them have a life with dignity and respect.

    Even the Hindu mythology narrates stories of same-sex relationships and also mentions about the existence of transgender deities. The discrimination that the lgbtq community faces today in india is solely an outcome of ignorance. They can't get away with saying same sex marriage can't be legalized because it will hurt religious sentiments. Great to hear so many lawyers voicing their thoughts.       What is parliament? It is a body that represent the will of the people. SSM must be debated in parliament with all it's complexities and challenges and not imposed on Indian people by non elected. Judiciary can only interpret law not make new law or ask parliament to make a new law.

Why should the rights of minority depend on the will of the majority. If LGBT people get their rights, their life will improve and it will not affect the lives of heterosexual people. But if it goes to parliament, then I don't trust that they can decide in favor of minority.

      LGBT people have all the rights that any citizen need for their development.
      Marriage is a social institution that was created solely for the protection of and granting legal rights to children and protection of family.
      Marriage is a universal and time tested institution.
      LGBT people don't need marriage as they can't procreate and have family. Just because two people are living together doesn't make them equivalent to husband and wife. Role of husband and wife are defined (these roles can evolve based on nature of society and economy) but not to extent where they lose their entire meaning

      @@junaid1682 technically no one (legally) can stop any heterosexual adults in engaging in a relationship as long as one/both of them are not married to someone else. There are various factors to this like moral, social & ethical factors why incest is a strict no. But the main reason to avoid inbreeding is there can be genetic malfunctions to put it in a simple way. This has nothing to do with same gender marriage issue.

      Many incest laws invoke this concept of genetics. But this rationale won’t withstand close scrutiny or the march of technology. If genetics is the issue, just get a vasectomy. Then people can have their sisters. Or skip the vasectomy and bang your brother. Gay sex can’t make a baby, so the problem is solved.

      Please look at what transgender is defined as in the transgender protection act of 2019 that *this* government passed.
      Which is not to say that there are no man & woman but if someone who was born male registers with the authorities as being a transgender female, then yes, they are not to be considered as male anymore. This is the law. You would understand this if you watch the whole proceedings and not juicy tidbits from some very limited clips.

    Here's a thing, a biological man IS a biological man, this can't be changed I accept that... But at the same time the people who are different than us, the people of LGBTQ community they also deserve the same rights as any other human in this country...       Who gets to decide who is biological enough to be called a "biological man"? What if a man doesn't have XY chromosomes but has XYX or some other rare form, does that disqualifies him as being a man even though his body is male? What if a person is born with a male body but has a female brain inside of their body and feels like a woman? Should we call them female and ignore their male body or should we call them male and ignore that they have a female brain and that their brain is not male? Either way we would be ignoring reality and a biological part of their body which doesn't completely conform to "biological male" or "biological female". All of this can be avoided by allowing gay people to be married instead of discriminating by gender.

There are two genders only, A man and woman. A man is biological male with a XY chromosome that can produce sperms. A female is someone that has XX chromosome and can mestruate also produce eggs. If there are alterations in the chromosome that means something have must gone wrong but doesn't change the science that having XY couldn't be a male or same with female. You can think and feel whatever you are but can't change the molecular level, which is your DNA 🧬 which all trillion of your cell identies. "A donkey dressing up into horse can never make it a horse." Doesn't matter what you identify it's your perception if you wanna stay in that delusion, good for you. Accepting the reality of what you are is called self love. Period.

    I think we should legalise same-sex marriages because first of all being able to identify and come out as gay and lesbian is such a stigma in our country and most people who come out to be a part of LGBTQ are disowned most of the times these people rely on their significant others for emotional, moral and financial support too. If these same sex couple marriage is being granted in our country most orphans will be able to have a home because people from these communities are the ones who are very enthusiastic and passionate about adopting

    I think adoption is such a center for same sex marriages too! it can literally change a kids life , which is much more likely to happen in such an arrangement.
    I mean its equal to giving someone a life. Everyday i cross by the red light and see children being beaten up ,having to work hard in the sun etc my heart aches even if its a 100 kid s being adopted its giving 100 kids a new life!

      You know this right ..that even after "same sex marriage" is legalized, these people can only adopt individually, And not as parents. Because adoption is under a separate law, vis- the juvenile justice act and the hindu personal law. So, even after being a "married couple" the adopted child will legally and officially have a single parent.
      Also, there's nothing stopping them from adopting now. Why wait for marriage ? It's just a sham argument that after marriage they'll adopt.

That's why the majority of people you see out there are comfortable being born and living as the gender they were assigned at birth on the basis of their sex. But at the same time, gender is also psychological. You are a man because you were born a male and you psychologically perceive yourself to be one. That's the norm but it isn't true for some people who may be trans or non binary. So it's not that simple

    again, the concept of sex, gender and sexuality is different. Sex is the mapping of your chromosomes, you can be XY, XX, XYX and its generally categorised as AMAB(assigned male at birth), AFAB, or intersex. The concept of sex is that, and all the "biology" these people speak of.
    Gender is a social construct, it is a function of societal expectations and features based on our bodies. It is a huge and broad spectrum. Identity or Gender identity, is formed in a human child within four or five years of age. And identity can evolve and nuances can be discovered within oneself for years on end. If your identity matches with that assigned at your birth, you are cisgender. And if you're not, you maybe non-binary, genderfluid or transgender.
    Sexuality is different, it is who you are attracted to, you can be attracted to your own gender (homosexual - gay/lesbian), other gender (heterosexual/straight), two or more genders (bisexual), irrespective of gender (pansexual) or you might feel no attraction (asexual), and multiple others. And although straights, and cis people make up the majority, queer people, basically everyone who is everyone not cis or straight, have existed since there were humans, are existing, and will keep existing forever.
    Just give this a quick read before spewing the most illogical bullshit known to man.

    1. Because of the societal pressure and stigma against gay people, many gay men still marry straight women. The lives of these men and women is far worse than hell! Loneliness becomes their life. Hence, Gay people should be allowed to marry.
    2. However, gay rights should stop here with marriage, health insurance, etc. Trans women should not be allowed to participate in women's competitions or should not able to get jobs under women's quota. Create a completely different category for gay and trans people legally. Just like there are men's and women's tournaments, there should be separate tournaments for trans men and trans women in which they can compete with each other. We don't need to ape each and everything that US does! US society is collapsing and is headed towards a race and gender war.

Shikhandi was a trans man in Mahabharata, Vishnu changed his gender a lotta times into Mohini, and also intersex people exist as much as trans people exist. The only scientific treatment for gender dysphoria (which makes people trans) is transitioning into the opposite gender. conversion therapy would simply lead to an increase in gender dysphoria of a person and it has been proven not to work in most cases.

    You see in my opinion having a concept of civil union is very necessary. Say even if I don't marry a woman and I have a relationship with another man and he is the one who loved me most in this world (let's say not sexually) . So I will expect the state to give him all the power attorney given to a wife in heterosexual marriage like inheritance, pension, signing authority, tax benefits etc. By recognizing two individuals in a civil union, you can give them legal rights they are demanding. As far as civil rights like divorce, alimony, domestic violence and other things are concerned, let's wait for UCC then the parliament will debate on the matter of homosexual civil rights ( if rahul gandhi allows the parliament to do so).

      Adoption of children and legalizing same sex marriage are different issues. Same sex marriage can only be legalized under the special marriage act and not under the personal laws. But, adoption is under the JJ Act and the hindu personal law... so any validation of same sex marriage won't let you legally adopt a child as parents. The child will only have a single parent ...you or your partner. You cannot legally be the mom-mom /dad - dad of the child on the official documents. So if adoption is your issue, you can adopt now also, ....not an issue.

    I can see why the insurance thing is a problem, I can see that there are benefits homosexual couples cannot apply for. This should be ammended. But I also agree that there is no notion when speaking about biological sex. One must not confuse feminity and masculinity with XX and XY chromosomes. Science is absolute truth and there is no place for someone's notion.       A nurse here. I wouldn't call science an absolute truth. More of a trial and error. But if you consider science as true , then please understand the ICD has already declared being trans or gay is not an illness.
      And while on the subject, there are a lot of people who just not have the majority chromosome constitution XX and XY. People can have a extra X chromosome or an extra Y.or may even miss a X . They are a minority but still exist. So, i would have to argue that the idea of just biological man and biological woman is a religious and social one.
      Identifying as a animal is whole another issue.

      Not all men are XY and not all women are XX. Sometimes XYX and other forms exist too. Nature does not fit neatly into people's ideas of "pure man" or "pure woman". There are even people with male bodies but born with female brains or female bodies but with male brains. People should not be discriminated against just because they don't fit perfectly into another person's view of what a "real man" is. Discrimination against gay people is discrimination based on gender.

Anyways I understand that gender identities are part of the social identity. Your social identity can be different percentages of femininity and masculinity and is quite fluid. Howver the biological truth is absolute. You cannot go and change each chromosome in your cell. That's why I say there is no notion when speaking about biological sex (or biological man in the context of this video). Hope you understand.

      That's the society's fault. If society hadn't established the strong norms of gender like "This is Man" and "This is Woman" it won't be happening.

      The irony is that such a situation is more typical for Indian culture rather than American. In traditional western cultures transgenders were persecuted, while in India you've got hijras, gender-fluid deities and the society seems to have always been quite-accepting of this, even under muslim rule, before the british came.

    Socio-economic rights are mandatory for same-sex couples. If you don't want to call it marriage, then legalize Civil Union or Civil Partnership with equal benefits as a married couple to the same-sex couples, although Marriage is legally a contract as long as the provision of Divorce exists.
    In my opinion, parliament cannot deny the Socio-economic rights to the same-sex couples as they are also the voting & tax-paying citizens of this vibrant democracy.

    No lawyer used CJI's adopted para-daughters to keep a valid point. If two differently abled person want to marry irrespective of sex, bcoz no biological normal person would marry, they will be dprived of love at an equal- partner level. Just parents and sympathy would be the form of love. Don't differetly abled have the right to love? Article 21 must add this.

I myself is from a little village, 18 years of my life i was just known that I was the only one who is attracted to the same gender. I grew up in a lower middle class family. I never seen someone who is from LGBTQIA in my entire childhood. I didn't even had access to mobile until i turned 18. I never been to west🙄 then wtf are you guys saing. From my early childhood i know that I was gay even I have no words to describe it. Please be sensible, for you it can be a mere comment or statement against LGBTQ but this is our day to day suffering. No need to have opinions if you don't understand something.🙏🙏

    As a woman i need to tell u this that any religion of the world never gave women equal rights. in hindus they call woman "devi" but being in a hindu family none of the family member gives equal right, respect, freedom or opportunities as men. but what gave these rights us were the constitution of India. so I think it's really important to give equal rights to the lgbtq community too from the constitution of the India.
