  • While searching for attorneys in Kentucky for OMC and I who are facing completely bogus charges after an egregious incident with the sheriff departments CHIEF deputy (Whitted) in Meade co Kentucky, I ran across this case circling the internet of a former Lt Kentucky State trooper who is now the Kentucky state police commissioner makes an unlawful arrest and is faced with a deposition in another case years later when he goes "toe to toe" with Kentucky's attorney Thomas Clay, who absolutely annihilates any and all credibility that this officer may have ever had. It becomes apparently obvious as to why cops in Kentucky are entirely ignorant to the law under this bafoon.

      Thank you for leaving all the information. It really does make it easier to redress my government in a peaceful manner. Something that should be encouraged,not considered a crime the way most precincts treat citizens. It's out of hand. I'm poor so it's hard to support you monetarily but I can call .

      Turns out this man slash ksp officer was a range officer for the harlan post at the time of the arrest they are doing the dep over.. harlan is our post.. same post behind my husband's illegal arrest we have spoken with you about.. same post refusing to come out and get my husband's statement for the attempt on his life while in jail this last time.

      How come it took 14 years? Courts here only give only 6 months to send in a violation against the state but they get years. Appeals and rule 35 are a couple of weeks to 120 days and often you can't even get your records in that amount of time.

    I stopped counting at 25 blatant lies. The one that just kills me is the "I was fearing for my safety". Really?? You felt disrespected!! Do not sit there and try to say that a man SEATED, IN HIS CAR, pointing his finger out the window at you, made you feel unsafe- if so, this is the biggest wuss I have ever seen!!     Raising your voice at a cop during a traffic stop and pointing your finger at him because you’re frustrated in no way justifies arresting someone for disorderly and “menacing”. This was clearly a fabricated contempt of cop charge from an egotistical and arrogant cop who felt disrespected and abused his authority to punish a citizen. Pure corruption.

    It took 14 years to get this corrupt piece of crap deposed?! This situation happened in 2009 and the lawsuit didn't even get to the deposition stage until this year?! That is just absolutely absurd and completely disgusting, and it only ever happens in a "civil" lawsuit when it involves police abuse. If I were to sue a neighbor because they created some kind of unsafe conditions that caused an injury, there is absolutely no chance it would take 14 years to get a deposition.

      @@forpublicsafety Yeah, I just got to the part where they said his victim had taken a settlement for this false arrest in like 2015 or something, but even 6 years is still absurd, although less so than if there had been no movement on the case until this year obviously. The difference in how they handle civil litigation that involves cops is still a major, major problem.

      The cops know how long to withhold and delay things for the statue of limitations to expire and they will do anything and everything to get it past that point of no ability to do anything legally about it. Yet they can "investigate" someone for years prior to making any arrest and even the very first thing they have as "evidence" even if it is 5 years ago they will use against the suspect. They make the claim that it is showing habitual and continued breaking of the law in spite of the fact that they made no charges prior to any "statute of limitations" expiration on a particular event. They hold onto the "evidence" in hopes of bring about more charges and even more harsh charges that will garner a longer jail sentence.

    Hi you two! Wow! I used to live in Kentucky and crooked cops were everywhere! I am glad to see fighting back against the vile corruption running rampant in our country! So glad you won a battle or few! Hope there are many more people taking your initiative! I am fighting against a wretched Disability Center for being non compliant with rules on the food distribution to the patients, one of which is my little sister who just recently received altzheimers! She is only 58 years old but, an alcoholic who just drank her self to a point of no return. I am now trying to get guardianship of her! There are only three of us left, her son who wishes not to be in charge so he gave it to me. Well hope all goes well for you all!

    Incredible lawyer - it's so great to have someone like this on the side of justice. Government no longer listens or respects "the people", it acts as a sovereign that has no accountability to anyone - especially to the rights of the people.       Exactly why you place ADMIRALTY/MARITIME liens on their entity by recording the constitutional violations perpetrated against you and the fines therefrom onto the county/ state record in affidavit form. Also on a UCC 1 FINANCING STATEMENT. At the end of the fiscal year the entity had to file all financing statements regarding it and its EIN number to the IRS. If you have it done through registered mail it is a security at 15 USC ET AL. It's called a tracer flag.

    The commissioner tells the prosecutor that there is more to the story and the story goes back to a time the commissioner had stopped the defendant previously. So now I'm thinking this is a retaliatory stop.

    I saw a comment from the sheriff that said they didn’t arrest for filming, but for disorderly conduct. Doesn’t matter how you feel about FPS and his woman, but there absolutely wasn’t any type of disorderly conduct between them getting there and the sheriffs getting there. The sheriffs didn’t like the way he was being spoken to and wasn’t getting his boot licked. They were arrested for speech that wasn’t disorderly, and were discriminated against for having cameras.

    I love also that he points out his practise is to attend court when required unless he has training. So many officers don't obey subpoena's and you don't if you have training. The rest of society get a warrant for that.

    The lies distortion and corruption is evident for all to see not only from the cop but from his defence team . When asked if he had information or knowledge of the video he says there was no video in the “ file “ he admits he had the video but wasn’t asked directly if he had a video and his defence backed him . When it’s revealed the underlying cause was drugs ? it was actually all concocted on the strength of an “ Anonymous “ drug tip , which wasn’t investigated further ? What the hell !!
    Is this the kind of behaviour we should expect from a police commissioner and a bunch of lawyers paid for by us ? And we see all this crap on the side of police cars about service to the public , integrity and honor and bravery blah blah blah good lord the hypocrisy is mind blowing !
    I hope you two manage to nail these other dirty lying dogs . But the whole system backs them . Let’s pray there are still some judges left out there with honesty integrity and morals .

      Better make sure who the judge gonna be for your case.And then go to the records department at the court house and request the otha of office papers for the judge and see if he was legally sworn in to up hold the constitution and your rights as law that doesn't go against the constitution. If he hasn't been sworn in and signed the paper work then he shouldn't be a judge sitting on that bench. Need to do this and while your at it get all and or any judges otha of office paper work that sits in judgment over and the courtroom. They shouldn't be there if they haven't sworn an otha and signed the paper work swearing to it.👍👍👍👍 59:29

    the fact that Clay would not let the other attorneys coach the witness with their objection is showing how much fire Clay has. Some judges, after a complaint, will tell the attorneys they can only use the word objection. I guess not in this case.

      “Mens Rea” is Latin for “guilty knowledge” or criminal intent.every single police officer and special Constable in England knows that and is taught it within weeks of his joining the police. It’s mentioned time and time again through law training so there is no ambiguity. This cretin on the stand knew this or aught to have known that there was no intent of committing disorderly conduct. It’s obvious to me that this vindictive arrest was nothing more than that and he was found out despite his prevarication and his skullduggery. I wouldn’t pay him in washers because he is not to be trusted in upholding the law.
      That is why they did not charge him with such.
      Incidentally,does anybody know if the road he was on was public or private, if it was public why did the guy say it was private?.

    You gotta love how this cop argues he was in fear for his safety and yet he doesn’t even cuff him right away, let’s him turn back to the cab of his vehicle, secures the gun without cuffing him first and at no time seems to be amped up or cautious in any way.     How can you be sure that they are not going to erase your filming or destroy the equipment? that sheriff deputy illegally opened the car door, searched the man without probably cause and violated several of the man's constitutional rights. The driver never resisted the false arrest. Mr Irvin sure don't want his client to answer any questions that make him look bad. Know where on the film shows the officer in fear of his life it is the driver who has to fear the corrupt officer.
