      2021 - 1200 civilians were shot and killed by cops. Same year 63 cops were shot and killed by civilians. 20:1 ration makes "Office Safety" a B.S. story. The 4th Amendment makes no mention of Detention, RAS, Dogs, Arrest, Officer Safety, Investigative Detention, or Qualified Immunity. These concepts are from the SCOTUS violating Separation of Powers and redefining the Constitution. The SCOTUS is a PRIVATE Corporation (Fascist) as listed on D&B (Unconstitutional), and you have No Standing (No Rights). Narcissists aka cops are inherently UNREASONABLE, because crazy people don't know they are crazy.

      Exactly, if saftey is the greatest priority, I can't understand how raising tension and giving conflicting orders isn't building a foundation to a dangerous situation.
      The funny thing is, if you feel a person doesn't like your chosen profession (which isn't illegal) escalating to violence etc proved them right. He did nothing to change his perception.

      You would be wrong by a LONGSHOT. Never mind the idea that you threw "law abiding citizen" in there because nobody knows who is going to be law abiding until after the fact, but police get ambushed by other people, or hit by cars all the time. Traffic stops are the source of the vast majority of officer fatalities (FOR WHERE THERE ARE A LOT). Try not to lie to others, but most importantly don't lie to yourself. If you can't judge reality you'll be making huge mistakes your entire life.

      Such a rare sight these days. When you or I are accused of a crime, it is government against one person (and especially the prosecutor)... but when a cop commits a crime, it is one man against the entire city and the prosecutor actually fights FOR the cop (the accused)? That alone seems like a major conflict of interest, and we all know how the judges, lawyers and DA's trade favors and barter cases. If a cop is accused, like in this case, then it is he alone who should defend himself (and his own lawyer), but to have the entire city behind to defend him is a blatant violation of the Rights of The People and especially to equal protection. It is not the Constitution that gives cops/government More Power, but it is the Constitution that Restricts the power of government, yet in cases like this, government attacks one, but then comes to the aid of another. (and of course the one's they help are always government). It's a good example on why we need the Constitution and why (as The People) we have the Right and Duty to set things like this straight when we see them. It is the job of a prosecutor to enforce JUST Laws and not to defend or protect another agent of government from the consequence of his own actions. It is the DA (in this case) whom should be prosecuting the assailant (cop), but instead, she defends him?

      We all know that pretextual traffic stops are being used wrongly and as a weapon against a certain minority.
      The blatant threats of deadly force and raw video footage of seniors, veterans, pregnant women and people in medical crisis have flooded the news and social media for years...they are just being wilfully brutalized by rogue cops.
      Cops openly boast about not caring about being sued, then going on paid vacation or leave is a well known fact!!!

      I’m pretty sure a member of the public will not get assault charge for body slamming an officer.. Assuming the person survive a hail of gunfire, taser and baton strikes.. You get multiple felony charges.
      So, yes, you are right the officers
      must be charged, but with multiple felonies.

      @@robertroth618 well there has been several studies done on this subject, some cops come home and cry to their wife in her arms the things they seen that day and their wives help them through it, depending on their wives reaction they go to work the next day and do their job according to their wife's advice, others come home and immediately cause chaos, beat their wives, abuse the family and then take it out on their calls when they go to work, either way is wrong, i think they need to seek medical intervention and not do ther job based on their home life or the advice given from a spouse, it distorts the law, there needs to be professionalism, but an insecure cop who is so afraid get killed on duty needs to really consider weather or not he is fit for duty, its a hard job there is no doubt about it, there are different emotions flying around at every call, cops need more surveillance and a closer tight grasp on their emotional ability to do their job properly, i think they need to attend regular assessments from an outside agency designed to look for the signs of irregularities in emotional patterns as part of a protocol, lets face it they see things that most of us will never see and we cant afford to have these loose cannons being the ones that "serve and protect" if they deviate from that mandate, thats why we see all these violent, law breaking, murdering cops with qualified immunity still corrupting our streets.

      We don't have these problems with the fire department. You know why?
      It's largely because they stay at the station until someone calls for them. If they went around writing tickets for fire safety violations, people would be just as fed up with the revenuing by the fire department as they do the police department.
      Maybe the cops should stay at the police station until someone calls for them.

    Update, June 2023: Driver Dominguez apparently suffered a broken nose and lost his job. An appeals court denied cops' claim of qualified immunity, and found it likely that a jury would find that the cops violated his Fourth Amendment rights by using unwarranted force. Shortly afterwards, the City of Scottsdale settled for $150K without admitting fault. It appears that the two officers are no longer with Scottsdale PD.

The mentality that cops are the good guys has been out the window for as long as I have been around and longer. Rodney King opened the eyes to a LOT of people about the cops yet people still believe they are the good guys. RUclips has exposed millions to the fact that cops are more corrupt than criminals. Personally there shouldn't be a thing like qualified immunity. When you get a trial you are suppose to have an unbiased judge yet go to any traffic court and you get a biased judge every time the second they pull up your criminal records they use that to determine your guilt on top of they want to keep getting money for their own pockets.

      The obviousness of this situation is that the officer initiated a scenario of aggression to getting a reaction from the driver for the sole purpose of being able to make a charge of resisting to justify the excessive force he used. The judges could see this in the video and were right on the mark in their objections to the cop's actions. It even went as far as them noticing that the officer stepped up to the car's door PREVENTING the driver from making an exit.

      It's never about driving safe it's to just assert authority. Because I've made many complaints about our sheriff's driving 85-95 miles an hour with no lights on and stopping at lights and stop signs because obviously there is no emergency call just tyrants doing whatever they please.       @@balla2172 Here's the thing, under the "Armed and Dangerous" precedent set in Terry V Ohio: if an officer has reasonable belief that a subject is armed AND dangerous, then they are within their rights to remove you from your vehicle (if applicable) and perform a Terry frisk without violating the 4th amendment. The major issue with this ruling however is that it's created a circuit split surround the phrase "Armed and Dangerous". To a reasonable person, the word 'and' in this context would be considered a qualifier, meaning that in order for an officer to perform a Terry frisk, you not only have to be armed, but also posing a clear and articulable danger to yourself, the officer, or the general public, which is how the standard is applied in most circuits. However in the 4th circuit for example, you have the US V Robinson decision, which applied the logic of "anyone who's armed is inherently dangerous" and therefore can be legally removed from their vehicle and/or Terry frisked without violating the 4th amendment. I can't remember off the top of my head which ones, but there are at least 2 other circuits that apply the same logic.

    I was a Road Officer for 12 years, and had to go thru Federal Background Checks for 30 years for my other work...The Officer clearly was clearly stirring up the confrontation.. Actions like his, treating the public this way, especially a person such as this Security Officer, who in order to get his job and carry a weapon had to go thru a damn good Background check, creates the animosity other officers nationwide are having to deal with today. Officers like this, are creating problems for other Law Enforcement everywhere. This Officer put the Driver in a WTF mindset being treated this way.

    I might JUST be a high pressure pipe welder making around 130,000 a year which isn't very much really, but I will always be able to say that I do NOT have a job of lying through my teeth every day in order to pay my mortgage. I can go to Church and feel good about who I am and what I have become .... and I have NOT become a professional liar in order to drive a Mercedes. ...       @@fatherinexile I am addicted to educating myself on Canadian Law pertaining to police interacting with citizens. I have about 10,000 hours of reading and watching.
      I first became aware of the "lying" method when educating myself on investigative interrogation techniques used in interrogation rooms.
      I read that a cop can lie to you constantly, as long as it's not coercive. Then I read that all police officers in training are not only taught to lie to citizens, but it is encouraged as a means of extracting evidence...that is when I lost all respect for law enforcement.
      It has gotten to the point that I can no longer find any data to expand my learning curve as far as police to citizen interactions....I've reached the end ...I'm getting to the point now that just for fun, I am memorizing the RCMP Code of Conduct Violations from their policy booklet ... now that is an addiction I have for sure.
      RCMP Police Act:
      Part IV: Code of Conduct
      Section 37: Responsibilities
      A thru H
      I like E because it scares new recruits that are too green to speak up when falsely detaining someone .. for example:
      I was stopped because the cop thought I was getting ready to drive the car after drinking, but it wasn't my car, he had the wrong person. I told him I will not provide ID unless arrested, he would arrest me, would not explain why I'm detained, but held my arm, so I could not leave, which equals physical detainment.
      I said to the young female recruit: Did you get a good mark on your final exam from the Academy? ... Would you like to further yourself in the field of policing? ...then you better get away from this man who is training you, because I have no choice but to submit proper complaints about him AND you to the Police Commissioner's Complaint Department tomorrow.
      She got all spooked and say What did we do? ... I said, he is violating my civil rights by detaining me without explaining the reason for the detainment promptly, as explained in the Charter of Rights and Freedoms of Canada, Section 10 (A), and Section 10 (B).
      She said, but what did I do? .. .I said under Section 37 of Responsibilities, subsection ( E), it states ...It is the responsibility of every member to ensure that no unlawful act by ANY member is concealed or allowed to continue. I said your partner is breaking the law by violating my Civil Rights and you are doing nothing to stop it, so I have no choice but to file formal complaints against you tomorrow ....she drags the cop over to the side of the car where I can hear them and they have a little chit-chat, and then they just get in the car and leave without even making eye contact with me.
      THAT never would have happened if I had not read and studied Canadian Law as much as I have. I am very glad that I know my rights inside out now.

      This happens all of the time. Cops, most of them from what I've seen, shouldn't be officers at all. Saw one the other day where a cop was trying to arrest a kid walking to work at night with a backpack on. He grabbed him from behind and body slammed him onto the asphalt. The cop just suspected that he might be someone that was breaking into cars and just body slammed him. The kid had no idea what was coming.

    law enforcement, in general, want to claim that "this job is so dangerous". ok, it can be. so is construction work, so is crab fishing, so is walking through the woods.
    They VOLUNTEERED for this job, and intentionally put themselves in danger. Why? Step away from danger into a safer spot and regroup. Live another day. Law enforcement routinely escalate situations and use that to facilitate making charges and arrests.

    That defense attorney is trying to sell some oceanfront property in Arizona, and she didn't even show the least amount of respect possible. If I were on that court, she'd have been serving 30 days for contempt. Lying to an appellate panel is grounds for disbarment, and she did just that, lied multiple times.

    I can't believe the judges allowed this defense attorney to claim that "traffic stops are inherently dangerous" based solely on the claim that "2000 officers are injured and 10 are killed each year". There are 20 million stops each year. Those are odds of 2,000,000-to-1 against death and 10,000-to-1 against injury per traffic stop. I feel like I face more danger just brushing my teeth.

      Qualified immunity is meant to provide protection for those officer who make mistakes but do so as they perform their duties "in good faith" and nothing less.
      It's strange that the "in good faith" part of QI doesn't get argued more. Telling someone you're going to "rip them out of the car" (instead of "we'll have to remove you from the vehicle") shows intent, mental state, and the low level of professionalism prior to force being applied. When force is applied and it's a full body slam into pavement it should be questioned if the officer was still acting "in good faith" of his duty.
      If it IS in good faith of his duty, then we can expect this type of interaction with the entire department. That means every officer will need to undergo new training and new departmental policies written, as that's clearly not what the citizens have hired them to behave like.
      If this is NOT in good faith, no QI protections.
      Forcing them to pick one also then forces them to choose whether they are going to back this officer.

      This case is the perfect example of why everyone should contradict the brainwashing we received that handing over your identification when asked , which is to consent. We Americans do not have to consent at any traffic stop , we have a legal right to assert our 4th , 5th , and 6th amendment rights verbally , you can not be legally detained or arrested for asserting your rights. If a police man wants any information from me , he'd better have a warrant with my name already on it , in which case I would probably want to get to the bottom of why there's a warrant for me , absent a warrant , no info will be provided by me , once you have asserted your rights , no commands from the officer are lawful.

      The cop after pulling him over should have said I pulled you over for "the offence" give me your lic, reg, and insurance. The cop asked if he had any guns. The guy said he owns a gun but does not have it with him. Instead of doing the correct thing the cop gets a bad attitude and escalates the situation. The cop needs to find a different line of work, perhaps flipping burgers

    I went and watched the video after hearing the woman defending the officer. How can she can sit there with a straight face and say that this happened because of the drivers actions is absolutely INSANE! That officer needs to be locked up. Absolutely insane. The guy was explaining everything to him was getting his insurance and license together. And he was absolutely out of line. And not only needs to be fired he needs to be jailed. This went waaaaaaay left waaaaaaaay too quick.

      It's her job to argue the defense of the officer, and she at least does a decent job considering it's basically impossible for her to defend. The only leg she has to stand on at all is that the driver turned and reached for something after things had escalated quite a bit. She isn't lying about the situation or making up evidence. The judges did see through her attempt though and I'm glad they denied the immunity claim and it ended up being settled by the city.

      I saw that as well, she was SO flustered and angry the entire time, and to me…that was weird AH! I get some lawyers being passionate about their cases, especially when it is clear cut and they should be winning, but you’d literally have to be insane to watch that video and conclude the cop was justified, either that or you’re sleeping with him and she has that kind of emotional involvement from what we can see of her.     Watching this video, while at an older age, it has never been more apparent that everyday citizens are at a unparalleled disadvantage when in these situations. Cops get something like a cumulative ground hog day ability to hone their corruptive and abusive skills with every interaction. So they know what to do and when to do it and use manipulation to entrap citizens who don't have any clue as to how to deal with these abusive cops. Citizens only get one chance to survive these situations where as cops get constant passes and blue line sympathizer to help get them evade accountability. This is a sickness within that community of sickos and this behavior borders on psychopathic tendencies... Sad that our system of protections protects these low lifes vs everyday citizens not posing any threat...

    I'll never forget a quote from a law enforcement supervisor, "Always go home at night, comply or die". They will kill you, even if there's no actual threat to officers, based on the good old adage, "For officer safety". This is taught through all training levels and they just deal with the legal issues later on. We, as the public, are absolutely unsafe out in public and in our own homes. So much for being free citizens.

    She says that "traffic stops are inherently dangerous." BS, a few dozen incidents compared to millions of stops is a very low ratio. Most interactions are due to police escalations.

      Not all. For instance there are cases where the driver has a warrant and is willing to hurt an officer to stay out of jail, usually this isn't even recognized by the officer until he gets the license and such from the driver and runs it. Still I'd say that there are far far too many cases where the officers escalate things. Part of me figures that it is because they have things going on in their personal lives that impact their attitude during work. But why should we expect retail workers to not have an attitude with customers and not expect the police to be the same and to deescalate instead of escalating situations. Police get training in de-escalation, retail workers don't get training and often seem to be held to higher standards by their employers.

      Just looked it up and police isn't even in the top 20 most dangerous jobs, fatality rate of 14 per 100000, and that includes car accidents and and non violent causes of death such as having a sudden heart attack while on duty or anything else, it's actually the exact same fatality rate as my job as an industrial maintenance technician, and my job definitely isn't dangerous, these numbers come directly from OSHA who keep pretty good track of on the job injuries and deaths, and is literally in the top 10 hits when you google most dangerous jobs, so feel free to fact check of you want.

(In fact from a noted aggressively proactive city/county), so I'll always lean toward giving the police a great deal of leeway in most instances. Not so much as an ignorant/blind bias, but more from an understanding of the many, complicated nuances of the job that must be processed in split seconds of time. I also am very critical of awful, thuggish, unnecessarily violent and ignorant police activity. In this day and age there is so much video of interactions that are available there are plenty of situations I've been extremely angry and disgusted over.
      All that to say that statistically, as far as on the job deaths, police work doesn't come close to the most deadly work. There is a difference between deadly and dangerous though. A big reason why it isn't as deadly has to do with training/officer safety advancements over the past 40+ years. I don't know where it would land on the list, but I would bet even active duty military personnel (as a whole) over the past 40 years wouldn't top the list either, but none of us would argue a lack of danger. Danger's deadliness gets mitigated through training, equipment, trauma care advancements. Instead of deadliness, measure your line of work's number of job related, disabling traumatic injuries and prevalence of severe psychological trauma or even just life expectancy overall. My point is simply that fatalities is only one statistic that doesn't provide the true picture.
      Btw, the officer in this case was 100% the problem here and shouldn't be in that line of work. I understand why qualified immunity exists, but it is entirely too broad, and this officer doesn't deserve to claim it.
      My 2 cents anyway.

    I've now watched a few of these, and it's a small sample size... that said, these cases make the point of why government attorneys, prosecuting attorneys, DAs, etc, rely on "running out the clock", making a defendant keep spending money on attorney fees until eventually agreeing to a plea deal. In none of these videos does the police's, city's, attorney come across as particularly good at their jobs, it seems they're not generally relying on skill, law, facts, they're relying on "I have an unlimited budget and will spend the opposition into oblivion".
    See also the James Flynn case, the "prosecutor " of Rittenhouse, I think Binger was his name... even the incompetent Lytitia (sp) James, AG of New York...

    If your going to pull a gun on cop at a traffic stop , you are not going to tell the cop that you own a gun or have a gun . This lawyer should be bringing that up. And these judges should have thought this.

      The video is out there. The cop escalated the whole thing over ego: "How dare you question me peon, I'll teach you what happens". The driver got roughed up and lost his job, but ultimately won a settlement by the city.

    The scariest moment you spend in time with the police is real. I was kidnapped by a Chandler AZ. Police officer, he got me while I was going for a walk in my gated community where I also worked as a “guard” for employment. It’s really bad when criminals have badges, I can’t get any help, now I deal with the retaliation, for the complaint I filed. I feel terrible for all the victims of corrupt authority, and what’s sad about this situation is the number of innocent victims by the hands of the authorities we were raised to trust, and respect. Good luck everybody.

      I know someone who was retaliated against and even after being forced to move , they were retatiated against in their new home out of the county .They should have moved out of state . But it was so evil that so many were involved ....No help ...

    The problem I’m having is the lawyers who defend these cops on taxpayer dime , is we pay their salaries for guns , car , why do we have to pay for the attorneys ,,,,… And these lawyers argue for these bastards,,,,,I say end qualified immunity let them pay there own lawyers as well , like rest of the people …… they get lawyers and qualified immunity is why these things happen .7. Years of abuse 7 years of intimidation 7 years trying to be the ROCK

    All of this was preceded by the officer opening the car door of the victim, which should have been a violation immediately by the officer. Once the door was opened, qualified immunity should have been denied.

    These judges give me hope that someday law enforcement will both be changed and more importantly, held accountable for their relentless assaults on citizens for minor traffic infractions, speech, and asking simple questions. Treating every citizen as if they are criminals must be stopped!

      Hopes that they will start holding them accountable thebvourt system should not be in charge of weather or not police lose qualified immunity that should be decided by a board of members of the community no different then jury duty a random pool of people should be called upon to hear the facts of what happened and it should be the public that makes that determination because the way things are going soon the public will stop not fighting back against this shit which they should be able to do if police use force in an unnecessary or overly forceful manner the citizens should be able to defend themselves to the same level as we would if it weren't police

    This whole case is predicated on the fact that this lawyer and cop feel like they should be able to hurt people and violate people's rights without any kind of accountability whatsoever. Thank the Gods these judges saw straight through their bullshit.

    I have seen plenty of videos showing an officer standing right up against a motorists door , demanding they get out of the vehicle . If you open the door , even in compliance , and hit the officer , they can claim that you assaulted him . If the officer lets you open the door , but steps up into the opening , as in this case , when you step out and bump into the officer , they can claim assault . The testimony given by both the attorneys and the judges implies that the officer manufactured the reason to assault the driver to me .

      This happened to me but worse. The cop opened my door hot himself and immediately arrested me. Currently going through a lawsuit cause Chick-fil-A caught it on their cameras

    AZ has constantly shown they have the worse cops in the country. The amount of outrageous videos that constantly comes out that state is astounding. They make NYPD look like the crown jewel of policing and civil decorum with civilian interactions.

      Yup. The mesa PD on what they allowed those 2 cops to do after the daniel shavier murder flushed all my faith down the toilet.
      Got evidence withheld, allowd the cops to be re hired just long enough to fill out ane submit paperwork for retirement due to "ptsd" and now they both collect a check for life.
      Sad state of affairs. If they wanna watch us with their cameras everywhere we go, we shall do the same.

      Better to get out of the car. Like the defense lawyer was saying the officer can far more easily justify using force while you are in the car. Also I've seen lots of times where people are pulled out of cars and it's almost always more violent than when they are already out of the car. If he had held up his hands and said he was going to get out of the car there is still no telling what the officer would have done to him, but it probably would have been quicker, involved less force, and would have looked far worse for the officer.

      @@michaelmurray6197That cop came up to the car claiming that the guy had an attitude, that he did not. The cop was looking for a fight from the start. The cop didn't give the guy room to get out of the car or much time between yelling at him or try to explain anything at all. It's very confusing and stressful for the person, but for the cop it's just his 5th stop of the night.
      Sure it's better to get out of the car, but look at it from the perspective of a guy who has no idea why he's even involved with the cop.
