We can’t let things like this keep happening. We need to prosecute to the fullest anything done illegally by anyone especially if they are in power. We are being robbed every single day!!!
Well, until we make a huge dent in “qualified immunity” these things will continue. The constable knew or should have known the action was illegal. Place his tail in jail and he and other pigs will reform.
This is a dangerous precedent. If other local governments see this, and how difficult it is for private citizens and their lawyers to unravel, they won’t hesitate to start using this tactic to begin acquiring property.
True. Also, I thought Texans were the most armed people in the USA. ?? Always talking about using guns to protect their freedom.. but this behavior would prove to me.. otherwise.
the people in power know how to game the system in their favor all the time. The regular people like you and me can never fight it unless we get an attorney and the cost may be out of reach. 12/12/20....It would 1st be insured by me as tenant as well as all my expensive/priceless/family furnishings & belongings. Rental insurance ALSO priovides living expenses until the place is rebuilt---or "appropriate arrangements" are made for the legal tenant.
Even if all of these documents/sales were legit, they would still have to honor the existing lease of the current resident or give proper eviction notice. Just because a property changes hands, doesn't mean that the existing legal renter can be kicked out.
Youre assuming the occupant had a lease. Which I recon was not the case since the occupant seems to of been evicted on short notice despite having lawyered up.
Why did the Sheriff let himself in the house.Only answer is corruption you can't get cops to kick a swatter out of a house but he is all excited to kick a person who rented the house out.
How did they get the police or sheriffs to actually remove someone from the house? Any time I see this play out for normal owners the police always say we can't do anything because of squatter or tenant's rights, it's a civil matter and you need to take them to court. I think that fact alone proves the man's point.
Do some research. It depends on the state/area what the laws are and what can be done. Some states are like this yes, but not every one of them. California, for example, is like what you're describing, but Florida is not. I'm going to assume here that Texas is like Florida.
Happens all the time. Our mortgage lender hid documents claiming we didn't pay, but yet if you called the number everything showed fine on lower levels. Our home was taken from us. On top of that, we bought the adjoining property separately and the county refused to answer our calls and literally gave the land to the person who bought the property, whom buys and sells property all over the county and we assume has leverage with the county.
@@dp9629 I am afraid you are incorrect. Land in the UK can be either privately owned OR leased, unlike the US where all land is lease from the government.

its really sad that the average American can watch a silly fake news piece and swallow every bit of it. Even the title of this piece is misleading "TX man loses home..." ; its not, and never was, his home. If you buy a house, do you have to continue allowing whoever has been staying there to continue staying there forever? Of course not. It is not illegal to kick someone off a property you own. It is also not illegal to enlist the constables office to throw someone out of your home for you, in fact, that is the legal way to do it, vs doing it yourself. If anything, there might have been some minor procedural stuff that wasn't followed by the new owner, such as an eviction notice, but this guy was going to get moved out of the house regardless. He seems to be under the mistaken impression that he owns the house because hes been paying rent for 20 years; he doesn't. Someone should have educated him on the difference between renting and owning.
Cops in small towns have a way of losing their jobs if they don't dance to the tune whistled by the county commission. So his daughter needed in a new house so wanted a new house so this commissioner decided to use his power to basically illegally kick him out and his daughter knows it's him. I definitely would go to the state supreme court try this case
He rented the house for 20 years so he brought and payed for a house for some one else to sale and keep all the money. The trouble with renting a house it is never yours you just pay off the mortgage and they can sell it under your nose and you can’t do anything about it. I feel sorry for him I wish him the best
While they can still sell the house, you still have rights as a tenant. And one of those rights is a written 60 Day notice informing you to vacate the premise. Evicting someone without informing them prior is against the law.

Thank you for reporting this story.
This is why staying silent simply because an elected official / law enforcement said so is never the right option. If he'd stayed quite about it, the fraudulent siezure would have gone unchallenged.
Society has to raise up moral people who believe stealing, lying, greed and murder is wrong. They won't and so nothing will get better.
This is a dangerous precedent. If other local governments see this, and how difficult it is for private citizens and their lawyers to unravel, they won’t hesitate to start using this tactic to begin acquiring property.

There needs to be jail time and massive financial settlements for the landlord and the tenant.
I very much doubt there was an Auction, as it would not have sold for 20k, especially to his daughter.

Actually no, we didn’t escape England for stuff like this. It’s because we did not have the ability to vote in England’s parliament. “No taxation without representation“. But in the United States we have plenty representation, we just vote for the wrong people. People who put money in politics. Democrats have a lot of problems, but they actually would get money out of politics if they ran the federal government. Remember it was Republican appointed judges who opened up money in politics a huge amount. And Republicans in Congress refused to fix it. Many Democrats don’t wanna fix it either, but Democrats can be forced to fix it because that’s what the base wants. But Trump and the Republicans do not want money out of politics. They love the money in politics. Don’t fall for the whole “drain the swamp“ campaign phrases.

They need to sue the cop that followed fraudulent orders. We must not let the cops get away with this behavior either. We must eliminate the long arm of corruption from the equation.
its really sad that the average American can watch a silly fake news piece and swallow every bit of it.
While they can still sell the house, you still have rights as a tenant. And one of those rights is a written 60 Day notice informing you to vacate the premise. Evicting someone without informing them prior is against the law.
