      🤦🏼‍♂He was being a little condescending / smart-alek while being "professional". In my humble opinion....he could have done better, but could have been much worse! It's really just that, in COMPARISON, it appears he was "amazing", but again his demeanor was a little on the shameful side....but we aren't perfect. At least he tried to limit himself without going "overboard".
      He said: "You know, there is a sign outside that says 'you don't have that right'....here let me show you..."
      Then he starts ACTING like he wants to help, instead of GENUINELY WANTING to help.🤥

It's a public place that the citizens have paid for we have a right to be there so it's not trespassing. As a citizen it is our free choice as to whether we want to be respectful or choose not to. Loitering means you do not have a purpose for being there, and he has stated his purpose for being there.

      I am writing to address the crucial issue of citizens, often referred to as 1st Amendment Auditors, exercising their rights to observe and record public spaces where government and civil servants perform their duties. This practice is fundamental for ensuring transparency, accountability, and adherence to constitutional principles in public service.
      Citizens have a fundamental right under the First Amendment to photograph and record public servants, including law enforcement officers and government officials, while they are performing their official duties in public spaces. This right has been consistently upheld by various court cases, including:
      • Pruneyard Shopping Center vs Robin's (1980): this Supreme Court decision shows that even on Limited Public Access, yet Privately Owned Properties are subjected to Constitutional Expression of Rights.
      • Glik v. Cunniffe (2011)
      • Kelly v. Borough of Carlisle (2012)
      • Fields v. City of Philadelphia (2017)
      • Turner v. Lieutenant Driver (2017)
      • Fricosu v. United States (2012)
      • Price v. Garland D.C. (2022)
      • Smith v. Cummings GA. (2000)
      Public servants, acting as governmental agents, are obligated to provide services in accordance with established laws and regulations. Unlawful denials of service or refusals to serve a civilian without lawful cause may constitute violations of civil rights protections under federal and state law.
      Also you must note that ALL Public Servants/Civil Employees MUST sign a Electronic Video & Audio Recording waiver to work as an Agent of the State, you can consider that a 4th Amendment Waiver, so they can not refuse services to a Citizen based on their personal feelings or opinions about them being filmed in Public. They also can not create a Public Disturbance without Lawful Authority or Restrict, Hinder, Impede, Prior Restrained a Citizen while they are exercising their Constitutional Rights. Supreme Court cases show that while Citizens who work on the Tax Payer dime have limited and restricted Rights.
      WHY? You may ask. Because Government and its' employees have Duties, Responsibilities and Privileges... Government can not have Rights. So they can not refuse or deny services based on feelings, or they will be in violation of Federal Laws.
      "No Expectation of Privacy while in Public" (Katz v. United States) which forms the basis of case laws that set the foundation of the 'Plain View Doctrine' that grants Law Enforcement Agents and Agencies the Privilege of circumventing the 4th Amendment for Lawful Purposes ONLY.
      Furthermore, public servants are expected to conduct themselves in a professional manner at all times. Instances where public employees accost, behave disorderly, create public disturbances, or engage in unnecessary scenes, or enforcing illegal policies are illegal and undermine Public Trust.
      You already should know that physical altercations, assaults, or unauthorized touching of individuals are clear violations of civil and criminal laws when the Public Servant has no Lawful Authority over the Citizen to do so.
      In cases where public employees engage in misconduct, including physical altercations or enforcement of unconstitutional policies, they may be criminally liable under federal statutes such as Title 18, Part 1, Chapter 13, Sections 241*¹ and 242*². These laws prohibit conspiracies against, or deprivations of, Constitutional Rights under Color of Law, ensuring accountability for government officials' actions. In addition, these two Laws are also Federal Felonies with Federal level Punishments.
      *¹ 18 U.S.C. § 241
      Section 241 makes it unlawful for two or more Civil Employees (Elected, Appointed, Contracted) or persons to injure, threaten, or intimidate a person in the United States in the free exercise or enjoyment of any right or privilege secured by the Constitution or laws of the United States or because of his or her having exercised such a right.
      *² 18 U.S.C. § 242
      This provision makes it a crime for someone acting under color of law to willfully deprive a person of a right or privilege protected by the Constitution or laws of the United States. It is not necessary that the offense be motivated by racial bias or by any other animus.
      241 has a Federal Penalty of minimum 10 years in a Federal Penitentiary to Life, $25k Fine and possible ☠ Capital Punishment.
      242 has a Federal Penalty of 1 year to Life, $25k fine, and also ☠ Capital Punishment.
      As to your unconstitutional polices if your City has them, ie Panhandling or No video recording 'Policies'. The principle that "no law shall be passed that is repugnant of the Constitution; if so, it will be null and void" reflects the concept of judicial review in the United States legal system. This principle is not tied to a specific case law but rather is a foundational aspect of constitutional law established by various Supreme Court decisions. Here are some key cases and principles that affirm this concept:
      • Marbury v. Madison (1803): This landmark case is pivotal in establishing the principle of judicial review, which empowers courts to review the constitutionality of laws passed by Congress and state legislatures. Chief Justice John Marshall's opinion in this case asserted that any law repugnant to the Constitution is void.
      • McCulloch v. Maryland (1819): In this case, the Supreme Court held that states cannot pass laws that interfere with or impair the supremacy of federal laws and the Constitution. This reinforced the principle that state laws conflicting with federal laws or the Constitution are invalid.
      • Cooper v. Aaron (1958): This case reaffirmed the Supreme Court's authority in matters of constitutional interpretation, asserting that the Court's interpretation of the Constitution is binding on all branches of government and must be followed by State Officials.
      • United States v. Windsor (2013): In this case, the Supreme Court invalidated a key provision of the Defense of Marriage Act (DOMA), finding it unconstitutional under the Equal Protection Clause of the Fifth Amendment. This decision underscored that laws contradicting constitutional principles are unenforceable.
      • Obergefell v. Hodges (2015): This case legalized same-sex marriage nationwide, holding that state laws banning same-sex marriage violate the Fourteenth Amendment's Due Process and Equal Protection Clauses. It exemplifies the Court's role in striking down laws that are inconsistent with Constitutional Rights.
      These cases and principles collectively demonstrate that the Constitution is the supreme law of the land, and any law that conflicts with its provisions is considered void and unenforceable. Judicial review allows courts, particularly the Supreme Court, to uphold the Constitution and strike down laws that infringe upon its guarantees and protections. Therefore, the idea that "no law shall be passed that overrides the Constitution" is foundational in American constitutional jurisprudence and is safeguarded through the process of judicial review.
      So when a 'Citizen Journalist, Social Observer, 1st Amendment Auditor' are halted, impeded, harassed, restrained or discriminated against by a Public Employee, just because they are an American Citizen who are exercising their Constitutional Rights in a Public venue, the Public Servant are restricting that Constitutionally protected Right, based purely on their unlawful opinions or feelings. So with the Equal Protection Clauses, they can be found violating the 14th Amendment, with knowledge and intent.
      So to finalize, you need to fully understand the fact that your Public Employees are accosting, being Disorderly Conduct, unprofessional in the standards and execution of their Duties and Responsibilities. They are committing policy infractions, Misdemeanors, Felonies which only serves to expands the gap between We the People and utterly destroying Public Trust.
      It is imperative that your policies and practices align with Constitutional standards, fostering transparency and accountability in governance. Upholding these principles not only strengthens public trust in our institutions but also protects the fundamental rights guaranteed by the Constitution.
      Thank you for your attention to this critical matter. I also hope that you heed this warning and change as needed to be Constitutional or I will visit all your locations and start collecting Pensions. Trust me I am one American Citizen you don't want coming to your town to do an Audit; because I will have the FBI and the Department of Justice and Constitutional Law in my back pocket.
      And now you have been placed on Legal Notice for your Traitorous Governmental Behaviors.

    The insecure Insecurity Guard didn't know the LAW, she didn't know James' RIGHTS, she apparently knows nothing about the CONSTITUTION, she doesn't know her own PLACE as a worker bee for a company that has a CONTRACT with the state government...in other words she knew NOTHING that was important for her to know, NOTHING AT ALL. No one is surprised, the bar is set waaay low for these people to become Insecurity Guards...pretty much everyone is smarter, more rational, more educated and more knowledgeable than they are.

    my cop friend contact told me that if an officer gets a complaint it stays in his/her file and depending on seriousness of it, it can hold the officer back from promotion or advancement of 6mo or 1 to 2 years. also what ever the correction may be needed or not. course that changes with location area. so complaints do mater if the department wants to run a tight ship and set the right example and high standards.
