  • A truck driver was sentenced earlier this week to 110 years in prison for a 2019 crash that left four people dead and several others injured in Colorado. By Friday, more than 3 million people had signed a petition, asking Colorado Governor Jared Polis to grant clemency to Rogel Aguilera-Mederos, or commutation for time served.     I've seen so many monsters who murdered people get 10 years, 20 years in prison but a man who is not at fault for his brakes failing gets 110? That's outrageous.

      I heard somewhere that it was brought up during the trial that there were fluids he did not check before going out that affect his breaks, and that's why they keep saying he was "negligent" but they don't elaborate on it because the news gets more traffic if they just hammer down the "accident" part.
      I think given that, he deserves some time in a low security easygoing prison, but certainly not the rest of his life. It seems to me that he cut corners, and he severely underestimated the impact it might have, and unfortunately paid the heaviest price possible

      See, but he pushed his brakes to failure; he didn't take the emergency ramp; he could have used his engine brakes and only drove 35 down the mountain. He lied about having mountain experience.....110 years is too much, yeah. But 25-30 is probably what he should get. 4 people still died because of his crucial mistakes. You can tell he's sorry, but he still needs to pay for his mistakes.....

      What about the 4 innocent people this man killed? He made the decision to drive without a CDL, he knew the breaks were bad when he left Texas, and he had 0 experience in driving in the mountains. This is reckless and he should absolutely be held accountable, along with the company he was driving for. Maybe not 110 years reckless, but at least 30-40.

      They gave him 110 years in prison because they knew what Big Suckers the Public is, and thought that such a long sentence would make them feel that America is a "safe and secure" place to live, while in truth it is not. I'm surprised that there's any public protest about the long sentence. The people around Denver may actually not be as Naive and Gullible as most Americans typically are.

    This was a tragic *accident,* not a deliberate act. This could happen to almost any driver.
    Cases such as this are one reason that our entire criminal "justice" system needs a national overhaul.

      I support truck drivers to. My grandpa drove for 30+ years. However this driver was recklessly driving which resulted in him losing his brakes and then not taking 2 runaway truck ramps and it resulted in him killing 4 people. That’s negligence that a trucker can’t afford to make.

    This was a specific law in colorado that the prosecutors took advantage of and overreached and the judge had zero discretion in the sentencing. This young adult (23 at the time) was recruited from another country and was looking for a better life. Our trucking industry is desperate for driver and has lowered the standards to be able to fulfill the need. This kid literally came to America after being recruited to drive truck, pushed through a rapid fast course to drive, sent out on the road solo with no experience, and given an extremely dangerous route in the mountains. This route was dangerous and never ever should an inexperienced 23 year old recruited foreigner with no driving experience have been legally licensed to drive a semi. The only training he got was his expedited trucking course. How about we hold the law makers accountable and the companies putting these kids on the road. How is it that we give 4 years to a woman who deliberately ignored a stop sign on a bus and ran into 3 kids and killed them and kept going. How is it that a kid looses his breaks and accidentally kills for and gets 110 years

      I-70 between Denver and Salt Lake is a restricted route for most truck companies, only a few run it and most drivers stay away from it. That kid was doomed from the beginning.

    I'm a trucker from California and the sentence this honest working young man got is a slap in the face of all truckers. I say we stop driving for one week in honor of this man. We should stop going to Colorado all together.

      @@rubenrojas8118 he never went into the runaway ramp... he just used the break down lane on the side of the highway like anyone would if they caught a flat. He was supposed to use the runaway ramp. Once you hit the runaway ramp there is no turning back. He didn't even try

      People who have CDLs get held to a higher standard of driving than regular people who just have a normal driver's license. Their violations get not only a state case but also a federal case depending on the charge even if they are driving a private passenger vehicle.

Listening to the trail when he said he missed the run away ramp because he thought his breaks would come back like they had in the past and didn’t want to loose his job. He made the wrong decision; he has to live with it, and needs to face time. But 110 years for an accident that was not intentional is extreme.

    I'm a trucker now and a former Police Officer. This was an accident. It's arguable.... Did he even commit a crime??? He is a human being. Different people respond differently to high stress situations. "Fight, Flight or Freeze" varies from person to person..... This man was likely paralyzed with fear when he realized he had no control after a mechanical failure..... It's a horrible tragedy but not one single person, myself included, can say with any degree of certainty what happened inside his mind that day but anyone that has ever read freshman level psychology knows of "Fight, Flight or Freeze" phenomenon..... This sentence is LUDACRIS..... I question whether criminal charges are even constitutional....

      When he missed the ramp, he could of been looking down at the dash trying to see what’s wrong and didn’t realize he had a runaway ramp that close.

      Thr breaks failing was an accident his decision to not use the ramp though was reckless this sentence however is outrageous compared to others who commit worse crimes that they woke up and decided to do that day and they do not get as bad as a sentence. I do believe he is guilty and should serve some time as he made very poor decisions but overall he could have been panicking after losing his breaks and spiraled from there :(

I just disagree with the amount of time considering there are people out there who have committed worse crimes and are doing less time. People play risky games all day and in a way it is still partial an accident for the breaks to fail that's why he does deserve time is because of decisions that played a roll in them failing or missing ramp but he did not wake up today and say I'm going to drive this way until my brakes fail and then miss ramps that would help and swerve into traffic and cause a huge accident killing people. There are however people who wake up and plan out murders mass murders rapes etc that get less time than this guy here.

    I drove trucks for 3 years in the 90s. I prayed every day for Devine protection of me and everyone around me. It was the most stressful, thankless job I've ever had. I never had an accident, though I came close a few times, because of ignorant car drivers. We depend so much on these drivers and have no idea of how difficult life on the road is. I support this young man 100%,

    My friend’s dad was a truck driver when we were kids and she cried so much whenever he had to leave. They really sacrifice a lot and I think this is crazy excessive. It was a accident.

      My boyfriend's dad is a trucker and owns his own company as well. He talks about how his dad is never home and how rough it was growing up without him. This is excessive and wrong. I also have a feeling once the jury and judge found out he is new to this country and doesn't speak English well that those things also played a part in contributing to this asinine sentencing. Cruel and unusual punishment. Give him 10 years and probation. Not take away the rest of his life and beyond.

    I've ran heavy haul trucks for over 25yrs and been extremely lucky several times and most of those times I was able to keep my cool and get the truck under control. But there has been a few times I had to really fight through my fear to get that control back especially as I've gotten older we all have those times when we freeze from fear but sentencing a person to die in prison over something he had no control over is sickening and will scare away future drivers from entering the trucking field

      So when you were a trucker did you usually drive at high speeds down mountains? Did you ever ride you brakes the whole way down a mountain from 11K ft to 5K ft? Did you ever know your brakes were failing, so you pulled over to the side of the road and make a call asking what to do. Then hop back in your truck and kept driving without waiting for your brakes to cool down? Did you ever put another trucker's life in danger by purposefully slamming you truck into his inorder to try and slow yourself down? If not you must not have been as good a trucker as this guy.

    I watched the video footage of the incident yesterday for the first time. Being a truck driver for over 20 years and having had experienced this exact same scenario when I was younger, I know exactly what he did wrong, and exactly what he was doing while the footage shows him swerving and unfortunately missing the sand trap.
    The difference with my scenario is I was very very lucky and got my truck back in gear, and I didn’t have a wreck with traffic backed up waiting for me at the bottom of the grade. So when I reached the bottom I was able to run it out and let the truck slow itself to where I could start downshifting, (mind you , I hit over 100 mph coming down that grade.)
    This kid wasn’t that fortunate. This was an accident caused by inexperience that led to mechanical failure.
    110 years is ridiculous.

In the school I went to we drove some big hills here in East Tennessee, on of my instructor told us all don't try to gear down going down hill. Yes 110 is too much but I think he deserves time

      Sadly many people get sentenced to hundreds of years in prison everyday. We need justice reform asap.
      I went to trucking school. It is our job to inspect our vehicle before we get in. It is our job to maintain proper air pressure for our brakes while driving to avoid brake failure.
      I hope he gets clemency. This is absolutely horrendous and sad. So many people lost their lives that day including the truck driver.

      I don't know but I thought that the driver is responsible for his brakes being in adjustment.. driver is on the road for days or weeks at a time they are the only ones to know if their brakes are out of adjustment if the truck is not stopping properly with a load!! When someone is stopped at the scales and they are given a red flag ticket for brakes being out of adjustment that goes to the (driver )not the company!! He lost control of his truck and he did not go up a break ramp or runaway truck ramp!! It was a judgment call and I think he made the wrong choice!! If he would have went up that runaway ramp no one would have been killed! You don't lose your brakes on a malfunction easily!! For him to be convicted if brakes had to be grossly out of adjustment

    This is a very sad story. I know someone who lost the breaks to his work delivery truck. About 14,000 pounds. He screamed at drivers and pedestrians ahead, blew the horn and the air horn to warn, "NO BREAKS!!!". This man was an expert driver with 20+ years under his belt, so, after trying everything else to slow down that loaded truck, his last decisions were simple, downshift as low as possible, press the emergency breaks as slow as possible and turn that wheel to flip the truck on its side, sliding down the hill across an intersection almost going into the freeway at an over pass (It was either that or keep going down the busier hill) He says, panic is an option that makes you react in a way where you hope that you have enough time to react, and that no one dies including yourself. He said your breaks can go out at anytime for whatever reason of no fault of your own. In this case, thankfully, no one died, but he was forever changed.
    I'm sorry for all the families that suffered such a tragic loss in this horrible accident. I'm sorry to this young trucker who simply went to work to do his job but instead was met with a tragic end. Everyone, EVERYONE involved will forever be changed because of a malfunction. I empathize with everyone in this sad unfortunate situation. I'd be mad at the world.!!
    So please always remember that it takes 500 feet for an 18 wheeler to come to a complete stop at regular speeds (30,000+ pounds empty load). I don't ever want to be on the receiving end of anyone without breaks, especially a truck driver.

      If you watched the full video it explains why. The brake in his truck gave out which is actually a normal thing and it’s very scary when it happens. Some highways have started to make these giant pits of sand so when that does happen drivers have somewhere to purposely crash into but this road didn’t have one of those

    Tragic situation. Heart goes out to victims' families. That being said, this was an accident. His brakes went out. And he had little experience. The sentence was harsh. Murders, rapists, and seriel killers have gotten less time. Some no time at all. The company should be held liable first for not giving him a safe and operational rig which led to loss of life.

He had no power over his brake failure: not just that, but he panicked and therefore missed the runaway ramp. I am completely mortified over this crooked justice system, and I hope he gets released.       Your a truck driver? Do you know that the truck's braking system runs off of 120 air pressure? if the rig looses air pressure, when the psi falls below 60 the low air warning buzzer sounds, soon after that as the air pressure continues to drop the breaks will automatically lock up. He was inexperienced in Mountain Driving he drove too fast for the weight that he was pulling and he burned his breaks up. Then he bypassed 2 safety ramps. Colorado is making an example out of him.

      If you was following the trial, you was noticed that the trucking company pirate someone that really did not have the experience he was only 6 months driving 18 wheelers, he only spoke and red in Spanish unfortunately he probably didn't know about the runaway path if your trucks yourself with me is problems. He was a brand new truck driver out on the road, the company that he was working for or bunch of nasty people. They change the name of the business, they had no insurance on their business and also on their trucks, along with the maintenance records for the trucks. They allowed him to be out left out there to be handled this case in his lap 110 years is a lot when you get people out here killing children and only getting through for 25 years. This is an accident it wasn't done intentionally.

      @@danielleparra4800 we don't know who owns the company of the truck as that has not been disclosed yet, but what was her during the trial was that the trucking company he was working for the not have proper and adequate insurance and maintenance records that the truck driver is supposed to be keep it on his log. Unfortunately things went sideways when his break started to fail and he could not stop the truck, also as being a brand new truck driver he probably didn't know about the runaway truck ramps, and on top of that he spoke very little English and he's test for the CDL was give it to him Spanish. Which is nothing wrong with that but if you can't read English you shouldn't be behind a truck. The trucking company he was working with change the name immediately, they also had no insurance on the drivers and also the trucks, and they did not have properly in his records for all trucks in their name. It's very sad 110 years that is way too much

    I was a dispatcher and weighmaster for a year: brakes can fail, even if well maintained. It was a horrible accident, and people died, but regular drivers who deliberately mow down pedestrians, bicyclists, and motorcyclists only get a couple of years.

    This is disturbing. My beautiful friend was murdered October 2019 a mother of two beautiful little girls. Her murderer was a child predator who was let out of jail. I had to watch her two daughters break down as her casket was lowered. I wish the system did more for case like hers. :(

    honestly...id feel differently... but he had multiple opportunities to stop. He drove past multiple runaway truck ramps, when he could have used them. Had he used them, no one would have died. 110 years is steep for a malfunction, but he needs consequences for the stupid decisions he made over and over again that cost people's lives. Period.     Yes, people lost their lives, but seeing him at the sentencing was heartbreaking. No matter what happens to him, he will live the rest of his life with his torment and guilt and that almost seems punishment enough. I am curious what the families of the deceased think about his sentencing, not the legalities with the company, but with this young man.

      He had over 40 charges against him, all with minimum sentences. It adds up quick.

    I feel bad for the lost of lives for this unfortunate accident. But to give this man 110 years is absurd! Its not like he had a gun and went out and intentinally killed 4 people. This was cause of a mechanical failure and the driver may have been scared, panicked that may have caused him to make poor judgment. He deserve prison but 110 years is way to harsh. People who commit murders get less then him..

      I agree 110 is a lot but! Everytime before you get in a semi to drive you do a pre inspection and after you're done and park you do a post inspection.

    My uncles murderer only got 15 years and didn't even serve the while sentence. He stabbed and killed with intent. This man panicked and yes people died but his sentence does NOT fit the crime.

    I was driving once when I hit black ice and almost hit another vehicle. Ever since my worst fear is accidentally killing someone in an accident and I drive as little as humanly possible. That incident changed me in so many ways and I didn't even hit them, I can't imagine the pain that poor man feels and to be punished on top of it... its called an accident for a reason.

    This man is doing his best in life to put food on his family’s table. He’s not a kingpin criminal ( even them gets less time like one year or two) or a child rapist , or some serial killers. This criminal system is outrageous and injustice, accidents happen and the penalty for hard working blue collar should not be 100+ years in prison.

      Yes. Yes he should. He was completely negligent and as a result four people suffered horrible deaths as they were simply driving about their day. Literally burned alive in their cars. Not to mention a bus of schoolchildren were injured. I imagine if those children had been the ones burned alive, you’d think differently. Another few meters of him crashing into that schoolbus and it could have been…
      Life is about choices and consequences. He chose to not take the runaway ramps which had the consequence of smashing into dozens of cars and igniting a fireball. You might disagree with the sentence but to say he has no blame for this, is not only foolish but absurd. The victims families offered a plead deal with him but he refused and would only accept a driving ticket.

    I wish we could have these types of sentences for corrupt judges and D.A’s. You make a single mistake as a worker and some bs like this can happen to you.       Exactly, He deliberately swerved into traffic killing several ppl thus his sentence... he deserves the chair 4 times over and so does anyone with a 20+ year sentence... video shows no evidence for brake failure, only that he was driving recklessly and refused every attempt to stop his truck or avoid traffic even if his brakes had failed...

    Literally the one of the most dangerous jobs you can have in the U.S. Yet somehow this young man received 100+ years for doing his job and surviving what we can see is a very horrific accident. Rip to those lost but punishing him is so cruel.

    I am so VERY glad I have completely retired from transportation. I was a trucker myself and I can tell you that companies really do not care about their drivers. There are other aspects to the trucking industry that by convicting this driver they NEVER addressed here and have treated this driver unfairly. First off, if he was a company driver and not an owner/operator then the condition of the company truck is not his own fault entirely. How about they arrest the mechanics responsible for maintaining that truck? NO ONE ever suggested that! You see, these companies are infamous about getting by on as little as possible and many times with little regard for the drivers or anyone else. It's about their bottom line! Me, I gave up my CDL permanently in order to never have to ever drive professionally ever again! So, being self retired I can TALJK without fear of being fired by any company. Thank GOD! I can even remember a dispatcher knowing that my time was almost up in terms of allowable driving time telling me that the load I had was a "high dollar" load and ill regardless it had better get to the destination on TIME! That happened to me many years ago but it still happens today to other drivers unfortunately. Companies push their equipment and the drivers to their breaking point and even beyond it all in the name of "The bottom line!" That pressure to meet deadlines and produce profit! Oh and the reward for it for us as drivers, a possible 110 year sentence in PRISON! That's what corporate America in the transportation industry has brought us to folks! So YEA! I am so very thankful I forced myself to retire! You see, we drivers give up our family life, our personal life, hopes. dreams, and virtually everything else for this job many times and all for what? To be under a company that does not care and a nation that has no clue except they want the deaths and wrecks to stop. OK I get that but come on folks, be smart about it. Get to the very root of the thing. Drivers can only do so much! For example, this isn't in the professional trucking industry but, in being a professional driver I actually drove for a company that transported handicapped clients. The company mandated that their drivers were never allowed to open the hood or in any way do anything with the engine or be in the engine compartment! Yes, that was REAL and you tell me, How in THE world can I be held liable for mechanical failure if I the professional driver am not allowed to even so much as pop the hood open? You see, I do not think the general public knows the whole story here and that is why this sentence is so unfair! Can YOU tell me for sure who exactly is at fault? I don't think so.

      Apparently he pulled over when he noticed the brakes were fading called his supervisor, and another trucker to ask what to do. They advised he keep going down the grade so I think it was a company truck. He has no experience driving on grades before like that from Texas he exceeded 45 mph several times before the breaks failed which was the max speed for 80k lbs. He has fault no doubt about it but 110 years I don't think so. People keep saying he should have downshifted and used engine braking they don't realize a governor will not allow a truck engine RPM to go high enough to shift it at 85 mph. That is what another truck driver posted somewhere else I read makes lot of sense. He did state he was trying to get it into a gear to slow down I think once he took it out of higher gear he got going too fast to get back in gear.

      Ever heard of mandatory minimum sentencing and serving consecutive vs. concurrent time? Well that's how you end up with a 110 year sentence.
      The judge on the case described the punishment as "excessive" but is powerless to do anything about it. Criminal/sentencing laws are passed at the state legislative level.

      In most of the United States, a life sentence means a person in prison for 15 years with the chance for parole. It can be very confusing to hear a man sentenced to life, but then 15 years later they are free. ... Parole is when a prisoner is released into the world temporarily or permanently on account of good behavior.

    I haven't signed an online petition in years, but I signed the one asking for clemency for him. It was an accident. In another video I watched, one of the relatives of one of those lost said that she didn't believe his sentence should be commuted but that the justice guidelines should be changed. No. I'm sorry and I genuinely feel for you and those families who lost loved ones, but that should not excuse a lack of sympathy or even empathy for another human being that was simply doing his job as he was asked. He didn't randomly decide to take the mountainous scenic route.

    The trucking company being sued was enough...You can't bring back the dead, unfortunately. This was a major accident, and due to company negligence should not weigh on the shoulders of the driver! The deaths of the people, and trauma from the accident are his burden to bear for the rest of his life. Prison is for drug dealers, murderers, and thieves!

      They're putting these drivers out in semi trucks way too young and with too little experience for the route lengths they're being assigned. They should really work up more experience with shorter routes before putting them on long hauls like they do. Everything in this country seems to be designed specifically to exploit the worker.
