  • The plaintiff was driving to the movies when the defendant rear-ended him with her car. He went to the emergency room because he was so shaken up. He’s suing for the deductible, cab fare, and car rental fees. The defendant says the accident wasn’t her fault because the plaintiff made an abrupt stop.

    So sweet that two seniors can finds valuable friendships after both are being widowed. Both are adorable and cute 💞 now i have to rent the movie Darkest Hour.

      I go to a painting group with many seniors. 2 women there have been friends since Catholic elementary school. They're both widows now and act like a married couple themselves 😂❤ I love seeing senior relationships as well 😍

    I love how the defendant thinks mentioning the fact that she asked the 80-year-old man that she rear-ended if he was OK paints her as a nice person. In reality, she’s the lady that accused the old man of a money grab. 😂

      Once I went to a book launch and saw these two older people who were so in love and happy, I came over and started chatting to them and spent the evening in their company. At the end I asked them what their secret was and they said: we got divorced from our exes a year ago, we're a new couple!

    Almost automatically your fault when you rear end some one. Always leave enough space to stop short etc

      Only "win" possibility is usually video showing the other car did a swoop and stop or something.
      The car behind has to be aware. She even admitted she was not.

    A WOMAN pulled out in front of me on icy roads and immediately slammed on the breaks forcing a slide that ended with me rear-ending her. I was deemed by the insurance company and cops, not at fault. (EDIT): In a SEPARATE incident, I was driving the speed limit (at 60 MPH) and a MAN pulled out at an extremely slow speed forcing me to slam on the brakes so hard it threw me into a slide. I didn't hit him but as luck would have it, a cop was behind me and he put the sirens on and pulled the guy over but let me go. A cop friend said had I hit him it would have been his fault. There are TIMES when a rear-ending is not the fault of the one who does the rear-ending.

      This is why context matters and why the Judge gives both sides the opportunity to explain their version of the events because even though the general rule is "if you hit someone from behind, you're at fault", there are circumstances that are the exception to that rule. Obviously, if someone cuts you off, that would switch the blame to them, if you hit them because of them cutting you off. But there are multiple factors that have to be considered to determine who is at fault, or by how much. For example, your story where the woman pulled out in front of you in icy conditions while you were going the speed limit. That easily could have been deemed as a split liability between the both of you because the law requires you to reduce your speed in poor conditions such as icy roads. Although not commonly enforced, you could technically get pulled over and receive a ticket for going the normal speed limit in conditions like that.

      @@mls2023 It's actually the law to reduce your speed in hazardous conditions such as icy roads or when there is reduced visibility, like thick fog or a white out from a blizzard or snow squall. Although it's not commonly enforced, you still could be pulled over and given a ticket for going the normal speed limit in those circumstances.

    If you have auto pay, make sure it comes directly from bank account and not your bank card. If you have to replace your bank card you need to update all your auto pay stuff. This happens alot.

    She probably thought he was going to go around the car ahead of him so she didn't start slowing down soon enough to avoid hitting him when he stopped. In her mind, him changing his mind to not go around made him partially liable.

    I got rear-ended a couple of years ago but it wasn't that car's fault. Because it was the fault of the person who rear-ended them into me.

    The samething happened to my husband with auto pay. He pays everything through auto pay and onetime it never went in because of the new year usaa didn’t send him a letter he received nothing until something came up and he found out the next month because it was a double payment. Anyways she’s still in the wrong, allow enough space between you and other drivers.

    How on earth did the Defendant not know she was uninsured?? There is more to this. I got an email and cancellation notice in the mail to tell me I was being cancelled, and I check my account weekly to make sure my debits come out, especially auto insurance. She looked pretty well dressed too. Also there was very little mention of a police report and who the report put at fault for the crash. She was probably following too close too. Also the elderly gentleman should have just filed through his insurance and let them deal with her.

      YEAAAAA Totally agree, Insurance companies do not just cancel you. If your on auto pay it will try your account a few times then between the bank and the insurance you are deffintly getting some sort of email or text or notice.

      I am a bit late to the party but will weigh in here. I am an insurance agent. When one of our clients is set up on autopay and it is declined by the bank, corporate automatically sends out a physical letter (regardless of if they are on paperless), if they are on paperless corporate sends out an email, if they aren't on paperless our office sends an email, and we call twice (once as soon as we are notified and again the day before their last day to pay). Despite all of that we get probably 1 person a month who contacts us because they can't figure out why they aren't getting insurance cards or can't find their policy online due to their policy being canceled. I think so many people don't listen to their voice mail and just trash anything we send them, because they assume it is a monthly bill. These are the same people who call us every renewal and complain that they never got a copy of their insurance card.

    HONESTLY THE DEFENDANT IS A PC OF 🤬🤬. SHE KNEW THAT IT WAS HER FAULT SHE HIT THEM FROM BEHIND, THEY'RE UP IN AGE WHY MUST THE PLAINTIFF CHASE HER. THE DEFENDANT WASN'T INSURED THAT'S NOT HIS PROBLEM. TYPICAL BEHAVIOR FROM THEM NOT OWNING / TAKING RESPONSIBILITY SHAMEFUL. THANK GOODNESS THAT THE BOTH PLAINTIFFS ARE OK NOW PAY UP BUM

    Had a woman stop for pedestrians at a traffic controlled crossing that was showing GREEN for the cars but she wanted to let the pedestrians cross instead (against their red light). She ended up causing three cars to hit her from behind because she slammed on the brakes unexpectedly. Completely her fault.

    I myself have been there about 2 and a half years ago when Ime and some friends of mine were on our way to a halloween party. On a rainy day, we were stopped for a school bus when, BLAMO! An SUV suddenly rear-ended us. I ended up getting a headache that lasted for several hours from hitting the headrest. My driver suffered far worse injuries, which for thankfully not fatal.

    There's a term called 'assured clear distance' which means that you should leave enough distance between yourself and the car in front of you to compensate for abrupt stopping or slowing down. The measure of assured clear distance is generally said to be 3-4 seconds behind the vehicle in front of you, usung a fixed reference point to measure the time.

    Simple fix, dash cam.. make sure it's a tri-camera setup, interior showing you're not texting, rear and front.. then if you're not at fault, it's real simple to prove.

    Anyone who decides to go to small claims court to defend themselves for rear-ending another vehicle, has a fool for a client. This is due to the fact that when you hit someone from behind you are automatically at fault 999 times out of 1,000, and that one time would be when the car rear-ended had no working running, or rear tail lights.
    In short, there's no defense when you rear-end someone with working brake lights, because you weren't paying attention, plain and painfully simple. Mix not paying attention with driving too fast and you have a sure-fire recipe for disaster.

    In the plaintiff's defense, I would like to say that being of a similar age as him, my first thought is not to up and take pictures, In fact, I cannot take pictures with my phone, It only makes and receives phone calls, I know I sound like a dinosaur but that is our age group.

    I don't know if her claim about the only reason she wasn't insured because auto paid failed is true or not and I am not entirely going to believe it, but I can't dismiss it either because there are all sorts of issues with auto pay either not working properly or double charging or who knows what. I don't trust it at all. I only have one bill on auto pay which is my cell phone and only because I get a discount for doing it But I watch it like a hawk
