  • The plaintiff’s car was towed by the defendant’s towing company. She says the defendant never informed her or the local police that her car was moved, and now she’s being ordered to pay thousands. She’s suing for damages. The defendant argues there were tickets on the car, and he was ordered to move it. He says he was just following protocol.

    Bet she won't block someone's driveway again. I've had someone block me in, so I know how frustrating it is as a homeowner. Just don't do it -- can be very costly!

      My driveway and mailbox gets blocked a lot. Waiting for no parking signs to get installed by the city. If they want their car, don’t block peoples driveways

    I feel it is fair she pay for the ticket and the tow, but all of the storage fees should be paid by the police who failed to register the tow.

      That's what will happen but she'll have to turn around and sue the police department for that amount. Usually what happens is she won't though because it's too much effort after going through this and losing

      If I know government, they wiggle out of it and say, "If you hadn't parked there, wouldn't be a problem in the first place!" Then again, they may make a deal to avoid court.

    This happens all the time. It happened to me. Shameful. My car was stolen. I called every other day to see if the car was found. Finally, I was told my car was recovered after 2 weeks of it being in the tow yard.

    Both litigants were well prepared, and the decision was fair.
    To park blocking 2 other people from using their spaces, and overnight yet, is totally thoughtless and entitled. She's probably parked illegally many times before, but after this expensive and time consuming situation, might be more careful.

      It's easy to do if you're in a rush. I accidentally parked in front of a driveway to meet a client. Unfortunately, I wasn't running late and wasn't paying attention. Fortunately, I only received a ticket and was not towed. If I remember correctly, this was the only property with a driveway on the block where I parked. I arrive early enough to not have to rush and I'm super careful about paying attention to my surroundings.

      She wasn't really complaining that she shouldn't have been towed, only that she shouldn't have to pay for almost a month worth of storage when she couldn't find where her car is due to the city not logging it in.

      @@peterlee584 remember, her case wasn't about whether she should have been towed or not, it's about her having to pay for almost a months worth of storage when it wasn't her fault that no one filed her car as even being towed.

    I get the tow company guy isn’t responsible. But dang that’s a lot of money to be out. It doesn’t sound like she really has much of a chance in getting paid by the city. I guess the only thing you can do is watch where you park. Or get dropped off where you’re going and get picked up in the morning.

    I feel for her, and she did everything right to try to find out where her car was, and then it turns out the police department screwed up! Going after the police department, good luck with that. Anyways, ppl and maybe she’s one of them, they feel they can park where ever they want, if she would’ve obeyed the sign she wouldn’t b in this position in the first place. This was a very expensive lesson for her.

      @Wezzman This was NOT a mistake it was a CHOICE she saw the sign ignored it & decided to illegally park her vehicle anyway blocking a private driveway. Plantiff felt so Entitled to inconvenience someone else without any consideration. Has alot of nerve to come out all willy nilly at 1pm act surprised that her car has been towed. Good luck trying to litigate with NYC they won't take any Accountability plus use our tax payer funds to defend their lack of professionalism and incompetence.

      And then lay TF around until "past noon" the next day ( She said she didn't come back until 1pm the next freaking day)
      I can give grace 🙏 for late-night, hard to find parking situations .....
      I get coming in late 1, 2, 4 in the a.m. and the perils of parking and having to walk 5 blocks back to the house.....Got it
      I wouldn't eff with someone in that scenario...
      What makes it jack-assness is not getting your LAZY ass up ... until AFTER-fucking-NOON ...the next day
      We all know "somebody" has to get up and go to work, school, church/whatever
      It ticks me off when "iffy parkers" don't just get TF up in morning and move their GD car.....
      Yes I know at 3am you couldn't find a park...but eff up ...not all the way through until AFTER lunch

    Yes, she shouldn't have parked there, but the case isn't about her being towed, it's about her having to pay almost a months worth of fees because no one could tell her where her car is. The lot had it for all this time but the city and the lot couldn't (or didn't) relay that information to the car's owner. Now she is out much more than she would have been if someone filed the paperwork when it was towed.

      @@margaretakins6829 it's NYC, you know how many tow companies are in the local areas? She also has no proof that it was even towed. Hence why she eventually tried to report it stolen, and that's when someone finally got back to her that it wasn't stolen.

      I also can’t help but to wonder if that is by law they have to wait 15 days to do a lien search. Or is that the tow company’s policy. Because if that’s their policy that policy sounds llegal. 15 days allow it to rack up all these fees. And then and only then you try to find the driver yourself to collect your money. Not moving in anyway to mitigate your damages. Seems like that policy or law only benefits tow companies.

      Then try to skip thru & minimize her poor decision by stating gwr vehicle half way blocked girl is that like being lil bit pregnant in her warped sense of logic.     Great case. Wasn't sure in which direction this would go. But I can't help but to feel empathy for the plaintiff because she did everything possible to find the whereabouts of her vehicle after the towing. Compelling case

      Seems like both must watched the show before. They were very prepared and very civilized. It’s nice to see people actually understand what they need to do/being to court. It always baffles me when they walk in with nothing.

      Actually seems hard to believe capital one didn't notify her immediately in early January bcuz they want their payment. More to her story she NOT saying probably didn't have proper insurance documents to get it out of tow. She also doesn't know whom driveway she was blocking perhaps someone with connections to teach her a very expensive lesson.

    I don’t feel sorry for her! No way if her relatives live there and she spent the night she’s probably been there before plus she’s from New York and I’m sure all residents know how parking is there so it’s her fault for parking in a space that is a no parking space. They should put another sign there that says no parking too because clearly there’s no room.

    I hope that the tow company helped the plaintiff with her case against the city. I could see the city attempting to put the mistake on the tow company if they weren't present.

      @@margaretakins6829 unfortunately that's not evidence in this case. She would need proof that the cop didn't file that paperwork. This video only shows hearsay from the judge that someone at that department may have said he forgot. That's not proof.

      @@ThisIsDjYigytugd the proof is in the fact that she called the police department multiple times has recordings and badge numbers of all the officers she spoke to with them saying that the tow was never logged. But the tow company has proof that they did log it. And it was the officers job to log it into their system. So who else dropped the ball but the New York cpd.

    It was definitely her fault for parking there in the first place, but that still doesn’t change the fact tow truck companies are horrible and they really take advantage of the consumer with outrageous prices and fees

    Judge must have been on the phone for a long time. Judge left plaintiff was in heels. When judge returns plaintiff is wearing flats. And why can’t the towing company have some mercy and not charge the entire amount. We need less court and more kindness.

    Yes, it’s the plaintiff’s fault that the car was towed away. But it is the police department’s fault that the tow was not entered in their tow log so that she could get her car in a timely manner. Fifteen days go by before she know where her car is, that unacceptable. She was calling the precinct daily trying to get that information.

    Someone parked in my aunties disabled spot which is outside her house. The car got towed away after the police called a truck This person was shouting at my auntie and said they were allowed to park there because they are disabled.

    I get she was in the wrong for parking there guys BUT there are fair consequences for doing that. What she went through here is unfair, for everyday it wasn’t logged in she should be refunded by the city or even a penalty for them for not doing their job.

    That sucks... Sadly, she parked in a crappy spot... IMO, that sign should be replaced with a simple NO PARKING sign instead of NO BLOCKING THE DRIVEWAY... The LEO on duty at the desk had one job at that time... log the tow... Shameful, really... I wish the Plaintiff good luck in recouping her money...

    Police really do be saying that shit. "No record of a tow." You just have to ask what tow companies they use and call the tow places yourself and ask if they have the car. Because the cops truly don't know. Too many of them to find the exact officer that did the tow

    Providing another perspective due to the fact she chose to add the "cute, unselfish me" rhetoric dropping off presents dur. Holidays. What-if homeowners had a med. emergency while street congested, hard to get Ambulance in, when most likely, FD and PD shows up first on scene to assess.

    What needs to be asked is.. would she feel responsible and pay up, if the 2 homeowners couldnt use their driveways, and had to park illegally and get towed and suffer expenses because of her SELFISH, actions..
    …the kind of behavior that shows she would rather inconvenience others, than herself!!!

    The exact same thing happened to me in Brooklyn my car got towed on a Friday couldn’t locate it until Tuesday. Had to pay for 4 days storage fee when they never reported my car. Wish I would’ve knoe. I could’ve sued.

    If she really believed her car was stolen at some point I would have been asking to see a claim through her auto insurance. Some people are woefully negligent and she really brought this on herself.

    I HAD SOMEONE BLOCK MY DRIVEWAY YESTERDAY ,YES I HAD THE CAR TOWED.
    DONT BLOCK MY DRIVEWAY AND IM HAVE BACK PROBLEMS SO I WASNT GOING DOOR TO DOOR TO FIND OUT WHO CAR IT WAS .SHE WAS PISSED AN CALLED POLICE I TOOK PICTURES AND SO DID TOW TRUCK DRIVER IT HAD BEEN AN HOUR SHE BETTER BE GLAD I WAITED THAT LONG. COPS TOLD HER WELL DONT BLOCK SOMEONE DRIVEWAY

    She should have sued the city and the driver at the same time. The towing may have still done something improper with reporting, causing the police department to properly log the tow.

    Her action put her in the position for something bad to happen. It sucks someone dropped the ball at the police station, but really the police have bigger priorities than making sure you are not a huge dick to people and illegally blocking them in.
    Get out and walk.
    It’s also not the tow ppls job to hunt you down and make sure you get your car.
    Had it been me, (never would be because I wouldn’t park there) I would have called EVERY FREAKING TOW COMPANY in the first 2 days.
    She knew it wasn’t stolen, she knew she was in the wrong and it was towed, if the police aren’t helping, help yourself and start looking for your car instead of sitting back and letting charges stack up for weeks.
