      we are heading into a world wide recession. housing and rent will go down and stores will close and people will lose their job. expats have driven up housing in pi beyond what the filipinos can afford long ago. But land, houses, and everything else will soon go on sale. There and all around the world. if paul does build a house at least he will have a place to live but it all gets cheaper soon.

      Clearly mistakes were made, engage a lawyer when buying property is just the usual step one in many countries. Personally I would not engage a builder until the title is free and clear in my name. (wife to be name via a 50 year land lease to me with a prenup, to be exact).

    Coming from over 15 years experience here and having made every mistake possible. if you do decide to purchase any property here get it mortgaged through a recognized bank. (BDO,BPI,PNB) etc. Even if you don't need the loan they will make sure everything is above board before mortgaging the property. This will have a two fold benefit. 1, you can be sure the title is clean, 2, your wife, girlfriend or whoever's name you needed for the title can't sell up, mortgage, or pawn without the bank knowing about it. Sign or co-sign the loan. Cheers and good luck.

      Very good advice. Other than the land, because foreigners cannot own land in the Philippines. Other than that is to draft a clause/document to ensure that the girlfriend, sidekick, or wife cannot sell, barter, or give away your property such as a house, vehicle, tools, motor scooter your clothes on your back without your approval. Make sure she signs it and guard that document with your life.

      It would be better to simply stash some cash away for her that she can access when he die. Buying land and house cheap style = big chance to get scammed by a builder or land owner. Also you have the risk your woman get nasty with you and kick you out when you become old and helpless.

      Paul, a Non-Citizen, in Philippines , "CANNOT" have title to LAND. That's why his name not on deed.

    "Clear' title to undeveloped land is a rarity in the provinces. This is because there is no probate court here to decide who inherits a property through the generations. It is rare to encounter the 'owners' name on the title because they have died decades ago. Once you hold a new title (after transfer) here, it can be challenged for up to one year after issuance, so don't build anything on it during that period. I've had it happen.

      True. Most live tax dec. only and pay less tax on the agricultural land. IMO the title hardly means crap if your not planning to sell.

      I had someone sell me beachfront resort property 15 years ago. When we went to sell it to another resort owner we found out the owner we bought from was not even allowed to sell it to us until it was released from the Dept. of Agrarian Reform after 10 years. Well, it had been by the time we sold it, but it was still in the original owners name and the deed had not been notorized. So we had to let the original owner sell it to the our buyer and she no doubt got a fee for it. I don't know because I left my filipina wife and she wound up with whatever money she got out of it. I came away with nothing not even my original investment. We had developed the property into a nice working resort with facilities. I have been scammed in other areas with my house in the city too. That is why I left. I will just learn from my mistakes and move on and start over if I can. I am retired so I just enjoy life one day at a time, if I can. Hope someone learns from my mistakes.

      @@JMgmkh I agree. I built our house in the province on Tax declaration land 16 years ago. I knew the risk, and rolled the dice. The tax declaration is transferred to my wife's name. We continue to pay taxes on it every year. I don't plan on ever selling, and I realize the majority of Westerners would not buy it without title, but another Filipino might. I have received verbal offers from Filipinos who told me if we ever decide to sell, let them know. We plan to hand it down to our duel citizen children. So far so good. I am curious how many other people have taken this route? I see risk in case of divorce, or Filipina spouse death? and the property lines are vague at best? but other than that? what are other risk? Please advise if anyone knows of any I should consider.

      Buying inherited property demands a paper chase and a survey…especially in the provinces, and doubly so in agricultural areas! The patriarch or matriarch of a family might have title for say, 1,000 hectares. He/she might divide that land into 5 , 200 hectare portions given to their 5 children. Those 5 owners likely only have “paper” not the actual title! The subdivision will be legal if recorded at Barangy hall… that’s why it’s in your best interests, to just pay a real estate broker, or attorney, to ensure the seller is legally entitled to sell the land, and that it’s not legally encumbered! Along with paying for a survey, even if there’s an older, recorded one in existence, your peace of mind is priceless!

      People who are About to lose their mind in the West say Enough ! then move abroad to shed the ties that bind them financially , spiritually , psychologically , health wise etc. . Then they arrive in Southeast Asia etc and self impose a straight jacket , a ball n chain , and an anchor both are tied to in case they get near a body of water .

      I've built two houses, bought a house and remodeled it. Bought a Condo and never started doing any work on any of them until we had our title in hand except to clear the land making it ready to build.

      And....why would you comment on something that you have zero knowledge of? You obviously have never owned property. Even in America it can take months to get a clear title after purchase. Here things take longer for a number of reasons that I wont get into. I love genious guys that will say "Not me, I will never make that mistake."

      Don't buy in Retirement - Period - Especially in a foreign country . Retirement is a time of shedding , lightening the load , slipping out of the heavy cloak of responsibilities . Rent , be mobile at a moments notice if need be for ANY reason , relax , no anchors

    At around the 12:55 mark, Paul hits on one of the most un talked about important aspects of business dealings in the Philippines. Paul is not lying when he says this guy is a unicorn. Not because of a business niche, but because the guy is not afraid to get clarity when having a discussion. It is EXTREMELY rare for a Filipino to admit they do not understand parts of your vernacular when having conversations with them. It is just part of the culture, either due to pride, saving face, or for some weird shame they feel if they don't understand your English. It is a minor thing with potentially huge consequences if not dealt with properly especially when it comes to business dealings. It is extremely hard for a westerner to explain or understand it, that's why it is hard to overcome it. Especially if you have no idea it exist. It does exist so be aware and take all the steps you can to make sure the person you are dealing with is on the same page. Its more difficult than you can imagine to overcome. Good luck.       Yeah...getting a clear, concise answer in the Philippines is all but impossible. I'm still working on my wife to use yes/no to questions I ask. I do not need a five minute story, but it's considered "rude" to not give the full story (no matter what it is).

      "My grandmother used to grow vegetables in her home village. The house they lived in was a two story...."

    We have had no trouble with our investment land. As soon as it was paid off in full, it only took the developer and their agents/financiers a few weeks to get our titles to us. Our house and lot was a slightly different story. It was bought new through the developer and one of their banks. When we had paid it off in full, the developer referred us to the bank. They delayed and delayed, dicked us around and gave us a lot of BS to the point that I went to their head office in Makati and to their section that handles this. I copped the usual BS. I politely but very forcefully told them to get their act together. I thumped the table and made a bit of a scene. They realised that I was not going to be f’ed around with and they asked me to wait while they chased things up. After about half an hour they emerged with all the paperwork! When I asked why I had to go to such lengths to get some action they just said it was languishing at the bottom of the in tray of an employee who had gone on extended leave. I asked how long before we can get the title. They said two to three weeks. I told them most emphatically that I will be back if I do not have the titles by the three weeks and that if I do have to come back I will be one of the most unpleasant people they have seen in their office for a long time. We got a phone call after about two weeks asking us if we would mind coming in as the title papers are ready for pick up. We went in and got them the next day.

    You should never build a house when the title is not in your name, in this case your wife's name. Expats vloggers give advice that they don't even follow. Paul you might need to hire a proven life coach to guide you the rest of your life as you are racking up bad decisions. Good luck

      If you are married, the foreigners name will be on the title of the house. Paul said in a previous video that he had that implemented as well as provisions if Mae should pass away before him.

    A real estate agent doesn't protect anyone... they are just like used car salesmen. The only thing they care about is closing the sale to get their commission. If helping the client gets the deal done, that's why they help the client.

    Paul, you worked in vehicle finance and no doubt were familiar with registering ownership of vehicles. It is odd that you could be this clueless on real property (land). It's the same game. Make sure you can register the asset you are buying, and can verify the particulars of the asset. God bless, love your channel.

      I do not think it had anything to do with a clear title or not. The issue is that there are 3 to 4 govt agencies that have to do their part to transfer the title, there is a tax that has to be paid. Things here work at a snails pace. Waiting 6 months to a year is very common unfortunately.

      3 to 4 is light, If you are buying anything under a mothertitle, that expands the steps. DAR clearance is required which only good for 6 months, they spins tires so much that expires. Employees at these different steps are not always trained properly creating more issues.

    Hi Paul, dont forget to mention that maybe the previous owner did not pay tax, all the taxes from the past will be on you, and you have limited time to pay before there is a bigg penalty, also check the amount off owners ( some might be not alive anymore and some are living abroud, all owners need to sign and from the deat people you need power off attorny) so if there are 8 ore more owners you can expect a heart attack before all is done☹️

      Do you live in the Philippines? There are things that surprised me about living here.
      Certain things are done that you might not understand until you have been here for a while. Eg… did you know that the 13a visa is only processed on Tuesdays in Cebu? You can’t actually go to the office on Monday and get that done.
      That is just one example. Clear title takes 6-8 months. Marriage License number (official PSA number takes 3-6
      Months). The paperwork here can be horrendous… seriously.
      So doing a land title is a huge thing!

    JR should have mentioned to check the tax declaration to make sure it is up to date and is legit with correct stamps and name of seller and local government official signature.

    Good information for anyone looking to aquire property here.
    Myself and my significant other are in the process of buying property. The first thing we did was to get our lawyer to check out the paperwork for said property. Luckily the owners did a lot of work to get it from mother title to the point where each of the siblings had their own plot already in each of their names so it wouldn't be any problem trying to sell it.
    Our lawyer told us that the paperwork was better than more than 90% of the paperwork he sees. That was good news, and he continued to check things out more with the proper registration authorities.
    Only after that is when we made the transaction.
    This law firm was recommended to me by a fellow Canadian neighbor and friend. I would recommend them to anyone. They are very professional and, I think, are very competent at what they do. Also, the English language is not a barrier as they are very fluent in English. I believe that one of the partners is also an American of Filipino decent with American military service as well.
    If you know anyone needing this kind of service they are located on the highway in Bacong. RTLB and associates.

    We paid a small expedite fee to a local politician who pushes paperwork through the system with the personal guarantee title would be complete in 4 months. A year later after a string of one more things, it is sitting, complete at RDO awaiting final signature, while architect and engineers are on hold. Gosh... "can they be persuaded to sign off now rather than in six months?" "Sure! 25,000 pesos." Now, after all that, and having both pre-purchase survey and two topics surveys done, we have border disputes. When we purchased, there was a house on the eastern property line and so I had the engineer confirm in writing that it was not actually encroaching on our land. We then put up nylon string along the entire perimeter. Immediately after purchase the neighbor on the western side put up a little house exactly on the property line and his roof came over a few feet. Big deal. But when topo engineer came out he determined that neighbor's house to east was actually bisected by property line. THEN we put a fence up. Random new tenant neighbor came over to complain that we were cutting his bamboo (he had been helping himself to our bamboo and was now stymied by the fence). Topo engineer then confirmed that original mahon (concrete boundary marker) had been uprooted and moved. 🤣

    Philippines is so backwards in property transfers, in Australia where I'm from from the date you sign a contract to buy a property it takes no more than 30 days for the transfer to occur. Its quick and very efficient. I live in the Philippines and I've bought and sold 2 properties in Australia in the last 2 years without even going to Australia, its all done online. Same when I register my car in Australia. I do it online. After all we live in a technological world today.

    the truth is, it's not only foreigners getting duped by shonky land owners but they rip their own off also. I know a coupe of 100% Filipinos who are going through similar situations with their land purchases. I think it's best to just hire people like JR to be involved from the word GO!!! Whether you are a foreigner or local.

    When buying land following are important simple rules
    1. Clean title. Make sure that the seller has a clean title and verify it with an experienced law firm.
    Many have so-called Mothertitle. It can be very complicated and time consuming to separate the lot you will buy from the Mothertitle.
    Endless procedures and signatures. It can take years and eventually be declined.
    2. Access by cemented road. If they say that the road will be here or there , do not believe it until you see it.
    3. Access to water and electricity. Without it you cannot build.

    12:42 "You can not buy a reputation." The builder who scammed people I've heard multiple times by the scammed they checked out this builder, got referrals, viewer properties, got opinions from previous customers and the dude had a great reputation.
    Putting too much value into reputation is a good way to get scammed. Con men always have a "good reputation" or they couldn't con people. There is zero reason to give a builder in PH 50% or more upfront. A weekly or monthly advance based is plenty for a serious builder. Ordering all the building supplies is not normally done because one delivered they'll be stolen pretty quickly. Supplies come in as needed.

    The issue is in ph there is no title n escrow process. And the people selling it won’t do that. This why there is so much scamming. The time frame from collecting money to title clearing or non title discovery is opportunity both foreigners n local take advantage of. Locals use barangay rules n procedures to solve these issues and will wait months to years to solve this then even negotiate a net on the money returned in favor 9f the seller for their time lost n expenses lol. It’s crazy. The other side of this tge Filipina puts pressure in you to just go through it and cross your fingers. Even if the realtor says they have title to sell the Filipinos realtor and lawyers have no idea about title law. They just say go through process so we can find out. Just because you have survey means nothing to title. Because there can be super complex family deals n bullshit agreements, thus are usually fabricated to put peer and family pressure to screw up your deal so they can squeeze family or you out of more money or a cut. Even realtors act dumb in this in ph even though they know it’s most popular reason of this issue then act dumb later. Why because they are in for the money and don’t care about your money interest because they just excuse this is is just how it’s done in ph. Why because there is no fiduciary duty legal boundaries, no escrow, no title insurance. So do deals go through… sure all the time. Are there scams alllll the time. Is there way to protect yourself. Yes say I will escrow with realtor and when you got title ready we can hand over. And transfer funds. But this scenario probably won’t happen. If you want to expedite thus you file instant lawsuit against the seller and tie up the funds in court until land is clear and judge releases it. Thus us only way to protect yourself 100% maybe. If you are lawyer in ph or expat or realtor expat argue this with me. Maybe I’m wrong or another way. I’m curious

      Absolutely spot on. I just bought a house & land in Australia, everything had to go through a central database, which automatically updates every 15 minutes searching continuously for any activity related to the title, emailing all parties in the transaction. Being a cash sale & clear deceased estate title we got settled in 1 week with zero doubts, a building inspection certificate, insurance note. Absolutely impossible in Asia, Philippines maybe in 50 years.

    Way back 2010 we bought lot and we do the payment and documentation like deed of sale. inside the baranggay office,and brought the paper to a notary lawyer.
    After that, we ask to geodetic to survey the lot for the tax map. Then, we went to the assessor office for the requirements of the land transfer. Since we bought a lot without a title , we applied at DENR for the title, and the form it's just costs 250 peso only. Then, after we comply with all requirements . That said lot was posted into the assessor office ,DENR and baranggay office about 4weeks.(reason for posting is if somebody dispute that said proprty) after 4 weeks we went to DENR office paying for land titling COSTS 16,172 ,lot area 647sqm.
    Our life in Philippines we never pay under the table. ❤

      Thanks for your info, I just bought some small land from my fiancée’s family., and put it in her name and my name was included on the document. We signed the deed of sale had it notarized and registered at the Barangay. Now I see all the other steps to get done to get a title in the province, before I get the building permits and build my tiny home and garden.😊

      Land title is one of the requirements when you build a house, and you can include your name then. My friend, my husband, said that you can do it without an agent .good luck to both of you.

      @ I’m in the process of buying some larger land very close to our first lot and from her relative. I’ll keep on the same path as you’ve described. I believe our next problem is to purchase right of passage to the property since it’s off the main road. All her relatives are surrounding land owners except an Italian seaman who just bought the property between us and the roadway. Always fun in the sun and on the island of Mindanao lol 😂

    Ex pat here. Paul has NO IDEA what he is doing and getting taken to the cleaners for it. I have been married to a Filipina for over 20 years. Never once had family issues with her family. We bought land, clear title and built our own 2500 sq ft house with a waterfall. Built a wall around the property. Never had any of these issues and all of our paperwork was complete in less than 1 year. we have been living a quiet relaxing peaceful life ever since.

      Don't buy . Just rent . Anything comes up from natural disaster to government upheaval , to all night parties or all day roosters , to say a Global Pandemic ? You're out in 10 minutes and on to the next place you like . To me Retirement is not for Adding any responsibilities

      Same. I did all the checks of the land we bought, I wouldn't waste my husband's hard-earned money only to put it in vain. Transferred the title and tax declaration within 3 months.

    I have built a cabin on a friends’ land, with a verbal agreement. Within a month of moving in, they evicted us. I was thirty, and that lesson has saved me so many times from investing where there is no binding paperwork, control, and consequences .

    My partner sells land on behalf of philippinos who own land but dont know how to do it .
    The amount of work she puts in for her clients is awesome, but sh is very successful.
    Lots of personal contacts with government department officials, barangay Captains and attorneys alloes her to get things done i
    She gets 5% of the sales price - which she agrees with the sellers, plus some of the land

    This is a common theme in asia. Even in India lots of property fraud. Vacant properties are occupied, municipal officers bribed to change the title. Then, the property is divided and resold to several parties, further complicating the situation.

    HI PAUL , This guy is a GOD SEND and a gentleman.
    As a now retired builder , I also had my real estate license and only used it for my own checks and balances.
    I like to read the comments on here , IT IS EASY FOR ALL OF US TO MAKE COMMENTS when we were not there , nor involved.
    I have lived in EUROPE , namely ITALY , when it was a 3rd world country , as is the PHILS today.
    Back then , it was a very government controlled , paperwork thick system , with a LOT of corruption.
    I still say , until the PHIL government stepped up to correct some of this stuff , things will not get any better.
    I wish PAUL and MAE the best of luck in getting the title and if they decide , building a house.

    In fairness to Paul & others who've been down the same road on real estate. The same thing can happen here in the USA. It can still take a LONG time to separate a small parcel out of a larger piece of ground. Granted it might not happen as often here, or take as long as it is taking there....but it DOES happen. Hopefully you'll get it done eventually & find a reputable builder to put up your home.

    Hi Paul. Things are done differently here regarding many things, and not just real estate. My partner and I have bought and sold real estate, and just today purchased a brand-new car. Things are different here and you have to become informed on all the issues. I hope you get everything sorted with your property. Our car purchase has involved buying a new vehicle from a car dealer in Manila, having only seen it in photos and a video, and having it shipped to the island where we live. See how many headaches that can give!

    There are reasonably priced premanufactured housing units that are not from ocean containers but built similar in size and with provisions to be lifted by crane to set in place. Buy 1 or more and join them. Advantage is you can load them out to move if you need to.

    In the US, when you buy a house there is an Scrow company that handle the transactions between sellers and buyers that make sure all title, lien etc. for a fee of course. Perhaps this young man can start that kind of company
